New business requires evidence of loss free with the prior carrier.

If the insured loses the credit because of a paid loss in excess of $750, the credit will be deleted on the renewal following the date the loss was paid. The policy will again start earning loss free credits on subsequent renewals if the risk remains loss free.

GROUP CREDIT

• 5% group credit• The agency has entered into an agreement with the owner/management having 10 or more employees.• The agency has entered into an agreement with a managing officer of an affiliate group. An affiliate group is

defined as “an organization of 10 or more dues paying members controlled by a Board of Directors”.• A minimum enrollment is not required.• The agent must indicate on the application the qualifying group for the 5% credit to apply.• All lines of business are eligible for the 5% Group Credit.• Applies to all pricing tiers.• Applies to all coverages on the policy.• Patrons’ optional bill plans are available. When choosing the EFT option, the insured will take advantage of

the newly introduced 5% EFT Credit. This will result in a substantial savings to the insured.• Existing Patrons’ insureds would be eligible for the 5% Group Credit if the agent of record has entered into an

agreement with the insured’s employer. However, if the existing Patrons’ insured is with another agent, thecurrent policy would have to be cancelled and rewritten with the new agent of record to receive the 5% GroupCredit.

• If an insured terminates their employment, they will retain the 5% Group Credit as long as they remain withthe same agent

• If an insured terminates their membership in the affiliate group, they will retain the 5% Group Credit as long asthey remain with the same agent

ISO GENERAL RULE 408. PROTECTIVE DEVICES IS REPLACED WITH THE FOLLOWING:

• Approved and properly maintained installations of burglar alarms, fire alarms and automatic sprinklers in thedwelling may be recognized for a reduced premium. Multiply the BASE PREMIUM by the following factors:

DWELLING POLICY PROGRAM MANUAL

INTRODUCTION

The Dwelling Policy Program provides property and related coverages using the forms and endorsements referred to inthis manual.

The rates, rules, forms and endorsements of the company shall apply in all cases not provided for in this manual.

This program does not apply to Farm Property. Refer to the company for its method of insuring farm property.

The Dwelling Policy Program Manual contains the rules, classifications and rating provisions for the issuance of theDwelling Policy. The rules are essentially the same as those contained in the previous Dwelling 77 Manual. However,they have been restructured and rearranged to facilitate a countrywide manual format. The manual is divided into twosections, countrywide GENERAL RULES and STATE RULES AND RATES.

The countrywide GENERAL RULES section contains rules common to most states. Any departures, additions, etc. tothese rules unique to individual jurisdictions, are contained in the STATE RULES AND RATES section.

The GENERAL RULES do not contain premiums, rates, charges or credits expressed in dollars and cents. They do,however, contain rating factors that are applied to state premiums.

In jurisdictions where ISO does not publish state rate pages containing Key Premium and Key Factor tables, eachcompany using this manual should furnish its manualholders with its own company developed rate tablescontaining either Key Premiums and Key Factors or Base Premiums.

Also, where ISO does not publish any state rate pages containing premiums, rates, charges and credits expressed indollars and cents, each company using this manual should furnish its manualholders with the state rate pagescontaining this information.

103. ELIGIBILITY

A Dwelling Policy may be issued to provide insuranceunder:A. Coverage A – on a dwelling building:

1. Used solely for residential purposes exceptthat certain incidental occupancies or up to5 roomers or boarders permitted;

2. Containing not more than four apartments; and3. Which may be in a townhouse or row house

structure; or4. In course of construction

B. Coverage A – on a mobile or trailer home:1. Using Form DP 00 01 only;2. Used solely for residential purposes except

that certain incidental occupancies or up to5 roomers or boarders permitted;

3. Containing not more than one apartment;4. For a policy period of not longer than one

year; and5. At the permanent location described in the

policy.

C. Coverage B:1. At the same location as the dwelling eligible

for insurance under Coverage A;2. Not used for business purposes except a

permitted incidental occupancy or when rentedfor use as a private garage;

3. At a separate location when used in connectionwith the insured location but not for businesspurposes.

D. Coverage C in:1. A dwelling, mobile or trailer home eligible

under Coverage A; or2. A dwelling with rental apartments including

furnishings, equipment and appliances in hallsor utility rooms; or

3. Any apartment, cooperative or condominiumunit used as private living quarters of theinsured or rented to others.

E. Coverage D for the loss of the fair rental value of:

1. A building eligible for insurance underCoverages A or B; or

2. Private living quarters eligible under CoverageC.

F. Coverage E for the additional living expensesincurred to maintain the insured’s household.

105. SEASONAL DWELLING DEFINITION

A seasonal dwelling is a dwelling with continuousunoccupancy of three or more consecutive monthsduring any one year period.

106. CONSTRUCTION DEFINITIONS

A. Frame – exterior wall of wood or othercombustible construction, including wood ironclad,stucco on wood or plaster on combustible supports(Use Construction Code 1)

Aluminum or plastic siding over frame. (UseConstruction Code 5)

B. Masonry Veneer – exterior walls of combustibleconstruction veneered with brick or stone. (UseConstruction Code 2)

C. Masonry – exterior walls constructed of masonrymaterials such as adobe, brick, concrete, gypsumblock, hollow concrete block, stone, tile or similarmaterials and floors and roof of combustibleconstruction. (Disregarding floors resting directlyon the ground). (Use Construction Code 3)

D. Superior Construction – (Use Construction Code4)1. Non-Combustible – exterior walls and floors

and roof constructed of, and supported bymetal, asbestos, gypsum, or other non-combustible materials.

2. Masonry Non-Combustible – exterior wallsconstructed of masonry materials (as describedin C. above) and floors and roof of metal orother non-combustible materials.

3. Fire Resistive – exterior walls and floors androof constructed of masonry or other fireresistive materials.

NOTE: Mixed (Masonry/Frame) – a combination ofboth frame and masonry construction shall beclassed and coded as frame when the exteriorwalls of frame construction (including gables)exceed 33 1/3% of the total exterior wall area;otherwise class and code as masonry.

107. SINGLE BUILDING DEFINITION

A. All buildings or sections of buildings which areaccessible through unprotected openings shall beconsidered as a single building.

B. Buildings which are separated by space shall beconsidered separate buildings.

C. Buildings or sections of buildings which areseparated by an 8 inch masonry party wall whichpierces or rises to the underside of the roof andwhich pierces or extends to the inner side of theexterior wall shall be considered separatebuildings. Accessibility between buildings withindependent walls or through masonry party wallsdescribed above shall be protected by at least aClass A Fire Door installed in a masonry wallsection.

201. POLICY PERIOD

The policy may be written for a period of:A. One year and may be extended for successive

policy periods by extension certificate based uponthe forms, premiums and endorsements then ineffect for the company.

B. Three years prepaid at three times the annualpremium.

C. Three years in annual installments. Each annualinstallment shall be the annual premium then ineffect for the companyUse Endorsement DP 04 32 Deferred PremiumPayment.

For maintaining common anniversary dates, a policymay be written for a period less than one year or lessthen three years on a pro rata basis.

202. CHANGES OR CANCELLATIONS

If insurance is increased, cancelled or reduced, theadditional or return premium shall be computed on apro rata basis.

203. MANUAL PREMIUM REVISION

A manual premium revision shall be made inaccordance with the following procedures:A. The effective date of such revision shall be as

announced.B. The revision shall apply to any policy or

endorsement in the manner outlined in theannouncement of the revision

C. Unless otherwise provided at the time of theannouncement of the premium revision, therevision shall not affect:1. In-force policy forms, endorsements or

premiums, until the policy is renewed; or2. In the case of a Deferred Premium Payment

Plan, in-force policy premiums, until theanniversary following the effective date of therevision.

204. MULTIPLE LOCATIONS

A policy may be issued to provide insurance at morethan one described location in the same state provided:

A. The same form and deductible applies at eachlocation;

B. A separate policy declarations page is completedfor each location; or

C. The policy declarations page is completed byshowing:1. The total policy premium for all locations in

the premium payments section.2. The deductible by entry of the deductible

amount and adding “at each location.”3. Inserting the form number that applies.4. Adding an appropriate reference to the

Additional Dwelling Declarations or companyequivalent.

205. MULTIPLE POLICIES

Does not affect coding.A. Insurance may be provided on the same property

under two or more Dwelling policies in one ormore companies as follows:1. The same form and endorsements must apply

to all policies2. The same deductible amount must apply to all

policiesUse Endorsement DP 04 30 Premium Sharing –Two or More Policies.

B. PremiumThe premium for each policy is developed asfollows:1. Compute the premium for the total limits of

liability from the manual of the companyissuing each policy.

2. Allocate the premium determined in B. 1.above based on the ratio of each policy’s limitof liability to the total limits of liability for allpolicies.

206. MINIMUM PREMIUM

Refer to Statistical Plan for coding requirements.A. For prepaid policies the minimum annual premium

shown on the state rate pages shall be charged foreach policy.

B. When policies are written under a premiumpayment plan, no payment shall be less than theminimum premium shown on the state rate pagesfor each annual period.

C. The minimum premium may include all chargeableendorsements or coverages for Fire or Fire andAllied Lines if written at inception of the policy.

D. The minimum annual premium shall not includecharges of Theft or Earthquake Coverage, exceptwhen Earthquake is the only peril covered underthe policy.

207. TRANSFER OR ASSIGNMENT

Subject to the consent of the company, all rules of thismanual and any necessary adjustments of premium, apolicy may be endorsed to effect:A. Transfer to another location within the same state;

orB. Assignment from one insured to another in the

event of transfer of the title of the dwelling.

208. WAIVER OF PREMIUM

Does not affect coding.When a policy is endorsed after the inception date, referto the state rate pages for the amount of additional orreturn premium that may be waived.

209. WHOLE DOLLAR PREMIUM RULE

Does not affect codingA. Each premium shown on the policy and

endorsements shall be rounded to the nearest wholedollar. A premium of fifty cents ($.50) or moreshall be rounded to the next higher whole dollar.

B. In the event of cancellation by the company, thereturn premium may be carried to the next higherwhole dollar.

301. BASE PREMIUM COMPUTATION

To compute the BASE PREMIUM, use the KeyPremiums and Key Factors that are displayed in thestate rate pages.

A. Fire (All Forms), E. C. (DP 00 01), Broad Form(DP 00 02), or Special Form (DP 00 03)

Coverage A – Dwelling /Coverage C – Personal Property

1. From the Key Premium Table, select the KeyPremium for the classifications or coveragesthat apply to the risk.

2. From the Key Factor Table, determine the KeyFactor for the desired limit of liability. If thedesired limit of liability is not shown in thetable, interpolate as illustrated in paragraph Bof this rule.

3. Multiply the Key Premium by the Key Factorand round to the nearest whole dollar todevelop the BASE PREMIUM ($.50 or morerounded to the next higher whole dollar).

B. Interpolation Example

When the desired limit of liability is less than thehighest limit shown, interpolate the Key Factorsusing the nearest limit above and below the desiredlimit.

Example: $25,500 desired limit; the nearestlimits are $25,000 and $26,000.

For $25,000, the Key Factor is 1.082; for$26,000 the Key Factor is 1.098. Figure thedifference between the two Key Factors anddivide by 10. This provides a factor per $100.

2. The incidental occupancy is operated by theinsured who is the owner or a resident of thepremises; and

3. There is no more than two persons at work inthe incidental occupancy

3. Storage of merchandise if the value of themerchandise does not exceed $10,000.

RULE A12 CONDITIONS CHARGES

A. DescriptionWhen any of the Conditions noted on the state ratepages exists in a Dwelling or Other Structure, theapplicable charge per $1,000 of insurance may beapplied to the Coverage A or C BASEPREMIUM and Coverage B Additional Premium.1. Heating:

Unsafe arrangement of heating devices,including chimneys, stovepipes, gas vents andfuel supply, etc.

2. Wiring: Unsafe or inadequate electric wiring,nonstandard extensions, overloading andoverusing, etc.

3. Conversion:Use of premises beyond designed occupancylimits, sub-division or conversion of originalliving spaces into multiple units withovercrowded occupancy, inadequate sanitaryfacilities and unsatisfactory arrangements ofcooking devices, etc.

4. Physical Condition:Building not in good repair, roof or chimneysdeteriorating, wood surfaces unpainted ordecaying and garages or porches not wellmaintained, etc.

5. Housekeeping:Open foundation or access to under-floorspace, yard, basement, hallways or attic notkept clean and free from rubbish and litter,etc.

6. Outside Fire Exposures:Extreme outside fire exposures not otherwiserecognized, for example, adjacent dwellings,apartments or other property in deterioratedcondition, brush exposures and rubbishaccumulation, etc.

7. Vacancy or Unoccupancy:Hazardous Conditions including vacancy orunoccupancy not otherwise surcharged.

B. ApplicabilityEach Condition does not necessarily apply to allperils covered in the policy. For example, if itinvolves a fire hazard, only the fire premium maybe increased; if an E.C. hazard is involved, theE.C., Broad or Special Form premium may beincreased.

C. Premium ComputationWhen any of the Conditions apply, submit to theinsuring company to determine the charge.

LIMITED FUNGI, WET OR DRY ROT, OR BACTERIA COVERAGE

When the endorsement is attached to the policy, limited amounts of insurance are automatically provided as follows:

Dwelling Property - $10,000 to pay for loss to covered real or personal property, owned by an insured, that isdamaged by fungi or wet or dry rot, or bacteria on the described location. This Coverage applies only for the policyperiod in which the loss or costs occur. If more than one location is insured under this policy, enter the address ofsuch locations on this endorsement or the policy declarations. Limits may be increased to $25,000 or $50,000. Thelimit selected is entered on the coverage endorsements or the policy declarations.

Application of Limits of Liability – For Property Coverage, the $10,000 or the limit selected is the most coveragethat will be provided during the policy period regardless of the number of locations insured for Limited Fungi, WetOr Dry Rot, Or Bacteria Coverage or the number of claims made during the policy period.

DWELLING LIABILITY

When the endorsement is attached to the policy, limited amounts of insurance are automatically provided as follows:

Dwelling Liability - $50,000 to pay for damages because of bodily injury or property damage involving theinhalation of, ingestion of, contact with, exposure to, existence of , or presence of any fungi, wet or dry rot, orbacteria. Limits may be increased to $100,000. The limit selected is entered on the coverage endorsements or thepolicy declarations.

Application of Limits of Liability – For Liability Coverage, $50,000 or the limit selected is an aggregate limit andis the most coverage that will be provided during the policy period regardless of the number of persons injured, thenumber of persons whose property is damaged, the number of insureds, the number of locations insured under thispolicy or the number of bodily injury or property damage claims made.

INTRODUCTIONA Personal Liability Policy may be written with or separatefrom a Dwelling Policy.A. When written with a Dwelling Policy, use Personal

Liability Endorsement DL 24 01 and Personal LiabilitySchedule Endorsement DL 24 03.

B. When written separate from a Dwelling Policy, useAdditional Policy Conditions Endorsement DL 24 02,Personal Liability Endorsement DL 24 01 and thecompany Personal Liability Declaration page.

The following rules supplement the rules in the DwellingManual.Code as separate record with subline 80 (480 if 150character format).

SUPPLEMENT TO THE DWELLING GENERAL RULESThe dwelling Policy Program General Rules apply to thisSupplement except as follows:

101. COVERAGE AND LIMITS OF LIABILITY

A. Personal Liability (Coverage L) and MedicalPayments to Others (Coverage M) shall beprovided in all cases.

B. The minimum limits of liability required under thePersonal Liability Policy are as follows:Coverage L - $ 100,000 each occurrenceCoverage M - $ 1,000 each person

C. These limits may be increased for an additionalpremium

D. The same Coverage L and M limits of liabilityshall apply to all exposures.

102. EXPOSURES

A. Initial Residence Premises Occupied by Owner orApartment Occupied by Tenant (Named Insured),with or without a Permitted Incidental Occupancy.

B. Other Insured Locations Occupied by Owner orApartment Occupied by Tenant (Named Insured),with or without a Permitted Incidental Occupancy.

C. Other Insured Locations Not Occupied by Owner.When the initial residence premises is insured by:1. the same company insuring the other location,

use Endorsement DL 24 04 AdditionalResidence Rented to Others

2. another company, use Endorsement DL 24 11Premises Liability (Non-owner OccupiedDwelling).

D. Business PursuitsCoverage is available for certain classifications, aslisted in the state rate pages, for the liability of theinsured arising out of business activities.Coverage is not available for business pursuits ifthe insured owns the business, is a partner ormaintains financial control in the business.Use Endorsement DL 24 05 Business Pursuits forall classifications listed except classification g.Business Pursuits “not otherwise classified.”

E. Owned SnowmobilesSnowmobile coverage is available for an additionalpremiumUse Endorsement DL 24 07 Snowmobiles.

F. Watercraft1. Watercraft powered by an outboard motor, or

combination of outboard motors, of up to 25horsepower, or sailboats less than 26 feet withor without auxiliary power, are covered in thepolicy form

2. Coverage is available, for an additionalpremium, for the following”a. Watercraft up to 26 feet in length,

powered by(1) Outboard motors exceeding 25

horsepower(2) Inboard; or(3) Inboard-Outdrive motors.Accumulate total horsepower if two ormore motors are regularly used togetherwith any single watercraft owned byinsured.

b. Sailboats 26 feet or more in length, withor without auxiliary power.

Use Endorsement DL 24 06 Watercraft.G. Loss Assessment Liability

The policy may be extended at an additionalpremium, to cover liability loss assessments forwhich the insured may be liable. No more than 2locations can be written in addition to the initialresidence premises.Use Endorsement DL 24 14 Loss AssessmentLiability Coverage.

103. ELIGIBILITY

G. Coverage pay be provided for:1. All insured locations occupied by the insured,

owner or tenant;2. Other locations not occupied by the owner.

H. If coverage is provided under G. l. above:1. It automatically includes coverage for

Employer’s liability. If, however, the policycovers more than two employees, an additionalpremium charge for Coverage M is required.

2. It may also be provided for all other exposureslisted in this supplement.

I. Additional InsuredsWhen coverage is provided in accordance with G.above, it may be extended to cover additionalinsureds, but only with respect to the insuredlocation. An additional insured is a person ororganization with interest in the insured location ora joint owner who does not occupy the insuredlocation.No Additional charge or coding is requiredUse Endorsement DL 24 10 Additional Insured.

204. MULTIPLE LOCATIONS

When a separate Personal Liability Policy is written,this rule in the Dwelling Policy Program Manual isreplaced by the following:A Personal Liability Policy may be issued to provideinsurance at more than one location, in one or morestates, under one policy when all policy provisions areequal.

205. MULTIPLE POLICIES

The following is added under paragraph A:When Fire or Fire and Allied Lines insurance is writtenon the same property under two or more DwellingPolicies in one or more companies, Personal LiabilityCoverage may only be written under one of theDwelling policies.

206. MINIMUM PREMIUM

When a separate Personal Liability Policy is written,paragraphs C. and D. are deleted and replaced by thefollowing:C. The minimum premium may include all chargeable

endorsements or coverages for Personal Liability ifwritten at inception of the policy.

301. BASE PREMIUM COMPUTATION

Refer to the state rate pages for the premiums andfactors pertaining to basic and increased limits thatapply to the exposures listed in this supplement.

304. PERMITTED INCIDENTAL OCCUPANCIES

E. Coverage for business pursuits is excluded underthe Personal Liability Endorsement. If an owneroccupied initial residence premises or other insuredlocation contains a permitted incidental occupancywhich is operated by an insured, the policy may beextended, for an additional premium, to cover theexposure.1. Home Day Care Occupancy

Available only for Initial Residence Premises.Refer to company if the Day Care Businessinvolves the care of more than 3 persons, otherthan insureds.Use Endorsement DL 24 17 Home Day CareCoverage.
