    ESIAPPLICABILITY The establishment which is employing more than 10 persons and using power for his

    manufacturing process or

    The establishment which is employing more than 20 persons and not using power for his

    manufacturing process

    Under Section 1(5): State Governments have extended the provisions of the ESI Act to thefollowing classes of establishments.

    Shops

    Hotels & Restaurants

    Cinemas including preview theatres

    Road motor transport undertakings

    Newspaper Establishments

    AREAS COVERED The ESI Scheme is being implemented area-wise by stages. The Scheme has already beenimplemented in different areas in the following States/Union Territories

    STATES - All the States except Nagaland, Manipur, Tripura, Sikkim, Arunachal Pradesh

    and Mizoram.UNION TERRITORIES - Delhi, Chandigarh and Pondicherry

    ELIGIBILITY Wage-limit is Rs.10, 000/- per month (with effect from 1.10.2006).All allowance except washing, conveyance allowance would be considered as wages for the

    purpose of applicability of the Act.

    Medical benefit Full medical facility including hospitalization for member and his family from the date ofmembership

    Medical benefit after retirement If the member has completed the 5 years membership before theretirement will get full medical care benefit on the payment of Rs. 10 p.m. is paid in advance for one year

    Sickness benefitEmployee will get 50% of wages for the sickness period (3 months Contribution paid), Employee

    will get medical treatment, medicines

    Maternity benefit Minimum 2 return period of contribution period should be completed to get the maternitybenefit. 12 weeks full wages + medical treatment

    Temporary Disablement benefitApproximate 70% of wages

    Permanent Disablement benefitDepends upon the loss of earning capacity

    Funeral expensesThe nominees will get Rs. 2500 for the expenditure of funeral of member

    Dependents benefit

    To widow for life or until remarriage, to legitimate or adopted son or unmarried daughter till the age of 18.

    Dependent covers spouse, Children (age below 18), father and mother, those who are dependent on the incomeof the insured person
