▪ ERP Portugal is a private law non-profit association, licensed as a compliance scheme by the
Portuguese Government to manage:
▪ Waste of Electrical and Electronic Equipment (WEEE);
▪ Waste of Batteries and Accumulators (WBA).
▪ ERP Portugal, as a Compliance Scheme, guarantees to the Members, Producers of EEE and BA, legal
compliance with their obligations, in accordance with Decree-Law n.º 152-D/2017 – UNILEX.
▪ At the same time, in order to facilitate the forwarding of WEEE and WBA to the companies that are
part of the ERP Portugal Compliance Scheme, it is possible to obtain free collection service, ensuring
their correct routing for recycling.

Definition of Product’s Producer, according to the Decree-Law n.º 152-D/2017, n.º 1, 3rd Article:
«Placing on the market» the first time a productis made available in the Portuguese market as aprofessional activity.
«Placing in the market» the availability of aproduct for distribution, consumption or use inthe market, in Portugal, in the scope of acommercial activity, either being onerous or freeof charge;
Meaning, it represents imports, manufacturing,sales, rental, offer, while professional activity ofthe company.

PRODUCER‘S EXTENDED RESPONSABILITY
The producer’s extended responsibility attributes to the producer of the product the responsibility for the environmental impacts and theproduction of waste resulting from the production process and the subsequent use of the products, as well as their management when theyreach the end of life.
This responsibility can be fulfilled by joining ERP Portugal.

Definition of EEE, according to the Decree-Law n.º 152-D/2017, n.º 1, 3rd Article:
“u) «Electrical or Electronic Equipment», or EEE, equipment dependent on electrical current or electromagnetic fields in
order to function correctly, as well as equipment for generating, transferring or measuring those currents and fields and
conceived to be used with a nominal tension no higher than 1000 V for alternating current and 1500 V for direct current;”

The EEE weight definition includes:

▪ Presentation of four quarterly reports and one annual report of consolidation, per year.
▪ Submission of periodic reports at the ERP PT platform with the quantities in kilograms put on the market, on the respective period,
up to 30 days after the end of each quarter.
▪ Certification of annual consolidated quantities, when requested.
▪ Members can transfer the responsability of periodicaly communicate this information to the Registry Entity to the Compliance
Scheme, through a contract agreement.
▪ The Members shall identify the respective registration number in the invoices they issue as well as in transport documents.
▪ Producers and retailers will have to specify the financial fees, in the invoice of transactions between economic operators (until 2020).

Conditions for EEE Members of small dimension
EEE and BA Producers
▪ Members who have an annual EEE placement in the national market weighing 1 tonne or less, based on the following
conditions:
□ In cases where the placing on the market does not reach 1 tonne, but the value of the total fee as a result of
the presentation of the annual declaration exceeds € 80.00, the Members are obliged to pay the amount
resulting from the declaration;
□ In cases where the placing on the market exceeds 1 tonne but the amount of the total fee following the
presentation of the annual declaration is less than € 80.00, the Members shall pay only the minimum annual
financial contribution.
▪ Rebate Model does not apply to adherents who fall under the conditions of small size.

Definition of BA, according to the Decree-Law n.º 152-D/2017, n.º 1, 3rd Article:
▪ «Battery or accumulator» - any source of electric power obtained through direct transformation of chemical energy, constituted by one or
more non-rechargeable primary cells or by one or more rechargeable secondary elements.
▪ «Portable battery or accumulator» – any battery, button battery, set of batteries or accumulator that is hermetically sealed, that may be
carried in hand and is not an industrial battery or accumulator, nor a battery or accumulator for automotive vehicles, namely the
batteries constituted by one element only, such as the AA and AAA batteries, as well as the batteries and accumulators used in mobile
phones, laptops, wireless electric tools, toys and home appliances;
▪ «Industrial battery or accumulator»: a battery or accumulator created, exclusively, for industrial or professional purposes or used in any
type of electric vehicles, such as the ones used as emergency or reservation energy source in hospitals, airports or offices, the ones
created, exclusively for portable payment terminals in stores and restaurants and for code bar readers in stores, the ones used in
manipulation or in several types of measurement equipment, the ones used in connection to renewable energy applications such as solar
panels and the ones used in electrical vehicles such as cars, wheel chairs, bicycles, vehicles used in airports and automatic transportation
vehicles;

MEMBERS RESPONSABILITIES AND OBLIGATIONS
▪ Producers and retailers, when selling portable BA, cannot detail to the end user the value of the financial fees, in their invoice sales
price.
▪ Producers and retailers of industrial batteries, when selling an accumulator, must differentiate, at a specific point in the respective
invoice, the value of the financial fees.
▪ Retailers must accept the return of BA waste, regardless of their chemistry, without charge to the end user and without the need for
them to acquire new portable BA or at a rate of one to one, in the case of industrial accumulators.
▪ The retailer is obliged to make containers available, in a well-identified and visible place, as well as information and awareness
materials, aiming to promote an efficient collection of BA waste.
▪ The retailer must ensure adequate storage and management of portable BA waste, by guaranteeing that no waste other than those intended
for the containers is placed, and that these containers are placed away from flammable material in a dry place, respecting also the indications
of their assembly.

▪ Presentation of one annual report and one declaration of consolidation, per year.
▪ Submission of the annual reports at the ERP PT platform with the quantities in kilograms put on the market, on the respective period,
up to 30 days after the end of the year.
▪ Certification of annual consolidated quantities, when requested.
▪ Members can transfer the responsability of periodicaly communicate this information to the Registry Entity to the Compliance
Scheme, through a contract agreement.
▪ The quarterly invoices for each year will be based on the data provided by the Annual Declaration for the year.

Conditions for BA Members of small dimension

▪ Members who have an annual placement of batteries and accumulators in the national market weighing 25 kilograms or less:
□ Payment of Annual Minimum Financial Contribution in the amount of € 25.00. Due at the time of accession,
and thereafter on March 20 of each year of membership.
□ Presentation of Annual Declaration submitted at the time of registration, and thereafter between January 1
and March 15 of each year of membership.
▪ Rebate Model does not apply to adherents who fall under the conditions of small size.

▪ The access ERP Portugal Platform is through the to website http://www.erp-recycling.pt.
▪ Access through the top menu by clicking on "Login".
▪ After becoming a Member of ERP Portugal, the user can access its "Reserved Area", to
perform various operations, such as submission of reports and consult current accounts.
▪ When the Member registration is validated by ERP Portugal, an automatic email with
the Member’s credentials is generated and sent to the address referenced in the
contract, which can then access the "Reserved Area“.

As part of its activity, and in order to facilitate the appropriate forwarding of the waste produced in the companies, ERP
Portugal provides a WEEE and WBA collection service.
▪ Free collection for ERP Portugal Members whenever the minimum weight of 60 kilograms is reached;
▪ To request this service, the interested ones shall send an e-mail to: [email protected], or directly
contact the operations center through the number 00351 800 20 88 89.
