REQUEST FOR EXPRESSION OF INTEREST – Casual Labour Hire including Welding and Minor Plant Hire Services 2017-18
John Holland Country Regional Network hereby requests that you submit an expression of interest
for the provision of Casual Labour Hire including Welding and Minor Plant Hire Services in
accordance with the following scope of works as set out below:
Introduction
John Holland Rail Pty Ltd (JHR) is contracted by the NSW Government, through Country Rail Contracts (CRC) of Transport for NSW (TfNSW), to manage, operate, maintain and upgrade the Country Regional Network (CRN). The current contract runs until 30 June 2021.
The CRN comprises 2386 route kilometres of operational passenger and freight railway lines throughout the state. A map of the CRN is available at:

JHR maintenance activity is based out of depots located at:
Bathurst,
Dubbo,
Tamworth,
West Wyalong,
Nyngan,
West Narrabri, and
Goulburn.
Note: No rates are required at EOI stage. The rates structure is giving some ideas to the subcontractors how John Holland Rail wishes them to price at tender stage.

Schedule 3 – Scope of Works Casual Labour Hire
1. Rates and Pricing in this agreement is based on a Schedule of Rates and related labour competencies as listed in the following Tables A, B, C, D, E, F, G, H,I, J,
K, L, M, N, O, P. The following rates and prices detailed in Tables A, C, E, G, I, & M are GST exclusive and will be fixed for the period Date of Agreement to
30/06/2018 and not subject to variation.
2. The following rates detailed in Tables A, C, E, G, I, & M are inclusive of all Employer’s on-costs in relation to salaries, wages, holiday pay, sick leave, payroll tax,
worker’s compensation insurance, public and employers liability insurance, taxes, superannuation contributions, administration charges.
3. The location of Main CRN Depots requiring labour hire services are as follows.

4. In addition to nominating the regional NSW areas in item 3, the tenderer has the ability to provide labour to; tenderers are required to detail the quantity and
classification of labour it has to offer.
4.1 Additional Definitions
a) “Afternoon Shift” is a shift where employees are roistered to finish after six (6) PM and before midnight.
b) “Early morning shifts” is a shift where employees’ ordinary hours are roistered to start after four (4) AM but before six (6) AM.
c) “Day Worker” means an Employee engaged to work between six (6) AM and six (6) PM.
d) “Night Shift” is a shift where employees’ ordinary hours are roistered to start before four (4) AM and/or finish after twelve (12) midnight.

Conditions applying to the labour schedule of rates;
5.1 Hours of Work
5.1.1 For day workers the ordinary hours of work shall be an average 38 hours per week, worked
Monday to Friday between the hours of 6AM and 6PM. Days worked Monday to Friday shall not
be more than ten (10) ordinary hours on any day.
5.1.2 For rostered Shift Workers the ordinary hours of work shall be an average of 38 hours per
week, worked Monday to Sunday.
5.1.3 Ordinary hours of work shall not be less than 8 hours in duration each day or shift.
5.1.4 All Hire Orders issued shall be for a minimum 4 hour hire period for each personnel.
5.2 Living Away From Allowance (LAFHA)
5.2.1 Where personnel are performing work in areas where they cannot reasonably return to their depot and the Hire Company does not provide acceptable single room accommodation , JHR will pay LAFHA in accordance with the following table.

5.1.1 Where accommodation only is provided the personnel will not be entitled to a LAFHA
payment but will instead receive the food component to cover Personnel’s meals
and incidental expenses when travelling away from home.
5.1.2 JHR shall approve all personnel eligible for LAFA payments prior to any
engagement.
6 SHIFT WORK

6.1 Early Morning Shifts are rostered to start after four (4) AM but before six (6) AM.
6.2 Afternoon shifts are rostered to finish after six (6) PM and before midnight.
6.3 Night Shifts are rostered to start before four (4) AM and/or finish after twelve (12) midnight.
6.4 Shift loadings for ordinary hours on rostered Saturday Shifts are paid at a loading of (xxx%)
excl GST.
6.5 Shift loadings for ordinary hours on rostered Sunday Shifts are paid at a loading of (xxx%)
excl GST.
6.6 Under no circumstances shall personnel be entitled to shift loading pursuant to this clause
and overtime rates under clause 7 of this Agreement at the same time. For the avoidance
of doubt personnel shall only be entitled to shift loading or overtime rates but not both.
7 Overtime
7.1 All time worked beyond a personnel’s daily ordinary hours, as determined by the applicable
roster, shall be deemed overtime.
7.2 Overtime on weekdays and Saturdays before twelve (12) noon shall be paid at time and a
half of the ordinary wage rate for the first two (2) hours and at double time for all time
thereafter.
7.3 All overtime after twelve (12) noon on a Saturday will be paid at double time.
7.4 Overtime on Sunday will be paid at double time.
7.5 Personnel who are required to work overtime on a non rostered day will be paid for a
minimum of four (4) hours work at the applicable overtime rate.
7.6 Personnel recalled to work overtime after leaving the worksite shall be paid for a minimum
of four (4) hours work at the rate of double time.
7.7 JHR may require any personnel to work reasonable overtime. Reasonable overtime will be
determined having regard to:
a) any risk to personnel health and safety;
b) the Personnel’s personal circumstances including family responsibilities;
c) the need of the workplace or enterprise, particularly with reference to emergency work requirements;
d) the period of notice given by the company to personnel of the overtime and by the Personnel of his or her unavailability to work.
8 WORK LOCATIONS
8.1 All personnel will be assigned to a depot location.
8.2 Personnel assigned to a migratory team, will be required to perform rostered work at various
work locations as required by the Company.

8.3 All Personnel may be required to work at places other than their designated depot location.
Personnel may be rostered to start and finish work at different locations to meet business
needs.
8.4 Personnel may also be rostered to work at locations which will require temporary
accommodation away from home.
9 Rest Period
9.1 Personnel are required to take a minimum ten (10) hour rest break between shifts (i.e.
Ordinary/Overtime/Call Outs).
9.2 If on the instructions of the JHR, the Personnel resumes or continues work without having
had ten (10) consecutive hours off duty, then from the start of their next ordinary shift hours,
the Personnel shall be paid double time until he or she is released from duty for a ten hour
rest period.
10 Meal and Rest Breaks
10.1 For all Personnel there shall be a cessation of work of not less than thirty (30) minutes
duration at approximately five (5) hours after the commencement of each day’s ordinary
work to take an unpaid meal break.
10.2 For Shift Workers on early morning, afternoon or night shift, there shall be a cessation of
work of thirty (30) minutes duration after the first four hours of work to allow shift workers to
take a meal break. The meal break taken in accordance with this sub clause shall be
counted as time worked when engaged on shift work.
10.3 There shall be one (1) rest break of fifteen (15) minutes duration without deduction of pay
after the first two (2) hours of work has been performed. Such breaks shall be taken at a
mutually convenient time and may be staggered in the section or sections of the workforce
involved. During hot weather the team supervisor may instruct additional breaks, without
loss of pay.
10.4 Delayed Meal Breaks
10.4.1 It may be necessary to defer the observance of meal breaks to enable the
completion of the task at hand in a timely manner. The deferment of meal breaks for
up to one (1) hour shall be permissible and such deferment shall not entitle the
Personnel to any additional payment.
10.4.2 Where Personnel are required by the Company to defer a meal break, for in excess
of one (1) hour, they shall be paid at overtime rates until the meal break is taken.
10.5 Overtime Rest Breaks - Meal Allowance
10.5.1 If Personnel are required to work more than one and a half hours (1½ ) overtime
(immediately) after ordinary hours, the Company will provide Personnel with a meal
or make a payment of $27.84 excl GST to meet the cost of a meal.
10.5.2 This allowance is also paid in lieu of any ‘rest break’ occurring during the first four
(4) hours of overtime after working ordinary hours.

10.5.3 This allowance shall be a flat amount and will not be included in the calculation of
overtime, leave or any shift or other loadings.
10.5.4 Personnel required to work more than four (4) hours of overtime after working
ordinary hours shall be entitled to a thirty (30) minute break without loss of pay.
10.5.5 Personnel in the receipt of LAFHA as per clause 5 who work overtime for more than
one and a half (1½) hours after working ordinary time shall receive a meal allowance
of $xxx excl GST instead of the allowance in clause 5.
10.6 Weekend Overtime Rest Breaks
10.6.1 Personnel working overtime on a Saturday or Sunday shall be allowed a paid rest
time of twenty (20) minutes after the first four (4) hours of work without loss of pay,
but this provision shall not prevent any arrangements being made for the taking of
a thirty (30) minute meal period, the time in addition to the paid twenty minutes
being without pay.
10.6.2 In the event of any Personnel being required to work in excess of a further four
hours, the Personnel shall be allowed to take a paid rest time of thirty (30) minutes
without loss of pay.
11 Public Holidays
11.1 Any Personnel required to work on a Public Holiday shall be paid at the rate of
Double Time and a Half the Wage Rate for all time worked on Public Holiday shifts
from the time the shift starts.
12 Stand Down
12.1 JHR may stand down Personnel at no cost to JHR in circumstances where JHR deem their
services are not required for a particular shift. The right to stand down Personnel is subject
to JHR ensuring that all reasonable options for other work have been explored before the
stand down is implemented. JHR shall provide as much notice as is practical in such
circumstances.
13 Clothing & Personal Protective Equipment
13.1 The Hire Company will provide Personnel at its own cost, with the following items of safety
clothing:
13.1.1 safety helmet (helmets must not be painted, drilled or modified in any way);
13.1.2 wide brimmed hat;
13.1.3 high visibility vest that meets AS4602;
13.1.4 protective eye wear that meets AS1337;
13.1.5 safety gloves;
13.1.6 safety footwear that meets AS/NZS2210.1;
13.1.7 long trousers;

13.1.8 long sleeve shirts;
13.1.9 wet weather gear
13.2 The Hire Company shall be responsible for replacement of all Personnel clothing and
PPE.
13.3 JHR shall provide all specialist PPE which is necessary to safely carry out the works for
which Personnel are engaged, other than that which is detailed in Clause 13.1 at its own
cost.
13.4 No safety equipment or PPE other than that approved by JHR is to be worn by any
Personnel whilst at work.
14 INCLEMENT WEATHER
14.1 Definition
14.1a) Inclement weather shall mean the existence of abnormal climatic conditions including but not limited to rain, hail, snow, cold, high wind, severe dust storm, extreme of high temperature for the locality concerned, or the like, or any combination thereof by virtue of which it is either not reasonable or not safe for Personnel exposed thereto to commence/continue working whilst the same prevail.
14.2 Process
a) Step 1.Obtain the information including meteorological data, local reports etc;
b) Step 2. Interpret the information provided with regard to the potential impact of
abnormal weather conditions on the planned work; and
c) Step 3. Based on the interpretation of the information develop a revised work plan
to mitigate the risks associated with the abnormal climatic conditions.
14.3 The above process will be undertaken by the following by JHR; a) For the purposes of this sub clause, Personnel operating machinery fitted with a functional weatherproof cab shall not be deemed to be exposed to inclement weather.
b) Personnel shall be paid for the ordinary hours rostered for the standard shift at the
applicable shift rate of pay or a minimum of four (4) hours where shifts have commenced
and stopped due to inclement weather.
15. Additional Allowances
The following allowances shall be payable to the Hire Company relating to labour hire during particular
shifts from time to time as nominated by JHR.

Scope of Works
1.0 Scope of Works - General Provision of qualified welders to assist John Holland Rail (JHR) Country Regional Network (CRN) in meeting their commitment in project delivery. Project locations will be limited within regional NSW.
2.0 Scope of Works - Detailed
2.1 Supply of Welding labour, vehicles and welding equipment for welding rail including but not limited to Railtech and Thermit type welds and junction welds.

3.0 Subcontractor’s Obligations
3.1 The subcontractor is to ensure that they work to the relevant standards, specifications as set out in item 3 and all John Holland Rail OH&S requirements. The subcontractor must also:
3.1.1 Participate in general site induction 3.1.2 Participate in daily Task Risk Assessment Briefings and tool box meetings 3.1.3 Compiling a John Holland Rail start card prior to tasks being performed 3.1.4 Ensure that the personnel supplied are sufficiently competent to undertake the task(s) as
requested by John Holland Rail. 3.1.5 Ensure that all plant meet John Holland Rail safety requirements and to be certified by a
John Holland Rail representative; prior to any work within the John Holland Rail CRN railway corridor
3.1.6 All quality documentation including weld returns to be compiled and submitted to the John Holland Rail supervisor daily
3.1.7 The subcontractor to provide the John Holland Rail supervisor with daily hours of work carried out
3.1.8 Prior to the start of each engagement, the subcontactor’s personnel shall ensure that contact is made to JHR supervisor/leading hand.
3.1.9 Daily site diary is required to be completed. 3.1.10 Subcontractor shall ensure that timesheets are approved by Supervisor/Leading hand and
submitted to JHR staff at the end of each week. 3.1.11 The Subcontractor shall provide Protection Officer when required, but the cost of Protection
Officer shall be charged separately by the Subcontractor (refer the rates from the Subcontractor for Casual labour hire).
4.0 Work to be done by JHR CRN
4.1 JHR CRN will provide a purchase order for resources prior to commencing work.
4.2 JHR CRN will provide supervision whilst work is being conducted in the JHR CRN railway corridor.
4.3 JHR CRN will provide the subcontractor with a roster with required resources.

4.4 Waste disposal is to be managed by JHR-supervisor.

6.2 Conditions and Definitions relating to Table A “Schedule of Rates”
6.2.1 Pricing in this Agreement is based on a Schedule of Rates as listed in Table A above. The rates detailed in Table A are GST exclusive and will be fixed from the date of the agreement to 30th June 2018 and not subject to variation.
6.2.2 The rates and prices detailed in Table A are inclusive of all Welder, Welders Assistant and Protection Officer 2 plus vehicle, firefighter and all tools & equipment. Also the rates include all Employer’s on-costs in relation to salaries, wages, holiday pay, sick leave, payroll tax, worker’s compensation insurance, transport, public and employers liability insurance, taxes, superannuation contributions, administration charges and company overheads and profit.
6.2.3 All Personnel must be site inducted by JHR prior to commencing works. Induction time undertaken by the Subcontractor’s personnel shall not be reimbursed by JHR.
6.2.4 Normal working hours are between 7am to 5pm Monday to Friday excluding Public Holidays 6.2.5 a) A Rate = Normal Rate – The “A Rate” is payable for all hours of work between 06:00am
and 18:00pm Monday to Friday Excluding Saturdays, Sundays & Public Holidays. b) B Rate = Time and a Half – The “B Rate” is payable for all hours worked on Saturdays.

6.5 Condition Applying to Table D – Plant Hire
6.5.1 The rates in the Table D above are GST exclusive, fixed and not subject to variation.
6.5.2 The rates includes an operator and fuel.
6.5.3 Normal time rate shall be applicable for the time between 6am and 6.00pm Monday to Friday excluding public holidays.
6.5.4 JHR approval must be obtained prior to the engagement of any Hirer’s personnel whereby LAFHA will be payable.
6.5.5 The Hirer shall submit Invoices to JHR accompanied by daily on site timesheets signed by both parties verifying the working hours including actual.
