1 EIA Listed activities & Time Lines UPDATED: JANUARY 2015 Background In terms of the Bill of Rights, included in the Constitution of the Republic of South Africa of 1996, everyone has the right to have the environment protected and to live in an environment that is not harmful to human health or well-being. Legal instruments developed to ensure that this right is given effect to, include, inter alia, the EIA regulations promulgated in terms of the ECA and the NEMA. Both sets of EIA regulations, including the amendments thereto, identified activities that may result in substantial negative impacts on the environment. These regulations require(d) that an environmental impact assessment process be followed in respect of these identified activities and applications be submitted to the competent authority for consideration. Commencement with any of the listed activities identified by the legislation set out in Table 1below prior to obtaining authorization from the competent authority is (was) prohibited by the ECA and the NEMA and constitutes(d) an offence. EIA Listed activities & Time Lines

Background

In terms of the Bill of Rights, included in the Constitution of the Republic of South Africa of 1996, everyone has the right to have the environment protected and to live in an environment that is not harmful to human health or well-being. Legal instruments developed to ensure that this right is given effect to, include, inter alia, the EIA regulations promulgated in terms of the ECA and the NEMA. Both sets of EIA regulations, including the amendments thereto, identified activities that may result in substantial negative impacts on the environment. These regulations require(d) that an environmental impact assessment process be followed in respect of these identified activities and applications be submitted to the competent authority for consideration. Commencement with any of the listed activities identified by the legislation set out in Table 1below prior to obtaining authorization from the competent authority is (was) prohibited by the ECA and the NEMA and constitutes(d) an offence.

Activity 23 of GNR 386

The decommissioning of existing facilities or infra structure, other than facilities or infrastructure that commenced under an environmental authorisation issued in terms of the Environmental Impact Assessm ent Regulations, 2006 made under section 24(5) of t he Act and published in Government Notice No. R. 385 of 2006, for - d. the disposal of waste; e. the treatment of effluent, wastewater and sewage with an annual throughput capacity of 15 000 cubic metres or more; f. the recycling, handling, temporary storage or tr eatment of general waste with a daily throughput ca pacity of 20 cubic metres or more; or g. the recycling, handling, temporary storage or tr eatment of hazardous waste. Activity 24 of GNR 386

The recommissioning or use of any facility or infra structure, excluding any facility or infrastructure that commenced under an environmental authorisatio n issued in terms of the Environmental Impact Assessm ent Regulations, 2006 made under section 24(5) of t he Act and published in Government Notice No. R. 385 of 2006, after a period of two years from closu re or temporary closure, for facilities for any pr ocess or activity, which require permission, author isation, or further authorisation, in terms of legislation g overning the release of emissions, pollution, efflu ent or waste prior to the facility being recommissi oned unless the facility for the process or activity is included in the list of waste management activities published in terms of section 19 of the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) in which case the activity is regarded to be excluded from the list”.

The construction of facilities or infrastructure, i ncluding associated structures or infrastructure, f or any process or activity which requires a permit or license in terms of legislation governing the gener ation or release of emissions, pollution, effluent or waste and which is not identified in Government Notice No. R. 386 of 2006, or included in the list of waste management activities published in terms of section 19 of the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) in which case the activity is regarded to be excluded from the list”.

The construction of facilities or infrastructure, i ncluding associated structures or infrastructure, f or the generation of electricity where the electric ity output is more than 10 megawatts but less than 20 megawatt s.

Activity 1(b) of GNR 386

The construction of facilities or infrastructure, i ncluding associated structures or infrastructure, f or the above ground storage of 1 000 tons or more b ut less than 100 000 tons of ore.

Activity 1(c) of GNR 386

The construction of facilities or infrastructure, i ncluding associated structures or infrastructure, f or the storage of 250 tons or more but less than 1 00 000 tons of coal.

Activity 1(d) of GNR 386

The construction of facilities or infrastructure, i ncluding associated structures or infrastructure, f or resorts, lodges, hotels or other tourism and hos pitality facilities in a protected area contemplated in the National Environmental Management: Protected Areas Act, 2003 (Act No. 57 of 2003).

(i) the electricity output is more than 10 megawatt s but less than 20 megawatts; or

(ii) the output is 10 megawatts or less but the tot al extent of the facility covers an area in excess of 1 hectare;

excluding where such development of facilities or i nfrastructure is for photovoltaic installations and occurs within an urban area.

Activity 2 of GNR 983

The development and related operation of facilities or infrastructure for the generation of electricit y from a non -renewable resource where —

(i) the electricity output is more than 10 megawatt s but less than 20 megawatts; or

(ii) the output is 10 megawatts or less but the tot al extent of the facility covers an area in excess of 1 hectare.

The development and related operation of facilities or infrastructure for the slaughter of animals with a product throughput of—

Activity 5 of GNR 983

The development and related operation of facilities or infrastructure for the concentration of —

(i) more than 1 000 poultry per facility situated w ithin an urban area, excluding chicks younger than 20 days;

(ii) more than 5 000 poultry per facility situated outside an urban area, excluding chicks younger tha n 20 days;

(iii) more than 5000 chicks younger than 20 days pe r facility situated within an urban area; or

(iv) more than 25000 chicks younger than 20 days pe r facility situated outside an urban area.

Activity 6 of GNR 983

The development and related operation of facilities , infrastructure or structures for aquaculture of —

(i) finfish, crustaceans, reptiles or amphibians, w here such facility, infrastructure or structures wi ll have a production output exceeding 20 000 kg per

annum (wet weight);

(ii) molluscs and echinoderms, where such facility , infrastructure or structures will have a producti on output exceeding 30 000 kg per annum (wet

weight); or

(iii) aquatic plants, where such facility, infrastr ucture or structures will have a production output exceeding 60 000 kg per annum (wet weight);

excluding where the development of such facilities, infrastructure or structures is for purposes of se a-based cage culture in which case activity 7 in th is

Notice applies.

Activity 7 of GNR 983

The development and related operation of facilities , infrastructure or structures for aquaculture of s ea-based cage culture of finfish, crustaceans, rept iles,

amphibians, molluscs, echinoderms and aquatic plant s, where the facility, infrastructure or structures will have a production output exceeding 50 000 kg per

annum (wet weight).

Activity 8 of GNR 983

The development and related operation of hatcheries or agri -industrial facilities outside industrial complexes where the development footprint covers an area

of 2 000 square metres or more.

Activity 9 of GNR 983

The development of infrastructure exceeding 1000 me tres in length for the bulk transportation of water or storm water —

(vii) with an internal diameter of 0,36 metres or m ore; or

Activity 11 of GNR 983

The development of facilities or infrastructure for the transmission and distribution of electricity —

(i) outside urban areas or industrial complexes wit h a capacity of more than 33 but less than 275 kilo volts; or

(ii) inside urban areas or industrial complexes wit h a capacity of 275 kilovolts or more.

Activity 12 of GNR 983

The development of —

(i) canals exceeding 100 square metres in size;

(ii) channels exceeding 100 square metres in size;

(iii) bridges exceeding 100 square metres in size;

(iv) dams, where the dam, including infrastructure and water surface area, exceeds 100 square metres in si ze;

(v) weirs, where the weir, including infrastructure an d water surface area, exceeds 100 square metres in size;

(vi) bulk storm water outlet structures exceeding 100 s quare metres in size;

(vii) marinas exceeding 100 square metres in size;

(viii) jetties exceeding 100 square metres in size;

(ix) slipways exceeding 100 square metres in size;

(x) buildings exceeding 100 square metres in size;

(xi) boardwalks exceeding 100 square metres in size; or

(xii) infrastructure or structures with a physical footp rint of 100 square metres or more;

where such development occurs—

(a) within a watercourse;

(b) in front of a development setback; or

(c) if no development setback exists, within 32 met res of a watercourse, measured from the edge of a w atercourse; —

excluding—

(aa) the development of infrastructure or structure s within existing ports or harbours that will not i ncrease the development footprint of the port or

harbour;

(bb) where such development activities are related to the development of a port or harbour, in which c ase activity 26 in Listing Notice 2 of 2014 applies ;

(cc) activities listed in activity 14 in Listing No tice 2 of 2014 or activity 14 in Listing Notice 3 o f 2014, in which case that activity applies;

Activity 14 of GNR 983 The development of facilities or infrastructure, fo r the storage, or for the storage and handling, of a dangerous good, where such storage occurs in cont ainers

with a combined capacity of 80 cubic metres or more but not exceeding 500 cubic metres.

Activity 15 of GNR 983

The development of structures in the coastal publi c property where the development footprint is bigge r than 50 square metres , excluding —

(i) the development of structures within existing p orts or harbours that will not increase the develop ment footprint of the port or harbour;

(ii) the development of a port or harbour, in which case activity 26 in Listing Notice 2 of 2014 appli es;

(iii) the development of temporary structures withi n the beach zone where such structures will be remo ved within 6 weeks of the commencement of

development and where indigenous vegetation will n ot be cleared; or

(iv) activities listed in activity 14 in Listing No tice 2 of 2014, in which case that activity applies .

Activity 16 of GNR 983 The development and related operation of facilities for the desalination of water with a design capaci ty to produce more than 100 cubic metres of treated water

per day.

Activity 17 of GNR 983

Development —

(i) in the sea;

(ii) in an estuary;

(iii) within the littoral active zone;

(iv) in front of a development setback; or

(v) if no development setback exists, within a distanc e of 100 metres inland of the high-water mark of th e sea or an estuary, whichever is the greater;

in respect of—

(a) fixed or floating jetties and slipways;

(b) tidal pools;

(c) embankments;

(d) rock revetments or stabilising structures inclu ding stabilising walls;

(e) buildings of 50 square metres or more; or

(f) infrastructure with a development footprint of 50 square metres or more —

but excluding—

(aa) the development of infrastructure and structur es within existing ports or harbours that will not increase the development footprint of the port or

harbour;

Activity 18 of GNR 983

The planting of vegetation or placing of any materi al on dunes or exposed sand surfaces of more than 1 0 square metres, within the littoral active zone, for the

purpose of preventing the free movement of sand, er osion or accretion, excluding where —

(i) the planting of vegetation or placement of mate rial relates to restoration and maintenance of indi genous coastal vegetation undertaken in

accordance with a maintenance management plan; or

(ii) such planting of vegetation or placing of mate rial will occur behind a development setback.

Activity 19 of GNR 983

The infilling or depositing of any material of mor e than 5 cubic metres into, or the dredging, excava tion, removal or moving of soil, sand, sh ells, shell grit,

pebbles or rock of more than 5 cubic metres from—

(i) a watercourse;

(ii) the seashore; or

(iii) the littoral active zone, an estuary or a dis tance of 100 metres inland of the high-water mark o f the sea or an estuary, whichever distance is the

greater—

but excluding where such infilling, depositing , dr edging, excavation, removal or moving— (a) will occur behind a development setback;

(b) is for maintenance purposes undertaken in ac cordance with a maintenance management plan; or

(c) falls within the ambit of activity 21 in this Notice, in which case that activity applies.

Activity 20 of GNR 983

Any activity including the operation of that activi ty which requires a prospecting right in terms of section 16 of the Min eral and Petroleum Resources

Development Act, 2002 (Act No. 28 of 2002), includi ng associated infrastructure, structures and earthw orks, directly related to prospecting of a mineral

resource, including activities for which an exempti on has been issued in terms of section 106 of the M ineral and Petroleum Resources Development Act, 200 2

(Act No. 28 of 2002).

Activity 21 of GNR 983

Any activity including the operation of that activi ty which requires a mining permit in terms of secti on 27 of the Mineral an d Petroleum Resources Development

Act, 2002 (Act No. 28 of 2002), including associate d infrastructure, structures and earthworks directl y related to the extraction of a mineral resource, including

activities for which an exemption has been issued i n terms of section 106 of the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 200 2).

Activity 22 of GNR 983

The decommissioning of any activity requiring –

(i) a closure certificate in terms of section 43 of the Mineral and Petroleum Resources Development Ac t, 2002 (Act No. 28 of 2002); or

(ii) a prospecting right, mining right, mining perm it, production right or exploration right, where th e throughput of the activity has reduced by 90% or more

over a period of 5 years excluding where the compet ent authority has in writing agreed that such reduc tion in throughput does not constitute closure.

(ii) a road with a reserve wider than 13,5 meters, or where no reserve exists where the road is wider than 8 metres;

but excluding—

(a) roads which are identified and included in acti vity 27 in Listing Notice 2 of 2014; or

(b) roads where the entire road falls within an urb an area.

Activity 25 of GNR 983

The development and related operation of facilities or infrastructure for the treatment of effluent, w astewater or sewage wit h a daily throughput capacity of

more than 2000 cubic metres but less than 15000 cub ic metres.

Activity 26 of GNR 983

Residentia l, retail, recreational, tourism, commercial or ins titutional developments of 1000 square metres or mo re, on land previously used for mining or heavy

industrial purposes; —

excluding —

(i) where such land has been remediated in terms of part 8 of the National Environmental Management: W aste Act, 2008 (Act No. 59 of 2008) in which case

the National Environmental Management: Waste Act, 2 008 applies; or

(ii) where an environmental authorisation has been obtained for the decommissioning of such a mine or industry in terms of this Notice or any previous

NEMA notice; or

(iii) where a closure certificate has been issued i n terms of section 43 of the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002 )

for such land.

Activity 27 of GNR 983

The clearance of an area of 1 hectares or more, but less than 20 hectares of indigenous vegetation, except where su ch clearance of indigen ous vegetation is

required for—

(i) the undertaking of a linear activity; or

(ii) maintenance purposes undertaken in accordance with a maintenance management plan.

Activity 28 of GNR 983

Residential, mixed, retail, commercial, industrial or institutional developments where such land was u sed for agriculture or afforestation on or after 01 April

1998 and where such development:

(i) will occur inside an urban area, where the tota l land to be developed is bigger than 5 hectares; o r

(ii) will occur outside an urban area, where the to tal land to be developed is bigger than 1 hectare;

excluding where such land has already been develope d for residential, mixed, retail, commercial, indus trial or institutional purposes.

(iii) any development and related operation activit y or activities and expansion and related operation activity or activities listed in this Notice, List ing

(iv) any phased activity or activities for developm ent and related operation activity or expansion or related operation activities listed in this Notice or

Listing Notice 3 of 2014; or

(v) any activity regardless the time the activity w as commenced with, where such activity:

(a) is similarly listed to an activity in (i), (ii), ( iii), or (iv) above; and

(b) is still in operation or development is still in p rogress;

excluding where—

(aa) activity 22 of this notice applies; or

(bb) the decommissioning is covered by part 8 of th e National Environmental Management: Waste Act, 200 8 (Act No. 59 of 2008) in which case the National

Environmental Management: Waste Act, 2008 applies.

Activity 32 of GNR 983

The continuation of any development where the environme ntal authorisation has lapsed and where the continu ation of the developmen t, after the date the

environmental authorisation has lapsed will meet th e threshold of any activity or activities listed in this Notice, Listing Notice 2 of 2014, or Listing Notice 3 or

Listing Notice 4 of 2014.

Activity 33 of GNR 983 The underground gasification of 300 kilograms or mo re coal per day, including any associated operation .

Activity 34 of GNR 983

The expansion or changes to existing facilities for any process or activity where such expansion or ch anges will result in th e need for a permit or licence or an

amended permit or licence in terms of national or p rovincial legislation governing the release of emis sions or pollution, excluding—

(i) where the facility, process or activity is incl uded in the list of waste management activities pub lished in terms of section 19 of the National

Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) in which case the National Environmenta l Management: Waste Act, 2008 applies; or

(ii) the expansion of or changes to existing facili ties for the treatment of effluent, wastewater or s ewage where the capacity will be increased by less than

15 000 cubic metres per day.

The expansion and related operation of facilities, infrastructure or structures for aquaculture of sea-based cage culture of finfish, crustaceans, reptile s,

The development and related operation of facilities or infrastructure for the generation of electricit y from a non-renewable resource where the electrici ty output

The development and related operation of facilities or infrastructure for nuclear reaction including e nergy generation, the production, enrichment, proce ssing,

reprocessing, storage or disposal of nuclear fuels, radioactive products, nuclear waste or radioactive waste.

Activity 4 of GNR 984

The development of facilities or infrastructure, fo r the storage, or storage and handling of a dangero us good, where such storage occurs in containers wi th a
