This day-and-a-half day training is aimed at enhancing effective cooperation and mutual trust among the European judiciary in order to learn how to better face those situations where the use of evidence obtained in another Member State should be secured in view of its admissibility in another Member State. The training will gather 8 national groups composed of 6 judges and prosecutors representing their Member State (Austria, Belgium, Germany, Greece, Hungary, Malta, Slovenia, Spain and Sweden). They will work on national breakout sessions and international groups directed by experts. Plenary sessions also conducted by experts will be a forum for discussions on the current landscape of EU cross-border gathering of evidence and the perspectives

and challenges offered by the Directive on the European Investigation Order (EIO) which its deadline for implementation into national legislation expired in May 2017. Furthermore, best practices and practical experiences in EU cross border evidence will be at the core of the seminar. The different sessions are aimed at highlighting differences of the legal systems and reaching common conclusions on how to use the evidence in cases with a cross border dimension in order to make prosecutions successful in another Member State (the issuing/ requesting state). Furthermore, knowledge on the EIO Directive will be at the core of the seminar to get participants familiar with the new EU instrument already implemented into national legislation only in some MS.
