32 LIMITED WARRANTY

LIMITED WARRANTY

This Limited Warranty only applies to the original purchaser of new passenger and light truck replacement tires sold by MOMO Tires Americas, LLC USA (MOMO TIRES), which have been used on the same vehicle within the USA and Canada that the tires were originally installed on and does not apply to exchanged tires that were provided under this guarantee. An eligible tire that becomes unusable for any reason within the manufacturer’s control will be replaced with the same or comparable new tire on the basis set forth in this Limited Warranty, effective September 1, 2018.

WORKMANSHIP AND MATERIALSIf a MOMO tire becomes unserviceable due to workmanship or material issues within one year from the date of original retail purchase (purchase receipt required) or within the first 2/32” or 1.6mm of the original usable tread, whichever occurs first (the “Initial Warranty Period”), the tire will be replaced with the same or comparable tire at no charge to the owner for such tire.

After the Initial Warranty Period, if a MOMO tire becomes unserviceable due to workmanship or material issues the owner must pay the cost for a comparable MOMO replacement tire on a pro rata basis. The authorized MOMO TIRES Dealer will determine the cost by multiplying the percentage of the original usable tread worn by the current dealer selling price. This warranty extends to 72 months from date of original retail purchase (purchase receipt required).

Ride related warranty claims must be submitted within the Initial Warranty Period (purchase receipt required) to be considered. If accepted, such ride related warranty claim will be paid at 100% of the current dealer selling price.

Under all circumstances, the cost of mounting, balancing and any other service charges, including applicable taxes, are required to be paid by the consumer.

A tire has delivered its original usable tread life and is considered to be 100% worn when the treadwear indicators (2/32” or 1.6mm tread remaining) become visible, regardless of age or mileage.

LIMITED MILEAGE WARRANTY FOR SELECT REPLACEMENT TIRE LINES ONLYThis Limited Warranty also warrants to the original consumer purchaser that the tread life of select MOMO Tires will have Mileage Warranty coverage for the described vehicle odometer miles (km) from the point of original retail purchase. Should the qualifying treadwear mileage conditions be met, the authorized MOMO TIRES Dealer will determine the replacement tire cost by multiplying the percentage of the mileage obtained by the current dealer selling price. This Mileage Warranty does not extend to anyone other than the original retail purchaser.

TREADWEAR WARRANTY CONDITIONSTo be eligible for the Limited Warranty described herein, the following conditions apply.

• You are the original purchaser of the tires and have a copy of the original invoice showing the application mileage.• You are the owner of the vehicle on which the tires were originally installed.• Only passenger and light truck tires listed in this section are covered by the Limited Mileage Warranty for the mileage shown.• You have had the tires rotated every 5,000 (8,000 km) to 7,000 (11,000 km) miles.• The tires are worn evenly across the tread, down to the treadwear indicator (2/32”, 1.6mm) of wear at which time they are considered to be 100% worn out.

There cannot be more than a 2/32” (1.6mm) tread depth difference across the tire.• Your servicing MOMO TIRES dealer must provide proof of a completed Tire Rotation Record.• MOMO Winter tires are not covered under the Mileage Warranty.• Passenger and P-Metric Light Truck tires are not covered for mileage when used on commercial vehicles or in commercial applications.• For vehicles equipped with staggered size fitments (different tire sizes front and rear), the mileage warranty for the rear tires will be 50% of the stated mileage

warranty for that line.• Under all circumstances, the cost of mounting, balancing and any other service charges including applicable taxes are required to be paid by the consumer.

WHAT IS NOT COVEREDThis Limited Warranty does not cover the following:

to balance the tires.6. Ride complaints after the first 2/32” (1.6mm) of tread wear or replacement of two tires from the same vehicle.

7. Tire damage due to road hazards, including, without limitation: puncture, cut, impact break, stone drill, bruise, bulge, snag, etc.8. Insufficient or improper maintenance, including, without limitation: failure to rotate tires as recommended, wheel misalignment, worn suspension components,

improper tire mounting or demounting, tire/wheel assembly imbalance, or other vehicle conditions, defects, or characteristics.9. Tire damage due to contamination or degradation by petroleum products or other chemicals, fire or other externally generated heat.

10. Accident, chemical corrosion, tire alteration, willful abuse, or vandalism. 11. Rapid treadwear or wear-out on tires not specifically covered under the Limited Mileage portion of the Warranty.12. Weather/ozone cracking after 4 years from date of tire manufacture.13. Tires with sealant, balance, or other filler material that was not originally applied or inserted by the tire manufacturer.14. Tires that have been recapped, retreaded or regrooved.15. Tires improperly repaired or with repairs not conforming to U.S. Tire Manufacturers Association standards, or with section repairs, or with a self-vulcanizing

plug only or patch only. 16. Tires used in commercial service, or in commercial applications.17. Tires inflated with anything other than air or nitrogen.18. Tires affected by flat spotting caused by brake lockup, improper transport, or storage. 19. Premature or irregular wear (a measured tread difference of 2/32” (1.6mm) or more across the tread on the same tire) due to vehicle mechanical deficiencies

or failure to rotate the tires at recommended intervals.20. Any tires worn beyond the wear indicators (less than 2/32” or 1.6mm remaining tread depth).21. The cost of applicable federal, state, and local taxes.22. Failure to follow any of the safety and maintenance recommendations or warnings contained in this warranty.

CUSTOMER OBLIGATIONSIn order to keep this Limited Warranty valid, you must have your tires regularly inspected and rotated. Tires must be operated at the proper tire inflation pressures as specified by the vehicle manufacturer and within tire/vehicle load capacity and speed limitations. It is also your obligation to maintain proper wheel alignment and tire/wheel assembly balance.

Tire inflation pressures must be set to the specifications established by the vehicle manufacturer. Check tire pressure with a gauge every month and before long trips or when carrying extra load. Determine the cause and extent of an inflation pressure loss as soon as possible, especially after an alert from the tire pressure monitoring system (TPMS).

To request an adjustment, you must present the tire to an authorized retailer. You must complete and sign the customer section of the MOMO Tires Americas, LLC Limited Warranty adjustment form and pay the appropriate replacement price, taxes, disposal fee, and service charges, if any.

LIMITATIONSTHIS LIMITED WARRANTY IS THE ONLY WARRANTY GIVEN BY MOMO TIRES. MOMO TIRES DOES NOT MAKE ANY OTHER WARRANTY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE (WHICH ARE EXPRESSLY DISCLAIMED). MOMO TIRES DOES NOT AUTHORIZE ANY OTHER PERSON, INCLUDING AUTHORIZED MOMO TIRES DEALERS OR VEHICLE DEALERS, TO CHANGE THIS WARRANTY OR CREATE ANY OTHER OBLIGATION IN CONNECTION WITH MOMO TIRES. THE RIGHTS AND REMEDIES AVAILABLE ARE LIMITED TO THOSE RIGHTS AND REMEDIES STATED IN THIS LIMITED WARRANTY. ALL OTHER REMEDIES ARE EXCLUDED. IN NO EVENT SHALL MOMO TIRES BE RESPONSIBLE FOR ANY CONSEQUENTIAL, INCIDENTAL, LOSS OF TIME, LOSS OF VEHICLE USE, INCONVENIENCE OR SPECIAL DAMAGE(S) IN CONNECTION WITH A MOMO TIRE, WHETHER FOR BREACH OF THIS LIMITED WARRANTY, OTHER CONTRACT BREACH, NEGLIGENCE OR OTHER TORT, OR ANY STRICT LIABILITY THEORY. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state.

HOW TO DISPUTE ISSUES CONCERNING THIS WARRANTYALL CLAIMS ARISING FROM THIS LIMITED WARRANTY OR THE MARKETING, SALE OR PERFORMANCE OF THE PURCHASED PRODUCT AGAINST MOMO TIRES AND ITS AGENTS, EMPLOYEES, DEALERS, AFFILIATES, RELATED CORPORATE ENTITIES SHALL BE SUBJECT TO BINDING ARBITRATION. You and MOMO TIRES acknowledge your and its right to litigate claims, disputes and controversies arising out of or in connection with this Limited Warranty, or the marketing, sale or performance of the tire purchased in court, but prefer to resolve any such claims, disputes and controversies through arbitration and hereby waive the right to litigate such claims, disputes and controversies in court upon election of arbitration by either party. Therefore, you and MOMO TIRES agree that all claims, disputes, and controversies between you and MOMO TIRES arising out of or relating to this Limited Warranty, or any other warranties, express or implied, or any claims arising out of or relating to the marketing, sale or performance of the tire purchased, including but not limited to claims for consumer fraud or brought under any consumer protection statute, but excluding claims for personal injury or property damage, shall be finally resolved solely by arbitration, upon election by either party, according to the formal dispute resolution procedures then in effect of the American Arbitration Association (“AAA”), or if the AAA is no longer conducting such arbitrations, a successor organization thereto or such other private arbitration service as you and MOMO TIRES shall mutually agree (the “Arbiter”). Any arbitration will be conducted in accordance with AAA’s rules applicable to consumer disputes. The Arbiter shall decide the issues submitted in accordance herewith, provided that all substantive questions of law will be determined under the laws of the State in which you purchased the tires. You agree that no claim subject to arbitration shall be arbitrated as a class action, or on a class-wide or representative basis, or on behalf of the general public, or on behalf of other persons that may be similarly situated. You agree that you do not have the right to act as a private attorney general, a class representative, or to participate as a member of a class of claimants with any claim subject to arbitration. You further agree that no claim subject to arbitration shall be heard by a jury and that any judgment or award of the Arbiter will be final and not subject to judicial review. All arbitrations will be conducted as document-only proceedings. Each party shall bear its own costs arising from and associated with the document-only proceeding with the exception of the arbitrator’s fees which will be borne by all parties in equal shares. If either party requests any procedures beyond a document-only proceeding, the requesting party will be responsible for all fees, including filing and administrative fees, above and beyond the fees required for document-only proceedings. Any award of the arbitrator(s) may be entered as a judgment and shall be enforceable in any court of competent jurisdiction. The arbitrators will have no authority to award punitive or other damages not measured by the prevailing party’s actual damages, except as may be required by statute.
