Summary: On September 5, 2007, Kerry Hattevik, Senior Manager of Regulatory Affairs, Western Region, Mirant Corporation of Competitive Market Advocates (CMA) met with Jaclyn Marks, advisor to Cmmr. Simon in San Francisco. Also present were Robert Mason, advisor to Cmmr. Simon; Lisa Cottle, outside counsel for Mirant, Corporation; Mary Lynch, Vice President, Regulatory and Legislative Affairs for Constellation Energy Commodities Group of CMA; Katie Kaplan, outside consultant for Reliant Energy, Inc., and Jeanne Armstrong, outside counsel for Reliant Energy, Inc. Written materials (attached to the notice) were used. CMA explained that given each companies desire to have a market in California that supports merchant investment, the companies came together in this proceeding to advance recommendations which could help foster such a market. CMA further explained how the paradigm of merchant based investment and the current hybrid market are incompatible with each other. CMA made clear that the fundamental paradigm is whether investment will be supported through market structures or ratepayer backed utility investments.
