Estate Planning from a Tax Perspective:

• Minimizing and deferring taxes on your death so that most of your estate can be preserved for your heirs

• Moving any tax burden to your heirs to be paid only upon the future sale of assets

Overview of Various Techniques to Attain Estate Planning Objectives:

• List assets &liabilities, income & expenses

• Outline a 5 year plan of goals & needs

• Assess life and disability protection

• Determine how you would like assets to be distributed upon death

• Select an executor/trustee of will & power of attorney/ representative for health care

• Decide on a guardian for young children

• Consult with a lawyer, accountant or trust company on matters to do with wills, incapacity planning and possibly trusts

• Consider trusts: spousal, spendthrift, disabled beneficiary (Henson), sprinkling

Understanding Wills

• An important legal document that can ensure that your assets will be distributed to the beneficiaries of your choice in the way you wish, instead of by a government formula, in a delayed manner, with possible unnecessary taxes payable, and the government and courts possibly determining the guardian(s) of your children

• Likely the most important document you will ever sign

• Approximately half of Canadians have no will, which means they will die with their wishes unmet

No Will?

• Called being intestate

• Court appoints an Administrator, possibly the Public Trustee

• Assets distributed pursuant to the formula of the law of the province deceased lived in when he/she died

• No provision for special needs beneficiaries

• May be delays and lack of access to cash for family members

• If no surviving parent, Public Trustee becomes guardian and manager of children’s assets

• A relative or other person can apply to court to become the guardian, but it’s up to the court’s discretion as to what decision is in the best interests of the child

• where the deceased has no spouse or children, the estate passes to the parents of the deceased and their descendants (the deceased’s siblings, nieces, nephews, etc.), and, if there are none, to the grandparents and their descendants and so on until an heir is found.

New Incapacity Legislation

• Bill 29 (parts of which were brought into force September 1, 2011) makes many amendments to BC’s existing tools for planning ahead:

– enduring powers of attorney

– representation agreements; and

– add a new third option: advance directives

What to do if there is no POA or RA

If there is not an enduring Power of Attorney and/or a Representation Agreement in place, and a person becomes incapable of making their own health care or financial decisions, the person’s loved one may find themselves in a difficult and costly position, especially if there is family conflict

Committeeships • A committeeship is a way of protecting the interests of a

dependent adult who is incapable of managing his or her affairs, his or her person, or both – Possible to have separate or joint committees

• Currently, the Patients Property Act is the statutory framework for appointing a committee for an incapable adult

2 (1) The Attorney General, a near relative of a person or other person may apply to the court for an order declaring that a person is, because of

(a) mental infirmity arising from disease, age or otherwise, or

(b) disorder or disability of mind arising from the use of drugs,

incapable of managing his or her affairs or incapable of managing himself or herself, or incapable of managing himself or herself or his or her affairs.
