1. I/wehaveappliedforallotmentofSaidUnitintheCommercialProject“ANANDAMRESORTSatOMAXEETERNITY”(“saidProject”)tobe
developedandconstructedunderlawfularrangementbyM/sKansalInfraplannerPrivateLimited(hereinafterreferredtoasthe“Company”)
onaplotoflandsituatedatOmaxeEternity,ChatikaraRoad,Vrindavan(U.P).
2.NotwithstandinganythingcontainedhereininthisApplication,I/weunderstandthatmy/ourApplicationwillbeconsideredasvalidandproper
onlyuponrealizationoftheamounttenderedalongwiththisApplication.
3.BeforeapplyingforallotmentofSaidUnit,I/wehaveveri�iedtheterms/conditionsofprovisionalallotmentandpriceofthesaidUnitwithother
Developersinthevicinityandhavefullysatis�iedmyself/ourselvesabouttheterms,conditions,priceofthesaidUnitandnatureofrights,title,
interestoftheCompanyinthesaidProject,whichistobedeveloped/constructedbytheCompanyasperprevailingbyelaws/guidelinesofthe
TownandCountryPlanningDepartment,UttarPradesh,Lucknow,MathuraVrindavanDevelopmentAuthorityoranyotherconcernedauthority
(hereinafterreferredtoas“saidAuthority”)andsubsequentamendmentsthereofandhasfurtherunderstoodalllimitationsandobligationsin
respectthereof.I/wefurtheragreetoabidebythetermsandconditionsofallthepermissions,sanctions,directionsetc.issuedbysaidAuthority

4.TheallotmentoftheSaidUnitisentirelyatthediscretionoftheCompany.TheallotmentofthesaidUnitshallbeprovisionalandshallbecon�irmed
ontheissuanceofLetterofAllotmentoronsigningofBuyer'sAgreementontheCompany'sstandardformatwhichhasbeenreadandunderstood
byme/us.
5.I/weacknowledgethattheCompany,asandwhendemandedbyme/us,hasprovidedallinformation&clari�icationsasrequiredbyme/usandthat
I/wehavenotundulyrelieduponandisnot in�luencedbyanyarchitectplans,salesplans,salebrochures,advertisements,representations,
warranties,statementsorestimatesofanynaturewhatsoeverwhetherwrittenororalmadebytheCompany, itssellingagents/brokersor
otherwiseincludingbutnotlimitedtoanyrepresentationsrelatingtodescriptionorphysicalconditionandusageoftheProjectandthesaidUnit
(including the size and dimensions and any other physical characteristics thereof), services to be provided by the Company, estimated
facilities/amenitiestobemadeavailabletome/usoranyotherdataexceptasspeci�icallyrepresentedinthistheApplicationandthatI/wehave
reliedsolelyonmy/ourownjudgmentandinvestigation(s)forapplyingforallotmentofthesaidUnit.
6.I/wehavefurtherunderstandsandagreesthatthecompanyshallprovidetheitemslistedinLuxurySpeci�icationshereinabove,ofthestandard
makeandsizeandI/weshallnotrequestthecompanyforchangeinrespectivespeci�ications,makeandsizeoftheitemslistedinthespeci�ications
norshallaskthecompanyforrefundofmoneypaidfortheoptedspeci�icationsatanylaterstage.
7. I/wehavefurtheragreesthatspeci�icationslistedaboveareindicativeonlyandthatthecompanymayonitsownprovideanyadditional/better
speci�icationsand/orfacilitiesotherthatthosementionedhereinaboveduetotechnicalreasonsincludingnonavailabilityofcertainmaterialsof
acceptablequalityandpriceorduetopopulardemandorforreasonoftheoverallbettermentoftheProject/IndividualUnit.I/weherebyagreesto
payforthecostofadditional/betterspeci�icationsand/orfacilitiesasadditionalchargesproportionatelyorasthecasemaybe,asandwhen
demandedbythecompany.
8. I/weherebyagreeandunderstandthattheSaidUnitareaprovidedherein&subsequentlyinAllotmentLetter/Buyer(s)Agreementarepurely
tentativeandsubjecttoapprovalfromtheSanctioningAuthorityorArchitectorStructuralEngineersoftheCompanyandI/weherebygivemy/our
consentforchange(decrease/increase)intheareaofthesaidUnit,changeinitsdimension,size,location,number,boundariesetc.The�inalsize,
location,number,boundariesetc.shallbecon�irmedbytheCompanyoncompletionofdevelopmentoftheProject.Incaseofincreaseintheareaof
thesaidUnit,I/weshallpayfortheinitial10%ofincreaseinareaattherateofbookingofthesaidUnitandshallpayforbalanceincreasedareaatthe
thenprevailingcompany'srate/marketrate.IncaseofdecreaseoftheallottedareaofthesaidUnit,theamountreceivedinexcessoverandabove
thetotalcostofthesaidUnitbasedonthechangedarea,shallbeconvertedinBSPinsameunit(asmaybe)bytheCompanytotheme/uswithout
my/ourprotestanddemurandwithoutanyinterestthereon.
9.I/wehaveexaminedtheplans,designsandspeci�icationsoftheSaidUnitandhaveagreedthattheCompanyshallapplyforrevisionoftheplanor
usageoftheSaidUnitormayaffectsuchvariationsandmodi�icationsthereinasmaybenecessaryorasitmaydeemappropriateand�itinthebest
interestoftheProjectorasmaybedonebyanycompetentauthority.Thenecessarychanges/alterationsmayinvolvechangeinposition/location,
includingchangeindimensions,areaornumberetc.oftheSaidUnit.
10.I/wehavespeci�icallyagreedthatifduetoanychangeinthelayout/buildingplan,thesaidUnitbecomespreferentiallylocated,thenI/weshallbe
liableandagreetopaythepreferentiallocationchargesasandwhendemandedbytheCompanyasperprevailingrates.
11.I/weagreethattheamountpaidwiththeapplicationandininstallmentsasthecasemaybe,totheextentof15%ofsaleconsiderationoftheSaid
Unitshallcollectivelyconstitutetheearnestmoney.

(a) to keep on abeyance/ suspension of the booking or cancel the allotment of the said Unit,
(b)toforfeit/deducttheearnestmoneytogetherwithinterestoninstallmentsduebutunpaidandinterestondelayedpayments,
(c)tore-allocatetheprovisionalallotmentofthesaidUnitwhichincludeschangeinareaandlocationofthesaidUnit.
(ii)IftheCompanyoptstoexercisetherightsmentionedinsub-clause(a)and(b)asabove,thenthebalanceamountshallberefundabletome/uswithout
anyinterest,afterthesaidUnitisallottedtosomeotherintendingAllottee(s)andaftercomplianceofcertainformalitiesbytheAllottee(s).
(iii)IftheCompanyoptstoexercisetherightsmentionedinsub-clause(c)asaboveandasaresultthereof,thereareanychangesindimension,sizeetc.ofthe
saidUnit,thenthepricetowardsincrease/decreaseofre-allottedSaidUnitshallbedealt(paid/adjusted)inamannerdetailedinthisApplicationForm.
(iv) Further,ifanydiscount/concession,inwhatsoeverway,hasbeengivenbytheCompanyintheBasisSalePrice/paymenttermtome/usinlieuof
my/ourconsensusfortimelypaymentofinstallmentsandotherallied/additionalcost,thenI/weherebyauthorizetheCompanytowithdrawsuch
discount/concessionanddemandthepaymentofsuchdiscount/concessionamountasapartofsaleconsiderationamount,whichI/weherebyagreeto
payimmediately.TheCompanyinitsabsolutediscretionmaycondonethedelaybychargingpenalinterest@18%p.a.foruptoonemonthdelayfrom
theduedateofpaymentand@24%p.a.thereafteronalloutstandingduesfromtheirrespectiveduedates.ThepaymentplanisannexedherewithasAnnexure-A.
13.I/weherebyagreethatincaseofcancellationofbookingofthesaidunit,I/weshallsubmit'NoObjectionCerti�icate'fromtheconcerneddealer,ifany,inthis
regard.
14.Companyhasproposedforhotelandnoneofthecustomerhaveanyobjectioninrunningactivityforahotel.
15.I/weagreetomakeallpaymentswithintimeintermsofscheduleofpaymentsasmentionedinAnnexure-Aand/orasmaybedemandedbytheCompanyfrom
timetotimewithoutanyremindersfromtheCompanythroughdemanddrafts/chequesdrawnuponscheduledbanksinfavorof“KansalInfraplanner
PrivateLimited”payableatpar.I/wefurtheragreethatincaseI/wemakeanypaymenttowardsthesaidUnitfromanythirdpartyaccount,thenI/weshall
ensurethattherewouldbenoclaimbysuchthirdpartyinthesaidUnitagainstthepaymentmadefromthirdpartyaccountandI/wefurtheragreethatthe
Companyshallnotbeliableorresponsibleforanyinter-setransactionbetweensuchthirdpartyandme/usinanymannerwhatsoever.Intheevent,I/we
makeanypaymentthroughanythirdpartyaccountthenI/weherebyagreetosubmitadeclarationsignedbysuchthirdpartytotheCompanyandupon
receiptofsuchdeclarationfromthethirdpartyandrealizationofpayment,theCompanyshallproceedtoissuereceiptofsuchpaymentmadebyme/usfrom
thirdpartyaccount.
16. I/weagreethattheofferforallotmentofthesaidUnitandsubsequentcon�irmationthereof(uponful�illmentoftheconditionsoftheAllotment)shallbe
subjecttothepermissionsgrantedbyTownandCountryPlanningDepartment,UttarPradesh,Lucknow,MathuraVrindavanDevelopmentandtheusageof
thesaidUnitandconstructionthereonbytheapplicantshallbesubjecttoapprovalofplanofthesaidUnitbytheCompetentAuthorityasperzoning
conditions,rulesandregulationsofTownandCountryPlanningDepartment,UttarPradesh,Lucknow,MathuraVrindavanDevelopmentandshallalsobe
subjecttotherestrictionsasmaybeimposedbytheCompetentAuthoritieswhichshallincludethenormspertainingtothecoveredarea,groundcoverage
andareaforcommonusagesinthesaidUnit.TheI/wefurtheragreethatirrespectiveofthesizeoftheSaidUnittobeallottedthroughBuyer'sAgreement,
I/wecanonlybeentitledtoconstructthebuildingthereononlyintheareaapprovedinzoningplan.IftheconcernedAuthoritymayimposethecertain
restriction/permissiontowardsbuiltupareaonthesaidUnit,insucheventualityI/weshallbeliabletocomplywithsuchrestriction/permissiontoitsfullest
extent.
17.AssignmentofallotmentoftheSaidUnitbytheapplicantshallbepermissibleatthediscretionoftheCompanyonpaymentofsuchadministrativecostasmay
be�ixedbytheCompanyfromtimetotime.Providedhowever,thattheassignorandtheassigneeagreetocomplywithallformalitiesinthisregardandthe
assigneeagreestoabidebyallthetermsofallotment.I/weherebyclearlyagreeandunderstandthatthedevelopmentperiodofthesaidUnitshallbe
reckonedwitheffectfromthedateofassignmentofallotmentrightinthesaidUnitinfavorofmy/ourAssignee(s).
18.Allstatutorycharges,taxes,cess,servicetaxandotherleviesdemandedorimposedbytheconcernedauthoritiesshallbepayableproportionatelybyme/us
fromthedateofbookingasperdemandraisedbytheCompany.Notwithstandinganythingcontainscontraryhereinabove,I/weherebyunderstandthat
Servicetax(Ifapplicable)shallbepayableinaccordancewithhisoptedpaymentplanforpaymentofsaleconsiderationofthesaidUnit.IfI/wefailtodisburse
theinstallmentalongwithapplicableServicetaxofthesaleconsiderationofthesaidUnitintimelymanner,insucheventuality,theunpaidservicetaxshallbe
construedasunpaidsaleconsiderationofthesaidUnitandApplicantshallbeliabletopaythedueinstallmentsalongwithdueservicetaxalongwithinterest
calculated@18%permonth(or,asapplicable).

agreeandauthorizetheCompany/MaintenanceAgency,tobeappointedforthispurpose,toadjustthemonthlyMaintenanceChargesalongwithapplicable
taxes,cessesetc.payabletotheCompany/MaintenanceAgencyfromthedateofcommencementofmaintenanceservicesinthesaidProjectagainstthe
aforesaidAdvanceMaintenanceChargesandI/weherebyagreethattheCompany/theMaintenanceAgencyshallnotdeliverthebillsfortheMaintenance
ChargesonmonthlybasistillsuchperiodtheinterestfreeAdvanceMaintenanceChargesarefullyexhausted.AftertheexhaustionofAdvanceMaintenance
charges, I/weherebyagree topaymaintenancecharges in respectof the saidUnit regularlyonmonthlybasisasper theBills/ Invoices raisedbysuch
MaintenanceAgencyandincaseofnon-paymentofmaintenancechargeswithinthetimespeci�ied,I/weherebyagreetopaymaintenancechargesalong-with
interestattherateof18%perannum.Furthernon-paymentofmaintenancechargesshallalsodisentitleme/ustotheenjoymentofcommonservicesincluding
electricity,wateretc.
20.IncaseatanytimetheCompanyhandsovertheMaintenanceServicesoftheProjecttotheResidentWelfareAssociation(RWA),I/weherebyagreetojointhesaid
RWA.FurthertheCompanyshallhavetherighttotransferthebalanceAdvanceMaintenanceChargesafteradjustingthere-fromanyoutstandingmaintenance
billsand/or otheroutgoingsoftheBuyer(s)to suchRWA/MaintenanceAgency,astheCompanymaydeem�it, andthereupontheCompanyshallstand
completelyabsolved/dischargedofallitsobligationsandresponsibilitiesconcerningtheinterestfreeMaintenanceSecurityorAdvanceMaintenanceCharges
includingbutnotlimitedtoissuesofrepayment,refundand/orclaims,ifany,oftheBuyer(s)onaccountofthesame.
21.I/wehaveNRI/PIOstatusorifI/weam/areforeignnational(s)thenI/weshallbesolelyresponsibletocomplywiththenecessaryformalitiesaslaiddownin
Foreign ExchangeManagement Act, 1999 and/or any other statutory provisions governing this transactionwhichmay inter-alia involve remittance of
payments/considerationsandacquisitionofimmovableassetsinIndia.Incaseanysuchpermissioniseverrefusedorsubsequentlyfoundlackingbyany
StatutoryAuthority/Company,theamountpaidtowardsbookingandfurtherconsiderationwillbereturnedbytheCompanyasperapplicableruleswithout
anyinterestandtheallotmentshallstandcancelledforthwith.I/weagreethattheCompanywillnotbeliableinanymanneronsuchaccount.
22.TheCompanyshallhavethe�irstlienandchargeonthesaidUnitforallitsduesandothersumspayablebytheapplicanttotheCompany.Loansfrom�inancialinstitutionsto�inancethesaidUnitmaybeavailedbyme/us.However,availabilityofLoan/approvaloftheProjectbytheFinancialInstitutionisnotthepre-requisite/conditionprecedentoftheallotmentofthesaidUnitandI/weherebyagreetopaythesaleconsiderationoftheaforesaidUnitaccordingtooptedPaymentPlan, irrespectiveofavailabilityof �inance fromanyFinancial Institution.Further ifanyparticular Institution/Bankrefuse toextend �inancialassistanceonanyground,theapplicantshallnotmakesuchrefusalanexcusefornon-paymentoffurtherinstallments/dues.
23.IncasetheCompanyisforcedtoabandonthesaidProjectduetoforcemajeurecircumstancesorforreasonsbeyonditscontrol,theCompanyshallrefundtheamountpaidbytheapplicantuponcomplianceofnecessaryformalitiesbyme/us.
24.TheCompanyshallendeavortogivepossessionoftheSaidUnittotheapplicantasearlyaspossible,subjecttoforcemajeurecircumstanceandreasonsbeyondthecontroloftheCompanywithareasonableextensionoftimeforpossessionsubjecttomakingoftimelypaymentofinstallmentstotheCompanybyme/us.
25. I/weshallbeforetakingpossessionoftheSaidUnit,mustclearalltheduestowardstheSaidUnitandhavetheConveyanceDeedforthesaidUnitexecutedinmy/ourfavorbytheCompanyafterpayingapplicablestampduty,registrationfeeandotherlegalcharges/expenses.
26. I/weshalluse/causetobeusedthesaidUnitfordesignatedCommercialpurposeonly.Thisisaconditionprecedentandnon-compliancethereofmayinvitecancellationofallotmentoftheSaidUnitandforfeitureoftheearnestmoneyandotherduesasstatedhereinaboveandtheapplicantwillhavetocompensatetheCompanyforallotherlossesresultingtherefrom.
27.I/weshallhavenoobjectionincasetheCompanycreatesachargeontheprojectlandduringthecourseofdevelopmentoftheProjectforraisingloanfromanybank/�inancialinstitution.However,suchcharge,ifcreated,shallbegotvacatedbeforehandingoverpossessionoftheSaidUnittome/us.
28.I/weshallgetmy/ourcompleteaddressande-mailIDregisteredwiththeCompanyatthetimeofbookinganditshallbehisresponsibilitytoinformtheCompanythroughletterbyRegisteredA.D.aboutallsubsequentchangesinhisaddressande-mailID,failingwhich,alldemandnoticesandletterspostedatthe�irstRegisteredAddresswillbedeemedtohavebeenreceivedbyhimatthetimewhenthoseshouldordinarilyreachatsuchaddressandheshallberesponsibleforanydefaultinmakingpaymentandotherconsequencesthatmightoccurtherefrom. I/weherebyagreethattheCompanyshallnotbeliable/responsibletoreplytoanyqueryreceivedfromanyaddress/e-mailIDnotbeingpreviouslyregisteredwiththeCompany.
29. Tosettleanyconfusionregardinganymatterhereinoranythingbeingnotcovered/clari�iedherein,itisagreedbyme/usthatreferenceshallbemadetothedetailedtermsoftheAllotmentLetter/Buyer'sAgreement,thetermswhereofhavebeenseen,readandunderstood/acceptedbyme/us. Itisspeci�icallyagreedbyme/usthatuponexecution,ifanyambiguityisapparentonitsface,onsuchcontingencythetermsandconditionoftheAllotmentLetter/BuyersAgreementshallsupersedeoverthetermsandconditionsassetforthinthisApplicationForm.However,I/weshallbeboundbythetermsandconditionsincorporatedunderthisApplicationFormtilltheexecutionoftheAllotmentLetter/Buyer(s)agreementinthisregard.
30.Incasetherearejointapplicants,allcommunicationsshallbesentbytheCompanytotheapplicantwhosenameappears�irst,attheaddressgivenbyhimformailingandwhichshallforallpurposesbeconsideredasservedonalltheapplicantsandnoseparatecommunicationshallbenecessarytotheothernamedapplicants.
