QUALIFICATION AS A SOLICITOR OR BARRISTER IN ENGLAND AND WALES

For 2020 entry, all of the undergraduate law degrees offered by Kent Law School will be recognised as Qualifying

Law Degrees (‘QLD(s)’) for the purposes of qualification as a solicitor. As of 2019 entry, the Bar Standards Board

ceased their recognition of any undergraduate law degree (at Kent, and elsewhere) as a QLD. HOWEVER, in order

to satisfy the academic component of professional training for intending barristers, students must study the

Foundations of Legal Knowledge (modules that all KLS undergraduate law degrees offer); and they must adhere

to the requirements specified below.

More detailed information about qualification as a solicitor or barrister, QLDs, and the changes to professional qualification,

can be found on the Law Student Guide.

Students must take and pass (i.e. attain a mark of at least 40% in) the modules listed below (hereafter referred to

as the ‘exemption modules’) over the course of their degree:

These modules serve as the ‘Foundations of Legal Knowledge’ for the purposes of qualification as a barrister and are

required in order to obtain a QLD. The Law School will assume that all students want tocomplete these modules ,

therefore all students will be automatically registered for them.

To obtain a QLD, in addition to the exemption modules, students must also study a further 60 Credits of Law.1

Students who successfully obtain a QLD are exempt from the need to undertake the Common Professional Examination

and can proceed directly to the Legal Practice Course (for solicitors). Students who successfully complete the

Foundations of Legal Knowledge, and obtain an overall degree classification of at least 2.2, will be eligible to proceed

to the Vocational Component of training for barristers, which currently takes the form of the Bar Professional Training

Course (‘BPTC’).

i) Implication of failure in exemption modules

It is vital that students PASS ALL the exemption modules listed above; there may be serious consequences for failing to

do so.

Although University rules governing compensation may permit a student to progress to the next Stage of their degree, or

even pass their degree as a whole, the exemption module will still have been failed. As a result, the student will not have

passed the Foundations of Legal Knowledge and, where applicable, will not obtain a QLD.

However, the Solicitors Regulation Authority (‘SRA’) and Bar Standards Board (‘BSB’) grant the Board of Examiners the

discretion to compensate a single failure of an exemption module but only in exceptional circumstances and if specific

criteria are met. More information about the criteria can be found on the Law Student Guide, but students should contact

the Student Support Office for guidance on the process of submitting evidence of extenuating circumstances to the Board

of Examiners.

ii) Number of attempts

The professional bodies allow a maximum of three attempts at each exemption module (one initial attempt followed by a

further two attempts). Attempts treated “as for the first time” do not count for this purpose.

If a student is compensated before being given three attempts to allow them to progress:

- The student can sit the module for exemption purposes alongside their programme of study or, if they have graduated, as an external candidate at the first available opportunity. For example, for a student who graduates with a compensated mark in an exemption module in July of any given year, the first available opportunity to sit for exemption purposes will be in August of that year.

iii) Time limits

All students, regardless of whether they are full or part time, have six years to complete their law degree for the

purposes of qualifying as a solicitor or barrister.

Note: Discretion is afforded to the Board of Examiners to extend this time limit, but only in exceptional circumstances.

Students are advised to contact the Student Support Office for further guidance.

Joint Honours Law Students

In week zero and week one there are introductory events and all joint honours students should attend as many of these as

possible. The compulsory module (The English Legal System and Skills), which is one of the Foundations of Legal

Knowledge , will have some sessions taught during week one. The lectures will be recorded so that students who are

unable to attend due to a clash will be able to access these online.

You must pass Stage 1 overall and take any ‘Compulsory’ modules in order to proceed to Stage 2. Any modules marked with an asterisk (*) cannot be compensated, condoned or trailed. Those modules marked with a cannot be trailed but can be compensated or condoned. Modules marked with a # cannot be compensated or condoned.

ENGLISH AND FRENCH LAW ENGFRELAW-A:LLB Single Honours

STAGE 1 - 120 credits – 60 in each term

1. An average of 60% (or a merit on preponderance) in stage 1 is a prerequisite to entry to the year abroad. Students

will be transferred to the LLB Law if this is not attained. The Director of the programme will, however, consider

applications for entry to the year abroad from students who do not achieve the required standard if:

a) There is documented evidence of exceptional circumstances which have interfered with the student’s academic

performance in stage 1, and

b) the Director of the programme is satisfied that, where appropriate to the circumstances, appropriate support is

available whilst abroad to mitigate the effect of those circumstances, or

c) In order to contribute to widening participation in Higher Education, the student meets one of more of the

contextual indicators required for entry to the Certificate route of the LLB Law programme.

2. A pass in LW539 Droit Français at stage 2 is also a prerequisite for entry to Stage A of the degree. If a pass is not

attained in LW539 then students will be transferred to the LLB Law.

For students taking International Legal Studies, in order to progress to the year abroad students must achieve an

SSPSSR DEGREES WITH A YEAR ABROAD

The School of Social Policy, Sociology and Social Research offers their undergraduate students the chance to add an

optional year or term abroad to their programme of study. Please see the SSPSSR Study Abroad pages at

www.kent.ac.uk/sspssr/studying/study-abroad/index.html for available programmes.

To be eligible for study abroad, you would normally need to have achieved an average of 60 or above in your first year

of study and two of your tutors will need to support your application. You will also need to attend a series of talks and

workshops. SSPSSR students on a UG programme ‘with a year abroad’ will spend one academic year studying in a

University with whom Kent has agreements for such exchanges. The specific institutions will change over time but will

normally include a range of institutions across Europe and in selected countries elsewhere in the world. At present they

include:

University of Tampere, Finland

University of Amsterdam, Netherlands

University of Granada, Spain

University of Trento, Italy

University of Hong Kong, China

University Maynooth, Ireland

Students must achieve an average of at least 60% in the first and second year of study to be eligible to proceed with

their Year Abroad. Students most show language proficiency for those programmes where the language of instruction

is not English (ie.Trento and Granada).

Students will undertake study as directed by programme directors and module convenors in the institutions where they

are enrolled and be assessed accordingly. In addition, students will retain contact with staff at Kent whilst abroad. A

student who successfully completes the ‘year abroad’ will gain 120 credits through the ‘Year Abroad’ module and

graduate with a degree ‘with a year abroad’.

Students undertaking Criminology degrees also have an opportunity to spend one term during the third year at San

Diego State University in California as part of an international exchange programme.
