The country is currently struggling to endure the same economic challenges that our people have faced for decades. High unemployment, lack of housing, and health care concerns are issues that we have all become familiar with. If we are going to continue to seek opportunity for our people, in the face of these challenges, we will need to cultivate a support system built on a foundation of shared interests. Creating partnerships, or working in collaboration with others allows us to leverage specific resources. Collaboration gives us access to the knowledge and experience of additional human resource, the ability to achieve more with limited finances, and the opportunity to address broader challenges. Over the last quarter I have been working with Tribal, State, Federal and Local units of government. I have also taken time to meet with a number of community based organizations. I have used these oppor- tunities to share the Bands’ vision and to gain support for our efforts. The National Indian Gaming Association (NIGA) invited me to present on the General Welfare Exclusion (GWE) at the Mystic Lake Casino August 22, 2012. The GWE is a Federal Internal Revenue Service (IRS) doctrine that is used to exclude government provided benefits from federal income taxation. The IRS has been targeting tribes across the nation in an effort to tax tribal social assistance programs without acknowledging the sta- tus of our sovereign governments, or our ability to determine the needs of our own tribal members. They are challenging all forms of tribal government provided benefits: Education, Burial Services, Heath-care, Transportation Services, and Housing. They even challenge the work that tribes do to preserve and protect our culture (honorariums). In various examinations initiated over the past five to seven years, the IRS has examined and/or asserted tax liabilities with respect to the aforemen- tioned tribal programs and others. The Leech Lake Band of Ojibwe is cur- rently under IRS scrutiny. They have entered the reservation in an effort to tax our tribal members on the social assis- tance benefits they receive from the tribal government. Leech Lake and many other tribes are taking a stance against the tar- geted taxation of tribal assistance pro- grams. We have partnered with Tribal organizations such as NIGA, the National Congress of American Indians (NCAI), and the Native American Finance Officers Association (NAFOA) in an effort to include tribes in future tax reform, and to assure the GWE applies to all tribal gov- ernment social welfare programs. Working in collaboration with NIGA, NCAI, and NAFOA will assist Leech Lake with addressing our IRS concerns. These organizations represent many of our tribal nations and serve as the collective voice of Indian Country in Washington D.C. Additionally, working with these orga- nizations allows us to network with the tribal nations they represent. Over the years Indian Country has been able to look to Leech Lake for guidance in the areas of Natural Resource Management, Human Services Programming, Education, Gaming and Tribal Sovereignty. It is important for us to remember that we can also look to Indian Country for similar guidance. On Thursday September 19, 2012 Minnesota Governor Mark Dayton (D) and members of his cabinet held consulta- tions with tribal leaders as part of a gov- ernment to government effort to address disparities in education and health care, concerns about natural resources, dissatis- faction with the MN DNR regarding the continued on page 2

Larry Pogemiller, Director of the Minnesota Office of Higher Educationexpressed his agency’s desire to assist with increasing post secondary educational attain-mentwithinIndiancountry.DuringthisconversationIwasabletohighlighttheLeechLakeTribalCollege(LLTC)andtheculturalinfluencesthatcontributetoitscontinuedsuccess.TheLLTCisaprovenmodelandspeakstoourabilitytopromotethepursuitofknowledgewithinourcultureandtheneedforstateagenciestosupportoureffortsindoing so. OthertribesexpressedinterestinthemissionoftheLeechLakeTribalCollegeanddiscussedtouringthefacilitywithprospectivestudentsfromtheircommunities. IhavevolunteeredtoworkwithothertriballeadersandtheDirectorofHigherEducationtosetuparoundtabletodiscussthehardshipsofourbandmemberstryingtoattendhighereducationandwhatwecandotogethertohelpelevatesomeofthoseburdens.IhopetohostthesediscussionsattheLeechLakeTribalCollege. OnSeptember28,2012myselfandmembersofmystaffmetwithVernLaplantDirectorofIndianPolicyfortheMinnesotaDepartmentofHumanServices.Wedis-cussedabroadrangeofselfsufficientservicesthatcouldbeadministeredbythetribe.Wealsodiscussedtheneedtoinvestininfrastructuretoaccommodateincreasesinser-viceandcoordinatetheefficiencyofourservicedelivery.Wealsodiscussedtheneedforaspecializedworkforcetoaccommodatethissortofgrowthandtomaximizeourbillingcapabilities. Human services infrastructure projects and future program administrationincludetheconstructionofahealthandhumanservicesfacilityintheCassLakeareaofDistrictIII,theconstructionofaculturallyappropriateyouthcrisiscenterintheBallClubareaofDistrictI,andyouthandadulttreatmentfacilitieswithintheDistrictIanddistrict ii communities. TheLLTCandUniversityofMinnesotaDuluth(UMD)areengagedincollabor-ative discussions around creating a two year human services applied science degree pro-gram,tobeofferedattheLLTC,andTransferabletoUMD’sBachelorsofSocialWorkprogram.WehaveadedicatedpartnerinLeechLaketribalmemberJohnDay,DirectorofAmericanIndianProjectsintheDepartmentofSocialWorkatUMD.Inorderforthisefforttobesuccessfulthecouncilandtheboardoftrusteeswillneedtocontinueempha-sizing the importance of Human Service professionals within the tribal workforce. August29,2012SecretaryTreasurerFinn,DistrictIIIRepStaples-FairbanksandImetwithMinnesotaCommissionerofRevenueMyronFrans.Thismeetingwastheresultofanongoingtaxdisputeinvolvingthesaleofnativebrandcigarettes.TheStateofMinnesotaiscurrentlywithholdingLeechLake’sportionoftaxescollectedonthesaleoftobaccoproductswithintheboundariesofthereservation.Thestatearguesthat the tribe is bound by outdated tax agreements that have proven to outrun their use. Weacknowledgedthecommissioner’sefforts toencouragenegotiationscen-teredonanewtaxagreement.However,weexpressedthatitwasinappropriateforthestate towithholdourproceeds fromtobaccoproducts togetus to the table.Wealsoexpressed our curiosity as to what the state was doing with the money they are currently withholding fromus.CommissionerFransexplained that themoney isplaced in thestategeneralfund.Iexpressedthedesiretoestablishanescrowaccountforthesefundstobedepositedinuntilourdisputehasbeenfinalized.Iexplainedtothecommissionerthatthisisneededtoassureourtaxproceedsaren’tabsorbedbystatebudgetshortfalls. We also expressed our desire to renegotiate the tax agreements. We explained thattheseagreementswereamechanismofthepastandthatwewouldpreferupdatedagreements that separate the taxable items into multiple tax agreements. the attorney forMNRevenue commented to the effect that thiswas a realistic option.Howeverit may cause an administrative burden to their agency. We now know that the state wouldbewillingtoacceptsomeofourtermsthroughoutthesenegotiationsasindicatedbytheattorney’scomment.Ibelievethatwewillsuccessfullyrenegotiatethetobaccoagreements alongwith the return of our tax proceeds. I believe that the state’s cur-rent administration is committed to working with tribes in a government to government

relationshipandthatadministrativeburdenswillhavenoeffectonourabilitytocometomutuallybeneficialagreement. July22,2012SecretaryTreasurerFinn,DistrictIIRepresentativeWhite,andItraveled to Washington d.C. to introduce ourselves to minnesota’s congressional dele-gation.WecontinuetolobbyforanewhighschoolbuildingfortheBug-O-Nay-Ge-ShigSchool.ProjectforIHS,additionalservicesaddedtotheCassLakeIHS,landissues,agriculture ideas with USDA, and memorandum of understanding with ChippewaNationalForest. August27,2012IwasjoinedbymembersofmystaffinameetingwithDarlaLenz,ChippewaNationalForest(CNF)ForestSupervisorandNeilPeterson,CNFTribalLiaison.Wediscussedtheneedtoupdatealongstandingmemorandumofunderstand-ing(MOU)betweentheCNFandtheBand.SupervisorLenziscommittedtoworkingwiththetribeintheareasofeconomicdevelopment,aswellasworkforcedevelopmentand training. Economicopportunitiesassociatedwithforestmanagementencompassarangeofdifferentactivities.WearehopingtotakeadvantageoftheseopportunitiesforourTemporaryEmploymentProgram.Contactsawarded to thisprogramfor forestman-agement will supplement their operating budget and decrease their reliance on gaming revenue.WealsodiscussedthepossibilitycontractinggeneralforestersfromapoolofcertifiedtemporarylaborerssuppliedbytheTEPprogram.ThecertificationwouldbedevelopedincollaborationwiththeCNFandLLTC. WealsohostedaWhiteHouseRuralRoundtableattheNorthernLightsEventCenteronSeptember10,2012asafollowuptoourD.C.meetingswith theUSDA.during this meeting we continued to express our desire to supply the Usda with wild riceforuseinitstribalfooddistributionprograms.Webelieveitisimportantforourpeople to sustain a traditional diet of natural food sources.We also highlighted theresidualbenefitsofbecomingafoodvendortoUSDA. Throughout thequartermy staff and I have alsometwith several organiza-tions regarding economic development. We had the opportunity to meet with itasca and CassCountiesEconomicDevelopmentCorporations,theMinnesotaIndianChamberofCommerceandtheBlandinfoundation. OnOctober24,2012 thebandhostedTheGreaterMinnesotaResource andGovernment Procurement Fair. This event was put together to provide communitymembers access to business resources and tools to make them more competitive in gov-ernmentmarkets.ItisimportantfortheBandtoprovideourmembershipwithopportu-nitiestocreatetheirownbusinessesIfeelthatthisisonecomponenttotribaleconomicdevelopmentthatisoftenoverlooked. Finally, President Obama signed H.R. 1272, the Nelson Act SettlementDistributionintolawonOctober5,2012.TheNelsonActlegislationhadbeenopposedbyLeechLakeLeadershipformanyyears,unfortunatelyitdidnotgoourway.EachMCTEnrolledmemberwillreceivea$300.00percapitapayment.Theremainderofthemoney will be split six ways between the mCt tribes. the tribal Council passed a resolution to place payments made to children undertheageofintotrustaccounts.Themoneywillearn3.5%interestandbeavail-abletoeligiblebandmemberswhentheyturn18.Anyfundsnotclaimedbyindividualswithinayeartimeframewillgobackintoapoolofmoneyandberedistributedtobackto the six bands. SofartheCouncilhasnotmetonwhattodowiththeremainderoftheNelsonActortheSalazarSettlementfunds.Wearegoingtomakesuretheinputofbandmembershipis taken into serious consideration. i encourage each and every band member to contact theirdistrictrepresentativestoassureyourinputisreflectedinthecouncil’sdecision. Wehavehadaverybusyandproductivefirstquarter,butwearegoingtoneedtocontinuetokeepthispaceifwearetomoveournationforward.Wearenotaloneinourefforts.Itisimportantforustosustainmeaningfulrelationshipswhileseekingsolutions.Identifyingsharedinterestsandthedesireforsimilaroutcomeswillgiveusthe ability to mobilize more resources and develop the support structure needed to suc-cessfullyaccomplishourgoals.Miigwetch!

Manaaji’idiwin (respect)OnWednesday,Oct.24,anevententitledRachel’s Challenge was presented to stu-dentsandfamiliesoftheBugONayGeShigSchool.SponsoredbyLakeCountryPower, Rachel’s Challenge seekstospreadamessageofrespectandkindnessasaway to create a more compassionate nation and world. Manaaji’idiwin is one of the seven values that guide the Anishinaabe people.Respect for self, others, the land, and thewater arekey conceptsuponwhich theBugonaygeshigSchoolwasfounded.Rachel’s Challenge was established as a tribute to rachel joy scott who was thefirststudentkilledintheColumbineschool tragedy. the program presenter, known only as Bill, shared high energy video clips and training that included reflection and audience participationdesigned to empower students to create a culture of kindness and compassion.“Startachainreaction,”hetoldthestu-dents. “Your words can make a differ-enceforthoseyouspeaktoeveryday.” High school students partici-pated in leadership training andwere encouraged to develop school programs forthemselvesandelementarystudents.Teachersandstaffmemberswillworkwithstu-dentsthroughouttheyearinhopesofcreatingapermanentchangeinschoolcultureand the way students interact with each other. For the past few years, the Leech Lake Reservation, Division of Resources

Management has been testing for ChronicWasting disease (CWd), and Bovine tuberculosis (tB) in white-tailed deer harvested by tribal members on the reservation. For additional information on thisprogram, Bovine tB, or CWd call the drm officeat335-7421.Criteria for participating in the sampling is outlined below. a $25 gas voucher for the Che-We Store will be provided for thefirst 60 deer thatwe can get samples from.• StartingOctober1th you can bring your

adult deer to the Leech Lake Divisionof Resources Management Office inCass Lake from 8:00am to 4:30pm,Monday-Friday.

• We will not collect samples fromfawns and cannot except head-shotdeer, or deer that have started to decay.

the minnesota Chippewa tribe (mCt) will be conducting a survey to help us learn moreaboutthebloodquantumofMCTmembersandtheirdescendants.

We will use the information from this survey to determine what other tribal affiliations (non- MCT) exists within families of enrolled members. However,noenrollmentcriteriawillbechangedastheresultofthissurvey–itisforinformationgatheringpurposesonly. Approximately 3000 enrolled MCT members will be invited to par-ticipate in this study using scientific random sampling – all MCT Band members eighteen (18) years of age and older have an equal chance of being selected to participate. mCt hired Wilder research to conduct this survey. We will start con-tactingMCTmembers in fall2012. If you are invited, we hope you decide to participate. Your participation and accurate information are vital to the validity and success of this survey. With a completed survey, you will be entered into a drawing with other survey participants.
