AN ACT CONCERNING THE ESTABLISHMENT OF THE UNIVERSITYOF CONNECTICUT HEALTH NETWORK AND CONNECTICUTBIOSCIENCE INITIATIVE
Be it enacted by the Senate and House of Representatives in GeneralAssembly convened:
Section 1. (NEW) (Effective from passage) It is hereby found and1determined that there is a need to advance health care, education and2economic development in the state by funding a series of initiatives3that will encourage collaboration, innovation, job creation and new4investment by hospitals and other key stakeholders in Connecticuts5health and bioscience industries. These initiatives include the6construction of a new bed tower at John Dempsey Hospital and7renovation to other academic, clinical and research space at the8University of Connecticut Health Center to sustain and strengthen9
these vital state resources and enhance the academic, clinical and10 research missions of the schools of medicine and dental medicine;11Connecticut Childrens Medical Center assuming operational control12and expanding its licensed bed capacity to include the neonatal13intensive care unit located at John Dempsey Hospital so that the unit14may be integrated into a regional childrens health system and15

additional bed capacity is created for John Dempsey Hospital to treat16adult patients; and providing funding to support the development of a17comprehensive cancer center to expand clinical trials and advance18
patient care at multiple sites in the Hartford region; a state-of-the-art19simulation and conference center to be located on the Hartford20Hospital campus that will be used to educate and train area health care21professionals utilizing new technologies and simulated care settings; a22primary care institute located on the campus of St. Francis Hospital23and Medical Center that will seek to increase the number of primary24care providers in Connecticut while developing new models in chronic25disease management and primary care delivery and education; a26University of Connecticut-sponsored health disparities institute to27enhance research and care delivery for Connecticuts minority and28
medically underserved populations; and an institute for clinical and29 translational science to be located on the University of Connecticut30Health Center campus by which partnering hospitals and other31organizations can attract more grant funding, research and clinical32trials to the state. It is also found and declared that there is a need to33foster growth in the bioscience sector of the state economy and expand34enterprise zones for such businesses in the City of Hartford and other35eligible municipalities. The foregoing initiatives, all to the public36benefit and good, and the exercise of the powers, to the extent and37manner provided in this act, are declared to be for a public purpose38and to be the exercise of an essential government function.39
Section 2. (NEW) (Effective from passage) (a) As used in sections 1 to40
16, inclusive, of this act, the following words and terms shall have the41
following meanings unless the context indicates another or different42
meaning or intent:43
University of Connecticut Health Center new construction and44
renovation means the planning, design, development, financing,45
construction, renovation, furnishing, equipping, and completion of46
clinical, academic and research space within John Dempsey Hospital47
and the University of Connecticut Health Center, including but not48
limited to construction of a new 170-180 bed tower for John Dempsey49
Hospital that will increase its total licensed bed capacity from the50

current 224 to a number not to exceed 234, including newborn51
bassinettes.52
NICU transfer means the transfer of forty (40) neonatal intensive53care unit beds at John Dempsey Hospital to the licensure and control54
of Connecticut Childrens Medical Center without any decrease in55
John Dempsey Hospitals licensed bed capacity and the increase in56
Connecticut Childrens Medical Centers total licensed bed capacity to57
a number not to exceed ___, including newborn bassinettes.58
Secretary means the Secretary of the Office of Policy and59
Management.60
UConn health network initiatives means the initiatives to develop a61
simulation and conference center on the Hartford Hospital campus, a62
primary care institute on the St. Francis Hospital and Medical Center63
campus, an institute for clinical and translational science on the64
University of Connecticut Health Center campus, a comprehensive65
cancer center, and the University of Connecticut-sponsored health66
disparities institute described in section 1 of this act.67
UConn 2000 means the University of Connecticut 2000 Act found at68chapter 185b, sections 10a-109a to 10a-109ff of the general statutes, as69
amended from time to time.70
University means the University of Connecticut, a constituent unit of71
the state system of public higher education, including The University72
of Connecticut Health Center.73
Section 3. Subsection (a) of section 10a-109e of the general statutes is74
repealed and the following is substituted in lieu thereof (Effective upon75passage):76
(a) The university may administer, manage, schedule, finance,77
further design and construct UConn 2000, to operate and maintain the78
components thereof in a prudent and economical manner and to79

reserve for and make renewals and replacements thereof when80
appropriate, it being hereby determined and found to be in the best81
interest of the state and the university to provide this independent82
authority to the university along with providing assured revenues83
therefor as the efficient and cost-effective course to achieve the84
objective of avoiding further decline in the physical infrastructure of85
the university and to renew, modernize, enhance and maintain such86
infrastructure, the particular project or projects, each being hereby87
approved as a project of UConn 2000, and the presently estimated cost88
thereof being as follows:89

Section 4. (NEW) (Effective upon passage) For the purposes of section90
3 with respect to the University of Connecticut Health Center new91construction and renovation project there shall be contributed federal,92
private or other moneys now available or hereafter to be made93
available in the amount of not less than one hundred million94
($100,000,000) on or before June 30, 2018 for costs in connection with95
such project, and, upon such receipt, there shall be contributed the96
proceeds of state general obligation bonds and temporary notes issued97
in anticipation of the receipt of the proceeds of bonds not to exceed98
$227,000,000. Such federal, state, private or other moneys now99
available or hereafter to be made available for costs in connection with100
the University of Connecticut Health Center new construction and101
renovation project shall be deposited in such account or accounts of102
the university as the Secretary and State Treasurer, in consultation103
with the university, deem appropriate so as to assure timely payment104
of the cost of such project.105
Section 5. (Effective from passage) Subsection (a)(1) of section 10a-106
109g of the general statutes is repealed and the following is substituted107in lieu thereof:108
(a)(1) The university is authorized to provide by109resolution, at one time or from time to time, for the issuance and110sale of securities, in its own name on behalf of the state,111

pursuant to section 10a-109f. The board of trustees of the112university is hereby authorized by such resolution to delegate to113its finance committee such matters as it may determine114
appropriate other than the authorization and maximum amount115of the securities to be issued, the nature of the obligation of the116securities as established pursuant to subsection (c) of this117section and the projects for which the proceeds are to be used.118The finance committee may act on such matters unless and until119the board of trustees elects to reassume the same. The amount120of securities the special debt service requirements which are121secured by the state debt service commitment that the board of122trustees is authorized to provide for the issuance and sale in123accordance with this subsection shall be capped in each fiscal124
year in the following amounts provided, to the extent the board125 of trustees does not provide for the issuance of all or a portion126of such amount in a fiscal year, all or such portion, as the case127may be, may be carried forward to any succeeding fiscal year128and provided further, the actual amount for funding, paying or129providing for the items described in subparagraph (C) of130subdivision (10) of subsection (a) of section 10a-109d may be131added to the capped amount in each fiscal year:132

Section 6. (Effective from passage) The State Bond Commission shall133
have power, in accordance with the provisions of sections 6 and 7,134
inclusive, of this act, from time to time to authorize the issuance of135
bonds of the state in one or more series and in principal amounts in the136
aggregate, not exceeding $227,000,000.137
Section 7. (Effective from passage) The proceeds of the sale of the138
bond issuance described in sections 6 and 7, inclusive, of this act, to the139
extent hereinafter stated, shall be used for the purpose of undertaking,140
constructing, reconstructing, improving or equipping, or purchasing141

land or buildings or improving sites by the university under UConn142
2000 for the project hereinafter described in subsection (a), including143
payment of architectural, engineering, demolition or related costs in144
connection therewith or, with respect to subsection (b), for the purpose145
of state grants:146
(a) For the university: the University of Connecticut Health Center147
new construction and renovation, not exceeding $207,000,000.148
(b) For the Office of Policy and Management, with the approval of149
the university: the UConn health network initiatives, not exceeding150
$20,000,000.151
Section 8. (Effective from passage) All provisions of section 3-20 of the152
general statutes or the exercise of any right or power granted thereby153
which are not inconsistent with the provisions of this act are hereby154
adopted and shall apply to all bonds authorized by the State Bond155
Commission pursuant to sections 6 and 7, inclusive, of this act, and156
temporary notes issued in anticipation of the money to be derived157
from the sale of any such bonds so authorized may be issued in158
accordance with said section 3-20 and from time to time renewed.159
Such bonds shall mature at such time or times not exceeding twenty160
years from their respective dates as may be provided in or pursuant to161
the resolution or resolutions of the State Bond Commission authorizing162
such bonds.163
Section 9. (Effective from passage) None of the bonds described in164
sections 6 and 7, inclusive, of this act shall be authorized except upon a165
finding by the State Bond Commission that there has been filed with it166
a request for such authorization, which is signed by the Secretary or by167
or, on behalf of, the university and stating that $100,000,000 of federal,168
private or other monies is available with respect to the University of169
Connecticut Health Center new construction and renovation project,170
and such other terms and conditions as said commission, in its171
discretion, may require.172

Section 10. (Effective from passage) Any balance of proceeds of the173
sale of said bonds authorized for any UConn 2000 project described in174
section 7 of this act in excess of the cost of such project may be used to175
complete any other UConn 2000 project relating to the University of176
Connecticut Health Center, if the State Bond Commission shall so177
determine and direct.178
Section 11. (Effective from passage) The bonds issued pursuant to179
sections 6 and 7, inclusive, of this act shall be general obligations of the180
state and the full faith and credit of the state of Connecticut are181
pledged for the payment of the principal of and interest on said bonds182
as the same become due, and accordingly and as part of the contract of183
the state with the holders of said bonds, appropriation of all amounts184
necessary for punctual payment of such principal and interest is185
hereby made, and the State Treasurer shall pay such principal and186
interest as the same become due.187
Section 12. Subsection (a)(10) of section 10a-109d of the general188statutes is repealed and the following is substituted in lieu thereof189(Effective from passage):190
(10) To borrow money and issue securities to finance the191acquisition, construction, reconstruction, improvement or equipping of192any one project, or more than one, or any combination of projects, or to193refund securities issued after June 7, 1995, or to refund any such194refunding securities or for any one, or more than one, or all of those195purposes, or any combination of those purposes, and to provide for the196security and payment of those securities and for the rights of the197holders of them, except that the amount of any such borrowing, the198special debt service requirements for which are secured by the state199debt service commitment, exclusive of the amount of borrowing to200
refund securities, or to fund issuance costs or necessary reserves, may201 not exceed the aggregate principal amount of (A) for the fiscal years202ending June 30, 1996, to June 30, 2005, inclusive, one billion thirty203million dollars, (B) for the fiscal years ending June 30, 2006, to June 30,204[2016] 2018, inclusive, one billion two hundred fifty million dollars,205and (C) such additional amount or amounts: (i) Required from time to206

time to fund any special capital reserve fund or other debt service207reserve fund in accordance with the financing transaction proceedings,208and (ii) to pay or provide for the costs of issuance and capitalized209
interest, if any; the aggregate amounts of subparagraphs (A), (B) and210(C) of this subdivision are established as the authorized funding211amount, and no borrowing within the authorized funding amount for212a project or projects may be effected unless the project or projects are213included in accordance with subsection (a) of section 10a-109e;214
Section 13. Subsection (a) of section 10a-109n of the general statutes215is repealed and the following is substituted in lieu thereof (Effective216from passage):217
(a) For the period from July 1, 2001,[to June 30, 2016,
]until218 completion, the university shall have charge and supervision of the219
design, planning, acquisition, remodeling, alteration, repair,220enlargement, and/or demolition of any real asset or any other project221on its campuses.222
Section 14. (Effective from passage) The NICU transfer is authorized223
so that John Dempsey Hospital may increase its ability to treat adult224
medical/surgical patients and the neonatal intensive care unit at John225
Dempsey Hospital may become a component of the regional childrens226health system operated by Connecticut Childrens Medical Center.227
Notwithstanding any provision of the general statutes: (i) certificate of228
need approval, as established by chapter 368z of the general statutes as229
may be amended from time to time, to the extent applicable, shall be230
expedited for the NICU transfer, the University of Connecticut Health231
Center new construction and renovation project and any of the UConn232
health network initiatives, with such expedience to take the form of the233
Department of Public Health or any successor agency, reducing any234
waiting period between the filing of any letter of intent that may be235
required, and the filing of the associated certificate of need application,236
to ten (10) days and such department issuing the decision to grant,237
deny or modify the request for the certificate of need no later than238
ninety (90) days from receipt of a complete application without any239

extensions of the ten (10) day or ninety (90) day periods being240
available to either the applicants or the department; and (ii) state241
employees who provide services in the NICU pursuant to any242
agreement entered into between John Dempsey Hospital and/or the243
University of Connecticut Health Center Finance Corporation, shall244
continue to negotiate wages, hours and other conditions of245
employment through such employee respective bargaining agents in246
accordance with chapter 68 of the general statutes as it may be247
amended from time to time.248
Section 15. Subsections (a) and (b) of section 32-41s of the general249
statutes are repealed and the following is substituted in lieu thereof250
(Effective July 1, 2010):251
(a) As used in this section:252
(1) Eligible business means a business which (A) has not more253than three hundred employees at any time during the preceding254twelve months and (B) is engaged in bioscience, biotechnology,255pharmaceutical or photonics research, development or production in256the state; and257
(2) Eligible commercial property means (A) real or258personal property which an eligible business has (i) owned or259leased and (ii) utilized at all times during the preceding twelve260months or (B) real property which the Commissioner of261Economic and Community Development or Connecticut262Innovations, Incorporated has certified as newly constructed or263substantially renovated and expanded primarily for occupancy264by one or more eligible businesses.265
(b) On and after July 1, [1997] 2010, eligible businesses and266
eligible commercial property located in (1) the city of Hartford267and/or the town of Farmington or (2) any municipality which268has [(1)](i) a major research university with programs in269bioscience, biotechnology, pharmaceuticals or photonics and270[(2)](ii) an enterprise zone, shall be entitled to the same benefits,271

subject to the same conditions, under the general statutes for272which businesses located in an enterprise zone qualify.273
Section 16. (NEW) (Effective from passage) No later than June 30,2742015, the President of the university and the Governors designee shall275notify the Secretary whether the $100,000,000 in federal, private or276other monies referred to in section 4 of this Act has been raised. If277such notification states that the funds have not been raised, this Act278shall be of no further force and effect and the provisions of UConn2792000 as they existed prior to the amendments effected by this Act shall,280as of the date of such notice, become of full force and effect, except that281the amendments to UConn 2000 in sections 12 and 13 of this Act, and282this section 16, shall survive, and to the extent that under section 10a-283
109g(a)(1), the board of trustees has not provided for the issuance of all284 of the authorized amounts by 2016, the board of trustees may do so in2852017 or 2018.286
This act shall take effect as follows and shall amend the followingsections:
