As per the Notification issued under Lokpal and LokayuktasAct-2013 each public servant shall file declaration,information/return as the case may be regarding his assets andliabilities as on the 31st day of March every year, to thecompetent authority, on or before the 31st day of July of thatyear. Further, as per these Rules, the public servants who havefiled declarations, information and annual returns of propertyunder the provisions of the rules applicable to such publicservants shall file the revised declarations, information or as thecase may be, annual returns as on the 1st day of August, 2014, tothe Competent Authority on or before, the 15th day ofSeptember, 2014. Copy of the letter dtd. 23.07.2014 alongwithNotification dtd. 14.07.2014 enclosed for ready reference.

All officers of KVICare hereby informed to comply with theabove notification as per the guidelines specified.

Zonal Dy.CEOs and Directors should ensure that theseguidelines are conveyed to the officers working under theirjurisdiction for information and adherence.

The undersigned is directed to refer to the subject mentioned above and to say that theGovernment has notified the Public Servants (Furnishing of Information and Annual Returnof Assets and Liabilities and the limits for Exemption of Assets in Filing Returns) Rules, 2014under the Lokpal and Lokayuktas Act, 2013. on 14.07.2014. The same is available on thisDepartment's website at http://persmin.nic.in/Lokpal_Homepage_New.asp.

2. As per the said Act and the Rules framed thereunder. every public servant shall f Iedeclarations, information or return. as the case may be regarding his assets and liabilities as onthe 31 sr day of March every year. to the competent authority. on or before the 31 st day of Julyof that year. It may be noted that as per Section 2(1 )(0) of the Act, "Public Servant" means aperson referred to in clauses (a) to (h) of sub-section (I) of section 14 of the Act but does notinclude a public servant if). respect of whom the jurisdiction is exercisable by any court orother authority under the Army Act, 1950. the Air Force Act, 1950, the Navy Act, 1957 andthe Coast Guard Act. 1978 or the procedure is applicable to such public servant LInder thoseActs.

3. It may also be noted that the definition of public servant covers all CentralGovernment servants (Groups A. B and C). Therefore, all Central Government servants arerequired to file the declaration. This is an irnportant difference from the Central Civil Services(Conduct) Rules 1964 and may kindly be noted.

4. As per these Rules, the public servants who have filed declarations. information andannual returns of property under the provisions of the rules applicable to such public servantsshall file the revised declarations, information or as the case may be, annual returns as on the1it dav of August, 2014, to the competent authority on or before. the 15tll day of September.2014. All Ministries/ Departments are, accordingly. requested to please bring the provisionsof the Public Servants (Furnishing ofInforrnation and Annual Return of Assets and Liabilitiesand the limits for Exemption of Assets in Filing Returns) Rules, 20{4. to the notice of allconcerned for compliance. .

5. Formal amendment to the Central Ci vil Services (Conduct) Rules 1964 will be madein due course.

G.S.R. (B).-In exercise of the powers conferred by sub-section (1) read with clause (k)

and clause (I) of sub-section (2) of section 59 of the Lokpal and Lokayuktas Act, 2013 (l of 2014), read

with section 44 and section 45 of the said Act, the Central Government hereby makes the following rules

to provide for furnishing of information and annual return containing declaration of assets and liabilities

by public servants and to provide for minimum value of the assets which the competent authority may

exempt from furnishing such information by a public servant under section 45 of the said Act, namely:-

1. Short title and commencement.- (1) These rules may be called the Public Servants (Furnishing

of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in

Filing Returns) Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- In these rules, unless the context otherwise requires, -

(a) "Act" means the Lokpal and Lokayuktas Act, 2013 (1 of 2014);

(b) "Appendix" means an Appendix to these Rules;

(c) "annual return" means the annual return to be filed by a public servant under sub-section (4)

of section 44;

\.d) "declaration" means the declaration of assets and liabilities made by a public servant under

sub-section (1) of section 44;

(e) "Form" means a Form specified in Appendix-Il;

(f) "information" means the information required to be furnished by a public servant under sub-

section (3) of section 44;

(g) "section" means the section of the Act.

3. Manner of submission of information and annual return.- (1) Every public servant shall

make a declaration of his assets and liabilities under sub-section (1) of section 44 in the format

specified in Appendix-I, along with the information required under sub-section (2), or as the case

may be, sub-section (3), and the annual return under sub-section (4) of section 44 in

Forms I to N specified in Appendix-IT.

(2) Every public servant shall file declaration, information or return, as the case may be,

regarding his assets and liabilities as on the 31't day of March every year, to the competent

authority as referred to in clause (c) of sub-section (1) of section 2, on or before the 31't day of

July of that year:

Provided that the public servants who have filed declarations, information and annual

returns of property under the provisions of the rules applicable to such public servants shall file

(he revised declarations, information or as the case may be, annual returns as on the 1S! day of

August, 2014, to the competent authority on or before the 15th day of September, 2014.

4. Minimum value of assets which competent authority may exempt from furnishing of

information.-The competent authority may, for reasons to be recorded in writing, exempt in

accordance with the proviso to section 45, a public servant from filing the information in respect

of any asset, if the value of such asset does not exceed four months basic pay of the public servant

or rupees two lakhs, whichever is higher.

Note 1. This return shall contain particulars of all assets and liabilities of the public servant eitherin his/her own name or in the name of any other person. The return should include details inrespect of assets/ liabilities of spouse and dependent children as provided in Section 44 (2) of theLokpal and Lokayuktas Act, 2013.(Section 44(2):A public servant shall, within a period of thirty days from the date on which hemakes and subscribes an oath or affirmation to enter upon his office, furnish to the competentauthority the information relating to-

(a) the assets of which he, his spouse and his dependent children are, jointly or severally,owners or beneficiaries;

(b) his liabilities and that of his spouse and his dependent children.)

Note 2. If a public servant is a member of Hindu Undivided Family with co-parcenary rights inthe properties of the family either as a 'Karta' or as a member, he should indicate in the return inForm TO. III the value of his share in such property and where it is not possible to indicate theexact value of such share, its approximate value. Suitable explanatory notes may be addedwherever necessary.Note 3: _.- "dependent children" means sons and daughters who have no separate means ofearning and are wholly dependent on the public servant for their livelihood.
