FINDING: CONSISTENCY - The project, as described in Condition No . 1 and asconditioned, conforms to the policies, requirements, and standards of th eBig Sur Coast Land Use Plan, Big Sur Coastal Implementation Plan (Part3), and the Monterey County Zoning Ordinance Part 1 (Title 20), whic hdesignates this area as appropriate for a water system accessory t odevelopment .

EVIDENCE: (a)

The text, policies, and regulations in the above referenceddocuments have been evaluated during the course of review ofapplications . No conflicts were found to exist . Nocommunications were received during the course of review of th eproject indicating any inconsistencies with the text, policies, an dregulations in these documents .

(b) The property is located at 55000 Highway 1 (Assessor's Parce lNumber 421-011-006-000), Big Sur Coast Land Use Plan . Theparcel is zoned Rural Density Residential, in the Coastal Zon e[RDR/40-D-HR (CZ)], which allows the construction of wate rsystem facilities serving 14 or fewer service connections as aprincipal use. Therefore, the property is suitable for the propose ddevelopment.

(c) The project planner conducted a site inspection on January 26 ,2009, to verify that the project on the subject parcel conforms t othe plans listed above .

from erosion. Due to the damage, the existing system is no tcapable of providing an adequate potable water supply for dailyuse, nor for emergency fire flow purposes . There is no alternativewater supply at the site, and a new well is needed to provide anadequate supply to the existing connection . The proposed wel lwill augment the existing primary water source for the facilitie sand ensure an adequate supply of water for potable use and fireprotection, especially in case of further damage to the existin gsystem. The proposed well will serve existing uses, and will no tresult in intensification (Big Sur Coast LUP Section 3 .4.3). Priorto the wildfire, the existing facilities used approximately 17,00 0gallons per day (GPD), not including irrigation for on-sit eagricultural gardens . Since the wildfire, the existing water systemhas only provided approximately 10,000 GPD. The proposed wellis planned to reduce the deficit in daily use requirements . Theapplicant intends to retain the spring portion of the existing wate rsystem, and stop use of the existing surface diversion source . Thepracticality of this approach will depend upon the quantity an dquality of water provided by the new well, and its long-ter mviability .

(e) The proposed well site is located in an area of the parcel that ha savailable road access both above and below the site. The newwell site will have no effect on special-status species, sensitiv ehabitat, or other significant biological resources (Big Sur CoastLUP Policy 3 .3 .2 .1) . Monarch butterflies are known to over-winter in Eucalyptus trees in the Pfeiffer Big Sur area . Theresource map in the Big Sur Coastal Implementation Planidentifies the riparian corridor as a sensitive environmenta lresource; however, it does not identify any other mappe dresources on the immediate parcel outside of the riparian corridor .No biological report was required for the project, and this aspectwas not further evaluated consistent with Big Sur CIP Policy20 .145.040.A.1 . The parcel is approximately 14 acres, and th eproposed well site is over 400 hundred feet from the ripariancorridor. Therefore, this is consistent with developmen tguidelines that restrict development within 150 feet of a ripariancorridor (Big Sur CIP Policy 20 .145.040 .C .1 .d) .

(f) Tree Removal : Ten (10) Eucalyptus and one (1) Monterey Pineare proposed for removal . All trees proposed for removal ar eeither non-native (Eucalyptus) or have a diameter of less than te ninches, and the removal of these trees is consistent with th ethinning of small trees from densely forested areas (Big Sur Coas tCIP Policy 20 .145 .060.A.1 .c) or the removal of non-native tree s(Big Sur Coast CIP Policy 20.145.060.A.1 .a) . The removal of thenon-native trees will not result in the exposure of structures in th ecritical viewshed . None of the trees proposed for removal excee d24 inches in diameter, and are not considered landmark trees pe rthe definition in the Big Sur Coast CIP (Policy 20 .145.060.D) .

Therefore, the proposed tree removal is exempt, and no separat eentitlement is required .

(g) The project includes a Coastal Development Permit to allowdevelopment within 750 feet of a known archaeological resource .County records identify the project site is within an area of highsensitivity for prehistoric cultural resources ; however, anarchaeological survey completed for this project did not identif ythe potential for impacts to prehistoric resources, and there is n oevidence that any cultural resources would be disturbed (Big Su rCoast LUP Policy 3 .11 .1) . Also, see Finding 2, Evidence b .Therefore, the potential for inadvertent impacts is limited and ca nbe controlled by the use of the County's standard project conditio n(Condition No . 3) .

(h) Environmental Health has not indicated that the use as propose dwill adversely impact the natural supply of water necessary t omaintain the environment and the supply available to meet theminimum needs of existing users during the driest years .

(i)

The project does not create any new structures within the critica lviewshed (Big Sur Coast LUP Policy 3 .2.2) .

(j)

Implementation of the project will not require water to b eexported out of the principal watershed .

(k) The project was not referred to the Big Sur Coast Land Us eAdvisory Committee for review. Based on the LUAC Procedureguidelines adopted by the Monterey County Board of Supervisor sper Resolution No . 08-338, this application did not warrantreferral to the LUAC because it does not include developmentrequiring CEQA review, does not involve a lot line adjustment ,does not require the issuance of a Variance, and does not include aDesign Approval subject to review by the Zoning Administrato ror Planning Commission .

FINDING: SITE SUITABILITY - The site is physically suitable for the useproposed .

EVIDENCE: (a) The project has been reviewed for site suitability by the followin gdepartments and agencies : RMA - Planning Department ,Environmental Health Division, and Water Resources Agency .There has been no indication from these departments/agencies tha tthe site is not suitable for the proposed development. Conditionsrecommended by the Planning Department and the EnvironmentalHealth Division have been incorporated .

(b) Technical report by an outside archaeological consultant indicate dthat there are no physical or environmental constraints that wouldindicate that the site is not suitable for the use proposed . Countystaff concurs . The following report has been prepared :

(c) Staff conducted a site inspection on January 26, 2009, to verifythat the site is suitable for this use .

(d) The application, . project plans, and related support materialssubmitted by the applicant to the Monterey County RMA - Plannin gDepartment for the proposed development, found in Project Fil ePLN090029.

3 . FINDING: CEQA (Exempt) : - The project is categorically exempt fromenvironmental review and no unusual circumstances were identified t oexist for the proposed project .

EVIDENCE: (a) California Environmental Quality Act (CEQA) Guidelines Sectio n15303, Class 3, categorically exempts the construction of new ,small facilities or structures .

(b) No adverse environmental effects were identified during staffreview of the development application during a site visit onJanuary 26, 2009 .

(c) The application, project plans, and related support materialssubmitted by the applicant to the Monterey County RMA -Planning Department for the proposed development, found inProject File PLN090029 .

(d) Findings 1 and 2, and supporting evidence .

4. FINDING: NO VIOLATIONS - The subject property is in compliance with all rule sand regulations pertaining to zoning uses ; subdivision, and any otherapplicable provisions of the County's zoning ordinance . No violationsexist on the property . Zoning violation abatement costs, if any, have bee npaid.

EVIDENCE: Staff reviewed Monterey County RMA - Planning Department andBuilding Services Department Monterey County records and is not awar eof any violations existing on subject property .

5. FINDING: HEALTH AND SAFETY - The establishment, maintenance, oroperation of the project applied for will not under the circumstances o fthis particular case be detrimental to the health, safety, peace, morals ,comfort, and general welfare of persons residing or working in theneighborhood of such proposed use, or be detrimental or injurious toproperty and improvements in the neighborhood or to the general welfareof the County .

FINDING: PUBLIC ACCESS - The project is in conformance with the publicaccess and public recreation policies of the Coastal Act and Local Coasta lProgram, and does not interfere with any form of historic public use o rtrust rights . No access is required as part of the project as no substantia ladverse impact on access, either individually or cumulatively, a s

described in Section 20 .70.050.B.4.c of the Monterey County CoastalImplementation Plan, can be demonstrated .

EVIDENCE (a)

The subject property is not described as an area where the Loca lCoastal Program requires access .

(b) The subject property is not indicated as part of any designate dtrails or shoreline access as shown in Figure 2 (Shoreline Acces sPlan) and Figure 3 (Trails Plan) of the Big Sur Coast Land Us ePlan.

(c) No evidence or documentation has been submitted or foundshowing the existence of historic public use or trust rights ove rthis property.

(d)

Staff conducted a site visit on January 26, 2009 .

FINDING: APPEALABILITY - The decision on this project is appealable to th eBoard of Supervisors and the California Coastal Commission .

EH9 - NEW WELL PUMP TESTSAll new or rehabilitated wells to be added to thepotable water distribution system shall firstundergo a minimum of a 72-hour continuouspump test to determine the yield of the well .Unless otherwise approved by the Director o fEnviromnental Health, the yield of the well shal lbe calculated by multiplying the 24-hour specificcapacity by the available drawdown. If theapparent transmissivity decreases between th efirst 24 hours of the test and the end of the test,the 24-hour specific capacity shall be adjusted bymultiplying the ratio of late-time transmissivity toearly-time transmissivity .

For the purposes o fthis condition, available drawdown is defined a stwo-thirds of the vertical distance from the stati cwater level to the lowest perforations of the well .
