The 8th annual Project Save-a-Smile took place at the St. Petersburg office of Dr. Ron O’Neal. Dr. O’Neal and his entire team provided digital x-rays, oral exams, cleaning and placing of dental restorations to foster children that have been identified as needy by several community foster children’s organizations. When the children get the dental care they so desperately need, it does more than save their smile—it shines up their self-esteem too.

While waiting for their treatment, the children had an opportunity

to play with ducklings and bunnies at the Animal House Naturals Pet Center table, jump around in the Funny Business bounce house, try out their fast ball in the Tampa Bay Ray’s pitching booth and learn how to cast a fishing rod with Tampa Bay Outfitters. Breakfast and lunch was provided by Chick-fil-A and Cappy’s pizzeria for all of the children parents and volunteers. There was a St. Petersburg Police K-9 demonstration, a reptile show and line dancing tunes by Venturi Productions. Volunteers from the St. Pete High School Key Club and St. Pete Kiwanis club kept the event running smoothly.

Face-painting, inflatable slides with kids bouncing, a dunk tank, the smell of grilling hamburgers and music jamming in the background while everyone is

relaxing and having a good time. Sound like a trip to your local dentist’s office? Probably not, however for a group of foster children in Saint Petersburg a few weeks ago this was exactly the case.

Project Save-a-Smile is a nonprofit organization founded by Dr. O’Neal. Its mission is to provide dental care to foster children that they would otherwise be unable to have access to. Dr. O’Neal and his team prides themselves in creating an environment that is sure to excite the youth about their oral health both on the day of the carnival and in the future. Dr. O’Neal states: “I truly enjoy being part of helping someone redefine their smile. Having the opportunity to help a child

realize the important of oral health is paramount. I’d like to personally thank the generosity of all of our sponsors that made the event such a success for the children.”

Over 1.5 million people are arrested each year for DUI first offense. These people could be your neighbors, coworkers, friends, or even your family.

Each experience is unique, but all share the same feeling — the shame and regret that comes from being convicted of driving under the influence. Or it could happen to you too.

The judge on your case will sentence you to a variety of punishments that may include fines, classes, probation, revocation or restriction of your license, and even jail. It’s important that you abide by this sentencing in order to fulfill your conviction and move past it in order to someday get your license back. The severity of your punishment will depend on the severity of your offense

Once you get a DUI, there is a good chance that your insurance company will terminate your policy. If you still have your driver’s license, it’s important to always carry insurance. In most states, you’ll also have to file an SR-22, which serves as proof that you have the proper amount of insurance that is required by the state you live in. You will have to carry insurance and the SR-22 form for a minimum of three years. If your policy lapses, your insurance carrier is required by law to notify your state

licensing authority, which will likely result in the suspension of your driver’s license

After you’ve been convicted of a DUI, you will likely lose your license for a period of time. Once you fulfill the suspension, you may be eligible to get a temporary or restricted license that will allow you to get back and forth to work and the alcohol program you will likely need to attend.

To be eligible to get your license back, you must demonstrate that you’ve completed or are in the process of completing any punishment you’ve been sentenced to. You will also have to show proof of insurance to the state by filing your SR-22 form from your insurance company. Finally, you’ll have to pay any fee your state charges to reissue your license. Check with your DMV for any additional regulations your state may have

to regain your license.

Quick fixes like sucking on a penny, swishing mouthwash, a cold shower or a cup of coffee will do nothing to impact your BAC. The only way to get sober after drinking is to allow your body to process the alcohol you’ve consumed, generally at an average of one drink per hour.

A BAC level as low as .02 can impact you’re driving and increase the likelihood of an accident. Beginning at .05 BAC level, your chances of an auto accident increase significantly

A recent annual report shows that approximately 254,000 people suffered injuries from alcohol-related collisions.

An estimated 20-25% of U.S. drivers admit to driving after drinking within the past year.

Of those people, 5% believe they were legally impaired at the time. When you break that down by the 208 million registered drivers, there are 2.6 million drunk drivers on the road every year.

The legal blood alcohol content limit is currently .08 in all 50 states, as well as the District of Columbia and Puerto Rico. Drivers with a BAC of at least .15 account for more than half of all the alcohol-related traffic deaths.

There was only one tax law that changed for 2013 that affects taxpayers of all income groups, the change to deductible medical expenses when a taxpayer is itemizing deductions. Only medical expenses that exceed 10 percent of your adjusted gross income (AGI), often referred to as the “medical expense deduction floor”, will be allowed as a deduction. (Taxpayers who are age 65 or older in 2013 still have a medical deduction floor of 7.5 percent.) This change will affect all those who itemize deductions and claim a medical expense deduction. So, if you typically claim this deduction, you’re going to want to watch for this change.

The other two changes for 2013 are the ones that you need to watch out for, as they affect “high income” taxpayers. The new laws require you to pay an additional 0.9% Medicare tax when there is an earned income of more than $200,000 for Single, HOH, or Qualifying Widow Taxpayers or $250,000 for Married

filing jointly taxpayers and $125,000 for Married but filing separately taxpayers. This change affects both wages and self-employment income. If your wages are $200,000 or greater the additional taxes will be withheld from your pay regardless of your filing status. If you are going to be affected by this change you may need to make estimated tax payments or adjust your withholding to ensure that the additional taxes don’t trigger a balance due when filing next year. You can submit a Form W-4 to your employer to increase your income tax withholdings.

If there are going to be additional Medicare taxes withheld and you won’t be subject to the additional taxes at the end of the year because you have a loss from a business or are filing jointly and have total earnings of less than $250,000 you have to wait to file your return to receive a refund of an excess taxes that are withheld. Typically, employers cannot refund the taxes. For 2013

There were three key changes you should know about how the Affordable Care Act (ACA) can affect your individual income tax return. There will be additional

changes going forward, so specifically, we are looking at tax year 2013.

IRS is developing a new Form 8959, to calculate any additional Medicare tax that may not be owed or excess tax paid. The excess taxes paid will be a refundable credit when reported on the tax return and any of the remaining tax will be issued as a refund after all federal tax liability has been satisfied.

The next change, and perhaps one of the most confusing one for high income taxpayers, is the new 3.8 percent Medicare surtax on Net Investment income. Taxpayers with an income of greater than $250,000 if Married Filing Jointly, $200,000 if Head of Household, Single or a Qualifying Widow and $125,000 if Married Filing Separately will owe the new tax on Net Investment Income (NII). NII includes investment income such as interest, dividends, capital gains, passive income, and rental or royalty income. The tax is assessed on the smaller of the total NII or excess income greater than the income thresholds. Sound confusing? It is. Here’s an example.

Timothy is a single taxpayer with an AGI of $225,000, consisting of $180,000 in wages, $30,000 in retirement income and $15,000 in net investment income from interest, dividends and passive income from an S-corp. $25,000 is subject to the surtax which is determined by subtracting the $200,000 threshold amount from the $225,000AGI. When comparing the excess income of $25,000 to the net investment income of $30,000, the excess income is lower, therefore the excess income of $25,000 will be subject to the 3.8 percent Medicare tax

Taxpayers will determine any applicable Medicare tax on the new Form 8960, Net Investment Income Tax--Individuals, Estates and Trusts, when they file their income tax return. Taxpayers whose AGI may exceed the threshold amounts and who have investment income may need to adjust their withholding or make estimated tax payments to ensure the new Medicare tax on investment income doesn’t trigger a balance due when filing taxes next year.

The good news for the vast majority of taxpayers is these particular new rules for 2013 will have very little impact. The BAD news is that if you are impacted, you will owe more tax. Further bad news for those impacted is that for some taxpayers, you may owe BOTH new taxes, and even more bad news, may owe taxes at a new HIGHER tax bracket and capital gain tax rate that were introduced in the American Tax Relief Act of 2012. The NEW highest tax bracket for very high income earners that is 39.6 percent and a new 20 percent capital gain tax rate applies to the same very high income taxpayers. So possibly a quadruple whammy tax increase if you are a very high earner with net investment income. Finally if you had medical expenses, you could find yourself with a potential tax increase due to the decrease in medical expense deduction from the increase in the medical deduction floor. But as I said, that scenario will only be for a limited population of taxpayers, but it certainly will be a bad April 15th for them. So, if you’re affected, or even just think you’re affected, talk to your tax professional to make sure you plan accordingly.
