DRAFT RESOLUTIONS
Premier’s Coordinating Forum

PROCEDURAL
ITEM 3: TORs and Rules of Order
• It is resolved that Terms of Reference and the Rules of
Order are adopted on condition that the following key
amendments are incorporated into the TORs and Rules
of Order:
a) A distinction is drawn between members (political heads),
participants (municipal and provincial government officials)
and observers (the public).
b) SALGA is recognised as a member (NOT a participant) of
the PCF.
c) SALGA and Municipal Managers are represented on the
PCF Technical Committee
d) The voting rights clause will be deleted from the rules, and
resolutions will be adopted on consensus basis and where
consensus is not reached, the matter will be deferred to the
following meeting.
PCF items for noting: •Issues for noting not allowed at PCF but rather presented at DCF’s and other relevant forums. •PCF focussed on issues that need to be resolved via discussions•Ensure agenda items are read prior to PCF to allow for short concise presentations and thus more focus more on discussions and resolutions.
Limit number of PCF agenda items, sensitive items referred to District Forums. Premier should approve.
ITEM 3: TORs and Rules of Order
a) The Premier may, if she deems fit, exclude the public from
certain sessions of the plenary.
b) The reporting clause will be amended as agreed.
c) Amendments to the name of municipality will be effected.

d) Premier can invite anyone to participate or address the
forum.
• It is resolved that changes made in the Terms of Reference
will be reflected in the Rules of Order.
• It is further resolved that once these amendments are
incorporated, the documents will be emailed to all and the
signed copies will be posted on the PCF website.

OTHER PROCEDURAL ISSUES
Reduction of PCF agenda items and referrals
• It is resolved that the number of PCF agenda items should be
reduced substantially to allow for more focused and robust
discussions on key strategic issues.
• It is resolved that the MEC for Local Government be enabled to
refer municipal items to other forums
ECONOMIC CLUSTER
ITEM 7.1: Education challenges and avenues for
cooperative governance with local government
PCF notes presentation and challenges faced by the Western Cape in improving the learning outcomes of all our children.
• Municipalities to support the Western Cape governments’ call for learners and teachers to be in class, on time.
• Municipalities to consider partnerships that support schools in dealing with the problems of learner poverty, crime, safety and infrastructure backlogs.
Base Camp Resolutions
It is noted that:
• 17 Base Camp Propositions finalized
• Bid Book & Website to be used as marketing tools from 23 November 2009
It is resolved that:
• Lobby Strategy for Final Draw and Soccerex to include 2010 District Coordinators & Base Camp Town Co-ordinators
• Base camp towns to appoint knowledgeable person to deal with media-related issues
• Supply and demand of broadband connectivity requires serious attention
• Municipal budgets to prioritize training pitch upgrades & finalized in Budget Adjustments Process
ITEM 7.2: FIFA World Cup 2010 (PGWC
Coordination)
7.2.1 Base Camp Resolutions
FanJol Resolutions
It is agreed that:
• The Broad Concept for the five Fanjols (as distributed by 13 Nov09) be adopted
• Support Football Friday.
• Districts tailor Concept Document to suit their particular Fan Jols in alignment with their budgets and expected participation by 30 Nov
• Districts facilitate transporting community members from nearby municipalities according to their budgets; extent of transport to be communicated to Provincial 2010 Coordinator by 30 Nov
• Names of FanJol Coordinators by 23 Nov
• Once each District FanJol Concept Document is complete, Service Level Agreements be entered into between PGWC,
ITEM 7.2.2: FanJol Resolutions
ITEM 7.2.3: 2010 Marketing and Communication
Resolutions
It is resolved that:
a) Branding as designed be adopted, with Bafana colours
b) Names of towns (not municipality) to be used in branding
c) Municipalities to fund production of marketing collateral
d) Collaborative Marketing at Soccerex & Final Draw Soiree be supported
e) The Focus be on tourism excellence, visitor information and marketing rather than overseas trips
ITEM 7.2.4: General 2010
It is resolved that:
a) The next meeting of the 2010 Municipal Forum include
Mayors and Municipal Managers, be held by end Jan
2010
b) The 2010 PCF Agenda cover overview and detailed 2010
FIFA World Cup plans
c) The next PCF agenda to include overall progress report
ITEM 7.3: Electrification of informal settlements
• It is resolved that MEC Madikizela should set up
engagements with municipalities, Eskom and National
government to influence policy around funding for
development of un-proclaimed areas.
ITEM 7.4: Toll Roads, traffic tariffs, road
maintenance and testing stations
• No recommendation / for noting
ITEM 7.5: Provincial Spatial Planning and
Allocations to Municipalities
a) It is resolved that all provincial departments should
disaggregate their 2010/11 budgets per district and per
ward, and their 2010/11 allocations to municipalities per
ward and per project.
b) It is resolved that all municipalities in the Province should
use and apply the spatial disaggregation of the provincial
budget and provincial allocations to municipalities in the
finalisation of their ward plans, IDP’s and Budgets
(2010/11).
SOCIAL CLUSTER
NEW ITEM: Operation Clean Audit update
a) It is resolved that the MEC for Finance will convene an
urgent meeting with Auditor General to discuss and
intervene in problems identified by municipalities relating
particularly to the treatment of assets.
ITEM 8.1: Water & sanitation Bulk Infrastructure

ITEM 8.2: Eden Drought & Social Conflict
Emergency Plan
• It is resolved that PCF should note the contents of the Social Conflict
Emergency Plan and provide comments to the Department of Local
Government and Housing by end of November 2009
• It is resolved that the Department of Social Development be mandated
to further develop and implement the Prevention / Mitigation and
Recovery / Re-integration components of the Plan and implement
• Municipalities to use demand side management to allow for differential
water tariffs on a sliding scale in their budgets for efficient water usage.
• Treasury to work with municipalities to create 2 sets of tariff structures
from budget speeches and budget cycles, one on emergency and the
other normal tarrif that will be appropriately applied when a disaster
occurs. For special exemption requests muniicpalities can contact MEC
Bredell l
ITEM 8.3: Festive Season integrated Plan (Road
safety)
• Presentation noted.
ITEM 8.4: Transfer of primary health care facilities
from municipalities to the province
• It is resolved that municipalities should assist provincial
government in transferring primary health care properties
to provincial government to allow them to upgrade
facilities.
ITEM 8.5: Fire readiness
• It is resolved that Department of Local Government and
Housing establish a forum between Department of Local
Government and Housing and municipalities to resolve
the roles of the District and local municipality in the
management of the fire service
ITEM 8.6: CDW Programme review update
• The PCF notes that by March 2010, the Dept of Local Government will consult with Local Authorities to finalise a structure for CDWs.
• The PCT notes that locally specific agreements will be entered into with each municipality where CDWs are employed.
ITEM 8.7: Municipal Assessment Visits
It is resolved that:
(a) Dept of Local Government will assess indigent policy implementation
and provide appropriate support to municipalities
(b) Dept of Local Government will assist municipalities to develop and
implement anti-fraud / anti-corruption strategies and policies
(c) Dept of Local Government will support municipalities in developing &
implementing communications policies
(d) The comments made at PCF (the need for more inclusive surveys, the
need to review the DORA) be reported to COGTA.
NEW items:
(e) Department of Local Government to ensure provincial plans and
resources are aligned in support of municipalities
(f) Department of Local Government to improve management of
information on poverty indices on farm

ITEM 9.4: Policy and Legislation
• The following draft policies and legislation and opportunities for comments are noted.
(a)Sustainable Energy White Paper: Comments to be submitted to DEADP before 15 Dec 2009.
(b)LUPO Amendments: Municipalities will be afforded an opportunity to comment on the proposed amendments
(c)NEMA / EIA regulations: Municipalities to actively participate during the 7 two-day NEMA EIA regulations Capacity building and awareness raising workshops to be held across the Province between mid January and mid February 2010.
(d)Licensing of Waste Management Activities: Municipalities to support Minister Bredell’s call for an agreement with Minister Sonjica that the Western Cape Province may deal with applications for waste management activities involving a facility at which hazardous waste have been or is to be stored, treated or disposed of.
(e)Coastal Development Setback Lines: Municipalities to actively participates in this project to develop methodology (early in new year)
ITEM 9.4: Policy and Legislation
(f) Western Cape Health Care Amendment Bill: Municipalities will make use of the extended commenting period and submit their comments on the Bill by 30 November 2009.
(g) Biosphere Reserve Bill: That the Municipalities will provide their comments on the Bill by 27 November 2009
(h) Privileges and immunities for councillors Bill, 2009: Legal opinion on this should be sought on immunity of councillors in Mayoral Committee Meetings.
(i) Standard by-law relating to holding of events has already been vetted by provincial legal services and will be published for comment.
(k) Standard by-law relating to public drunkenness: consulted with Dept of Justice and SAPS. It will published for public comment
(l) Draft WC Liquor Amendment Bill: Municipalities will make comments on the Bill by 30 November 2009
ITEM 9.5. Provincial Training Academy
Stand over
ITEM 9.6: Impact of PSDF on Municipal Planning
• DEADP to organise another forum to discuss municipalities
and provincial constitutional roles and responsibilities in
relation to planning once legal opinion is finalised and
whether the PSDF should be repealed as a structure plan.
• Deadline by end of January 2010.
ITEM 9.7: Competency levels of accounting officers
a) It is resolved that Provincial Treasury can assist
municipalities with process of identifying of accredited
service providers to perform assessments of officials to
determine competency gaps
b) It is resolved that Provincial Treasury will provide detailed
information relating to the accredited Unit Standards,
course and service delivery providers and the
subsequent methodology to be followed to comply with
the 2013 deadline
ITEM 9.8: Single Public Service
• There was disagreement by PCF members whether the
PCF is the forum to resolve the issue of municipalities being
against SALGA’s stance on SPS or whether debate should
be referred back to SALGA
• No resolution.
• The PCF may continue to debate the issue.
• The PCF to note the position of the PWGC
