Green Deal Finance Closureo Green Deal is not deado It is the government support to the funding of Green
Deal plans that has stopped. o This will have a significant effect on the Providers and
the Finance Company itself o Only 10,000 of the 576,000 Green Deal assessments
resulted in Green Deal Planso The drivers for the remaining 98% still existo The Bonfield report
Energy Savings Opportunity Scheme (ESOS)o New energy-saving initiative introduced in response to
the EU’s Energy Efficiency Directive.
o Applicable to “large undertakings” – oMore than 250 employees oTurnover of more than €50m (around £39.5m) and a
balance sheet exceeding €43m at 31 December 2014.

Section 63 Climate Change (Scotland) Act 2009
o The Scottish Government is committed to achieving an 80% reduction in CO2 emissions by 2050 and a 42% reduction by 2020
o Regulations requiring the assessment and improvement of existing non-domestic buildings will shortly be laid in Parliament with proposed implementation in summer 2016
What will the regulations require?
o Initially will only apply to buildings with a floor area exceeding 1000m2 which require an EPC for either sale or lease to a new tenant.
o Buildings that meet energy standards equivalent to those introduced in 2002 or that have been improved via a Green Deal will not need to meet the requirements
What will the regulations require?o In addition to an EPC further assessment of the building
required to identify a target for improvement of the carbon and energy performance of the building
o Action plan showing how this target would be met through physical improvements to the building
o If improving 3.5 years allowed to do the physical worko Can defer improvements if operational energy rating –
Display Energy Certificate (DEC) is producedo Scottish Government to provide details on DECS shortly
Section 64 – Existing Dwellings
o Scottish Government have implemented the Energy Efficiency Standard for Social Housing (EESSH)
o Consultation on the Regulation of Energy Efficiency in the private Sector (REEPS) expected shortly
o We don’t know what its going to say, but we can tell you what’s to happen in England and Wales
Private Rental Sector - New Legislationo Legal obligation for as many fuel poor homes “as
reasonably practicable” to be raised to Band C by 2030.o Currently only 5% of England’s 2.3 million fuel poor
homes reach the Band C standard. o Raising standards will cut bills significantly.
Private Rental Sector - New Legislationo The Energy Efficiency (Domestic Private Rented
Property) Order 2015 No. 799o The regulations now approved by Parliament and are
lawo Four distinct events;
1. Action tenants request 20162. Minimum standards new tenancy agreement 20183. Minimum standards domestic 20204. Minimum standards non domestic 2023
Private Rental Sector – reasonable requestoResidential private landlords will not be able to unreasonably refuse consent to a tenant’s request for energy efficiency improvements o where subsidies are available to pay for them e.g. ECO and Green DealoImplementation April 2016,
Private Rental Sector – new tenantso Private domestic and non-domestic landlords will need
to ensure that their properties reach at least an ‘E’ EPC rating
o Or must have installed those improvements that could be funded using subsidies available to pay for them,
o Trigger point is the granting a tenancy to new or existing tenants
o Implementation April 2018
Private Rental Sector – new leaseo These requirements will apply to all private rented
properties – including occupied propertieso April 2020 - domestic sector o April 2023 - non-domestic
