    MOD GROUP ELECTIONS AND GROUP CONFERENCE 2010

    Dear Colleague

    This circular sets out the arrangements forMoD Group Elections and Conference 2010

    TimetableThe full MoD Group pre-conference andelection timetable is set out at Annex A.

    ElectionsNominations are sought for the MoD Groupposts as set out in the election regulationsattached at Annex C.

    Note that it is group policy that all candidateswho wish to stand for election to the GECmust accept responsibility that they must besubject to accountability decided by theGEC, MOD Group Conference, NationalConference and any full electoral ballot.

    Nominations are particularly welcomed frommembers from under represented groups,which in this group includes women, blackminority ethnic groups (Asian, Chinese,Caribbean, African etc), disabled, young and

    lesbian, bisexual, trans and gay members.The union has reviewed the group electionprocedures to greater ensure consistency

    with those used for the national elections.As a result there are a number of changesthat have been made in the way that theMoD Group conducts these elections andbranches should read these revisedregulations carefully.

    In particular you should note:

    The limit for the number of words inan elections statement has beenincreased from 250 to 400 words.

    Candidates may submit a statementfor each post for which they areapplying.

    Candidates will now be informed ofeach nomination that has been madeand will be sent the forms to confirmtheir acceptance of nomination.However, timescales and resourcesmean that for some late nominationsthere will not be time for a candidateto confirm their acceptance following

    such notification and it is still theresponsibility of the nominatingbranch to ensure that the candidate isaware of a nomination and the

    responsibility of the candidate thatthey submit their acceptance ofnomination, and any electionstatement(s) in time. Pleasephotocopy and provide Candidatesprofile form to your nominees forcompletion together with a copy ofMoD Group Election Regulations

    Annex A which sets out the rules forelection statements, and the Note forGEC candidates Annex D, in goodtime to enable them to do this.

    The Nomination and acceptanceforms can now be submitted by fax.You are warned of the unreliability ofthis method of transmission and arerecommended to use other means ifat all possible. Election statementscannot be submitted by fax.

    An electronic copy of the electionstatements is now a mandatoryrequirement. Branches are asked toassist

    those candidates who do not have directaccess to such facilities.

    ConferenceMoD Group Conference 2010 will be held atthe Brighton Conference Centre, Brightonfrom Monday 17 May to Tuesday 18 May2010. The conference will last 1 days,

    finishing at lunchtime on the Tuesday.Precise starting and finishing times forConference sessions will be set out in theConference Agenda which will be distributedin accordance with the conference andelection timetable, however you should notethat you will probably have to travel on theday preceding conference. If you are a newor trainee delegate you will be required toattend a meeting on the Sunday evening. Ifyou have referred back any motions, or haveany emergency motions then you will wish tomeet the members of standing orderscommittee on the afternoon of the Sunday.

    MotionsMotions for discussion at Group Conferencemust be confined to matters appropriate tothe MOD and its agencies. Motions mustcomply with the rules contained in StandingOrders in the Group Constitution onConference Standing Orders, an extract ofwhich is attached as Annex E.

    All motions should be submitted on the formattached at Annex F. If additional sheets arerequired then please make photocopies ofthis form. It is important that there is onlyone motion on each form. Motions receivedafter the deadline set out in Annex F, will notbe accepted. They should be addressed tothe Secretary of Standing Orders Committee,MOD Group, at PCS HQ.

    Emergency MotionsEmergency motions will only be valid inrespect of issues arising which do not permitthe calling of a special or emergency generalmeeting before the deadline set out in AnnexF for the submission of motions. Branches

    wishing to submit emergency motions forconference need to notify the Secretary ofStanding Orders Committee in writing by thedeadline set out in Annex B, of the wordingof the motion on the appropriate form

    attached at Annex F.

    DelegatesThe basis of representation at GroupConference is laid down in Rule 18 of theGroup Constitution: -

    Up to 100 members 1delegate

    101-300 members 2delegates

    301-500 members 3

    delegates

    More than 500 members 4delegates

    Branches may combine in a consortium toelect a delegate in accordance withsupplementary rule 6.14 of the PCS rules.Branches proposing to form a consortiumshould notify the Secretary of StandingOrders Committee in writing no later than thedeadline set out in Annex B .

    The names and addresses of delegates toConference should be notified to theSecretary of Standing Orders Committee onthe form at annex G no later than the closingdate set out in Annex B. A separate formshould be used for nominating eachdelegate.

    Branches from the private sector are alsoinvited to nominate delegates to attendconference on the same basis as set out inRule 18.

    Delegates are reminded that they areexpected to attend all sessions of theGroup Conference.

    Annual General Meetings Outcome ofBranch ElectionsBranches are instructed by the NEC to notifyGroup Office of their Election results bycompleting form Annex I. This is to enable

    HQ to maintain an accurate register withinCommix of Branch Activists.

    Annex A

    Ministry of Defence Group Elections Regulations2010 - Postal Balloting

    GENERAL1. In accordance with the GroupConstitution Rule7, the followingregulations have been devised by theGroup Secretary in consultation with theGeneral Secretary and the IndependentScrutineers. They will govern the 2010Group Executive Committee (GEC)elections and be binding on all memberswithin the Group.

    2. These regulations will be circulated toall Branches within the Group. In addition,the Group Office will supply a copy to anymember on request.

    ELIGIBILITY TO PARTICIPATE3. Only Ordinary members of the Groupmay take part in the elections. Associateor life members may not be nominated orcast a vote.

    COMPOSITION OF THE GEC4. The GEC ballots will consist of 8separate elections as follows:-

    (a) Group President 1(b) Group Vice President 1(c) Group Treasurer 1(d) Group Organiser 1(e) Group Assistant Secretaries 8(f) Group Executive Cittee Members 16(g) Standing Orders Committee 3(h) Auditors 2

    LIMITATIONS/RESERVATIONS5. No limitations or reservations exist inthe elections.

    NOMINATIONS6. Only branches may submitnominations. In all cases this must befollowing agreement by a properlyconstituted Branch General Meeting,

    except where there has been prior GECagreement that, because of the scattered

    location of members, such a meeting isimpracticable.

    7. Nominees must be ordinarymembers entitled to vote in the electionsand the consent of the nominee to standmust be obtained.

    8. A nomination shall only be valid ifmade on an official nomination paper witha certificate signed by the branch

    chairperson and secretary (or, if either isabsent, by another branch officer),certifying that the nomination has beenmade at a properly constituted BranchGeneral Meeting, and giving the date andplace of the meeting.

    9. The maximum number of candidateswho may be nominated by any branch foreach election is limited to the number tobe elected in that election. An excess ofnominations for an election shall invalidate

    that branchs nominations so far as thatparticular election is concerned.

    10. Any alterations or deletions to thenomination forms must be authenticatedby the signatures of the branchchairperson and secretary (or, if either isabsent, by another branch officer).

    11. Candidates standing for electionunder job-sharing arrangements shall benominated jointly by a branch. Both shall

    be required to signify their willingness toserve and stand jointly for election to onepost.

    12. When making nominations membersand branches should consider PCS EqualOpportunities Policy. PCS is committed toensuring the profile of its elected officialsreflects the diversity of the PCSmembership at all levels.

    13. Completed nomination papers mustbe received by the Group Secretary, byno later than 5.00 pm on Thursday 4

    March 2010. Faxed copies of nominationforms shall only be accepted if received bythe Group Office on fax number 020 7 8012620 by the same deadline. Nominationsreceived after this date and time shall notbe accepted. You are strongly advised tosend this document using the next-day

    guaranteed delivery service.

    14. The nominating branch should informthose members nominated by the branchthat they have been nominated and supplythem with a copy of these regulations andthe attached profile and acceptance form.

    15. The Group Secretary shall satisfythemselves that the rules relating tonominations have been complied with andthat the consent of the nominee has been

    given. If a member has any complaintconcerning the nomination process it willbe dealt with under the proceduresoutlined in regulation31.

    ACCEPTANCE OF NOMINATION16. A nominees name shall only beentered on the appropriate ballot paper if:

    (a) the nominee has been validlynominated, in accordance withthese regulations; and

    (b) the nominee provides writtennotification to the GroupSecretary, that they are willingto stand, clearly identifying thepost or posts this applies to;and

    (c) this notification is received byno later than 5.00pm onThursday 11 March 2010. If

    written notification is notreceived by then it shall beassumed that the nominee isnot willing to stand and theirname shall not be included inthe list of candidates.

    Nominees may submit their notification byfax to 020 7801 2620, by post to theGroup Secretary Paul Barnsleyor send asa Word attachment to an email [email protected] to be received by the

    required deadline.

    17. The Group Office shall send eachnominee written confirmation that theyhave been nominated for a position, oncenotification is received from a branch. TheGroup Office shall also send the nomineea copy of these regulations. Nomineesshould indicate their acceptance of

    nomination, by the required deadline, onthe attached candidate profile andacceptance form.

    Nominees may provide written acceptanceof nomination prior to receivingconfirmation from the Group Office, andshould do so if the deadline is near.

    Use of the attached profile andacceptance form is not mandatory.However, to be valid an acceptance of

    nomination must contain the informationset out therein.

    ELECTION ADDRESSES18. Candidates may submit an electionaddress for each post for which they arestanding. Candidates standing for morethan one post who wish to use the sameelection address for each post mustclearly state that this is the case.Candidates submitting a different electionaddress for each of the posts they arestanding for must clearly indicate whichelection address is for which post.

    19. Each election address, must notexceed 400 words in total. This includesbiographical information. If the 400 wordslimit is exceeded, only the first 400 wordswill be printed.

    20. In addition to the election address, thecompleted candidate profile and

    acceptance form enables each nominee toprovide a factual statement of theirsurname, forename(s), gender, andbranch. This information will be printed inaddition to any election address submittedand will not count towards the 400 wordslimit.

    21. Election addresses must be receivedby the Group Secretary by no later than5pm on Thursday, 11 March 2010.Election addresses must be provided

    electronically either as a Word attachmentto an email to [email protected] or on a

    CD Rom in the same format. A hard copycan additionally be provided, although thisis not essential.

    Election addresses will be acknowledgedwithin 24hrs, if you do not receive anacknowledgment please contact your

    Group Office on 020 7801 2645.

    22. For verification purposes candidatesmust provide with their election addresseither their membership number or theirnational insurance number. Any candidatemay be required by the Group Office toverify their election address.

    23. Each candidate is responsible forensuring that their election addresscontains no libellous material.

    UNCONTESTED ELECTIONS24. If in any part of the elections thenumber of valid candidates is equal to orless than the number of posts or seats tobe filled no ballot shall be held and, asapplicable, the candidate or candidates (ifavailable) shall be declared elected.

    MISUSE OF MEMBERSHIP DATA25. No information derived from theunions membership or other databases(i.e. commix or any mailing lists derivedfrom it) comprising names and/oraddresses of members of the Group shallbe used by any candidate or by acandidates supporters, without thespecific prior authority of the Union.

    VOTING26. This Group election will be conductedby a postal ballot and ballot papers forthese elections will be sent to all ordinary

    Group members at the designated ballotaddress of their choice. The member shallbe able to complete their ballot paper atany time and at any place they wish andreturn it to the Independent Scrutineers inthe prepaid envelope provided.

    27. Votes may be cast for no more thanthe maximum number of persons to beelected in each ballot. An excess of voteswill invalidate the votes cast in thatelection. Alterations, erasures, comments

    in writing and any other marks or writingon the ballot paper, other than a cross in

    ink in the voting space against eachselected candidate, will invalidate a ballotpaper. A member can apply for areplacement ballot paper by contactingtheir Group Office on020 7801 2645.

    28. Completed ballot papers must be

    received by the Independent Scrutineerbyno later than 12 Noon on Wednesday12 May 2010. Ballot papers received afterthen shall not be included in the count.

    29. Members should ensure that theyhave informed PCS of their up-to-dateballot address. Members can update theirpostal address via the PCS websitewww.pcs.org.uk by logging on using theirmembership number and selecting mymembership (if you have not logged in

    before you will need to create apassword), by phoning 020 78012670/2680 or by [email protected] If members wishto use an address other than their homeaddress as their proper address they mustinform PCS in writing. This is to ensurethat legal requirements regulating sometypes of ballots can be met. Lettersshould be addressed to MembershipRecords. Supplementary Rule 3.19 (d)requires every member to keep PCS headoffice informed of their proper address atall times.

    30. Following despatch of voting papers,members may be reminded of the electionand of a members right to vote.

    COMPLAINTS OF ALLEGED BREACHOF THESE REGULATIONSComplaints concerning, solely ormainly, the validity of nominations,

    supplying of acceptances or electionaddresses.

    31. Any complaint as to the allegedbreach of these regulations concerning,solely or mainly, the validity ofnominations and submission ofacceptances or election address shall bemade in writing to the Group Secretary.These shall be made not later than oneweek before the issue of ballot papers,which shall begin on Thursday 22 April

    2010. If the Group Secretary considersthat the regulations have been breached

    the Group Secretary shall, after consultingthe Group President, determine whataction, if any, should be taken, includingwhether the election should be declaredvoid or any candidate disqualified. TheGroup Secretary will seek the confirmationof this action with the General Secretary

    before proceeding. The Group Secretaryshall publish the decision, together withthe reasons for it, to branches of theGroup.

    Complaints other than thoseconcerning, solely or mainly, thevalidity of nominations, supplying ofacceptances or election addresses.

    32. Any complaint as to an alleged breachof these regulations otherwise than

    concerning, solely or mainly, the validity ofnominations and submission ofacceptances or election address shall bemade in writing to the Group Secretary.Any such complaint must be submittedwithin seven days of the declaration of theresults of the election. The GroupSecretary will investigate the complaintand refer it with their recommendations tothe General Secretary. If the GeneralSecretary upholds the complaint that acandidate by their own act or through theact or acts of those supporting thecandidate, has caused a breach of theseregulations, the candidate may bedebarred from the election and/or theirelection may be declared null and void.The decision of the General Secretaryshall be final and binding on all members.The Group Secretary shall publish thedecision, together with the reasons for it,to branches of the Group.

    INDEPENDENT SCRUTINEERS33. The Independent Scrutineerappointed by the NEC for these GroupElections will be The Electoral ReformServices Limited, The Election Centre, 33Clarendon Road, London, N8 0NW.34. The Independent Scrutineer shallsupervise the production and distributionof voting papers, keep a record of thename and address of each member towhom a voting paper is sent and performall such other functions as designated by

    the General Secretary. They shall beresponsible for the fair and accurate

    counting of votes and the decision of theIndependent Scrutineer with regard to therejection of any voting paper as invalid willbe final.

    ANNOUNCEMENT OF RESULTS35. The Independent Scrutineer shall

    report the result of the elections to thePCS Balloting Office who will inform theGroup Secretary. The result shall not bepublished until the full scrutineers reporthas been received. The scrutineersreport will be supplied to any member ofthe Group following receipt of a writtenrequest to the Group Secretary.

    RETENTION AND DESTRUCTION OFBALLOT PAPERS36. Ballot papers shall be retained by the

    Independent Scrutineer for a period of sixmonths from the announcement of theresult.

    Election Addresses Candidate Checklist

    For these elections, you may submit an election address for each post you are standing for.Candidates standing for more than one post who wish to use the same address for each postmust clearly state that this is the case. Candidates submitting a different election address foreach of the posts they are standing for must clearly associate the appropriate election addresswith the appropriate post, see election regulation 18.

    The word limit for your election address is 400, including any biographical information. Seeelection regulation 19.

    Numbers, initials and dates count as words, so 2,000, PCS, 2000 all count as one word.

    Hyphenated words count as one word, so ex-CPSA counts as one.

    With the exception of abbreviations, the PCS Group Office will convert text that is all in capitalsinto normal upper and lower case.

    Any italics and underlining will be converted to bold text by the PCS Group Office.

    Election addresses must be provided electronically, see election regulations 18 to 23. Any errorsyou make will be reproduced. Please proof read your election address carefully.

    NOTES FOR GEC CANDIDATES

    If you are standing for positions on the GEC and you are elected you will need to beaware of the following:

    GEC dates. GEC dates for the rest of the year (2010) that have already been agreed:

    September 7-9 - commencing at 1.00 pm 1st dayNovember 23-25 - commencing at 1.00 pm 1st day

    Venue. Meetings are held at PCS HQ, Clapham, and if you cannot get to the meeting bythe start time without leaving home earlier than 7 am then you will be entitled to travel onthe previous day and stay another night. You will probably wish to avoid taking holidayson these dates.

    Facility Time. After conference the Group Secretary will write to the Deputy Director ofEmployee Relations (DDER) telling them of your successful election to the GEC. DDERwill then write to your line management telling them that they need to agree your facilitytime. This should cover time to prepare, travel to, attend and follow up on meetings. Forordinary GEC members it will not normally exceed 50%, although if you have branchresponsibilities you will need to add this to the claim. For GEC officers the facility timeallowance is likely to be 100%. Further guidance on this, and other GEC matters, will besent to you if you are elected.

    Large amounts of facility time may make it difficult for you to remain in your present postin which case an alternative, acceptable, post should be found for you.

    RULES ON CONFERENCE MOTIONS

    Extract from the Group Constitution, Annex B Conference Standing Orders

    Rule 2. All motions shall be in the affirmative.

    Rule 5. A motion to affiliate to another organisation shall include a synopsisof its aims and objective together with the annual cost of affiliation. Any such motion ifadopted shall be subject to approval by the National Executive Committee.

    Rule 7. A motions to amend shall not directly negative the substantivemotion, and if carried shall become part of it.

    Rule 39. All motions designed to amend the Groups rules shall be so printed as to

    leave no doubt as to the objective they are designed to achieve.
