Energy Savings Opportunity Scheme
(ESOS) Energy-saving initiative introduced in response to the EU’s Energy Efficiency Directive. Deadline of 5th December 2015 extended to 29th January 2016 Applicable to “large undertakings”:
More than 250 employees Turnover of more than €50m (around £39.5m) and a balance sheet exceeding €43m at 31 December 2014.

Private Rental Sector – New Legislation
April 2016 - residential private landlords will not be able to refuse a tenant’s request for energy efficiency improvements where subsidies are available to pay for themFrom April 2018, private domestic and non-domestic landlords to ensure at least an ‘E’ EPC rating - Or Landlords must have installed those improvements that could be funded using subsidies, before granting a tenancy to new or existing tenants

Raising standards will cut bills significantly
Fuel poverty target to ensure:– as many fuel poor homes as is reasonably
practicable to achieve a minimum energy efficiency standard of Band C by 2030

Any energy efficiency improvements must be financeable without any compulsory upfront cost to the landlord.These requirements will apply to all private rented properties – including occupied propertiesApril 2020 - domestic sector April 2023 - non-domestic
Commercial properties
National EPC register indicates that 18% of commercial stock has EPC rating of F & G
20% of stock are rated as an E
Implications are that rent reviews will be effected, valuations for secured lending & also difficulties to market if not upgraded

Deregulation Act – New Legislation
Further legislation designed to prevent landlords taking retaliatory action against tenants who request improvements
Legislation to protect tenants will increase demand for EPCs in the private rented sector.
Deregulation Act 2015
Became law on 26 March 2015
The Deregulation Act 2015, provides for the “removal of burdens on business, civil society, individuals, public sector bodies and the taxpayer” Section 33 makes significant changes to Section 21 of the Housing Act with the intent of preventing ‘retaliatory eviction’
Housing Act 1988 Section 21
Section 21 of the Housing Act 1988 allows a landlord to terminate an assured short hold tenancy giving 2 months’ notice without reason
The Act also allows, if certain conditions have been adhered to, to accelerate the possession and a Judge has little discretion not to grant possession
Implications of changeDeregulation Act, Section 33, prevents the landlord from serving a Section 21 notice until the landlord has complied with the relevant legal obligations such as the:
condition of dwellings,the health and safety of occupiers of dwellings,the energy performance of dwellings and that information has been provided to the tenant.
Section 33 of the 2015 Act applies to assured shorthold tenancies in England granted on and after October 2015
Deregulation ActSummary
From October 2015, landlords entering a short term tenancy risk losing their right to issue an eviction notice under Section 21... if they have not complied with all their legal obligations... including the provision of an EPC
