EXCERPTS FROM THE MINUTES OF THE 99th REGULAR SESSION OF THE 13TH SANGGUNIANG BAYAN OF BANAYBANAY, DAVAO ORIENTAL HELD ON AUGUST 25, 2015 AT THE SB SESSION HALL.

MUNICIPAL ORDINANCE NO. 2015-01

AN ORDINANCE SUPPORTING THE ESTABLISHMENT AND OPERATION OF THE DAVAO ORIENTAL STATE COLLEGE SCIENCE AND TECHNOLOGY (DOSCST) BANAYBANAY CAMPUS, AND APPROPRIATING FUNDS THEREFOR

The THIRTEENTH SANGGUNIANG BAYAN OF BANAYBANAY, DAVAO ORIENTAL, with members in session duly assembled, hereby ORDAINS that:

SECTION I. Declaration of Principles and Policies.a. Constitutional mandate: It is the duty of the state as enshrined in

Section 1, Article XIV of the Philippine Constitution to “protect and promote the right of all citizens to qualify education at all levels, and shall take appropriate steps to make such education accessible to all.” In Section 2 (1) the state shall “establish, maintain, and support a complete, adequate ,and integrated system of education relevant to the needs of the people and society.” And in paragraph 3 of the same Section, the state shall “establish and maintain a system of scholarship grants, student loan programs, subsidies, and other incentives which shall be available to deserving students in both public and private schools, especially to unprivileged.”

b. Local Government Code mandate. Under Section 17 of Republic Act 7160 the law mandates all local government units, among other basic services and facilities, to support education.

SECTION II. Definition of Terms:a. Automatic Appropriation- refers to an amount fixed in this

ordinance which shall be appropriated by the LGU annually;b. Banaybanay Campus- refers to the DOSCST operated campus in

the Municipality of Banaybanayc. DOSCST- refers to the Davao Oriental State College and Science

Technology, a government college whose main campus is located in the City of Mati;

d. LGU- refers to the Municipal Government of Banaybanay, represented by its legitimate authorities.

SECTION III. ESTABLISHMENT OF DOSCST BANAYBANAY CAMPUS

a. The DOSCST, through its legitimate authorities, shall approve and authorize the establishment and operation of a DOSCST campus to be located in the Municipality of Banaybanay, Province of Davao Oriental, subject to the confirmation of the Municipal Government of Banaybanay.

b. The DOSCST Banaybanay Campus, upon establishment, shall:1) Seek approval from the CHED of all courses offered; 2) submit

to the Sangguniang Bayan the necessary permits/recognitions in aid of legislations; 3) ensure that the school site is in conformity with the zoning ordinance ; 4) train the students as agents of change motivated and equipped to provide necessary leadership needed in nation building.

SECTION IV. PROVISION OF BASIC FACILITIES AND SERVICES

a. The LGU shall provide, and donate the same to the DOSCST , the basic facilities for the establishment and operation of the Banaybanay Campus, such as, but not limited to: 1.)A land area conducive to the operation of a College;2.)School Buildings3.)Offices4.)Library5.)Laboratory6.)Classroom facilities7.)Other facilities

b. Subject to the availability of funds, the LGU may provide other facilities and services as may be requested b the DOSCST

SECTION V. AUTOMATIC APPROPRIATION

The LGU shall appropriate the amount of not less than Two Million (Php 2,000,000.00) Pesos as annual subsidy. The amount shall be increased annually, which may be sourced from the General Fund.

The appropriation shall not be reduced unless the Banaybanay Campus has reached a status and certified as financially self –sufficient campus.

SECTION VI. ADMINISTRATIVE PROVISIONS

a. The Municipal Mayor , through the Local Finance Committee, shall be primarily responsible for the inclusion of the amount provided in SECTION V in the Annual Budget.

b. Subject to lawful conditions, the Municipal Mayor may designate/assign auxiliary personnel to help in the operation of the Banaybanay Campus.

c. The Municipal Mayor, through an executive order, may create a team to implement the provisions of this ordinance and recommended for improvement.

SECTION VII. EFFECTIVITY This Ordinance shall take effect upon approval by the Sangguniang Bayan.
