THE FORMATION AND FORMULATION OF THE RULES AND REGULATIONS

OF THE DRAVIDAMUNNETRAKAZHAGAM

The Dravida Munnetra Kazhagam was formedin 1949 (17-9-1949) and a draft of rules regulationsof the Party was prepared by the Rules FramingCommittee. It was duly approved by the GeneralCouncil and was adopted and passed by the firststate level conference of the Party held at Chennaiin December 1951. The late K.A. Mathialagan wasthe secretary of the Rules Framing Committee.Subsequently, on 6-6-1958 a Rules and RegulationsAmendment Committee was nominated by the CentralExecutive Committee which met at Chennai. Theamendments suggested by the said committee wereformally adopted by the Central Executive Committeeand passed by the General Council held in July 1959.The late N.V. Natarajan was the secretary of theCommittee.

The General Council held at Trichy on 26-5-1962nominated a Rules and Regulations AmendmentCommittee with late N.V. Natarajan as the Secretaryto suggest necessary amendments to the thenexisting rules and regulations. The suggestionspresented by the committee were adopted by theExecutive Committee and passed in the GeneralCouncil held at Chennai on 14th and 15th of October,1967.

The Central Executive Committee held on14-6-1972 at Chennai nominated a Rulesand Regulations Amendment Committee with

late N.V. Natarajan as Convener. The amendmentssuggested by the Committee were adopted by theCentral Executive Committee and passed at theGeneral Council held at Pudukottai on 6th & 7th ofJanuary, 1973.

Later when the Central Executive Committeemet on 1-7-1977 a Rules and Regulations AmendmentCommittee was nominated with late Neelanarayananas Chairman and late N. Ganapathy as Secretary andThiruvalargal. Kovai M. Ramanathan, MadurantakamC. Arumugam, Bangalore T. Diravidamani,Paramakkudi Suba. Thangavelan as members. Theamendments recommended by the Committee wereunanimously adopted by the Central ExecutiveCommittee held at Parangipettai and approved bythe General Council held at Chidambaram on 9th and10th of September, 1977.

Consequent to the growth of the Party and theexperience gained meanwhile, a few amendmentsto the Rules and Regulations were proposed at, andunanimously approved by the General Council heldat Trichy on 2nd and 3rd of August, 1980.

Again on representations made to amend theRules and Regulations of the Party, a Rules andRegulations Amendment Advisory Committee wasconstituted with late Neelanarayanan as convenerand late S.S.Thennarasu, Thiru. Ko.Si.Mani, lateK.M.Kathiravan and late N.V.N. Somu as Members.The recommendations made by the Committee wereunanimously approved and passed by the GeneralCouncil held at Pondicherry on 16th and 17th of May1981.

On the suggestions of the members of theGeneral Council a few amendments were proposedthrough a resolution and passed unanimously in theGeneral Council held at Tirupattur (North Arcot) on12th and 13th of December 1981.

In the light of the experience gained in runningthe organisation and in order to streamline theadministration of the Party Branches, the GeneralCouncil which met on 23rd and 24th March, 1985 atPeriyar Thidal, Chennai, nominated a Rulesand Regulations Amendment Committee withThiru L. Ganesan, as the Convener, Thiruvalargal.Murasoli Maran, M.P., C.T. Dhandapani,Pulavar Palanisamy, A.L. Subramaniam,Late A.V.Krishnamoorthy, Mohammed Sahi,T.S. Kalyanasundaram and Paramathi Shanmugam asmembers.

Some of the amendments suggested by theCommittee were placed before and approved by theGeneral Council held at Chennai on 27th and 28thJuly, 1988. Further amendments were discussed indetail and approved unanimously at the GeneralCouncil held at Chennai on 2nd February, 1988.

At the general Council meeting held on2-7-1989 at Chennai, few amendments to the Rulesand Regulations of the Party were proposed and theywere unanimously approved.

A Rules and Regulations Amendment Committeewas nominated by the General Secretary on6-6-1992 with Thiru L. Ganesan, as Secretary, and

Thiruvalargal. P.S. Thiruvengadam,R.D. Seethapathi, So.Ki. Moorthy, T.S. Kalyanasundaram and Marudur Ramalingam as Members.Subsequently on 21-11-1993 Thiru L. Ganesan wasreplaced by Kovai Era. Mohan for the Secretaryshipof the Committee and Thiru P.V. Kalayanasundaramwas nominated as a Member. The Committee aftermeeting on several occasions suggested severalamendments to the Rules and Regulations of theparty.

In the meetings of the General Council held atThanjavur on 29-12-1993, at Madurai on 29-7-1994,at Chennai on 2-6-1995, at Chennai on 27-7-1997 andat Chennai on 8-4-2000 the various suggestions ofthe Committee to amend the Rules and Regulationsof the Party were considered in detail and approvedunanimously. These amendments and otheramendments adopted by the General CouncilMeetings of 23.4.2002 and 2.6.2003 are incorporatedin this Publication and the Rules and Regulationsof the Party in operation on date is broughtout inthis Booklet.

This Booklet specifically gives the Aims, andObjects of the Party and the Rules and Regulationsof the Organisation.

RULES AND REGULATIONS

RULE - 1 : NAME :-

The name of this Organisation shall be"Dravida Munnetra Kazhagam". The word"Kazhagam" and "Party" wherever they occurshall refer, unless specifically used in any othersense, only to "Dravida Munnetra Kazhagam".

RULE - 2 : AIMS :-

In conformity with the aims as laid down byArignar Anna, the aim of the Kazhagam is to striveand forge Dravidian cultural co-operation amongthe four linguistic states of Tamilnadu, AndhraPradesh, Kerala and Karnataka, within the framework of the sovereignty, unity and integrityof India and within the ambit of the Constitution ofIndia. The Dravida Munnetra Kazhagam bears truefaith and allegiance to the Constitution of India, asby law established and the principles ofsocialism, secularism and democracy and woulduphold the sovereignty, unity and integrity of India.

RULE - 3 : IDEALS :-

Having strict adherence to the principles ofDuty, Dignity and Discipline stressed by Arignar

Anna as the basis, the party will striveto safeguard the democratic rights in politics, toestablish a society free from any kind ofexploitation, to effect reforms in society in orderto bring about a renaissance based on rationalism,to eradicate poverty in the economic field, to findout ways and means, to secure the welfareof all on the basis of socialism to promote the statelanguage without giving room for domination by otherlanguages in order to secure them due place ofimportance, to decentralise the powers concentratedin the centre and to secure autonomy for the Statesand genuine Federation at the centre.

RULE - 4 : FLAG :-

The Party's flag will be of the length andbreadth in the ratio of 3:2 with black colour at thetop and red colour at the bottom in even size.

RULE - 5 : MEMBERSHIP :-

SECTION - 1

All persons irrespective of sex above theage of 18 who accept the ideals and aims of theKazhagam and assure to abide by its rules and regu-lations shall be eligible for membership of theKazhagam.

SEC.-2

Any person who is a member of any otherpolitical Party or of any communal or religiousorganisation shall not be eligible for membership ofthe Kazhagam.

SEC.-2A

Persons who join the party after resigning fromany other political party, during the period ofenrolling of new or renewal of the existing membersaccording to the directions of the General Secretary,shall not be entitled to cast their vote in theelections to be held for the various branches ofthe party unless they are specifically exemptedfrom such bar by the party Head quarters.

SEC. - 3

Those who desire to join the party have to givetheir names and other particulars in the prescribedforms, printed and provided in duplicate by theHeadquarters office, without any discrepancy in theentries and returned through the authorised officebearers with the amount of membership fees payableto the Headquarters. They will be treated asmembers from the date on which they are registeredby the Headquarters, after the verification of thedetails provided in the forms and they are eligible tovote in the elections of the respective unit from thedate when the individual membership card is issuedto them.

SEC. - 3A

The following persons are authorised to recom-mend to the acceptance of the form by putting theirsignature, denoting their respective office in theParty.

(a) The office bearers of the (1) concernedunit of the party; (2) higher body of the concernedunit. (3) State level unit of other States;

(b) (1) District units; (2) City units;(3) members of the central executive committee;(4) members of the general council: (5) D.M.K.Members of the Legislative Assembly andParliament of the respective area; (6) formerSecretaries who were elected during the previouselection.

Subsequently, if it is found out that those whoare admitted to be members of the party based onthe recommendation made by one of the aforesaidpersons are proved to be unqualified or bogus,suitable action will be taken against the person whomade the recommendation.

SEC. - 4

Only those who cannot sign may affix their lefthand thumb impressions on the application form. But,along with the impressions, the persons who proposethe membership should also affix their signatures.If any doubt arises regarding the thumb impression,it is the responsibility of the proposer to prove thegenuineness of the same.

SEC.-5

Any person desirous of joining as a member ofa particular unit should be one who is ordinarily aresident of the area within the jurisdiction of thatunit. Only when there is no unit in the said area, hemay register himself as a member in a unit which issituated at an adjoining area.

SEC.-6

Except in the case of newly formed units, theapplications for registration as members in thealready existing units shall be sent to the partyHeadquarters office within a period of one month fromthe date on which a member whose name is registeredfirst, signed the same. This should not be delayedon the ground that the number of members enrolledhas not reached the strength of twentyfive.

SEC.-7

The membership cards sent from the partyHeadquarters office should be delivered to the mem-bers within a week by the concerned secretary,organiser or the person responsible for the same.

SEC.-8

In joining as Members or in enrolling them, theprocedure laid down by the Headquarters office ofthe Kazhagam from time to time shall be followed.

SEC.-9

A person can become a member only in one unitof the party. If any person had enrolled in more thanone form or registered himself as member in morethan one unit and has exercised his vote in both unitsduring organisational election, his vote will becomeinvalid and further he is disqualified to vote orcontest in the elections for the units of the party athigher levels.

SEC. - 10

For valid reasons, a member registered in oneunit can transfer his membership to another unit inwhich he desires to join after getting the consent ofthe Secretaries of the two units and by paying atransfer fee of Rs.3/- to the party Headquartersoffice for such transfer. If any of the secretariesrefuses to give his consent without proper reasons,the member can appeal to the Secretary of the higherunit.

SEC.-11

Section 10 shall not be operative during theperiod from the date of announcement of the generalelection to the party till the completion of the same.

RULE - 6 : MEMBERSHIP FEE :-

SECTION - 1

A membership fee of Rs.3/- shall be paid

The entire membership fee paid by themembers along with the membership applicationforms with necessary recommendation shall be sentto the party Headquarters by the concernedSecretary or Organiser or the person responsible forthe unit or by the person authorised to enrollmembers. If bogus members are recommended, boththe person who so recommended and the person whoenrolled such bogus members will becomedisqualified to vote or contest in the Party elections.

RULE - 7 : UNITS :-

SECTION - 1

The units formed in the villages will be calledVillage Units; and the Sub Units formed in TownPanchayats, Municipalities, Townships andCorporations will be called Ward Units/ DivisionUnits.

SEC. -2-V i l lage Unit

Village Units are those units established in thesubdivisions of a Village Panchayat having distinctnames and boundaries in the Government records orin the voters lists. The list of such villages shall beannounced by the party Headquarters wherever nec-essary at the time of party election.

SEC. - 3

As regards the units to be established as perSec.2, the people belonging to Scheduled Caste in theVillage Units are entitled to organise separate unitsin their residential areas if they so desire subject tothe condition that only persons belonging to thescheduled castes be office bearers in such units.Such units are not permitted in Panchayat Towns,Townships, Municipal Towns, City Units and CityDistrict Units where no village units arepermissible.

SEC. - 4 - Ward/Division Unit

Units formed in the Wards or Divisions of TownPanchayats, Townships, Municipalities, Cities andCity Districts shall be called Ward/Division Units.

SEC. -5

Only a Unit having a membership of not lessthan 25, shall be accepted.

SEC.-6

The members of the Village Units or Ward Unitsshall assemble and elect four office-bearers, namely,a Chairman, a Secretary, a Deputy Secretary and aTreasurer from among themselves. If on the date ofelection, the total membership of the Village Units is100 or less, one representative for the higher unitand 10 members for the Executive Committee shallbe elected. If such membership is more than 100,two representatives for the higher unit and 15members for the Executive Committee shall beelected. The election for the Executive Committeeshall be held immediately after the election of theoffice-bearers and the representatives for the higherunit. The right of the unit to vote in the higher unitshall stand cancelled if it has not conducted theelection of the Executive Committee. The identitycard for the representative elected to the higher unitwill not be sent to the unit.

SEC. - 7

The general body meeting of the unit shall beheld atleast once in six months and the meeting ofthe Executive Committee shall be held atleast oncein two months. The Secretary of the unit shall sendcopies of the minutes of the meeting to the higherunit and to the party Headquarters office. If themeetings are not convened regularly, the higher unitshall have the right to convene the same.

SEC. - 8

The Village Units should have proper contactthrough the Panchayat Union Unit secretary, and theWard Units should have regular contacts through therespective Secretaries of Town Panchayat, Munici-pal Towns, Townships, Areas and City Units to thehigher units.

SEC.-9

Every unit, sub-unit and associate forum shallhold propaganda public meetings or culturalperformances atleast twice a year. In case of failureto do so, such units should inform the higher unit andthe District unit, the reasons for not conducting suchmeetings.

RULE - 8 : TOWN PANCHAYAT UNIT :-

SECTION - 1

The units formed at Town Panchayats shall becalled Town Panchayat Units.

SEC.-2

The elected office bearers of the ward unit,formed as per section 4 of Rule 7 and representativesof each ward unit elected on the basis of one for eachward shall constitute the Town Panchayat Unit. Themembers of the Town Panchayat Unit shall elect aChairman, a Secretary, a Treasurer and three DeputySecretaries (of which one shall be from the Generalpool, one shall be SC/ST and another shall be a Woman)and five representatives to the Panchayat

Union Unit. The Town Panchayat Unit shall also electsix members to the Executive Committee. By virtueof holding the secretaryship of the Town PanchayatUnit, he shall be a representative at the PanchayatUnion Unit as well as the District Unit. Those who areelected to be the office bearers of the Town PanchayatUnit and the representatives to the Panchayat UnionUnit shall be the members of the executive committeeof the Town Panchayat Unit.

SEC.-2A

Only those persons who were elected as theoffice bearers of the Ward Units and representativeselected to the higher unit shall be eligible tocontest for the membership of the ExecutiveCommittee of the Town Panchayat Unit.

SEC. - 3

The Town Panchayat Unit shall have its contactwith the higher units through the secretary of thePanchayat Union Unit.

SEC. -4

The Executive Committee of the TownPanchayat Unit shall meet at least once in two monthsand the General Body meeting of the Town PanchayatUnit shall be convened atleast once in four months.The secretary of the Town Panchayat Unit shall sendcopies of the proceedings of the meetings to thehigher unit and also to the party Headquarters office.In case the meetings are not convened regularly, thehigher unit shall have power to convene the same.

SEC. - 5

For the posts of Chairman, Secretary, DeputySecretaries and Treasurer of the Town PanchayatUnit any qualified member belonging to the said TownPanchayat may be elected.

SEC. - 5A

Only those who are members of the partycontinuously for a period of not less than five yearsare eligible to contest for the post of the officebearers of the Town Panchayat Unit andrepresentatives of the District Units. This conditionneed not be applied to the persons who are electedas representatives to the Panchayat Union Unit butthey should be currently members of the Ward Units.

SEC. - 6

It is the responsibility of the Town PanchayatUnit to see that the Ward Units function properly.

SEC. - 7

A Town Panchayat Unit shall be recognised onlywhen a minimum often Ward Units are formed underthe same. The election for the various posts of TownPanchayat Unit which does not have the minimum often Ward Units, shall be temporarily kept in abeyanceand either a convener or an ad-hoc committee shallbe nominated after the election to the post ofGeneral Secretary is held. The regular election forthe Town Panchayat unit shall be held after therequisite number of Ward Units are formed and tillsuch time the representatives of the Ward Units shallhave no right to cast their votes in the election forthe Unit of the Panchayat Union.

RULE - 9 : MUNICIPAL - TOWNSHIP UNITS

SECTION - 1

The elected ward secretary and representatives ofthe Ward Units of the Municipal Town/Township shallconstitute Municipal Town/ Township Unit. The membersof the Municipal Town/Township Unit shall elect aChairman, a Secretary, a Treasurer and Three DeputySecretaries (of which one shall be from the General pool,one shall be SC/ST and another shall be a Woman). Theyshall also elect their representative on the basis of thepopulation of the Municipal Town/Township Unit, onerepresentative if population is upto 50,000, two ifpopulation is between 50,001 to 1,00,000, threeif population is between 1,00,001 to 1,50,000, four ifPopulation is between 1,50,001 to 2,00,000 and Fiveif Population is 2,00,001 and above to the District Unit.By virtue of holding the post of secretaryship, theSecretary of the Town Unit shall be a member of theDistrict Unit. After the election of the representatives tothe District, the executive committee of the town unitshall be constituted, consisting of 21 members includingoffice bearers of the Town Unit and representatives to theDistrict Unit. Any eligible member of the Municipal Town/Township may be elected as office bearer of the MunicipalTown/Township Unit or as representative to the DistrictUnit. Those who are elected as office bearers of theMunicipal Town/ Township Unit and representatives tothe District Unit also become members of the MunicipalTown/Township Unit.

SEC.-2

Only the Secretaries of the municipal Unitsand Township Units formed by not less than three -fourth (75%) of the total number of wardsconstituting Township - Municipal Units comprising

of Ward Units according to S.4 of Rule 7. shallbecome members of the General Council by virtueof their posts as Secretaries of Municipal-TownshipsUnits.

SEC. - 3

The Executive Committee meeting of theTownship-Municipal Unit should be convened at leastonce in two months and the General body meeting ofthe Township-Municipal Unit should be convened atleast once in four months. The copies of theminutes of the said meetings should besubmitted to the higher unit and the Headquartersoffice by the secretary of the unit. If the said meetingsare not duly convened, the higher unit shall have theright to convene the same.

SEC. - 4

It is the responsibility of the Township-Municipal Unit to make the Ward Units carry outtheir functions.

SEC.-5

There must be an office in the concernedTownship-Municipality for the functioning of Units.

RULE - 10: PANCHAYAT UNION UNIT

SECTION - 1

A panchayat Union Unit shall be formed inevery Panchayat Union having at least 10 villageUnits.

SEC.-2

The Secretaries of the Village Units in aparticular Panchayat Union, the representatives ofthe Village Units, the secretary of the TownPanchayat Unit and the representatives elected bythe Town Panchayat Unit shall constitute themembers of the Panchayat Union Unit.

SEC.-3

The members of the Panchayat Union unit shallelect a Chairman, a Secretary, a Treasurer andThree Deputy Secretaries (of which one shall be fromthe General pool, one shall be SC/ST and another shallbe a Woman) and also three representatives to theDistrict Unit. They shall also elect members of theExecutive Committee, consisting of 21 membersincluding the office bearers of the Panchayat Unionunit and the representatives to the District Unit.

SEC.-4

The secretary of the Panchayat Union Unit shall,by virtue of his post, become the member of theDistrict Unit.

SEC.-5

Only the secretaries of the Panchayat UnionUnit with not less than 25 Village Units shallbecome members of the General Council also byvirtue of their posts. If any reasonablerepresentation is received, the General Secretaryshall have power to examine and grant exemption iaproper case.

SEC.-6

A Panchayat Union Unit may be formed even ifit has only 5 Village Units, if the Panchayat Union issituated in areas completely surrounded by hills. Insuch Panchayat Unions, it is only after 10 Units areformed, the secretary of that Panchayat Union Unitwill become a member of the General Council by vir-tue of his post.

SEC.-7

For the posts of Chairman, Secretary, DeputySecretaries, Treasurer of a Panchayat Union Unitand District representatives of a Panchayat UnionUnit, any member belonging to the respectivePanchayat Union who is qualified may be elected.

SEC. - 8

The General-Body Meeting of the PanchayatUnion Unit shall be convened at least once in sixmonths and its Executive Committee meeting at leastonce in 3 months. The copies of the minutes of suchmeeting should be submitted to the higher unit andto the Headquarters office. If such meetings are notduly convened, the higher unit shall have the right toconvene such meetings.

SEC.-9

Normally, the office of the Panchayat UnionUnit shall be based at the Headquarters of thatPanchayat Union. If any exemption is required forvalid reasons, permission of the District Secretaryshould be obtained for the same.

It is the responsibility of the Panchayat UnionUnit to make the Units in the Panchayat Union carryout their functions.

RULE- 11 : DISTRICT UNIT

SECTION - 1

Within the boundaries of each Revenue Districtin Tamil Nadu there shall be a District Unit.

SEC.-2

Except the city District units namely NorthChennai and South Chennai, in all other Districtunits the secretaries of the Town Panchayat unit -Panchayat union unit - City unit - Municipal Town /Township unit - Area unit and the representativeselected by them to the District units shall be themembers of the respective District units.

SEC. - 3

The members of the District Unit shallassemble and elect to the District Unit a Chairman,a Secretary, Three Deputy Secretaries, of which oneshall be from the SC/ST, one shall be from theGeneral Pool and one shall be a Woman, and aTreasurer and Two Women members in addition tothe existing number of members to the GeneralCouncil fixed according to the number of Taluks inthe District, and one in addition to the existingnumber of members to the Central ExecutiveCommittee fixed according to the number ofRevenue Divisions in the District. In the Districts

where City Units are functioning five members tothe General Council to represent the City Unit andone member to the Central Executive Committeeshould be elected by the District representatives atDistrict level. The office bearers of the District Unitand members of the Central Executive Committeewho are so elected shall, by virtue of their posts,become members of the General Council.

SEC.-4

The secretary of the District Unit shall, byvirtue of his post, become a member of the GeneralCouncil, a member of the Central ExecutiveCommittee and a member of the AdministrativeCouncil.

SEC. -5

For the posts of District Chairman, Secretary,Deputy Secretaries, Treasurer, members of theGeneral Council, members of Central ExecutiveCommittee, qualified members belonging to therespective districts may be elected.

SEC.-6

The office-bearers of the District Unit, thesecretaries of Panchayat Union Unit - City -Municipal - Township Unit, Town Panchayat Unit ofthe District and members of General Council and theCentral Executive Committee from the district, shallconstitute the District Executive Committee.

SEC.-7

The General Body Meeting of the District Unitshall be convened at least once in six months andthe Executive Committee Meeting at least once inthree months. The copies of the minutes of thesemeetings shall be submitted to the Headquarters bythe District Secretary. If such meetings are not dulyconvened, the higher unit shall have the right toconvene the same.

SEC.-8

Office of the District Unit shall be based at theHeadquarters of the district. If any exemption isrequired for valid reasons, permission of the Gen-eral Secretary should be obtained for the same.

SEC. -9

It is the responsibility of the District Unit tomake the City Unit, Panchayat Union Unit, Municipal- Township Unit in the district to carry out theirfunctions and to make the Village Units and Ward/Division Units to carry out their functions, throughthe City - Panchayat Union - Municipal - Townshipand Town Panchayat Units.

RULE- 12 : CHENNAI

SECTION - 1

The Chennai City shall, as far as the partystructure is concerned, be comprised of two districtsnamely South Chennai and North Chennai.

SEC.-2

There shall be a Ward Unit in each Ward of theCorporation in the Chennai City.

SEC.-3

There shall be an Area Unit in every AssemblyConstituency of the Chennai City.

SEC.-4

Every Ward Unit should consist of not less than100 members.

SEC.-5

The General Members of every Ward Unitshould assemble and elect six office bearers ,viz. Chairman, Secretary, three Deputy Secretaries(of which one shall be from the General pool, oneshall be SC/ST and another shall be a Woman)andTreasurer, five representatives to the Area Unit andexecutive members in such a way that there shall bean executive committee consisting of 21 membersincluding six office bearers of Ward Unit and Fiverepresentatives to the Area Unit.

SEC. -6

The secretary of the Ward Unit shall by virtueof his post, become a member of the Area Unit and arepresentative of the District Unit.

SEC. - 7

The General Body Meeting of the Ward Unitshould be convened atleast once in six months andthe Executive Committee Meeting atleast once in twomonths. A copy of the minutes of the meeting so

convened should be submitted to the higher unit andthe Headquarters office by the Secretary. If the saidmeetings are not duly convened, the Higher Unit shallhave the right to convene the same.

SEC. - 8

The Secretaries of the Ward Unit andrepresentatives elected by the Ward Unit shallbecome the members of the Area Units.

SEC.-9

The members of Area Unit shall assemble andelect six office bearers, viz., Chairman, Secretary,three Deputy Secretaries, (of which one shall be fromthe General pool, one shall be SC/ST and anothershall be a Woman) and Treasurer and fiverepresentatives apart from the Secretaries of WardUnits of that Area, to the District Units.

S E C . - 1 0

The secretaries of the Area Units shall, by virtueof their posts, become members of the District Unitas well as members of the General Council. Theoffice-bearers of the Area Unit shall also become therepresentative of the District Unit.

SEC. -11

The office-bearers of the Area Unit and thesecretaries of Ward Unit of that area shall constitutethe Executive Committee of the Area Unit.

SEC. - 12

For the posts of the office-bearers of the AreaUnit and for the posts of district representatives ofthe Area Unit, any qualified member belonging to thatarea may be elected.

S E C . - 1 3

The Executive Committee Meeting of the AreaUnit shall be convened atleast once in two monthsand the General Body meeting of the Area Unitatleast once in three months. A copy of the decisionof the meetings so convened should be submitted tothe higher unit and Headquarters office by thesecretary of the Area Unit. If such meetings are notduly convened, the higher unit shall have the right toconvene the same.

SEC. - 14

It is the responsibility of the Area Unit to makethe Ward Units in the Area to carry out theirfunctions.

SEC. - 15

In Chennai, the secretaries of Ward Unjts, theoffice-bearers of Area Units, the Districtrepresentatives elected by them and members of theCentral Executive Committee and members of theGeneral Council elected by the District Unit shallconstitute the District Unit.

SEC. - 16

The members of each of the two District Unitsof Chennai, shall elect among themselves Six officebearers namely a Chairman,a Secretary, a Treasurerand Three Deputy Secretaries (of which one shall befrom the general pool, one shall be from SC/ST andone shall be a Woman), to the respective DistrictUnits. They shall also elect to the General Councilsuch members as to the number of the Area Units of

the District and two women members in addition tothis. They shall also elect two members to the CentralExecutive Committee and one more in addition to thesame. The elected members of the CentralExecutiveCommittee and the office bearers of theDistrict Unit, by virtue of such election, will becomemembers of the General Council.

SEC.- 17

The office-bearers of District Unit, the membersof General Council and the Central ExecutiveCommittee of the district and the Secretaries of theArea Unit shall constitute the Executive Committeeof Chennai District.

It is the responsibility of the District Unit tomake the Area Units to carry on their functions andto make respective Ward Units through therespective area units to carry out their functions.

SEC- 19

As regards other procedures, the District Unitshall function as per the provisions contained in Sec.4, 5& 7 of Rule-11.

R U L E - 1 3 : CITY UNITS

SECTION - 1

The Corporation Cities of Madurai,Coimbatore, Trichy, Salem and Timnelveli shall asper the party structure, be treated as City Units.SEC.-2

A Ward Unit shall be formed in each of theCorporation Wards and a Ward unit shall consist ofa minimum of 100 members.

SEC. - 3

The members of the Ward Unit shall elect office-bearers viz.,Chairman, Secretary, three DeputySecretaries, (of which one shall be from the generalpool, one shall be from SC/ST and one shall be aWoman), and Treasurer, five representatives to thearea unit as well as 10 persons as members of theExecutive Committee. The secretary of the WardUnit, shall, by virtue of his post, become a memberof the Area Unit and representative to the City Unit.

SEC.-4

As far as Madurai City is concerned, eightWard units shall comprise of one area unit and assuch there shall be nine Area Units for the existing72 Wards.

SEC.-4A

There shall be 8 Area Units in Coimbatore,6 Area Units in Trichy, 7 Area Units in Salem and4 Area Units in Tirunelveli City Units, formed on thebasis of boundary links.

SEC. -5

The Secretaries of the Ward units and the Arearepresentatives elected by Ward units shall becomemembers of the Area Unit having jurisdiction overthe said Ward units.

SEC.-6

The member of the Area unit shall electsix office bearers viz., one Chairman, one Secretary,three Deputy Secretaries, (of which one shall be fromthe general pool, one shall be from SC/ST and oneshall be a Woman), and one Treasurer and fiverepresentatives to the District Unit. The officebearers of the Area Unit, shall, by virtue of theiroffice, become members of the District Unit and theArea Secretary by virtue of his office shall becomethe member of the General Council.

SEC. - 7

The Executive Committee of the Area Unit shallconsist of the office bearers of the area unit and theSecretaries of the concerned Ward Units.

SEC.-8

For the posts of the office bearers of the AreaUnit and District representatives elected by the Areaunit, any qualified member belonging to the area maybe elected.

SEC.-9

The meetings of the General Body of the AreaUnit shall be convened atleast once in three monthsand that of the Executive Committee atleast once intwo months. The copies of the decisions taken atsuch meeting shall be submitted to the higher unitand Headquar te r s office by the Area UnitSecretary. If the said meeting is not duly convened,the higher unit shall have the right to convene thesame.

SEC.- 10

It is the responsibility of the Area Unit to makethe Ward Units in the Area to carry out theirfunctions.

SEC.-11

The City Unit in each of the Corporation Citiesof Madurai, Coimbatore, Trichy, Salem andTirunelveli shall consist of the Secretaries of therespective Ward Units, office bearers of therespective Area Units and the Districtrepresentatives elected by such area units.

SEC.- 12

The members of the City Units shall elect sixOffice bearers namely one Chairman, one Secretary,three Deputy Secretaries, of which one shall be fromthe general pool, one shall be from SC/ST and oneshall be a Woman, and one Treasurer, and DistrictUnit representatives, equal to the number of AreaUnits in the City.

SEC- 13

The Executive Committee of the City Unit shallconsist of all the office bearers of the City Unit,Secretaries of the Ward Units, Secretaries of theArea Units and the members of the General Counciland the Central Executive Committee elected fromthe City Unit.

SEC. - 14

The City Unit Secretary, by virtue of his office,shall become a member of the General Council andCentral Executive Committee. The Office bearersof the City Units, by virtue of their office, shallbecome the District Unit representatives andmembers of the General Council.

RULE - 14 : STATE LEVEL UNIT

SECTION - 1

The State Level Units at Andhra Pradesh,Karnataka and Kerala States and the MumbaiRegional Unit as well as Andaman - Nicobar Islandsshall consist of Secretaries of the branch units andthe representatives elected to the State Level unitat the rate of 2 persons per branch unit.

SEC. - 2

The members of the State level unit shall electsix office bearers namely one Chairman, oneOrganiser, three Deputy Organisers,of which oneshall be from the general pool and one shall be fromSC/ST, and one shall be a Woman, and one Treasurer.AH the State level units of Andhra Pradesh,Karnataka and Kerala States, Mumbai Regional unitand the Andaman - Nicobar Islands shall each elect10 General Council members and two more womenmembers and two Central Executive Committeemembers if the number of branch units in theconcerned State level unit is 200 or above. If thenumber of branch units is below 200, only fiveGeneral Council Members and oae more womanmember and one Central Executive Committee

Member shall be elected. The office bearers of thestate level unit as well as the Central ExecutiveCommittee members, shall, by virtue of their office,become the members of the General Council.

The executive Committee of the respectiveState level Units shall consist of not more than 25members, including the office bearers of the Statelevel Unit, the General Council members and theCentral Executive Committee members and thoseelected from among the representatives of the Statelevel unit.

SEC. - 3

The State Organiser shall, by virtue of his post,become member of the General Council, a memberof the Central Executive Committee and a memberof the Administrative Council. The office-bearers ofthe state level unit shall by virtue of their postsbecome members of the General Council.

SEC. -4

For the posts of Chairman, Organiser, DeputyOrganiser, Treasurer, members of the GeneralCouncil, members of the Central ExecutiveCommittee of the state level anit, qualified memberbelonging to the respective State may be elected.

SEC.-5

The General Body Meeting of the state levelunit shall be convened atleast once in six months andthe meeting of the Executive Committee atleast oncein three months. The copies of the minutes of thesaid meetings shall be submitted to the Headquartersoffice by the Organiser. If the above meetings arenot duly convened, the Headquarters Office willconvene such meetings.

SEC. - 6

It is the responsibility of the respective statelevel unit to make the branch units in such States tocarry out their functions.

SEC. - 7

For Administrative convenience, the GeneralSecretary of the party, at the time of party electionsshall announce the number of Constituency or AreaUnits.

RULE - 15 : PONDICHERRY ft PONDY -KARAIKAL STATES

SECTION - 1

For the purposes of administrative conveniencein the party structure in the Pondicherry State, thesame is divided into Pondicherry State and Pondy -Karaikal State.

SEC.-2

The Pondicherry State shall consist of thefollowing 24 constituencies : -

1. Muthialpet, 2. Kasukkadai, 3. Urulayanpet,4. Nellithoppu, 5. Rajbhavan, 6.Bussy, 7. Uppalam,8. Mudaliarpet, 9. Reddyarpalayam, 10. Laspet,ll.Thattanchavadi, 12. Uzhavarkarai, 13.Villianur14. Usudu, 15. Ariyankuppam, 16. Mannadipattu,17. Thirubuvanai, 18. Nettapakkam, 19. Embalam,20. Bagoor, 21. Kuruvinatham, 22. Mahe, 23. Enam,and 24. Pallur.

The Pondy-Karaikal State shall consist of thefollowing 6 Constituencies:-

1. Karaikal North, 2. Karaikal South,3.Kottucherri, 4. Nedungadu, 5. Thirunallaru, and 6.Thirumalairayanpattinam.

SEC. - 3 : UNITS

The units formed within the ward units in theMunicipal areas shall be called as Inner Units. Inrural areas the units formed in villages with specificterritorial boundaries and having specific names shallbe called village units.

SEC. - 4 : INNER UNITS

The inner units formed within the municipalwards shall elect five office bearers namely, oneChairman, one Secretary, one Deputy Secretary, andone Treasurer and five representatives each for thehigher unit (ward unit). The elected inner unit officebearers would become representatives of the WardUnits by virtue of the said election.

SEC. - 5 : WARD UNIT

The Wards Unit shall consist of the officebearers of the concerned inner units and the electedrepresentatives for the Ward. The Wardsrepresentatives shall elect the office bearers namelyone Chairman, one Secretary, three DeputySecretaries, (of which one shall be from the generalpool, one shall be from SC/ST and one shall be aWoman),and one Treasurer and five representativesto the Constituency Unit. The office bearers of theWards Units, shall, by virtue of their office, becomethe representatives of the Constituency Unit.

SEC. - 6 : VILLAGE UNIT

The members of the village units situated inrural areas shall elect the office bearers namely oneChairman, one Secretary, Deputy Secretary and oneTreasurer apart from one representative to theConstituency Unit. The Secretary of the village unit,shall, by virtue of his office become the member ofthe Constituency Unit.

SEC. - 7 : CONSTITUENCY UNIT

The Constituency Unit formed in urban areashall consist of the office bearers of the Ward Units,representatives to the Constituency Unit elected bythe Ward Units and secretaries of inner units in theconcerned Wards of the Constituency Unit.

SEC. - 7A

The Constituency Units formed in rural areasshall consist of the Secretaries of the Village Unitsand representatives elected by the Village Units tothe Constituency Unit.

SEC. - 7B

The respective Constituency Units shall electthe office bearers namely one Chairman, oneSecretary, two Deputy Secretaries of which one shallbe SC/ST and another shall be Woman and oneTreasurer and two representatives to the state levelunit. The office bearers of the Constituency Unit,shall, by virtue of their office, become therepresentatives of the state level unit.

SEC. - 8 : PONDY STATE

The office bearers of the 24 constituency unitsas per the provisions of Sec. 2 Rule-16 and therepresentatives elected to the state level unit by theConstituency Units shall elect the office bearers ofthe Pondicherry state level unit viz. one Chairman,one Organiser, one Treasurer, three DeputyOrganisers, of which one shall be from the generalpool, one shall be from SC/ST and one shall be aWoman, and two members to the Central ExecutiveCommittee and five members to the General Council.

SEC. - 9 : PONDY - KARAIKAL STATE

As per Sec. 2 of Rule 16, the office bearers ofthe constituencies 1 to 6 namely, Chairman, Secretary,Treasurer, Deputy Secretaries, and representativeselected to the state level unit will elect the officebearers of the Pondy-Karaikal State Unit namely,Chairman, Organiser, Treasurer, and three DeputyOrganisers of which one shall be from the generalpool, one shall be from SC/ST and one shall be aWoman, and one member to Central ExecutiveCommittee and three members and two more womenmembers to the General Council.

SEC. - 10 : EXECUTIVE COMMITTEE

The Executive Committee of the Inner Unit shallconsist of 16 members comprising of the five officebearers namely Chairman, Secretary, Deputy Sec-retaries, and Treasurer, the five members elected tothe Ward Unit and six members elected to the Ex-ecutive Committee.

SEC. -10A

The Executive Committee of the Ward Unit shallconsist of the secretaries of the inner unit, officebearers of the Ward Units namely the Chairman,Secretary, Deputy Secretaries and Treasurer andthose elected to the Constituency Unit from the WardUnits.

SEC.-10B

The Executive Committee of the Village Unitshall consist of 16 members comprising of the officebearers of the Village Unit namely theChairman, Secretary, Deputy Secretaries, andTreasurer, one representative elected to theConstituency Unit and ten members elected to theExecutive Committee.

SEC. -10C

For the Constituency Units situated at urbanareas a total number of not more than 15 personsincluding the Ward Units Secretaries, the officebearers of the Constituency Units namely theChairman, Secretary, Deputy Secretaries, andTreasurer and the representatives to the higher unithave to be elected.

SEC.-10D

For the constituency units situated in the rural

areas a total number of not more than 15 persons

including the office bearers of the constituency unit

namely Chairman, Secretary, Deputy Secretaries,

and Treasurer and the representatives to the state

level unit have to be elected.

SEC. - 10E

The Executive Committee of the state level unitshall consist of the Secretaries of the ConstituencyUnits, six office bearers of the state level unit namelythe Chairman, Organiser, Deputy Organisers, andTreasurer and those elected to the higher unitsnamely Central Executive Committee and GeneralCouncil.

SEC.-11

The office bearers of the state level unit, shallby virtue of their office become the members of theGeneral Council. The state organiser, shall, by virtueof his office, become a member of the CentralExecutive Committee and the AdministrativeCouncil.

SEC. - 1 2

The Executive Committee shall function inaccordance with the provisions of section 4, 5, 6 & 7of Rule 14 and the General Rules and Regulationsof the Party.

RULE - 16 : RESPONSIBILITIES

SECTION - 1

CHAIRMAN : He shall preside over theGeneral Body meetings and the ExecutiveCommittee meetings and in the absence of Secretary,Deputy Secretaries, and Treasurer, he shallundertake their responsibilities also and dischargethem only during such interim period of absence.

SEC. - 2

SECRETARY : The Secretary of every unitshall undertake all the administrative responsibilitiesof the respective unit.

SEC.-3

DEPUTY SECRETARIES : Apart fromcarrying out the responsibilities entrusted by theSecretary, Deputy Secretaries shall undertake theresponsibilities of the Secretary during his absenceand discharge the same only during such interimperiod of absence.

SEC.-3A

In the event of the Secretary's resignation orhis removal as per disciplinary action, or the deathof the Secretary, the General Secretary isempowered to appoint a secretary-in charge for thepost. The person so appointed shall have all thepowers and rights entrusted to such office.

SEC.-4

TREASURER : The Treasurer of every unitshall undertake the responsibilities of maintainingthe funds collected on behalf of the party, giving theamount to meet the expenses as required by theExecutive Committee and by the Secretary, keepingaccounts for the income and expenditure and placingthe details of accounts at the General Body meetingas well as Executive Committee meeting through theSecretary. He shall undertake the responsibilities ofthe Secretary and the Deputy Secretary also in theirabsence and discharge them only during such interimperiod of their absence.

SEC. - 5

According to the decision of the Executive Com-mittee of the respective unit, the cash balance of theParty shall be remitted into a bank specified by themin the joint account of both the Secretary and theTreasurer and the same shall be withdrawn by themjointly. This procedure shall be followed.

SEC.-5A

Till the completion of the election to theHeadquarters, a secretary-in charge or an ad-hoccommittee shall be appointed for the units for whichno election has been conducted.

After the completion of the general election tothe Party, if vacancies arise on unexpected reasons,such vacancies shall be filled up only throughbye-election. The vacancy for the post of Secretaryalone shall be filled up temporarily in accordance withSec. 3 of Rule-16.

RULE - 17 : HEAD QUARTERS OFFICE -GENERAL COUNCIL

SECTION - 1

The supreme apex unit of the Party havingultimate authority shall be the General Council.

SEC.-2

The General Council shall consist of thosemembers elected to it by the other state level units,District and City District Units, members elected tothe Central Executive Committee, those who aremembers in the Administrative Council, the officebearers of the state level units, and District Units,City Secretaries, qualified secretaries of thePanchayat Union Units, Municipal Town Units,Township Units and Area Units and those membersnominated by the General Secretary, after hiselection to the post, if he so desires.

SEC.-3

The members of the General Council shall electThe President, The General Secretary and TheTreasurer. The elected President will nominate threeDeputy General Secretaries, of which one shall beSC/ST and one shall be a Woman and one fromthe general pool. The members of the GeneralCouncil shall also elect four members to the AuditCommittee.

SEC.-4

The meeting of General Council of the Partyshall be presided over by the Party President and inhis absence by one who is elected temporarily forthat purpose.

SEC. - 5

Only the General Secretary of the party isempowered to convene the meeting of the GeneralCouncil. The General Council shall be so convenedby the General Secretary according to necessitiesand circumstances or once in a year.

SEC.-6

For conducting the meeting of the GeneralCouncil, not less than one third of the total numberof members shall be present.

SEC.-7

If not less than one third of the total number ofmembers of the General Council so requests undertheir signature, an extraordinary meeting of theGeneral Council shall be convened by the GeneralSecretary within one month from the date of suchnotice.

SEC.-8

The General Council alone shall have ultimateauthority for deciding the policies of the party, fordrawing up programmes for executing the same andfor carrying out all other activities relating to theparty work.

SEC.-9

Normally, the tenure of the General Councilshall be five years, however, it shall be extended tillthe newly elected General Council meets.

RULE - 18 : PARTY PRESIDENT

SECTION - 1

The Party President elected by the GeneralCouncil shall preside over the meetings of theCentral Administrative Council, Central ExecutiveCommittee, General Council, General Conferenceand Special Conference.

SEC. - 2

The General Secretary elected by the GeneralCouncil, shall carry out all the duties as defined inthe rules and regulations for his post, in making policydecisions and in discharging administrativeresponsibilities of the Party affairs, only inconsultation with the Party President.

SEC. - 3

In case, the General Secretary resigns or if heis unable to discharge the party work for aconsiderably long period, the Party President willassume all the powers as defined in the rules andregulations of the Party for the post of GeneralSecretary until a new General Secretary is elected.

RULE - 19 : GENERAL SECRETARY

SECTION - 1

All the administrative responsibilities will beattended to and managed by the General Secretary.

SEC. - 2

The General Secretary may, if he so desires,nominate not more than 30 members to the GeneralCouncil.

SEC. - 3

For administrative convenience, the GeneralSecretary may appoint Headquarters OfficeSecretaries for the various wings.

SEC.-4

The General Secretary shall have power to con-stitute separate committees and wings in order toexecute the party work promptly, in a detailed andclassified manner.

SEC. - 5

Along with the members of the CentralExecutive Committee elected by the District - theCity District - State Units and those who are havingcharge as members of Central Executive Committeeby virtue of their election or nomination, additionalmembers upto 15 in number may be nominated bythe General Secretary as members of CentralExecutive Committee from among the members ofthe General Council.

S E C . - 6

The members of the Central ExecutiveCommittee nominated by the General Secretary, theHeadquarters office Secretaries and all thosenominated to the sub-committees by the GeneralSecretary shall continue in their respective posts solong as that General Secretary hold his post asGeneral Secretary or so long as he desires.

SEC.-7

The rights and responsibilities bestowed on theGeneral Secretary shall be as follows:- conveningthe meetings of General Council, Central ExecutiveCommittee and Administrative Council - carrying outthe programmes and implementing the decisions ofthe General Council and the Central ExecutiveCommittee - holding of the general election and thebye-elections of the party - examining the accountsof all the units of the party through Audit Committee- holding property rights, administrative charges oforganisations, institutions and all movable andimmovable properties - to sue and be sued in allmatters pertaining to the party and its properties bothmovable and immovable - taking disciplinary actionagainst the party unit's office - bearers or individualmembers who contravenes the party's policies andideals, its rules and regulations and discipline of theparty - Taking final decisions on the resolutions ofdisciplinary proceedings passed by every/any unitof the party and taking all steps to further the policiesand ideals of the party and to develop and strengthenthe structural pattern of the party.

SEC. -8

While the General Council or the CentralExecutive Committee or the AdministrativeCouncil are not in session the General Secretary shallhave the right to make appropriate decisionsaccording to Sec.2 of Rule-18 regarding the standto be taken pertaining to political events and courseof action to be pursued. But such decisions shouldbe placed at the immediate next meeting of theCentral Executive Committee for ratification.

When the Central Executive Committee does notmeet, the General Secretary may also obtain theviews of the members of the Central ExecutiveCommittee through correspondence regarding aparticular political event and the course of action.

SEC.-9

The General Secretary shall have the right todeposit and withdraw the funds of the DravidaMunnetra Kazhagam in current account, savingsaccount or fixed deposit account of any statutorilyrecognised (Scheduled) Bank or Fund, to borrow fromthe said institutions on the security of the prop-erties of the Party, on behalf of the Party for the re-quirements of the Party and also to lend Party's fundson proper security and to engage in the transactionpursuant thereto on behalf of the Party.

SEC.- 10

The General Secretary shall have the right toauthorise the elected party treasurer to deposit orwithdraw money on his behalf as his representativein the account of the Bank or Banks in which theParty's funds are kept and to carry out the functionsmentioned in Rule-20 Sec.9.

SEC.-11

The General Secretary shall take decision inconsultation with party President in all the mattersof the duties defined for his post in the rules andregulations, policy decisions and the party'sadministrative responsibilities and carry out the sameaccordingly.

SEC. - 1 2

If the party president resigns or if he is unableto serve the party for a considerable long period, theGeneral Secretary himself will take over the powersdefined and assigned to the party president in therules and regulations till a new President is elected.

RULE - 20 : TREASURER

SECTION - 1

The Party Treasurer shall hold theresponsibility of maintaining Party's income andexpenditure accounts.

SEC.-2

He shall on behalf of the General Secretary ofthe party receive the membership fees, the surplusamounts of General and special conferences of theparty, the income accruing from the properties ofinstitutions and units, movables and immovables, theamount collected as donation for the Headquarterson behalf of the Headquarters office; the amountcollected by conducting dramas, culturalperformances, special meetings, exhibitions, etc. andkeep them as the receipts of party funds. It is theresponsibility of the Treasurer to disburse theamount for meeting the expenses approved by thePresident and the General Secretary and alsoresponsible for maintaining the party accounts forthe amounts received and expenditure incurred.

RULE - 21 : DEPUTY GENERAL SECRETARIES

It is the responsibility of the Deputy GeneralSecretaries to take up the responsibilities entrustedto them by the General Secretary and to carry outthem on behalf of the General Secretary.

RULE - 22 :

SECTION -1 HEADQUARTERS PRINCIPALSECRETARY

To coordinate with the various units of TamilNadu State and various other State units, aHeadquarters Principal Secretary shall be appointed.

SEC. - 2 HEADQUARTERS SECRETARIES

It is the responsibility of the HeadquartersSecretaries to take up that responsibilities entrustedto them for the respective assignments by theGeneral Secretary to carryout the same on behalf ofthe General Secretary.

RULE - 23 : CENTRAL EXECUTIVE COMMITTEE

SECTION - 1

The party President, General Secretary,Treasurer, Deputy General Secretaries, members ofthe Highlevel Strategy Committee, HeadquartersPrincipal Secretary, Headquarters Secretaries,members of the Administrative Council, Secretariesof District Units, City District Units, City Units andState Organisers, members elected from the

respective Districts, City District and the State levelunits to the Central Executive Committee, membersof the Audit Committee, Members of the PropertyProtection Committee, members of the ResolutionCommittee, members of the Advisory Committee onamendment of rules, and the Chairman and GeneralSecretary of the Labour Progressive Federation,Leaders of the D.M.K. Party in the LegislativeAssembly, Legislative Council of the State and inboth Houses of the Parl iament and membersnominated by the General Secretary from among themembers of the General Council shall constitute theCentral Executive Committee.

SEC.-2

The Central Executive Committee shall meetatleast once in six months.

SEC.-3

The meetings of Central Executive Committeeshall be presided over by the party president and inhis absence by one who is elected from among themembers of the Committee who are present at themeeting.

SEC.-4

The Central Executive Committee will study theprevailing conditions in the Country and the partyaffairs every now and then and advise thePresident and the General Secretary to enable themto take necessary decisions.

RULE - 24 : THE ADMINISTRATIVE COUNCIL

SECTION - 1

The Administrative Council shall consist of thePresident,General Secretary, Treasurer, DeputyGeneral Secretaries, members of the HighlevelStrategy Committee, Headquarters PrincipalSecretary, Headquarters Secretaries, DistrictSecretaries, City District Secretaries, StateOrganisers, Members of the Audit Committee,Members of the Property Protection Committee,Members of the Resolutions Committee, Membersof the Advisory Committee on Amendment of Rulesand Chairman of the Labour Progressive Federation,General Secretary of the Federation, leaders of theD.M.K. party in the Legislative Assembly,Legislative Council of the State and in both theHouses of Parliament.

SEC. -2

The Administrative Council will, every now andthen discuss the day to day affairs of the party,political trends, other prevailing conditions in thecountry and activities relating to the units of theparty and advise the President and the GeneralSecretary to lead the party accordingly.

SEC. - 3

The Administrative Council will meet as andwhen necessary.

SEC.-4

The meeting of the Administrative Council shallbe presided over by the President and in his absenceby the General Secretary.

RULE - 25 : OFFICE OF THE HEADQUARTERS

SECTION - 1

There shall be a Headquarters office at Chennaito carry out the day to day affairs of the Head officeand to have contact with all the units of the party.

SEC.-2

The Headquarters office shall function under thecharge of the General Secretary.

RULE - 2 6 : HIGH LEVEL STRATEGY COMMITTEE

There shall be a High level StrategyCommittee comprising of not more than twenty (20)members including the President, General Secretary,Treasurer, Deputy General Secretaries, HeadquartersPrincipal Secretary and members appointed by theGeneral Secretary. These members shall, by virtueof their post, become members of the AdministrativeCouncil.

RULE - 27 : AUDIT COMMITTEE

SECTION - 1

The Audit Committee shall consist of sevenmembers, four members duly elected by the GeneralCouncil and three members nominated by theGeneral Secretary.

SEC.-2

It shall be the responsibility of the AuditCommittee to audit the income and expenditureaccounts of all the units of the party and submit areport to the General Secretary.

RULE - 28 : PROPERTY PROTECTION COMMITTEE

SECTION - 1

There shall be a Property Protection Committeewhich consists of President, General Secretary,Treasurer and seven members duly nominated fromamong the members of the General Council by theGeneral Secretary thus totalling to ten members.

SEC.-2

All the properties both movable and immovablebelonging to the Headquarters and the units of theparty shall be deemed to have come under the chargeof the Property Protection Committee.

SEC.-3

The properties that are purchased by the variousunits of the party shall be duly registered aspurchased by Dravida Munnetra Kazhagamrepresented by the General Secretary.

SEC. - 4

The General Secretary of the party shall bringto the notice of the Property Protection Committeeabout all the purchases of properties or sale orleasing, renting etc. regarding the same.

SEC.-5

The General Secretary is empowered to initiateall litigations pertaining to properties, conduct thecases and defend the cases instituted against theparty.

RULE - 29 : PARLIAMENTARY BOARD

SECTION - 1

The Headquarters office will, as and whennecessary, constitute a Parliamentary Boardconsisting of President, General Secretary, Treasurerand Deputy General Secretaries or constitute sub-Committees, in order to study the situation relatingto all elections in which the party is contesting andto recommend the names of its candidates who areto contest in such elections.

SEC. -2

The Board will study the situation prevailing inthe constituencies in all the elections in which theparty is contesting and take decision as to who shouldcontest in such elections on behalf of the party.

SEC.-3

In case of necessity, the Headquarters officewill constitute sub committees which are to be of as-sistance to the Parliamentary Board.

RULE - 30 : ELECTION

SECTION - 1

D.M.K. Party elections from the Panchayatbranches upto the Headquarters' office-bearers and

to the various wings of the party shall be heldaccording to the election rules and regulationsnotified by the Headquarters office from time to time.

SEC. -2

The general election to all the units of the partyshall be held within a period not exceeding five years.

SEC.-3

Before holding the general election to the unitsof the party, the work relating to renewal ofmembership and enrolment of new members shouldbe duly completed within the time specified by theGeneral Secretary.

SEC.-4

The General election which is to be held afterenrolling the new members and renewal of existingmembers of as stated above, shall be conducted onthe dates to be notified by the General Secretary forthe Village Units, Ward Units, Town Panchayat Units,Municipal Town and Township Units, PanchayatUnion Units, Area Units, City and City District Units,District Units, other State level Units and for theHeadquarters office in the respective order.

SEC. - 5

Excepting the office bearers andrepresentatives of the Village Units and Ward Unitsof the Town Panchayat Unit, or wards of theMunicipal Town and Townships in all other units, allthose contesting the election for the posts (including

office-bearers of the Town Panchayat Units, theoffice bearers and representatives of the divisionunits of the City Districts of North Chennai and SouthChennai) and those who are to be nominated for allthe units, should possess the following qualifications:

(a) One should have been a member of theparty continuously for a period of five years. Forcontesting the election, only to these units at AndhraPradesh, Kerala, Karnataka, Andaman Nicobar andMumbai, one should have been a member of the partyatleast for a continuous period of three years. TheHeadquarters' office will have discretionary powerto give exemption to any member from this rule.

(b) If any member is having any arrears dueto be paid to the Headquarters' office on any account,he should have completely cleared it.

(c) During the relevant period, no disciplinarycase should be pending against him and he shouldnot have been subjected to no confidence motion.

SEC. - 6

Those who do not get their membershiprenewed within the time specified by the GeneralSecretary, will cease to be members and be deemedto have lost all their positions including the right ofmembership.

SEC. - 7

Those who do not get their membershiprenewed within the time specified by the GeneralSecretary but who join subsequently as members andthose who had been expelled by the party butsubsequently allowed to rejoin will be considered asnew members only.

SEC.-8

The elections to the division units of the CityDistrict and City Units will be held by the Headquarters' itself through its election officers. Asregards the elections to the Village Units and WardUnits in other districts, the elections shall beconducted as per the announcement of the GeneralSecretary.

SEC. - 9

Among those who contest in the elections to theposts of office bearers in the organisations at theHeadquarters level, only those who secure more than50% of the votes cast and found valid will be consid-ered as having won the election.

If no one is able to secure more than 50% ofthe valid votes, except the first two candidates whohave secured more number of votes, all the othercandidates will be eliminated from the contest andthe election should be held again immediately.

From among the candidates who have securedmore number of votes, if more than one candidate

has obtained equal number of votes, thosecandidates who are to be retained in the contest willbe decided by means of drawing a lot.

SEC- 10

Those who get elected to any of the offices ofthe higher units, will be deemed to have vacated fromtheir office in the lower units to which they wereoriginally elected or nominated as the case may be.

SEC. -11

If one is elected from a lower unit as arepresentative to a higher unit is to take charge as aoffice bearer of the higher unit, there is no need forhim either to leave his post in the lower unit whichhe represents or to participate in the ExecutiveCommittee Meeting and the General Body Meetingof the lower unit.

SEC. - 12

The Headquarters office Secretaries and theoffice bearers of the City District, District, City,Panchayat Union, Township and Town Units shouldnot take any direct charge of the trade union officesso that they may be able to pay attention to theirparty responsibilities on full time basis.

S E C . - 1 3

In case a situation arises to hold an election toparticular unit or to a post or posts during the periodbetween one general election and the other, the con-cerned units should obtain prior permission from theirhigher units and then only hold such elections.

SEC.- 14

In the bye-elections taking place in Village Unitand Ward Unit, along with those who have cast theirvotes in the party's general elections, those who getthemselves enrolled as members subsequent to thatgeneral election, will also be eligible to cast theirvotes or to contest in such elections subject to thecondition that they would be so eligible only afterthe expiry of one year after they get their member-ship cards.

SEC.- 15

When disputes arise in an election to an unit,its next higher unit will try to settle the same. Bythis process, only those disputes which the districtunit is unable to settle, shall be referred to theGeneral Secretary for his decision. Members shouldnot resort to any other method before the decisionof the General Secretary is duly announced. TheGeneral Secretary will have the right to take actionaccording to his discretion against those who resortto such improper methods.

S E C . - 1 6

The decision taken by General Secretary asstated above shall be final and binding regarding theissues that may arise in election matters.

SEC- 17

The details of results of the general electionas well as bye-election should be communicated toall higher units by means of submitting copies of thesame to them.

SEC- 18

If no woman is elected to the executivecommittee of every unit at all levels of the party, suchcommittee should take a decision in such a manneras to ensure that a woman should find place in sucha unit and nominate a woman accordingly.

SEC- 19

The quorum for an election meeting shall beone-half of the total number of members, if thestrength of the concerned unit ranges between 25 to200, one-third if it is between 201 and 500, one fourthif it is between 501 and 1000 and one-fifth if it ismore than 1000 respectively.

SEC. - 20

If any vacancy arises in anyone or for all of theposts of President, General Secretary and Treasurerelected by the General Council for any reason, theGeneral Council shall be convened within sixty daysfrom the date of such vacancy and elections duly heldto fill the vacancy or vacancies of such post or posts.

SECONDARY UNITS & ASSOCIATEFORUMS

RULE - 31 : VOLUNTEERS WING :-

SECTION - 1

The Volunteers Wing will render service bymaintaining discipline and giving protection to thegeneral public during party conferences and other

party events. It would also render service inalleviating the sufferings of the people during thetime of natural calamities. The party HeadquartersOffice will lay down the regulations for thisorganisation.

S E C . - 1 A

The units of the Panchayat Unions, Townships,Municipalities and Cities would select fifty youngsuitable members of the party and impart themphysical training. They would be supplied withuniform dress in the same pattern throughout TamilNadu. They would be trained to render assistanceto the public during the time of natural calamitieslike storm, floods and fire. The expenditure in thisconnection shall be borne by the respective units ofPanchayat Unions, Townships, Municipalities andCities.

SEC.-1B

There shall be four Deputy Conveners at thestate level, one District convener and two DeputyDistrict conveners for each District and City and oneconvener and two deputy conveners for eachPanchayat Union, Township, Municipality, Area Unitsand City Units from the fifty suitable party membersselected from that area. The secretary of theVolunteer's Wing shall appoint the conveners andDeputy conveners in consultation with the respectiveunit secretaries with the approval of the GeneralSecretary. The persons so nominated shall possessthe requisite qualification and age.

YOUTH WING

SEC.-2

Youth Wing will be established as a secondaryorganisation in every village and every ward orDivision of Town Panchayat, Township, Municipalityand Cities. It will communicate with the Secretary ofthe concerned Ward or Division Units and carry onits function. Wherever there is no Village Branch - ifyouth wing is formed it has to work with the consentand control of the Secretary of the Unit of therespective Panchayat Union.

SEC.-2A

The membership fee to be paid shall be Rs.2/-(Rupees two only).

SEC. - 2 B

Youth between the age of 16 and 30 may join asmembers of this wing. Those who are eligible in agemay also join as members of party units, but the officebearers of the youth wing cannot be office bearers inthe parent body.

SEC. - 2 C

One convener and two Deputy Conveners forthe District and City and one convener for State,Panchayat Union, Area, Town, Township and CityUnits, will be nominated for the Youth Wing.

The above said nominations shall be made bythe secretary of the Youth Wing in consultation withthe concerned unit Secretaries and with the approvalof the General Secretary. The persons so nominatedshall possess the requisite age limit.

SEC. - 2 D

A wing could be formed only if there are not lessthan 10 members for a village unit and not less than20 members for each of the Town Panchayat,Township, Municipality and Corporation Ward orDivision. For the administration of each wing, aChairman, a Secretary, a Deputy Secretary and aTreasurer and also upto 5 Executive Committeemembers, at the rate of one for every ten membersshall be elected. The Youth Wing while organisingpublic meetings and cultural programmes for thepropaganda of the party principles shall give priorintimation to the secretary of the concerned partyunit and, if there is no such unit, to the secretary ofthe higher unit.

SEC. - 2 E

If, in a future date, the members of the Youthwing desire to become office bearers in any one ofthe Units of the parent body, the period of theirmembership in the Youth Wing shall be taken intoaccount while calculating the five year membershipqualification.

WOMEN'S WINGSEC. - 3

The Women's Wing will function throughout thestate with the assistance of the party units on theregulations prescribed by the Headquarters office inorder to protect and uphold the rights and dignity ofwomanhood, so that all women can be made aware ofthe principles and ideals of the party as well itsprogrammes and to make women to enthusiasticallyparticipate in the party activities.

SEC. - 3A

Such Wings may be formed with atleast tenmembers in Villages and with atleast 20 membersin the Wards of Municipalities.

STUDENTS' WING

SEC.-4

This may be formed among the studentsstudying in Colleges, Higher Secondary Schools,High Schools as well as Professional Institutions andwill engage in promoting oratorical and writingtalents, renaissance in arts as well as progressiveand rational thoughts which will eradicate thedifferences of caste, religion, etc.

SEC. -4A

In order to enable this Wing to functioneffectively, along with the Secretary of theStudents' Wing appointed by the Headquartersoffice, six Deputy Conveners will also be appointed.All these will together appoint District convenersand two Deputy Conveners, with the permission ofthe Headquarters Offce. The District conveners inturn will form separate Students' Wings forColleges, High Schools, Higher Secondary Schoolsand Professional Institutions and make them functioneffectively.

LABOUR WING

SEC. - 5

The Labour Progressive Federation which is theCentral labour organisation, constituted withseparate rules and regulations of its own, in order toprotect and foster the progress of the labourers, theirrights and welfare, will function under the control of,and on advice given by the Headquarters and actaccordingly.

SEC. - 5A

The labourers who are members in the D.M.K.should serve as members only in the trade unionsaffiliated to the Labour Progressive Federation wher-ever such units are functioning.

SEC.-5B

If it is desired by the concerned Trade Union orthe Federation to take disciplinary action against orexpel the members of the D.M.K. who arehaving membership in the trade union affiliated tothe Labour Progressive Federation, such actionshould be taken only after obtaining the approval ofthe Headquarters office.

SEC. - 5C

All the movable and immovable properties,already acquired or hereinafter to be acquired by theLabour Progressive Federation and the affiliatedtrade unions shall be owned and managed by a trustformed in the name of Labour ProgressiveFederation.

SEC. - 5 D

The President, General Secretary, Treasurerand the Labour Wing Secretary of the D.M.K.,Chairman, General Secretary and Treasurer of theLabour Progressive Federation shall be the trusteesof the above said trust.

FARMERS'WING

SEC. -6

Farmers' Progressive Union will function at theVillage, Panchayat Union and District level topromote the interest and welfare of the farmers andto redress their grievances. These wings will functionin accordance with the guidelines and advicesreceived from the Headquarters.

AGRICULTURAL LABOUR WING

SEC. - 7

As per the guidelines given by theHeadquarters agricultural labour progressive wingwill be formed at villages, Panchayat Unions andDistrict level to enable the agricultural labourers toget their due wages and legal rights and also toproperly redress their grievances then and there.

ADI DRAVIDA WELFARE WING

SEC. - 8

This wing will function as per the guidelinesgiven by the Headquarters to protect the fundamentalrights of the Adi Dravidas, to achieve social harmonyand to establish their due rights in the field ofeducation and employment.

FISHERMEN WING

SEC.-9

The Fishermen wing which functions as per therules framed by the Headquarters shall endeavourto redress the grievances of the fishermen and try tosolve their problems connected with their fishingprofession and also to uplift their socio economicconditions.

LITERARY WINGSEC. - 10

This Literary Wing will conduct seminars,'patti mandrams', poet's seminars, literaryfunctions, etc. in order to foster and preserve theeminence of language, art, literature, heritage,culture and the hoary history of the Tamils and todisseminate the same amongst the Tamilsthroughout the world and to make the ancient Tamilclassics popular and to encourage and create modernliterature. This Wing will function as per the patterndevised by the Headquarters office.

LAWYERS' WING

SEC.-11

A Lawyers' Wing of the party shall beconstituted by the Headquarters office at everydistrict level. These wings will function according tothe regulations prescribed by the Headquarters officewith the aim of assisting the party men who are toface cases on political grounds.

WEAVERS WING

SEC.- 12

The Kazhagam has been striving to redress thegrievances of weavers whenever they faceproblems. In order to solve their problems andgrievances Weavers Wings shall be formed at thedistrict level and function as per the guidelinesreceived from the Headquarters.

SEC. - 13

If the Wings that are functioning as associatesof the party so feel it necessary, they can formulateseparate regulations and programmes andimplement them after getting the approval of theHeadquarters Office for the same.

ASSOCIATE FORUMS

SEC.- 14

Those who wish to start ancillary units likeassociate forums and reading rooms should obtainprior permission from the District Secretary throughthe concerned Village Unit and Ward Units. Evenafter an associate forum is formed, if itsoffice-bearers want to conduct propaganda meetings,they may do so only after informing about them inwriting to the secretary of the concerned party unit.In case any objection is raised they should representto the higher unit in writing and after obtaining itsconsent, they should conduct the same.

SEC. -14A

An associate forum or reading room dulyrecognised by a Village Unit or Ward Unit, shouldnot have any organisational links with an associateforum or reading room which are situated outside itsarea of jurisdiction, merely because the latter forumor reading room happens to function under the samename. If the concerned party unit recommends theHeadquarters office through its higher unit that suchassociate forums which tend to bring a link amongthe associate forums and reading rooms whichfunction under a similar name in other areas to givean appearance as if they all function together as aseparate or independent organisation at Municipal,Township, Panchayat Union, District and State level,should not be recognised as associate units of theKazhagam, then the Headquarters office will be atliberty to accept such recommendation and declareaccordingly.

SEC.-14B

After the declaration that such an associateforum or reading room under a particular name isnot the associates of the party by the Headquartersoffice, no member of the party should hold any officeor be a member of such associate forum or readingroom as the case may be.

RULE - 32: CONFERENCES (DISTRICT CONFERENCES)

SECTION - 1

District conference shall be convened by theconcerned District Unit atleast once in three yearsafter duly obtaining permission from the Headquarters office in this regard.

SEC.-2

The members of the District Unit shallconstitute the Reception Committee of theconference and the District Secretary shall be theChairman of the Reception Committee.

SEC. - 3

The Reception Committee will decide who is topreside over the District Conference and who is toinaugurate it.

SEC.-4

The Secretaries of the Village Units and WardUnits of the concerned District and therepresentatives of the higher units shall be thedelegates to the District Conference.

SEC. - 5

The accounts of income and expenditure of theDistrict Conference should be scrutinised by theReception Committee within 30 days of theconference, placed for the perusal of the auditcommittee and then submitted to the Headquartersoffice.

SEC. - 6

Headquarters office in consultation with therespective District Units and State Units will decidehow the surplus amount available from suchconferences is to be utilised.

CONFERENCES OF STATE UNITS

SEC. - 7

The respective State Organisation units atAndra Pradesh, Kerala, Karnataka, Pondicherry,Mumbai, Andaman-Nicobar Island shall constitutethemselves as Reception Committees and hold therespective state conferences. The state unitorganiser shall be the Chairman of the ReceptionCommittee of the Conference.

SEC. - 8

The provisions contained in Sec. 3, 4, 5, & 6 ofRule 32 shall apply to respective state conferencealso.

GENERAL CONFERENCE

SEC.-9

The General Conference of the Kazhagam shallbe presided over by the President of the Kazhagamand inaugurated by the General Secretary.

S E C . - 1 0

All the members of the General Council shallbe members of the Reception Committee. TheDistrict Secretary of the district in which the generalconference is held shall be the chairman of theReception Committee of the general conference.

SEC. -11

The members of the General Council, themembers of all the District units, City Units and themembers of the State Unit shall be the delegates tothe General Conference.

SEC. - 12The surplus amount available from the General

conference shall be credited in the account of theHeadquarters office.

SEC.- 13

The accounts of the General Conference shallbe examined by the Audit committee and placed be-fore the next General Council.

SPECIAL CONFERENCESEC. - 14

If necessity arises for convening any specialconference to take urgent decisions regarding party'saffairs and regarding conditions prevailing in thecountry, the Central Executive Committee shall holdsuch a special conference.

SPECIAL PROGRAMMES

SEC. - 15

All the units of the party and all the individualsbelonging to the party who wish to conduct specialprogrammes to collect funds for their benefit, shallobtain prior permission of the Headquarters officethrough the concerned District Units and those whohave not so obtained prior permission will be subjectto disciplinary action.

RULE - 33 : QUORUM FOR THE MEETINGSECTION - 1

The quorum for the General body meetings ofall the units of the party shall be one-fifth of itsmembers and the quorum for the ExecutiveCommittee meetings shall be one third of itsmembers.

(a) those who fail to attend three consecutivemeetings without obtaining permission shall cease tohold their offices. The Secretary of the concernedunit shall inform the member who fails to attend threeconsecutive meetings of the consequence withinstipulated time. If the unit so desires, it may admithim as a member on the written request of the saidmember.

RULE - 34 : PERIOD OF NOTICE TO BEGIVEN FOR MEETINGS

SECTION - 1

Notice of the Executive Committee Meetingsshall be given to the concerned members three daysprior to the said meetings and in the case of othermeetings of the units, notice shall be given sevendays in advance.

SEC.-2

In case of emergency meetings convened forspecial and urgent need, the said period of notice maybe relaxed, provided it should be ratified at the nextregular meeting, explaining the reason therefor.

SEC.-3

If one-third of the members of an unit submit awritten representation requesting the secretary ofthe unit to convene a meeting, the meeting of thesaid unit shall be convened within 15 days from dateof the receipt of the said representation.

SEC.-4

If the said representation is not complied with,such a representation may be sent to the higher unit.The Secretary of the said higher unit shall convene

the meeting of the said unit within a month from dateof the receipt of such representation.

RULE - 35 : RESIGNATIONS

SECTION - 1

If any member or office-bearer desires to resignfrom the party or from the post, he should intimatethe same to the concerned unit in which he is amember, stating the reasons therefor.

SEC. -2

If any office-bearer of a Village, Ward/DivisionUnit or its individual member resigns, his letter ofresignation together with its acceptance by theExecutive Committee should be forwarded to theHeadquarters Office through the concernedPanchayat Union - Municipal Town - Town Panchayat- Township - Area Unit.

SEC. - 3

If an office-bearer or member of an unit whichis higher to the Village, Ward/Divsion unit resigns,his letter of resignation together with its acceptanceby the Executive Committee of the concerned unitshould be forwarded to the Headquarters officethrough the next higher unit.

SEC.-4

The Office-bearer so resigning should forthwithhand over the fund, properties, registers, books ofaccount and other responsibilities relating to theParty to the person higher in office and if not to theoffice-bearer next to him. In case all the office-bearers of a particular unit resign, all the funds,properties, registers, books of account and

responsibilities of that unit should be handed over tothe Secretary of the higher unit.

RULE - 36 : NO CONFIDENCE MOTION

SECTION - 1No confidence motion is one which is duly

brought against those who are in charge of the unitsof the party.

If a no confidence motion is to be broughtagainst an office-bearer of a unit, one-third of thetotal membership of the concerned unit should submitthe motion duly signed by them to the Secretary ofthe concerned unit duly explaining the reasonstherefor, also sending copies of the same to thehigher units and to the Headquarters office. If a noconfidence motion is to be brought against theSecretary of the unit, the said motion should besubmitted to the Secretary of the next higher unit,sending copies of it to the higher units and the HeadQuarters Office.

SEC.-2

The Secretary of the unit should convene themeeting of the members of that unit within fifteendays of the receipt of the said motion, afterinforming the Secretary of the higher unit.

SEC. - 3

The meeting so convened shall be presided overeither by the Secretary of the higher unit or by a rep-resentative of the higher unit duly authorised by him.

SEC.-4

If the Secretary of the concerned unit does notconvene the meeting to discuss the no confidencemotion within the stipulated period, the Secretary of

the higher unit should, after informing the Headquar-ters office, convene such a meeting within the next15 days from the said stipulated period.SEC.-5

For passing a no confidence motion, votes ofnot less than two thirds of the total membership ofthe particular unit are necessary.

SEC. - 6

If a no confidence motion is passed and anoffice-bearer is so removed thereby, he shouldforthwith hand over all the funds, properties,registers, books of account and other responsibilitiesin his care, to the next higher office-bearer and ifnot to the office-bearer next to him.

SEC.-7

A no Confidence motion passed by a unit shouldbe forwarded to the Headquarters office through thenext higher unit.

SEC. - 8

If the office-bearer or unit aggrieved by the saidno confidence motion so desires, he or it, as the casemay be, may prefer an appeal to the GeneralSecretary within 30 days from the date of passingthe said motion.

SEC.-9

If the Office-bearer or the unit against whom ano confidence motion has been so passed fails to pre-fer an appeal within 30 days from the date of passingof the said motion, it shall be deemed that the saidoffice-bearer has been discharged from his office orthat the said unit has lost its right to function as such.

SEC. - 9A

From the date of his election a Panchayat UnionSecretary shall organise a minimum of 10 PublicMeetings in a year, the town Secretary shall organisea minimum of 5 Public Meetings in a year and TownPanchayat Secretary shall organise a minimum of3 Public Meetings in a year. Further, they shallnecessarily subscribe to one newspaper whichpropagates the Party ideals.

Those Secretaries who do not organise PublicMeetings as above and who do not subscribe to anewspaper shall be subjected to Disciplinary Action.

RULE - 37 : DISCIPLINARY ACTION

SECTION - 1

All the members of the party, its units and theoffice - bearers of the units shall be subject to thecontrol and disciplinary proceedings of the party.

SEC. - 2

Disciplinary action shall be taken against anindividual member or a particular unit or anoffice-bearer for acting in violation of principles andpolicies of the party, or for conducting himself in sucha manner as to bring to slur on the dignity of the Party,or for wilfully disobeying the rules and regulationsof the Party and instructions of the higher units, orfor refusing to carry out the decisions of the Partyand working against the decision of the Party or foracting in a way which may weaken the discipline ofthe Party.

SEC. - 3

For all bodies excepting the AdministrativeCouncil, Central Working Committee, and the General

Council, namely; State level units, District units, CityUnits, Panchayat Union units, Area Units, MunicipalTown Units, Township Units, Town Panchayat Units,Division/Ward units and Village Units, if disciplinaryaction is to be taken against any individual of the saidunit or any unit subordinate to the concerned unit, theaction shall be taken by a majority of the total membersof such unit attending the meeting and two thirds ofthose present favouring the decision. The decisiontaken in the above manner shall be forwarded to thehigher units and Headquarters office in the form of arecommendation.

SEC.-4

Admonition, Warning, Suspension for a specificperiod or removal from the party, constitute the variousforms of disciplinary proceedings.

SEC. -5

While taking disciplinary action, the final authorityto suspend for a particular period or to expel shall restonly with the General Secretary. If a situation arises totake disciplinary action either to expel an individual oran office-bearer or to dissolve an unit, the concernedunit or the Secretary of the higher unit shall have poweronly to duly recommend it for the final decision of theGeneral Secretary, and it is only after it is approved bythe General Secretary, express notice of suchsuspension or dissolution shall be published by theconcerned unit or the Secretary of the higher unit.

SEC. -6

If it is felt that one who is charged with an offencereferred to in Sec.2 above is to be suspended forthwith,the Secretary of the higher unit may do so after obtainingthe permission in this regard from the General Secretary.

SEC. - 7

Before disciplinary proceedings are taken againsta member or an unit, explanation should be called forand obtained as to why disciplinary action should notbe taken, by indicating the charges and giving oneweek's time.

SEC. - 7A

The General Secretary of the party is empoweredto take direct action against any individual member, unitor associate Forums under Section - 4 above, duringextraordinary and necessary circumstances. Thepersons who are temporarily suspended are not entitledto participate in the party activities or to cast theirvotes.

SEC.-8

The decision taken on the Disciplinary Action shallbe deemed to have been come into force from the dateon which that decision is taken. If the aggrievedindividuals duly represent to the General Secretaryseeking redressal, the General Secretary may suspendthe action thus taken, till the completion of the enquiry.

SEC.-9

The individual or the unit against whom/whichdisciplinary proceedings of suspension or removal are

taken, should forthwith hand over all the properties,

Registers, Books of accounts and responsibilities which

have hitherto been under his/its charge to the higher

office-bearer or unit and if not to the next office-bearer.

SEC.-9 A

From the date of his election a Panchayat Union

All the applications seeking justice in the matter

of disciplinary proceedings, shall be considered by the

Headquarters office either directly by itself or throughany person or a committee authorised by it on its behalf.

SEC. - 11

In disciplinary proceedings, the decision taken bythe General Secretary shall be final and binding.

RULE - 38 : POWERS OF THE GENERAL COUNCIL

SECTION - 1

The General Council alone shall have power tomake any addition or amendment or deletion in theprinciples and policies of the Kazhagam and in its rulesand regulations. Such additions or amendments ordeletions shall be passed only when two thirds of thetotal members of General Council are present andmajority of the total members of the General Councilvotes in favour.

SEC.-2

The General Council shall be the final authorityin making decisions regarding organisational set up ofthe Kazhagam and all other residuary matters, notmentioned in the above said rules and regulations.
