Evaluation of responsive submissions
All respondents who submit responsive submissions and:
1) a) submit an original valid Tax Clearance Certificate issued by the South African Revenue
Services or have made arrangements to meet outstanding tax obligations;
b) are registered with the Construction Industry Development Board (CIDB) in an appropriate
contractor grading designation;
f) are registered and in good standing with the compensation fund (COIDA) or with a licensed
compensation insurer; and
h) have completed and signed all returnable forms and submitted all additional documents
requested in this tender document,
2) in the opinion of the Employer can as necessary demonstrate that they possess the necessary
professional and technical qualifications, professional and technical competence, financial resources,
equipment and other physical facilities, managerial capability, reliability, experience and reputation,
expertise and the personnel to perform the contract;

The evaluation criteria will be scored independently by not less than three evaluators in accordance with the schedules and requirements mentioned above: The scores of each of the evaluators will be averaged, weighted and then totalled to obtain the final evaluation score.

SECTION B : MBD 2 : TAX CLEARANCE CERTIFICATE REQUIREMENTS
It is a condition of bid that the taxes of the successful bidder must be in order, or that satisfactory arrangements have been made with South African Revenue Service (SARS) to meet the bidder’s tax obligations.
1.0 In order to meet this requirement bidders are required to complete the TCC 001 : “Application for a Tax Clearance Certificate” form and submit it to any SARS branch office nationally. The Tax Clearance Certificate Requirements are also applicable to foreign bidders / individuals who wish to submit bids.
2.0 SARS will then furnish the bidder with a Tax Clearance Certificate that will be valid for a period of 1 (one) year from the date of approval.
3.0 The original Tax Clearance Certificate must be submitted together with the bid (attached to the inside back cover of this procurement document). Failure to submit the original and valid Tax Clearance Certificate will result in the invalidation of the bid. Certified copies of the Tax Clearance Certificate will not be acceptable.
4.0 In bids where Consortia / Joint Ventures / Sub-contractors are involved, each party must submit a separate Tax Clearance Certificate.
5.0 Copies of the TCC 001 : “Application for a Tax Clearance Certificate” form are available from any SARS branch office nationally or on the website www.sars.gov.za .
6.0 Applications for the Tax Clearance Certificates may also be made via eFiling. In order to use this provision, taxpayers will need to register with SARS as eFilers through the website www.sars.gov.za .

CONDITION OF QUOTATION
Quotations are required for the whole of the work embraced by the documents.
1. QUOTATION FORMS NOTE: ACCEPTANCE OF QUOTATION
The lowest or any quotation will not necessarily be accepted. The Council does not bind itself to accept the lowest quotation and reserves the right to accept the whole or any part of a quotation.
The Council reserves the right to negotiate the rates with different tenderers in order to standardize the common payment,
Quotations will be liable to rejection unless submitted on the attached Quotation Form, and Bill of Quantities where applicable, all of which must be duly completed and signed.
No faxed quotations will be accepted.
Tenderers shall complete the Quotation Form and Bill of Quantities where applicable in ink. Erasable ink shall not be used. No erasure or any scratching out relating to the completion of the Quotation Form and Bill of Quantities shall be made. Any corrections or alterations shall be made by ruling out incorrect words or figures and inserting the correct words or figures above with the contractors initials affixed thereto.
Failure to comply with these conditions will invalidate the quotation.
If the Tenderer in submitting his quotation makes an error which is patent, the Council reserves the right to correct the error so that the quotation documents reflect the true position.
Where a Bill of Quantities is supplied, the rates shall be deemed to be correct. Any errors in the extensions will be corrected and the corrections will be carried forward to the Quotation Form. Where a correction is made, the corrected amount will be deemed to be the final offer.
All rates and totals in the Bill of Quantities shall be EXCLUSIVE of Valued Added Tax (VAT).
However the final quotation sum entered on the Quotation Form shall be INCLUSIVE of Valued Added Tax (VAT) with the amount of such tax being stated separately.
2. PRICES AND VALUE ADDED TAX (VAT)
Prices shall be quoted net in South African Currency. Prices quoted shall be deemed to be exclusive of value-added tax and the amount of such tax shall be stated separately on the Quotation Form.
Bidders shall indicate on the Quotation Form whether or not they are registered vendors and, if so, they shall indicate their VAT registration number.

3. PAYMENT
Payment will be made within 30 days from the date of invoice and only after approval by the Engineer’s representative. No backdating of invoices will be accepted. Early payment, if requested is to be arranged with the Finance Department and is subject to the imposition of a discount.
4. TENDERER’S CONDITION OF CONTRACT
Every Tenderer shall be deemed to have waived, renounced and abandoned any condition printed or written upon any stationery used by him for the purpose of, or in connection with the submission of his quotation which is in conflict with the letter of this Contract.
5. DISCREPANCY IN DOCUMENTS
In the case of any accidental discrepancy or doubt as to the meaning or intention of any part of the drawing/s (if any) and document/s connected with this Contract, reference must always be made to the Engineer for an explanation and the Contractor will be held responsible for any errors that may arise from neglect of this precaution.
6. QUALITY OF WORK
The overall quality of the work shall be to the standard stated in Project Specifications and to the satisfaction of the Engineer or his representative.
7. DAMAGES FOR DELAYS
If the service provider fails to proceed with and complete the tasks in the manner required by the Contract within the time for completion referred to in the Quotation Form and the Project Specifications, the Council shall be entitled to require payment from the service provider of the sum stated in the Quotation Form as liquidated damages for each and every day by which the completion of the tasks is delayed beyond the fixed date as aforesaid, and such damages may be deducted by the Council from any monies due to the service provider provided that nothing contained in this Clause shall prevent the Council from exercising against the Contractor any other remedies which may be available to it either in terms of this Contract or at common law, or from electing to recover from the service provider any damage or loss sustained by it in consequence of any breach of the Contract in lieu of enforcing its rights to liquidated damages in terms of this Clause.
8. TERMINATION FOR INSOLVENCY
If, in the opinion of the Engineer, the Contractor:-
(i) is not executing the Contract in accordance with the true intent and meaning thereof;
(ii) is refusing to execute the Contract, or delaying the execution of the Contract;
(iii) is not carrying out the Contract at such rate of progress as to ensure completion within the period specified;

or in the event of any other failure or default by the Contractor, the Engineer may give notice in writing to the Contractor to make good the failure or default, and should the Contractor fail to comply with the notice within the period specified therein, then and in such case the City Council shall, without prejudice to any of its rights under the Contract, be at liberty forthwith to perform such service that the Contractor may have neglected to do, or to take over the Contract wholly or order from or Contract with any other person. The Contractor shall be responsible for any loss the Council may sustain by reason of such action as it may take in terms of this Clause.
9. TENDERER’S BANKING DETAILS
It is a requirement of the quotation that the successful Tenderer has the facility of a bank account opened at a recognised financial institution in order that payment may be made. Relevant details of this account shall be inserted on the Quotation Form.
The Tenderer shall ensure that his offer is quoted in the same name as that of his banking account in order that payment may be made to the correct party.
10. TARGETED PROCUREMENT
For the purposes of determining the degree of preference to be accorded, Tenderers are required to complete the application for targeted enterprise status. Failure on the part of a Tenderer to fill in and/or sign the declaration will be construed to mean that the preference points are not claimable. Preference points will not be awarded in that case.

11. TARGETED PROCUREMENT PENALTIES
In addition to the penalties specified in the Conditions Pertaining to Targeted Procurement, the contractor will be liable to prosecution and disqualification from future Council tenders.
12. EXPERIENCE
It is a condition of this contract that the service provider must have proven experience in the particular field of work.
13. COMMENCEMENT OF WORK AND TIME COMPLETION

14. ELIGIBILITY
The tenderer will not be eligible to submit a tender If:
The Contractor submitting the tender is under restrictions or has principals who are under restriction to participate in the Employer’s procurement due to corrupt or fraudulent practices;
The Tenderer does not have the legal capacity to enter into the contract; The Contractor submitting the tender is insolvent in receivership, bankrupt or being wound up, has had his affairs administered by a court or judicial officer, has suspended his business activities, or is subject to legal proceedings in respect of the foregoing; The Tenderer does not comply with the legal requirements stated in the Employer’s procurement policy; The Tenderer cannot demonstrate that he has the necessary professional and technical qualifications, competent financial resources, equipment and other physical facilities, managerial capability, personnel, experience and reputation to perform the contract; The Tenderer cannot provide proof that he is in good standing with respect to COID duties, taxes, levies and contributions required in terms of legislation applicable to the work in the contract.
Only those tenderers who are registered with the Construction Industry Development Board in a contractor grading equal to or higher than a contractor grading designation 1GB/2GB as defined in the Regulations ( June 2004), in terms of CIDB Act No 38 of 2000, are eligible to submit tenders for this contract.
15. ADJUDICATION OF TENDERS
15.1 Responsive tenders will be in accordance with the Council’s targeted procurement
policy.
15.2 The Quality criteria – tenderer will be adjudicated in taking inconsideration the documents submitted, all documents as per Quality Criteria must be submitted for tenderer to be considered.

16. SCOPE AND SPECIFICATION
16.1 SCOPE OF CONTRACT This Contract is for repairs of boundary walls damages associated with pipe burst in the city and
surrounding residential areas.
The contractor will need to provide an Artisan bricklayer, Foreman, 2 (two) skilled workers, general
labour.
In addition to the above, the Tenderer will be required to maintain his own telephonic and email
communication including all relevant office administration equipment and facilities throughout the
duration of the contract.
16.2 REQUIREMENTS
i) Due to the rather large response received by eThekwini Water and Sanitation (EWS) in
the past to similar enquires, the need has arisen to access the level of experience and
whether or not sub –suppliers will be employed. It is a requirement that the relevant
forms are duly filled and submitted with quotation.
ii) EWS also requires assurance that the quality standards (as per the technical
specification) and the time frame for delivery will be met. The above stated shall be
submitted in the form of written statement with supporting documentation, where
required. A contingency plan in the event of delivery delays must also be submitted.
iii) In the case of alternatives, tenders must provide proposed technical layout drawings
with the quotation.
This contract calls for Qualified Artisan Plumber with trade test and proven relevant
working experience as an Artisan plumber
iv) Ability to read and interpret technical documents and drawings
v) Knowledge of relative safety standards and willingness to use protective clothing (face-
shield, gloves etc.)
vi) Able to communicate in English
vii) Professional Certification (e.g. an Department: Higher education & training certificate
will be a plus)
viii) Have a minimum of Level one year first aid certificate and that certificate should be provided prior the commencement of the contract.
Skilled Supervisor (Forman)
Responsibility
The duties of the skilled supervisor will be;
i) Supervises and coordinates activities of workers engaged in excavation building work.

ii) Inspects work or confers with Clerk of Works and Technicians to maintain specified standards and quality.
iii) Performs other duties as described under the Ethekwini Municipality SUPERVISORY JOB DESCRIPTION.
17. SPECIFICATION This Contract is for repairs of boundary walls damages associated with pipe burst in the city
and surrounding residential areas
18. CONTRACT DURATION
The contract duration is six months.
19. METHOD OF CARRYING OUT THE WORK
The Contractor shall at all times carry out work for which their Artisan builders is hired for, in the order and manner prescribed by the Engineer. Instructions given to the Artisan builder shall be deemed to be given to the Contractor.
20. DAMAGE TO PERSONS AND PROPERTY
The Contractor shall indemnify and keep the Council harmless against any claim for death,
injury, damage or loss (including consequential) to any person, animal or property
whatsoever (including surface or other damage to land or crops not being on the site
suffered by tenants or occupiers) which may arise out of or in consequence of the treatment
and maintenance of the works against all claims, demands, costs, charges and expenses
whatsoever thereof or in relation thereto.
21. GOVERNING LANGUAGE 21.1 The contract shall be written in English. All correspondence and other documents pertaining
to the contract that is exchanged by the parties shall also be written in English. 22. APPLICABLE LAW 22.1 The contract shall be interpreted in accordance with South African laws, unless otherwise
specified. 23. NOTICES 23.1 Every written acceptance of a bid shall be send to the tenderer by email and any other notice
to him shall be posted by ordinary mail to the address provided in his/her bid or to the address notified later by him.
