ABOUT THE DRA ACADEMY OF LAWDIFC Academy of Law was established in 2015 as an independent entity to provide quality ancillary services to the UAE legal community. Its core functions include training and regulating lawyers, publishing and disseminating information, hosting events for the legal community, and providing free legal advice for people in need.

ABOUT THE LADThe Government of Dubai Legal Affairs Department was established as per Law No. (32) of 2008 as one of the Government Departments affiliated to His Highness The Ruler’s Court, with a view to providing various legal services to the Government and Government entities in the Emirate of Dubai. This includes the supervision of all legal matters involving the Government of Dubai and its entities, to keep pace with the progress achieved by the Emirate of Dubai in economic, social and developmental fields. These initiatives are the first of their kind in the United Arab Emirates, which address different categories related to the legal and judicial community. ABOUT THE DIFC WPRThe Wills and Probate Registry (The Registry), a public entity of the Dubai government, is an ancillary body of DIFC’s Dispute Resolution Authority (DRA) established by Resolution No. 4 of 2014 issued by Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, the President of the Dubai International Financial Centre (DIFC). The Registry is established under the jurisdiction of the DIFC Courts, allowing it to operate as a distinct entity. The rules governing the Registry reflect the spirit of UAE laws that respect the cultural and religious diversity of people working and living in the country.

The editorial board is made up of experts from a range of backgrounds with specific experience of either the work of the DIFC, legal practice,education or publishing. Their remit is to advise the Academy of Law on potential areas for possible publications, the approach to such projects, reader needs, promotional avenues and potential authors and contributors.

Dr. Harold KosterDean: College of Law, University of DubaiDr. Harold Koster is Dean of the College of Law at the University of Dubai. Amongst others he is involved in the LLM in Arbitration Law & Dispute Resolution and the LLM in Financial Crimes & Compliance. Harold was born in The Netherlands and studied tax, corporate and criminal law at the University of Groningen. He also studied

law in Aberdeen and Leeds and earned a PhD at Erasmus University Rotterdam. He worked for more than ten years as a lawyer before he became a (part time) judge in the Court of Appeal in Amsterdam. He lives in Dubai since 2011.

David GalloDirector: Academy of LawDavid Gallo is the first Director of the Academy of Law. He brings more than twenty years of international legal and business experience to the newly established support body for the UAE legal community. He is a licensed US lawyer (active; UAE attested) who began his career as corporate counsel before moving into

operational and commercial roles with companies in the United States, United Kingdom, United Arab Emirates and Saudi Arabia. The majority of his career has been spent with General Electric subsidiaries, while his most recent role was as CEO of a trading unit of an Abu Dhabi-based family-owned conglomerate. David has lived and worked in multiple geographies, with project assignments in the US, Western Europe, Saudi Arabia, UAE, Kazakhstan, Brazil, Chile, China, Korea and Thailand.

Clifford LewisLearning and Development Officer: Academy of LawClifford joined the Dispute Resolution Authority as Learning and Development Officer for the Academy of Law in November 2015. He is a licensed Psychologist and Human Resource practitioner who has worked in Africa, Europe and the Middle East. He specializes

in individual-, group- and organisational development. Clifford has a broad spectrum of industry experience, having worked in the manufacturing-, retail-, higher education-, financial services- and legal services sector. In addition to his current role as Learning and Development Officer, he is also a published author and doctoral

candidate with the School of Business and Management at Queen Mary University of London. His research interests are in equality and diversity within the leadership structures of organisations. Clifford holds several academic awards, including a Stellenbosch University Leadership Bursary, a Studentship from the Centre for Research in Equality and Diversity at Queen Mary University and an award for Best Paper that he received at the Conference on Equality, Diversity and Inclusion in Munich.

Natasha BakirciAssistant Registrar: DIFC CourtsNatasha Bakirci joined the DIFC Courts in February 2012 as Judicial Clerk, and was appointed Assistant Registrar in November that year. She is responsible for reviewing all the judicial output of the Court as well as preparing Practice & Registrar Directions and amendments to the Rules of Court. Natasha is also the main person

responsible for the development of Memoranda of Guidance and the advancement of the Courts’ relationship with fellow commercial courts in other jurisdictions. Natasha established the DIFC Courts Academy in 2012, in conjunction with Thomson Reuters, and helped to draft the Courts’ new Code of Conduct – among the first Codes of Ethics for lawyers in the region. Natasha also co-wrote the Courts’ Enforcement Guide, which sets out the legal framework governing the enforcement of DIFC Courts judgments and orders outside the DIFC.

Hussain HadiHead of Middle East Publishing: LexisNexisHussain oversees all operations in the Middle East for LexisNexis. Working with editorial and translation teams in Beirut, Dubai, London and Paris, he manages the Lexis Middle East Law online service - the definitive research tool for lawyers with business interests in the Arab world. It provides a single point of online access

to the laws and cases of the UAE in English and Arabic, as well as the commercial laws of Saudi Arabia, Oman, Kuwait and Qatar. With 15 years of legal publishing experience at LexisNexis, Oxford University Press (OUP) and Informa, Hussain has commissioned over 150 international and commercial law books, while launching numerous online research and training portals. He has also created and managed over a dozen legal journals and business publications in partnership with organizations including the Abu Dhabi Chamber of Commerce, the Dubai Judicial Institute, the General Arab Insurance Federation, and the Association of Corporate Counsel Middle East.

DIFC Academy of Law, in association with LexisNexis, is proud to bring you the Introduction to DIFC Courts’ Laws and Procedures course and the Introduction to the DIFC Courts’ Code of Conduct course. This 2-hour workshop is mandatory for registered DIFC lawyers and is divided into two parts that have been specifically developed to meet the needs of both Emirati and expatriate lawyers, legal advisors and consultants.

The course will cover a wide range of activities including gaining authorisation to practise law, fundamentals of client relationships, relationships with other lawyers and the courts, as well as financial regulations. The course is accredited by the Government of Dubai Legal Affairs Department, with attendees gaining 2 hours of CLPD points.

WHO SHOULD ATTEND THESE COURSES?Please note that this course is mandatory only for the lawyers that are registered with the Dubai Legal Affairs Department as well as the DIFC Courts. All other lawyers are welcome to take the course and also receive the 2.0 CLPD points, though it is not mandatory for them to do so.

SPEAKER BIOGRAPHIES

Natasha BakirciAssistant Registrar: DIFC CourtsNatasha was called to the Bar of England and Wales in 2006. She has an LLB from the University of London (2001) and an LLM Masters in Public International Law from the London School of Economics (2003). Natasha comes to the Courts after five years with the European Court of Human Rights in Strasbourg. Natasha joined the DIFC Courts in February 2012 as Judicial

Clerk, and was appointed Assistant Registrar in November that year. She is responsible for reviewing all the judicial output of the Court as well as preparing Practice & Registrar Directions and amendments to the Rules of Court.

Philip PunwarPartner: Baker Botts LLPPhilip was called to the Bar of England & Wales by the Honourable Society of the Inner Temple in November 1989 and elected a Master of the Bench in October 2013. In addition to being an Advocate of the DIFC Courts, Philip is a practising Barrister, a Chartered Arbitrator (CIArb) and an Accredited Mediator (CEDR). He is a partner in the international arbitration

and dispute resolution group of Baker Botts LLP. During the course of his practice before the DIFC Courts, Philip has represented the first Claimant to succeed at trial, obtained the first Freezing Order and appeared in the first appeal to the Court of Appeal. In 2014 he was the first Supervising Lawyer appointed by the Court and in 2015 he oversaw the execution of the first DIFC Courts Search Order.

Amna Sultan Al OwaisDeputy Registrar: DIFC CourtsAmna joined the DIFC Courts in 2006 as the Deputy Registrar. She is also Deputy Registrar of the Special Tribunal Related to Dubai World, Deputy Chief Executive of the Dispute Resolution Authority and Chairwoman of the DIFC Courts’ Users’ Committee. Amna has played a key part in the establishment and development of the DIFC Courts. Her role is to support the judicial bench and Registrar in the management and day-to-day administration of the DIFC Courts. Amna undertakes various judicial functions and other duties as prescribed in Article 17 of the DIFC Courts Law No. 10 of 2004.

Graham LovettPartner: Gibson DunnGraham trained and qualified as an English solicitor with Clifford Chance, where he spent 22 years. After 10 years in London Graham was seconded to their Dubai office in 2004 and become regional managing partner. Graham joined Gibson Dunn in January 2016 to head up the regional disputes practice. He specialises in complex commercial arbitration and

litigation, often with a cross-border element. Graham is ranked in the top tier in Chambers Global 2016 for Dispute Resolution (Middle East and UAE) and Corporate Investigations.

Delvin SumoLegal Conduct Officer: Academy of LawDelvin recently joined the Academy of Law as the Legal Conduct Officer. Prior to stepping into this role Delvin worked as Legal Consultant in Dubai. In this role, her focus was mainly on case management and consulting with local and international clients on matters of employment and real estate. Delvin has background in both Western- and Middle Eastern Law, which

has made her an invaluable team member, specifically within the international context of the DIFC.

Mark BeerRegistrar: DIFC CourtsMark joined the DIFC Courts in 2008 as Registrar and became Chief Executive in 2009. He is a Judge of the Courts’ Small Claims Tribunal, Chairman of the DIFC Legal Group, a Member of the DIFC Courts’ Rules Subcommittee, Registrar of the Special Tribunal Related to Dubai World and Chief Executive of the Dispute Resolution Authority. In 2010 he was elected the Vice-

President of the Middle East for the International Association for Court Administration. Under his management, the Courts have secured a reputation as one of the most efficient commercial courts in the world.

The Academy of Law in collaboration with the DIFC Wills & Probate Registry will be running a training programme on the “WPR Rules” and “Will Drafting for the WPR”. The training programme will enable practitioners to draft wills in line with the rules of the DIFC WPR. Successful completion of the course assessment will also entitle the practitioner to be included on the DIFC WPR’s list of approved Will Draftsmen, provided that they also comply with all other requirements set out by the DIFC WPR Practice Direction.

THE PROGRAMME HAS THE FOLLOWING LEARNING OUTCOMESWPR RULES WILL DRAFTING

Explain the structure and of the main tenants of the WPR Rules, namely the Roles of the Registry, Application of the Rules to a DIFC Will, Probate Process and Claims, Administration of Estates

Describe the structure- and explain the formalities of a Will as prescribed by the DIFC Wills and Probate Registry Rules.

Perform the entire process of will registration, estate planning and probate work within the framework given by the WPR legal basis, namely rights, duties and obligations of users of the WPR and their legal advisors.

Manage a formal client interview and assess a clients’ estate devolution requirements.

3Explain the general mandate and powers of the WPR Registry and the DIFC Courts.

Take comprehensive instructions from your client for the preparation of a Will.

4Describe the overall structure of the WPR Rules and explain how they integrate into the wider UAE laws.

Draft a Will in accordance with your clients’ specific instructions and circumstances.

5Describe Part 55 of the RDCs (DIFC Court Rules in relation to Probate proceedings in the DIFC Courts) and explain how it works in conjunction with the DIFC WPR Rules.

Learn to identify and mitigate professional conduct challenges and concerns commonly associated with the preparation of Wills.

6Implement the WPR Rules in advising clients on their Dubai estate planning in relation to DIFC wills and the subsequent probate process.

Satisfy the requirements of DIFC Wills and Probate Registry Practice Direction No. 1 of 2016 to be authorized to draft Wills for registration in the Register of Will Draftsmen.

SPEAKER BIOGRAPHIESMihaela Cornelia MoldoveanuSenior Manager: DIFC Wills & Probate RegistryMihaela’s academic record combines economics, law and policy, within a Master’s study in Public Policy and Human Development at the Maastricht Graduate School of Governance (The Netherlands). Her interdisciplinary background and BA in European Studies has been geared to prepare her for advisory work in legal and administrative reforms.She brings 11 years of work experience, amongst which previous appointments at the European Parliament and the United Nations.

With fluency in six European languages, she has applied her skills in a variety of management and consultancy positions, overseeing projects in Europe, the United States and Central Asia.

Most recently based in Kabul for 4 years, she completed the New Competition Law for Afghanistan, contributed to the National Trade Policy and helped design the first Alternative Dispute Resolution Centre for Commercial Disputes, in Afghanistan. With her solid understanding of strategy and of setting up new structures, she has been appointed in 2014 as Project Manager at the DIFC Courts, to oversee a novel development, namely the design and launch of the DIFC Wills and Probate Registry. She was heavily involved and mainly responsible for the drafting of the WPR Rules during the period of a year, along with specialist legal practitioners abroad and with the support of the legal community in Dubai. She currently oversees the Registry as Senior Manager.

Victoria BeaumonPrivate Client SolicitorVictoria is a proficient Private Client Solicitor, admitted to The Law Society of England and Wales in 2009. She received a BA in Law and Business Studies from the University of Warwick UK, and completed the Legal Practice Course at BPP Professional Education in Leeds, UK. She is also a member of the Society of Trust and Estate Practitioners.

Victoria worked with TWS Legal Consultants, a leading Dubai based Private Client firm specializing in Wills and Probate services, and frequently advised clients of varying nationalities on the distribution of their assets situated in Dubai in accordance with both Sharia and DIFC WPR laws. During these two years, she was also an active member of the legal working group committed to establishing the DIFC WPR Rules.

In the UK, Victoria trained and practiced with the Private Client team at Gordons LLP, an award winning UK Commercial law firm, for over five years and specialized in advising clients on succession planning and inheritance tax issues, often involving multi-jurisdictional matters. Victoria drafted Wills for some of the wealthiest individuals in the North of England and developed specialist advice services to families with vulnerable beneficiaries and individuals suffering from mental capacity issues. She also provided tailored succession advice to the elderly and infirm, in particular end of life tax planning and prepared several urgent death bed Wills.

Victoria is a proficient Private Client Solicitor, admitted to The Law Society of England and Wales in 2009. She received a BA in Law and Business Studies from the University of Warwick UK, and completed the Legal Practice Course at BPP Professional Education in Leeds, UK. She is also a member of the Society of Trust and Estate Practitioners.

DIFC INTRODUCTION TO LAWS FOR 2016In association with Lexis Nexis, the DIFC Dispute Resolution Authority’s (DRA) Academy of Law has developed the Introduction to DIFC Laws Certificate. This programme has been specifically designed to meet the needs of today’s Emirati and expatriate lawyers, legal advisors and consultants, seeking to gain a better understanding of and develop their familiarity with DIFC laws.

This certificate is unique and forms part of Sheikh Maktoum Bin Mohammed Al Maktoum Initiatives for Legal Excellence, and it will be taught in collaboration with leading common law practitioners in the DIFC. The ‘Introduction to DIFC Laws’ Certificate comprise of 8 distinct courses which are presented in English. Participants may select to attend the certificate in its entirety or specific courses on an elective basis.

WHO SHOULD ATTEND THE COURSES?This certificate is ideal for Emirati and expatriate lawyers, legal advisors and consultants, in addition to civil and common law practitioners, who seek a better understanding of the laws of the DIFC.

COURSE CERTIFICATIONShould one elect to complete the entire certificate, at the end of the programme, you will be issued with an ‘Introduction to DIFC Laws’ certificate by the Academy of Law and LexisNexis. Each 2-hourcourse within the programme entitles the attendee to 2 Continuing Legal Professional Development (CLPD) points with the Government of Dubai Legal Affairs Department (LAD). Competition of the entire certificate would qualify for the full 8 hours non mandatory training.

Alternatively, one may also elect to enrol for selected courses from the certificate programme. It is not compulsory to enrol for the entire set of courses upon registration. It is also not required to enrol for all the courses one intends on taking at once. Bookings may be made through LexisNexis on an ad hoc basis.

DIFC COURTS’ PROCEDURES INTRODUCITONIn association with Lexis Nexis, the DIFC Dispute Resolution Authority’s (DRA) Academy of Law has developed the Introduction to DIFC Courts’ Procedures Certificate. This programme has been specifically designed to meet the needs of today’s Emirati and expatriate lawyers, legal advisors and consultants, seeking to gain a better understanding of and developing their familiarity with DIFC Courts’ procedures.

This certificate is unique and forms part of Sheikh Maktoum Bin Mohammed Al Maktoum Initiatives for Legal Excellence, and it will be taught in collaboration with leading common law practitioners in the DIFC. It comprises of 12 distinct courses which participants may select to attend in its entirety or on an elective basis.

WHO SHOULD ATTEND THE COURSES?This certificate is ideal for Emirati and expatriate lawyers, legal advisors and consultants, in addition to civil and common law practitioners, who seek a better understanding of the procedures of the DIFC Courts.

COURSE CERTIFICATIONShould one elect to complete the entire certificate, at the end of the programme, you will be issued with an ‘Introduction to DIFC Courts’ Procedures’ certificate by the Academy of Law and LexisNexis. Each 2-hour course within the programme entitles the attendee to 2 Continuing Legal Professional Development (CLPD) points with the Government of Dubai Legal Affairs Department (LAD). Competition of the entire certificate would qualify for the full 8 hours non mandatory training.

Alternatively, one may also elect to enroll for selected courses from the certificate programme. It is not compulsory to enroll for the entire set of courses upon registration. It is also not required to enroll for all the courses one intends on taking at once. Bookings may be made through Lexis Nexis on an ad hoc basis.

Cancellation If you are unable to attend, a substitute delegate from the same firm will be very welcome in your place. If this is not suitable, the course must be paid in full. If the date and/or venue of the training course have been agreed and Lexis Nexis wishes either to reschedule or cancel it, Lexis Nexis reserves the right to apply the training fee to the rescheduled training or any future training. In association with Lexis Nexis, the DIFC Dispute Resolution Authority’s (DRA) Academy of Law has developed the

Introduction to DIFC Courts’ Procedures and DIFC Laws 2016 Certificates. These have been specifically designed

to meet the needs of today’s Emirati and expatriate lawyers, legal advisors and consultants, seeking to gain a better

understanding of and developing their familiarity with DIFC Courts’ procedures and Laws.

This certificate is unique and forms part of Sheikh Maktoum Bin Mohammed Al Maktoum Initiatives for Legal

Excellence, and it will be taught in collaboration with leading common law practitioners in the DIFC. Each 2-hour

course within the programme entitles the attendee to 2 Continuing Legal Professional Development (CLPD) points

with the Government of Dubai Legal Affairs Department (LAD). Competition of the entire certificate would qualify for

the full 8 hours non mandatory training.

Participants attending the full certificate courses will receive access to the following additional complimentary
