This report is prepared pursuant to Chapter 20 of Title II, IIPotable Water Systems,1I of the Public Health Regulations which requires submittal of plans and supporting data to the State Department of Health when a new source of water supply is added to a public system. The new source of water supply, Koloa Well 5426-05 (KOLOA WELL IIDII ), on Paa Ridge in Koloa will be added to the Kauai County Department of Water Supply's Koloa - Poipu Water System. The report follows the format of IIGuidelines for Preparation of Preliminary Engineering Reports for New Potable Water Sources,1I Drinking Water Program, State Department of Health. The information it contains has been gathered from various project reports and, documents as I isted below. As appropriate in this report, these will be referenced by their letter designations as 1 isted.

II. GENERAL INFORMATION:

Project Description and Location:

The Kauai County Department of Water proposes to construct a well pump facil ity and access roadway at the existing exploratory well, Koloa Well 5426-05 (KOLOA WELL "0"). The well pump facil ity construction consists of:

1. Installation of a 1200 gallon per ~inute (GPM) lineshaft vertical turbine pump and motor in the 420-foot deep Koloa Well "0".

2. Construction of pump control building with pump controls, recording devices and chlorination equipment.

3. Installation of 600 feet of 16-inch diameter water transmission piping and overhead electrical power line and improvements to the existing well access road.

The project is situated on Paa Ridge, 4,000 feet east of Koloa Millon the southeast side of Kauai. (See FIGURES 1 and 2)

Owner and Operator of the System:

Upon completion of the well pump facil ity construction the improvements will be dedicated to the Kauai County Department of Water and will be entirely operated and maintained by that department.

I II. PHYSICAL AND HYDROLOGICAL CHARACTERISTICS OF THE AREA:

A. Locat ion:

Koloa Well 5426-05 (KOLOA WELL "0") is located at the bottom of the southwest portion of Paa Ridge in the district of Koloa, County of Kauai. The site is situated two miles east of Koloa town, two miles from the ocean, and 1,000 feet northwest of Koloa Well IICII (See FIGURE 2).

B. Climate:

liThe climate of Kauai is comfortably uniform and is charaterized by the northeast tradewinds generated by regions of high pressure to the north. These winds keep the average monthly temperatures near sea level within the range of 690 F in February to 77°F in August. The mean temperature decreases about 30 for every 1,000 foot increase in elevation.

The consistent approach of the tradewinds from the northeast distinguishes the island into windward and leeward sides. Windward Kauaireceives larger amounts of rainfall as the result of the condensation of water vapor as it is forced up into the atmosphere by the mountain mass. This feature of the island's climate creates extreme differences in rainfall within short distances. Mount Waialeale, for example, has a mean annual rainfall of 466 inches; while at Mana, 18 miles away, rainfall is 21 inches per year. Koloa on the leeward side of Kauai receives 40 to 50 inches per year.

The tradewinds are recurrently interrupted by Kona storms, which occur generally during the winter months of October through April. Kona storms are responsible for periods of heavy rainfall which often cause flooding. The air becomes overly humid and winds blow from the South or West. 1I

C. Topography:

The proposed well pump facil ity is located on moderate slopes at the bottom of the southwest portion of Paa Ridge. The existing ground elevation at the well site is approximately 224 feet.

liThe topography of the land is very closely associated to the type of volcanism which produced it. Land underlaid by the Waimea Canyon volcanic series is steep and well drained. The average slope of the Haupu range just behind the well site is 25 percent. The steep slope accounts for the relatively thin lava flows which accumulated on top of one another creating the high permeabil ity of the Waimea series.

Conversely, land underlaid by the Koloa volcanic series is comparatively flat, although well drained. The average slope of the land below the Haupu range and extending to the ocean is about two percent. Koloa lavas spread out slowly from their source, forming thick layers and producing underground formations with low permeabil ity. The sl ight slope of the land, however, makes it practical for sugar cane cultivation since mechanical harvesters are most effective over flat areas.

Unusual topographic features consist of three volcanic vents which were sources of Koloa lavas: Puuhi, Puu Hunihuni and Puu Wanawana. The crater of Puuhi, the cone on which the storage tank is to be situated, serves as a reservoir for irrigation water. Waita Reservoir, the largest man-made body of water in the state is to the northeast of Koloa .11

Geology:

"Kauai is, geologically, the oldest of the major islands in the Hawaiian chain. The Kauai volcanic shield built itself off the ocean floor more than four mill ion years ago. Rock formations belonging to this original shield are part of the Waimea Canyon volcanic series, a major portion of which are the thin lava flows of the Napal i formation which later covered the shield mass.

Following a long period of quiescence, further volcanism occurred which produced the thick flows of the Koloa volcanic series. The distribution of the Waimea Canyon and Koloa series in the Koloa - Poipu area is shown in FIGURE 3." (REFERENCE a)

E. Earthquake Considerations and Design Parameters:

According to Seismic Zone Maps, Kauai is zoned zero (0), which indicates that no seismic design is required. (REFERENCE e, page 150)

F. Groundwater Conditions:

"Based on data gathered from dril ling and pump test of Koloa Well 5426-05 (KOLOA WELL "0") by Hydrologist/Geologist Stephen P. Bowles, Island Resources, Ltd. and inspected by the Department of Water, County of Kauai, groundwater stands at approximately 26 feet above mean sea level. The existing ground elevation is approximately 224 feet at the well (See FIGURE 2). Safe yields for long-term pumpage are not especially known because of the complex geologic structure. However, ongoing pumpage of the Koloa Well "C" have shown that adequate source capacity does exist. Based on chemical analysis in accordance with the Federal Safe Drinking Water Act, the water quaility conforms with the requirements of the act. II (REFERENCE d)

liThe drilling of a well into either of the volcanic series has an important influence on the amount of water available for withdrawal from the ground. The Napal i formation is highly permeable allowing water to flow quickly through the ground to be wi thdrawn by the well. I n the project area, thi s ground water is confined between impermeable dikes and is not part of the basal lens. Therefore, there is 1 ittle danger of salt water intrusion from below the basal lens during periods of high demand. The existing source well is drilled into rocks of the Napal i formation.

The Koloa volcanic series, on the other hand, is poorly to moderately permeable. Water withdrawal is slower and more difficult. Water presently being tapped in this series by Koloa Mill originates from perched aquifers. These aquifers and the Waimea aquifers are isolated hydraul ically from each other. Essentially, there is no water transfer between the two underground reservoirs." (REFERENCE a)

G. Flood Problems Including Tsunami Inundation Zones:

No flooding or tsunami inundation is possible at the Koloa we 11 site.

H. Conformance with Local Land Use Planning and Zoning Regulations:

The Koloa Well "0" site is located on State land designated Conservation (FIGURE 4). The pump house, waterline, overhead power I ine, and improved access roadway are permissible under conditional usage in a limited subzone within the Conservation District. Approval for a Conservation District Use Permit has been approved by the Board of Land and Natural Resources, Department of Land and Natural Resources, State of Hawaii.

The land is 1 isted under the Detailed Land Classification as "type" E. The construction of well pump facility is permitted on this type of land by HRS 205.

The proposed project is situated on land designated by the Kauai County General Plan as agricultural. Under the provisions of the County Zoning Ordinance No. 164, public utilities and facilities are permitted uses within all districts. (REFERENCE d)

I. Discussion of Water Rights and Future Uses:

There are presently ten wells drilled into the Waimea acquifer in the Koloa area. These wells are 1 isted in TABLE 1. Wells 16A and 16B presently supply all of the domestic demand in the Koloa - Poipu area, which in 1975 - 1976 averaged approximately 1.4 mgd. The remaining eight wells serve as supplementary sources of irrigation water. Although irrigation water is mainly of above ground origin, Bowles estimates that these wells may have to be depended on to supply a total of 5 mgd for plantation use. Therefore, the total present withdrawal from the Waimea aquifer can be as high as 6.4 mgd.

The demand for domestic, potable water is expected to increase. To conservatively estimate the demand stress on the aquifer, this increase may be assumed to be suppl ied entirely by the Waimea aquifer. The eventual demand exerted by the Koloa - Poipu area is estimated by the General Plan to be 4.3 mgd. The eventual demand of Moana Corporations' subdivision is 0.6 mgd. Therefore, 4.9 is the expected domestic demand which will be placed on the aquifer. This figure includes the 1.7 mgd which is to be supplied to Poipu by the proposed water system. The domestic demand added to the agricultural requirements (which are not expected to increase) of 5 mgd sums to 9.9 mgd.

IITherefore, under full average flow conditions, there is a reserve of 4.1 mgd. Bowles, however, feels that there is reason for caution: liAs there is continued emphasis to develop domestic water from the Waimea aquifer, full aquifer deve 1 opment is ins i ght."

Bowles' concern is due to the difficulty in estimating the actual discharge capacity of the aquifer. Although he estimates the safe yield to be 14 mgd, Bowles recognizes the large degree of error which is inherent in attempting to quantify the capacity by stating in his report. •• , IIThat the Waimea aquifer can support a sustained annual pumpage of from 5 to 10 mgd. 1I

The experience during the 1975 drought illustrates the need for the careful handling of the water resource. During the drought, the existing wells were pumped heavily for the first time since their construction. In September, 1975, total pumpage from all wells averaged 16.3 mgd and water levels in the wells dropped dramatically. However, there was no significant increase in the sal inity of the water pumped •••• The dual use of the water also poses potential problems during periods of heavy pumpage. Coordination between the requirements of agriculture and the public needs to be effected. A program of coordination and resource

management has been initiated between the County of Kauai and McBryde Sugar Company (REFERENCE b) whereby both parties have agreed to the following:

1. This agreement shall apply to all wells existing or hereafter drilled within the area shown in EXHIBIT 'WI.

2. Within the first quarter of each year commencing as of 1977, each party shall supply the other with a written report showing the quantity of water pumped and the water levels of each well controlled by each party for the preceding calendar year. The report shall show the quantity pumped and the water level on quarterly i nt er va 1 s.

3. Each party shall fully inform the other as far in advance as possible of its plan for expansion of its use of water pumped from wells within the pertinent area, plans; such as, installation of larger pumps, longer periods of pumping, drill ing of additional wells or any activity that may affect the underground water level in the area.

4. In the event either party bel ieves and is concerned that the aquifer in the area is being unduly depleted or its well output is being unduly affected by the other party's activity, it may notify the other party of the concern and request voluntary corrective action by the other party.

a. Upon receipt of such notice and request, the party receiving such notice shall acknowledge the notice and respond as to the decision concerning any corrective measure it proposes to undertake voluntarily within forty-five (45) days of receipt of such not ice.

5. In the event the complainant's notice and request is not acknowledged within forty-five (45) days or the voluntary corrective action offered by the respondent is unacceptable to the complainant, the matter shall be submitted for settlement by arbitration:

a. The complainant shall appoint one arbitrator.

b. Within ten (10) days of complainant's appointment, the respondent shall appoint its arbitrator.

The two arbitrators will seek to settle the problem between them within fifteen (15) days of their appo i ntment.

If the two arbitrators are unable to agree on a settlement, they will seek a geologist or hydrologist as the third arbitrator. In the event the parties are unable to agree as to the third arbitrator, the Judge of the Fifth Circuit Court shall be requested to make the appointment of a geologist or hydrologist.

6. The arbitrators shall hold such hearings as are required and shall arrive at a decision within sixty (60) days of the appointment of the third arbitrator.

7. The decision of the arbitrators shall be I imited to the following matters, singularly or a combination thereof and, if practical, shall be in priority order as listed:

a. Lower setting of any pump in the area.

b. Imposition of a moratorium on drill ing of any new we II.

c. Imposition of a moratorium on installation of larger pumps.

d. Imposition of a moratorium on new subdivisions, zoning permits or use permits in the area and/or an imposition of a moratorium on increased usage of water for irrigation.

e. Imposition of compulsory reduction in water usage.

8. Each party shall assume the fees and costs of its arbitrator. The other costs of arbitration and the fees and costs of the third arbitrator shall be shared equally.

9. Nothing herein contained and regardless of any arbitration decision rendered shall bar the Water Board from initiating eminent domain proceedings permitted under the Hawaii Revised Statutes.

10. Nothing herein contained shall bar the use of Chapter 177, HRS, (the Ground Water Use Act) to regulate, protect, or control the use of ground water in this area, and any prior decision reached by arbitration shall be subject to the provisions of said Chapter 177, HRS.

11. In the event of a breach of the terms of this agreement, the party committing the breach shall be liable for the costs of the other party, such costs to be limited to costs incurred in seeking arbitration under the terms of this agreement and excluding any consequential damages.

12. All questions relating to arbitration procedure not covered herein shall be as provided for in Chapter 658, Hawai i Revised Statutes." (REFERENCE a) and (REFERENCE c)

IV. EXTENT OF WATERWORKS SYSTEM

Description of the nature and extent of the Existing Area and Future Area to be Served:

The existing Koloa - Poipu system consists of three well sources, three storage tanks and water mains ranging in size from four inch to twelve inch diameters. This system can also be supplemented during emergencies by water from the nearby Lawai - Omao system; the connection between these systems is separated by a normally closed valve.

Two service levels are being served by this system. A high service level (primarily Koloa Town area) is supplied by a well (Koloa Well 16B) discharging water into the 200,000 gallon storage tank (Omao). A low service area (primarily Poipu and Kukuiula) is supplied by Koloa Well 16A and Koloa Well 5426-04 (KOLOA WELL IICII ) discharging water into the 250,000 gallon storage tank (Panao) and the 1.5 mill ion gallon storage tank (Mahaulepu).

This planned improvement is designed primarily to serve this lower service area. (See FIGURE 6, Water Service Sub-Areas I through 7).

Much of the planned development will take place along the coastal area where the primary zoning is for high density uses. (See FIGURE 5)

Description of Population Served, Land Use and Consumption Data:

The population of the island of Kauai was 29,524 in 1970 •••• The Kauai General Plan completed before the 1970 census figures were available, estimated the population of the island in 1970 at 32,000. The most recent estimate of the actual number of resi dents on Kauai is 32,500 as of July, 1975, an increase of 10 percent over 1970 •.•. The Koloa district had a population of 6,851 in 1970 •••• In 1973, the resident population was estimated at 7,510 increasing 10 percent in three years. Most of the increase in the district can be attributed to the more numerous job opportunities in the hotel and service industries ••• 11 (REFERENCE a) and (REFERENCE b)

· The land uses of the area were discussed in Section II I.H of t his report.

In keeping abreast with the planned stages of development for this area, it was estimated that an average day demand of 1.47 mill ion gallons per day (mgd) would be required. Therefore, the existing Koloa Well 5426-04 (KOLOA WELL "C") 1,200 gallons per minute (gpm) pump was designed to supply a maximum-day demand of 1.71 mgd; the existing 1.5 million gallon storage tank was designed to accommodate the average day demand of 1.47 mgd; the pipelines were designed to carry a peak hour flow of 6.63 mgd. The proposed Koloa Well 5426-05 (KOLOA WELL "0") will provide a installed "Stand-by" source to the above system.

Appraisal of Future Requirements for Services:

liThe proposed full growth improvements for this area consists of three 600 gpm capacity wells near Koloa Wells 16A and 16B, and three 800 gpm capacity wells north of Koloa town on the slopes of Kumanumanu Hill. The wells at the former site will serve the Poipu area and the wells at the latter site will serve the Koloa area. Storage requirements for the Koloa area will be met with the construction of a 1.0 million gallon storage tank along the lower Lawai - Koloa road. The storage requirements for the Poipu area will be met with the addition of another 1.0 million gallon storage tank.11 (See FIGURE 2) (REFERENCE a)

Provisions for Extending Water Works System to include Additional Area, Easements, Right-of-Way Acquisition:

The planned well is located in lands owned by Grove Farm Company, Inc. and is leased to McBryde Sugar Company. The project site will be dedicated to the Department of Water, County of Kauai, after construction and final acceptance.

Negotiations with these parties in obtaining easements and rights-of-way in the past have been very successful, and we do not anticipate any problems in the future.

E. Required Capacity to Meet Fire Protection and Pressure Requ i rements:

The elevation of the existing 1.5 mg storage tank will provide a service pressure of about 95 pounds per square inch (psi) along the coastal areas. Fire protection meets the fire flow requirements shown on TABLE 2.

F. Alternate Solutions Considered and Supporting Data for Recommended Plan:

The well pump site was chosen to create the least disturbance on the environment. The well site is situated on unused land

'and the pipel ine follows establ ished well site access roads.

No action or the postponement of further action would result in the disruption of service to the residents of the Koloa -Poipu area due to shutdown of existing Koloa Well IICII pump for maintenance operations or pump malfunction. This would also jeopardize the safety of residents since emergency fire flow protection would be limited to the reservoir storage only.

G. Environmental ~nd Economic Impact:

The impact that the proposed project will have on the environment can be broken down into two categories: primary impacts, which are associated with the construction and initial operation of the water system; and secondary or long-term impacts which mayor may not become apparent after several years of continuous functioning. Because of their particular importance, impacts on ground water resources in the areas are discussed separately.

1. Primary Impacts

During the construction phase of the project, it is expected that some volume of dust and noise will be produced. In the midst of cane fields this will not be an inconvenience. Construction will occur only during specific daylight hours and dust prevention measures; such as, dampening the ground with a minimum amount of water, will be instituted.

Construction activities, if not properly coordinated, will interfere with the normal harvesting and maintenance operation performed by sugar plantation employees. Many of the cane haul roads are wide enough to accommodate cane trucks and construction machinery simultaneously.

Site work at the well sites will permanently transform the landscape in the immediate area. Excavation and trenching surface shall be restored to its original cond it ion.

Once construction has ended, one of the primary impacts resulting from the operation of the water system will be the upgrading of the existing water supply to Koloa and Poipu by providing an installed II s tand-byll source to the

existing Koloa Well "C". It will provide greater security against potential pump failures or water main breaks by developing a "stand-by" source of water to Poipu. The upper service level (Koloa town) will benefit since it no longer serves as the only source of water for Poipu during emergencies.

The pump control house and storage tank will not be visible by persons approaching Koloa via Koloa Road and from the coastal roadways because of the thick haole koa brush interrupting the lines of sight.

Secondary Impacts

The installation of the proposed water supply improves the climate for development, but will not in itself result in a sudden movement towards further urbanization. Several requirements must be satisfied for residential or resort development to proceed successfully: land must be available, public service facil ities must be able to handle greater numbers of people and the public must be in favor of such projects. In Poipu, at present, the availabil ity of land is controlled by zoning restrictions; the existing water system (there is no publ ic sewer system) is inadequate to provide significant flow increases and the recent publ ic outcry against new development along the Poipu coastline has received statewide attention. Only an appropriate combination of the aforementioned factors will result in continued building construction.

There are presently several developments which have been in the planning stage for a number of years which could proceed once the new "stand-by" water supply is installed.

"However, the pr i vate sewage treatment system for each development must be approved by the Department of Health.

Once the water system becomes operable, attention may be focused on other public services which require improvement. One of these is the public sewage

,collection and treatment system. Pressure may be exerted on local governmental agencies by the residents of Poipu to implement the Water Quality Management Plan. The schedule for the installation of the area's publ ic sewage treatment plant and collection system, however, depends heavily upon the availabil ity of. Federal grants.

The improved cl imate for development may lead to fuller use of available beach and recreational facilities and open space in Poipu. Traffic volume along Maluhia Road and Poipu Road could increase through Koloa town which is an older, more placid community than Poipu. v. POTENTIAL SOURCES OF CONTAMINATION

A. Description of Existing Sewerage Systems:

Cesspools are the predominant sewage disposal system in the Koloa town area and parts of Poipu. A private sewage treatment plant and sewer lines are maintained by the Poipu Beach Hotel. However, the existing well is located on the slopes of Paa Ridge, approximately 2 miles away from the nearest cesspool. Therefore, contamination of the source through the existing cesspool system is of low risk. (REFERENCE a)

B. Others, including Agricultural and Industrial Pollutant Sources:

The well site is located within conservation zoned district land and is bounded east and south by sugar cane fields. Possible contamination (nitrates) from the surrounding agricultural activities, i.e. leaching of fertilizers by rainfall and irrigation, may be considered of low risk. The chemical analysis report (TABLE 3) of the well water shows a nitrate level of 0.4 parts per mill ion (ppm), which is far below the maximum allowable level of 10.0 ppm.

Prel iminary tests taken during the early stages of well drilling indicated the presence of brackish water. Consequently, the well was cased to a depth of 95.4 feet below sea level which has resulted in water production coming in from a depth interval of 95.4 to 195.4 feet below sea level. Table 3 also shows a chloride level of 96 parts per million which is well below the maximum level of 250 parts per mill i on.

VII. PROPOSED TREATMENT WORKS

The water drawn from Koloa Well 5426-05 (KOLOA WELL "0") will be treated by an automatic gas chlorinator injection system. This treated water will be pumped into a 1.5 million gallon storage tank and then distributed to the consumers.

Other required information referring to treatment plant facil ities does not apply to well sources.

VIII. PUMPING FACILITIES

"This well source is needed to supply water to meet the growing demands for the Poipu area. The electrical power required to operate the deepwell pump will be suppl ied by Citizens Electric Company. In the event of power failure or other emergencies, the Koloa - Poipu Water System will be provided water from the nearby Lawai - Omao Water System. These systems are connected by an 8-inch water main that is separated by a normally closed valve.

A pump control building will be constructed at the well site to house the pump control panel, recorders, chlorinator units and other accessori es requi red to operate the pump.11 (REFERENCE a)

The above information is for existing Koloa Well 5426-04 (KOLOA WELL "C") which currently serves the Koloa - Poipu Water System. Koloa Well 5426-05 (KOLOA WELL "0") is a "stand-by" source to Koloa Well 5426-04. The construction of the Koloa Well 5426-05 pump facil ities is similar to Koloa Well 5426-04.

IX. FINISHED WATER STORAGE

The existing storage tank site is located on the northwest slope of the Puuhi volcanic cone. The 1.5 million gallon tank was designed to accommodate an average day demand of 1.47 mill ion gallons per day (MGD). This tank is a reinforced concrete structure, approximately 113 feet in diameter and 22 feet high. The tank overflow water will be conveyed by a concrete-lined ditch and discharged into a nearby irrigation system.

The telemetering and supervisory control system consist of telephone control 1 ines that transmit signals from a water level indicator inside the tank to the pump control panel at the well site. This pump control panel controls the operation of the pump and chlorinator unit.

The exterior of the tank is being painted with an exterior coating that blends into the surrounding environment. The interior of the tank is painted with an epoxy resin type coating •

x. WATER DISTRIBUTION SYSTEMS

Information required under this section is presented in the construction plans. The construction plans for Koloa Well "0" (5426-05) Koloa - Poipu Water System, Koloa, Kauai, Hawaii were prepared by Akinaka & Associates, Ltd according to Department of Water, County of Kauai standards. Raymond D. Sato, Manager and Chief Engineer, Department of Water, County of Kauai, approved and signed the construction plans on November 2, 1983.

SUBJECT: KOLOA WELL D CONSTRUCTION A~D TESTING SUMMARY

Attached is an as-built sketch of the Koloa well "D" along with copies of the driller's lag. Twa pumping tests were conducted an the completed well.

On November 11, 1981, a test was made to establish the specific capacity of the well. Figure 1 illustrates the results of that test. Chlorides, measured by HACH Kit analysis, were identical (4 samples) at 106 mg/l.

On November 16, 1981, a continuous 72 hour pumping test commenced at a rate of approximately 1160 gpm. Figure 2 is the graph of test data. As noted, there is a slight, but steady, decline in the water level. This behavior is predictable as the well penetrates a dike confined high level aquifer. The County Koloa well "C" and Grave Farm well 36 also pump from the same aquifero .

Typically, a dike confined aquifer will reflect such a dewatering performance. The total amount of water pumped by a single well is not as significant as the total amount of water pumped by all wells penetrating the aquifer. For this reason, the long term test is of little significance in determining the amount of water which shculd be pumped from the aquifer or. a sustained basis. A carefully cortrolled ard monitored aquifer test would be required in order to more accurately determine the sustainable yield of the aquifer.

~aiinity checks were conducted every 6 hours during the 72 hour test. The results are indicated on Figure 2. Just prior to shut down, a sample was collected for analysis in accordance with the Federal Clean Drinking Water Act. The laboratory results are attached and all items listed meet the Clean Water Act requirements.

According to the County Department of Water Supply-Developer agreement, the designed production rate of Koloa "0" should be 1200 gpm. As rooted On Figure 1, the drawdown at 1200 gpm is about 4 feet. The water level elevation is about +26 feet. A pump intake submergence of 50 feet is recommended in the final installation.

This letter is pursuant to Department of Health review of the Board of Land and Natural Resources I recent approval of your application to drill a new well (No. 5426-05). As you are aware, Chapter 49, Public Health Regulations sets down requmments for "publ ic water systems ll as defined by that Chapter. A "public water system" as defined is one which serves a minimum of 25 persons at least sixty days per year or has fifteen or more service connections.

Section 29 of Chapter 49 requ~res that all new potable water sources serving public water systems be approved by the Director of Health prior to their use to serve domestic water. Such approval is based primarily on an engineering report which adequately addresses all concerns as set down in Section 29, Chapter 49, PHR. This report must be prepared by a licensed engineer and bear his seal upon its submission to the Department.

The above discussion of Section 29 requirements will also be applicable any time in the future should your system not serve the minimum numbers of persons but eventually expand to that minimum size. As mentioned earlier, the system at that time would also be subject to all applicable terms and conditions of Chapter 49, PHR. The Department of Health must be notified of the system qualification as a public water system.
