For “pipeline” this is any position thatperforms an operations, maintenance oremergency response function.

Remember: The tasks you actually performqualify you as a safety-sensitive employee,not your job title.

Some employees, like managers andsupervisors, may be qualified for these jobsbut not currently performing them.

As a safety-sensitive employee… You must not use or possess alcohol or any illicit drug while

assigned to perform safety-sensitive functions or actuallyperforming safety-sensitive functions.

You must not report for service, or remain on duty ifyou… Are under the influence or impaired by alcohol;

Have a blood alcohol concentration .04 or greater; (with a bloodalcohol concentration of .02 to .039

Have used any illicit drug.

You must not use alcohol within four hours of reportingfor service or after receiving notice to report.

DOT drug tests are conducted only using urinespecimens.

The urine specimens are analyzed for thefollowing drugs/metabolites:

Marijuana metabolites /THC

Cocaine metabolites

Amphetamines (including methamphetamine, MDMA)

Opiates (including codeine, heroin (6-AM), morphine)

Phencyclidine (PCP)

Safety-sensitive employees are subject to drugor alcohol testing in the following situations:

Pre-employment.

Reasonable Suspicion/Cause.

Random.

Return-to-duty.

Follow-up.

Post-Accident.

As a new hire, you are required to submit to a drug test.

Employers may, but are not required to, conduct alcoholtesting.

Only after your employer receives a negative drug testresult (and negative alcohol test result - if administered)may you begin performing safety -sensitive functions.

This also applies if you are a current employeetransferring from a non-safety -sensitive function intosafety -sensitive position (even if it is the same employer).

You are required to submit to any test (whether drug, alcoholor both) that a supervisor requests based on reasonablesuspicion.

Reasonable suspicion means that one or more trainedsupervisors reasonably believes or suspects that you areunder the influence of drugs or alcohol.

Supervisors cannot require testing based on a hunch orguess alone; their suspicion must be based on observationsconcerning your appearance, behavior, speech and smellthat are usually associated with drug or alcohol use.

You are subject to unannounced random drugtesting.

No manager, supervisor, official or agent mayselect you for testing just because they want to.

Under DOT regulations, employers must use atruly random selection process.

Each employee must have an equal chance tobe selected and tested.

You will be notified of your selection andprovided enough time to stop performing yoursafety sensitive function and report to thetesting location.

Failure to show for a test orinterfering with the testing processcan be considered a refusal.

As soon as possible but no later than 32 hours after anaccident, an operator shall drug test each employeewhose performance either contributed to the accident orcannot be completely discounted as a contributing factorto the accident.

An operator may decide not to test, but such a decisionmust be based on the best information availableimmediately after the accident that the employee'sperformance could not have contributed to the accidentor that, because of the time between that performanceand the accident, it is not likely that a drug test wouldreveal whether the performance was affected by druguse.

Safety-sensitive employees areobligated by law to submit to and

cooperate in drug & alcohol testingmandated by DOT regulations.

If you have violated the prohibited drug & alcoholrules, you are required to take a drug and/or alcoholtest before returning to safety-sensitive functions forany DOT regulated employer.

You are subject to unannounced follow-up testing atleast 6 times in the first 12 months following yourreturn to active safety sensitive service.

Return-to-duty tests must be conducted under directobservation.

The amount of follow-up testing you receive is determined bya Substance Abuse Professional (SAP) and may continue forup to 5 years.

This means the SAP will determine how many times you willbe tested (at least 6 times in the first year), for how long, andfor what substance (i.e. drugs, alcohol, or both).

Your employer is responsible for ensuring that follow-uptesting is conducted and completed.

Follow-up testing is in addition to all other DOT requiredtesting.

All follow-up tests will be observed.

Regardless of the DOT agency requiring the drugtest, the drug testing process always consists ofthree components:

The Collection. (49 CFR Part 40, Subparts C, D, E)

Testing at the Laboratory. (49 CFR Part 40, Subpart F)

Review by the Medical Review Officer. (49 CFR Part 40,Subpart G)

During the collection process, a urine specimencollector will:

Verify your identity using a current valid photo ID, suchas driver’s license, passport, employer issued pictureID, etc.

Create a secure collection site by:

Restricting access to the site to only those beingtested.

Securing all water sources and placing blue dye inany standing water.

Removing or securing all cleaning products/fluids atthe collection site.

During the collection process, a urine specimencollector will:

Afford you privacy to provide a urine specimen.

Exceptions to the rule generally surroundissues of attempted adulteration orsubstitution of a specimen or any situationwhere general questions of validity arise, likean unusual temperature.

Ask you to remove any unnecessary garmentsand empty your pockets (you may retain yourwallet).

Instruct you to wash and dry your hands.

Select or have you select a sealed collectionkit and open it in your presence.

Request you to provide a specimen (aminimum of 45 mL) of your urine into acollection container.

Check the temperature and color of the urine.

In your presence, pour the urine into two separate bottles (Aor primary and B or split), seal them with tamper-evidenttape, and then ask you to sign the seals after they have beenplaced on the bottles.

Remember: Neither you nor the collector should let thespecimen out of your sight until it has been poured into twoseparate bottles and sealed.

Ask you to provide your name, date of birth, and daytime andevening phone numbers on the Medical Review Officer Copy(Copy #2) of the Federal Drug Testing Custody and ControlForm (CCF).

This is so the Medical Review Officer (MRO) can contact youdirectly if there are any questions about your test.

Complete necessary documentation on the Laboratory Copy(Copy #1) of the CCF to demonstrate the chain of custody (i.e.handling) of the specimen.

Give you the Employee Copy (Copy # 5) of the CCF and maysuggest you list any prescription and over-the-countermedications you may be taking on the back of your copy ofthe CCF (this may serve as a reminder for you in the event theMRO calls you to discuss your test results).

Package and ship both sealed bottles and completed CCF to aU.S. Health and Human Services (HHS) certified testinglaboratory as quickly as possible.

If you are unable to provide 45 mL of urine on the first attempt, thetime will noted, and you wil l be:

Required to remain in the testing area under the supervision of thecollection site personnel, their supervisor, or a representative fromyour company,

Leaving the testing area without authorization may be considereda refusal to test

Urged to drink up to 40 oz. of fluid, distributed reasonably over aperiod of up to three hours,

Asked to provide a new specimen (into a new collection container).

If you do not provide a sufficient specimen within three hours, youmust obtain a medical evaluation within five days to determine ifthere is an acceptable medical reason for not being able to providea specimen.

If it is determined that there is nolegitimate physiological or pre-existingpsychological reason for not providing aurine specimen, it will be considered arefusal to test.

At the laboratory, the staff will:

Determine if flaws exist. If flaws exist, the specimen is rejectedfor testing.

Open only the A bottle and conduct a screening test.Specimens that screen positive will be analyzed again using acompletely different testing methodology.

If the specimen tests negative in either test, the result will bereported as a negative.

Only if the specimen tests positive under both methods will thespecimen be reported to the medical review officer as a positivetest.

Report the findings of the analysis of the Abottle to the Medical Review Officer (MRO).

Store the A and B bottles for any reportedpositive, adulterated, or substituted result forat least 12 months.

Remember: The Lab will conduct specimen validitytests (SVTs) to determine if the specimen wasadulterated or substituted. Tests found to beadulterated or substituted are also reported to theMRO and may be considered a refusal to test.

Under DOT regulations, MROs are licensedphysicians with knowledge and clinicalexperience in substance abuse disorders.

They must also complete qualification trainingcourses and fulfill obligations for continuingeducation courses.

They serve as independent, impartialgatekeepers to the accuracy and integrity ofthe DOT drug testing program.

All laboratory results are sent to an MRO forverification before a company is informed ofthe result.

As a safeguard to quality and accuracy, theMRO reviews each test and rules out any otherlegitimate medical explanation beforeverifying the results as positive, adulterated orsubstituted.

At the start of the test, a Screening Test Technician (STT)or a Breath Alcohol Technician (BAT), using only a DOT-approved device, will:

Establish a private testing area to prevent unauthorized peoplefrom hearing or seeing your test result.

Require you to sign Step #2 of the Alcohol Testing Form (ATF).

Perform a screening test and show you the test result. If thescreening test result is an alcohol concentration of less than 0.02,no further testing is authorized, and there is no DOT action to betaken.

The technician will document the result on the ATF, provide you acopy and provide your employer a copy.

If the screening test result is 0.02 or greater, you will be requiredto take a confirmation test, which can only be administered by BATusing an Evidential Breath Testing (EBT) device.

The BAT will :

Wait at least 15 minutes, but not more than 30 minutes, beforeconducting the confirmation test. During that time, you are not beallowed to eat, drink, smoke, belch, put anything in you mouth or leavethe testing area.

Remember: Leaving the testing area without authorization may be considereda refusal to test.

Perform an “air blank” (which must read 0.00) on the EBT deviceto ensure that there is no residual alcohol in the EBT or in the airaround it.

Perform a confirmation test using a newmouthpiece.

Display the test result to you on the EBT and onthe printout from the EBT.

Document the confirmation test result on the ATF,provide you a copy and provide your employer acopy.

Report any result of 0.02 or greater immediatelyto the employer.

If after several attempts you are unable to provide anadequate amount of breath, the testing will bestopped.

You will be instructed to take a medical evaluation todetermine if there is an acceptable medical reasonfor not providing a sample.

If it is determined that there is no legitimatephysiological or psychological reason, the test will betreated as a refusal to test.

CONFIRMATION TEST RESULTS ARE THEFINAL OUTCOME OF THE TEST.

0.02 - 0.039 The FTA & PHMSA require only that you test below 0.02 orcannot work until the next scheduled duty period but not lessthan 8 hours from the time of the test.

0.04 or greater Immediate removal from safety-sensitive functions. You maynot resume safety-sensitive functions until you successfullycomplete the return-to-duty process.

If you are instructed to submit to a DOT drug or alcohol testand you don’t agree with the reason or rationale for the test,take the test anyway.

Don’t interfere with the testing process or refuse the test.

After the test, express your concerns to your employer througha letter to your company’s dispute resolution office, byfollowing an agreed upon labor grievance or other companyprocedures.

You can also express your concerns to the appropriate DOTagency drug & alcohol program office.

Whomever you decide to contact, contact them as soon aspossible after the test.

DOT regulations prohibit you from refusing a test.The following are some examples of conduct that theregulations define as refusing a test (See 49 CFRPart 40 Subpart I & Subpart N):

Failure to appear for any test after being directed todo so by your employer.

Failure to remain at the testing site until the testingprocess is complete.

Failure to provide a urine or breath sample for anytest required by federal regulations.

Note: Tests conducted under direct observation ormonitoring occur in limited situations. The majority ofspecimens are provided in private

Failure to provide a sufficient urine or breath samplewhen directed, and it has been determined, through arequired medical evaluation, that there was notadequate medical explanation for the failure.

Failure to take a second test when directed to do so.

WHAT IS CONSIDERED A REFUSAL TO TEST?

DOT regulations do not address employment actionssuch as hiring, firing or granting leaves of absence.

All employment decisions are the responsibility ofthe employers.

Under Federal regulations, the main requirement foremployers is to immediately remove employees fromperforming DOT safety-sensitive jobs.

Be aware that a positive or refused DOT drug oralcohol test may trigger additional consequencesbased on company policy or employment agreement.
