Development of European/UNECE legislation implementing the WLTP for type approval purposes

Update on Progress and Outstanding Issues

This document provides a summary of the ‘state of play’ of the work to develop the WLTP GTR requirements in a European context and implement into type approval legislation. It draws upon actions and discussions from the AdminWG meetings (face to face and audio/web) that have been held to date. The information provided is split broadly into the following areas:

It was agreed that Béatrice’s proposal to use an average figure for the criteria pollutant emissions in the Certificate of Conformance. Needs to be discussed/agreed at EU WLTP. Outstanding issue. 1 Development of EU WLTP as Annex XXI to implementing regulation of co-decision regulation EU No. 715/2007

The EU WLTP used the WLTP GTR Benchmark (01.02.2014) as the baseline document. As at 17 th July 2014 the EU WLTP has been updated to include all the changes made to the GTR up to 29 th June 2014. These changes can all be considered as updates to the Phase 1a document, rather than new Phase 1b requirements.

The following table provides details on the decisions that have been agreed and the open points that still need further discussions/decisions/technical work. Comments from the GTR are also copied into the table in the relevant sections.

Document formatting. It was agreed at AdminWG meetings that the preferred approach to formatting would be to retain the UNECE formatting rather than convert to EU formatting (e.g. using a comma for a decimal separator). EC legal services have been contacted to confirm whether this approach is acceptable. No definitive response received. Proceed with UNECE format for now. Closed issue.

2 Terminology updates needed (e.g. “gtr”, “responsible authority”)

“Responsible authority” has been replaced with “approval authority”.References to “Contracting parties” have been reviewed and updated on an individual basis, because in many cases they relate to optional requirements – which may not be optional in the EU and therefore need to be deleted. Closed issue.

3 Consider deleting equation numbers as they are not used for any cross-references.

Agreed to leave equation numbers in the document as they are useful to have even if they are not used in text x-refs. For consistency throughout the gtr/Annex, the equations in Annex 8 are also now numbered. Closed issue.

4 Use of “shall” v. “should” Serge Dubuc has circulated (29.06.14) a table that includes all uses of the word “should” in the GTR, with recommendations as to which of these to change to “shall”. Experts have been invited to contribute. Outstanding issue.

5 Reference to ‘reporting’ and ‘recording’ of information.

Serge Dubuc created a table that identified all instances of the word “recorded” in the GTR. TRL reviewed this table and made a preliminary assessment of which instances relate to providing information in the test report and which refer to recording for other purposes (e.g. to feed in to a calculation). This was documented in AdminWG-06.Stephan Redmann and Helge Schmidt agreed to review TRL’s work to provide the definitive answer.In order to provide a clear differentiation between the two categories of usage in the GTR of the term “recorded”, it was proposed that the text should remain as “recorded” where it is for calculation purposes or similar, and changed to “included in the test report” for those other instances. Bill was hoping that the document would be discussed in the GTR IWG meeting in Geneva – but this did not happen.AdminWG 19th June – André Rijnders provided a proposal for an amendment to the definition concerning optional equipment. This aligns with the Mass and Dimension Regulation (EU No. 1230/2012).AdminWG 24th June 2014: Bill’s document and André’s proposed amendment were discussed. Clarity is needed as to what mass should be used in the combined approach. Some issues were identified with Bill’s proposals and he agreed that some of his recommendations relating to mass needed to be reconsidered.Outstanding issue

2 WLTP Implementing RegulationAdminWG 4th February 2014 minutes - There is a general understanding that in EU legislation the WLTP should be applied at least to the Type 1 emission test (Annex III of 692/2008/EC) and the CO2 emission/fuel consumption test (Annex XII). However, there are also other elements, which refer to the test cycle, in particular the sections on evaporative emission tests (Annex VI), durability (Annex VII), low temperature (Annex VIII) and OBD (Annex XI). While it is clear that at a certain moment in time the WLTP should also be mandated for those other parts of emission type approval, this may not be required initially. For example it could be possible to keep on an optional basis the NEDC as a OBD demonstration test cycle during a transition period. Vehicle manufacturers should communicate their ideas in this respect to the Commission.

AdminWG 10th April 2014 – at the AdminWG on 1st April, Klaus Steininger asked for feedback on the preferred process for introducing WLTP into EC regulation. Two options were being considered:

An annex to Regulation 692/2008 (i.e. Annex XXI); or

As a stand-alone second implementing regulation that is cross-referenced from EU 692/2008.

Further discussions were held on these principles (on 10th April), with a third option emerging as potential favourite. This would be to develop a new regulation (xxx/2015) that is a direct copy of 692/2008 but with the WLTP administrative provisions replacing the NEDC ones. There would then be two ‘co-existing’ but not ‘co-habiting’ regulations, one for NEDC and one for WLTP.

AdminWG 29th April 2014 – Bill Coleman provided a presentation with three options for preparing a new regulation xxx/2015. The options were broadly as follows:

Option 1: Regulation xxx/2015 would just contain Annex XXI WLTP; Option 2: Regulation xxx/2015 would be a copy of 692/2008 but with WLTP as a new Annex XXI and

with the content of the equivalent NEDC annexes (Annex III, Annex X and Annex XXI) being deleted; and

Option 3: Regulation xxx/2015 would be a copy of 692/2008 but with WLTP replacing NEDC in Annexes III, X and XII.

Following discussions at this meeting and further discussions at subsequent AdminWG meetings it was agreed that Option 2 was the best approach in terms of simplicity and efficiency. At the AdminWG on 24 th June 2014 Klaus Steininger gave himself an action to confirm with EC legal services whether this approach was acceptable. Outstanding issue

Article 2 - Definitions Need feedback from EC legal services as to whether ‘competing’ definitions can be included within the regulation (with one confined to Annex XXI). Preferred approach is to have minimal change to Article 2 and most of work confined to Annex XXI.

Advice needed from Commission legal services, via Klaus Steininger.NB: they were contacted in February 2014. A response is awaited.Work on the assumption that a different definition in the Annex over-rides definitions elsewhere.

Annex I: Administrative provisions for EC type-approval

Annex I. Paragraph 1.1.

Requirements for mono fuel gas vehicles, bi-fuel gas vehicles and flex fuel H2NG vehicles.

Need to confirm whether the 80% value in the Bi-fuel: gas 80% energy in Type 1 test remains correct for WLTC.

The Netherlands will be discussing whether the 80% value in the Bi-fuel: gas 80% energy in Type 1 test remains correct for WLTC at GFV on 3rd April 2014.

Outstanding issue. (NB – this will require new 692/2008 text (as the requirement is currently in R.83 but not 692/2008))

Flex fuel H2NG vehicles are to be removed from R.83 (based on OICA proposal at 68th GRPE) – but will stay in 692/2008.

Annex I. Paragraph 3.

Extensions to Type-Approvals

[Lots of points of discussion for this section. See AdminWG-03 v8 for details]

The ‘combined approach’ does not match with the extension criteria.

There is a need to come up with a holistic way forward that covers COP, ISC, best case, worst case, family concept etc.

At the AdminWG (1st April 2014) Bill Coleman presented a draft of a process schematic identifying the implications for type approval, COP and ISC of incorporating WLTP into EC Regulation. This was loaded onto Circabc as AdminWG-11, with a request for comments. It was noted that discussions would be held at the ACEA emissions group (w/c 7th April) and that an ACEA expert group would need to be set up to develop proposals.

6 European certification issues

6.1 HEV Utility Factors

Following on from the discussions held at EU WLTP in 2013 & 2014, a first proposal for text to incorporate the HEV UF into the EU WLTP was provided by BMW on 11th April 2014. Further discussions and decisions that followed at subsequent EU WLTP meetings resulted in a revised UF curve being selected for incorporation into the EU WLTP. Based on this amended curve revised text was provided by BMW on 18 th June 2014. This was incorporated into Appendix 5 to Sub-Annex 8. Outstanding issue (although nearly complete)

6.2 Ambient Temperature Correction Test (ATCT)

BMW/Audi/PSA and others have developed a supplemental test for the determination of CO 2 emissions under regional temperature conditions. This test is undertaken at 14 oC.

At the AdminWG meeting on 1st April 2014 it was agreed that a working group should be set up to introduce the supplemental test developed into the EU WLTP. The working group was comprised of Andreas Eder, Laura Bigi, Stephan Redmann, Iddo Riemersma, Klaus Steininger, Helge Schmidt, Markus Bergmann and Rob Gardner, with other industry experts being brought in where required.

The original text, developed by BMW/Audi in November 2013, was updated during a series of working group audio/web meetings and finalised on 11th June 2014. The finalised test requirements were presented to the EU WLTP meeting on 24th June 2014, with the finalised text for the technical elements being agreed at the AdminWG that followed on the same day.

Some introductory text is still required and text is also needed to provide details on the FCF documentation requirements. There is also a possibility that there may be some change relating to the engine compartment insulation / vehicle family relationship. Outstanding issue (although nearly complete)

6.3 Test Cycle Flexibilities

The introduction of corrections for test cycle flexibilities is an EU requirement for the introduction of the WLTP. This has been a topic at EU WLTP meetings, with work being undertaken by TNO (on coast-down corrections) and TUG (on chassis dynamometer corrections). The work initially considered a relatively large number of potential flexibilities, however following the presentation of initial findings at the EU WLTP meeting in February 2014 it became clear that just a limited number of cycle flexibilities investigated in the study will finally be corrected, because the others do not have a very strong impact on the final CO2 emission value.

A draft of the TNO/TUG report “Correction algorithms for WLTP chassis dynamometer and coast-down testing” was circulated via the EU WLTP and WLTP GTR channels in May 2014, with requests for feedback to be provided.

Whilst the cycle flexibilities are primarily being developed for introduction into the EU WLTP, both Japan and India registered an interest in also including the flexibilities into the GTR - at the GTR IWG meeting in Geneva, June 2014. A task force has been set up to work on the details of the flexibilities to be included in the EU WLTP and possibly also the GTR. The first audio/web meeting of this task force was held on July 16th 2014 with a follow-up meeting planned for early August.

At the AdminWG 10th April 2014 it was agreed that the best approach for introducing test cycle flexibilities into the WLTP (most ‘user-friendly’ for those using the WLTP) would be to integrate them into the relevant sections/paragraphs, rather than to include them in a separate Annex with associated cross-references. This approach will therefore be used as the basis for the ongoing work. If the flexibilities are also to be incorporated into the GTR there will need to be close working between Rob Gardner (EU WLTP) and Serge Dubuc (GTR) to agree and implement a consistent approach to introducing new text. 7 Other related pointsa. AdminWG 1st April: Germany (Stefan Redmann) introduced a BASt study on CoP evolution coefficient (March 2014) – this is a research project to check if new passenger cars (still) show mileage-dependent changes with regard to the emissions of CO2 after the first 15,000km. Results can be used to determine whether a fixed evolution coefficient of 0.92 is still appropriate – for 692/2008 Annex 1 para 4.3.4.5. and also Regulation No. 101 para 9.3.1.1.2.3. The results from this study won’t be available until quite late on in the transposition process. They will feed into a fixed evolution coefficient. A request was made for ACEA to provide some of their data to feed into the process. Outstanding issue

b. AdminWG 10th April: Criteria pollutant emission flexibility - André Rijnders pointed out that there is still the possibility in WLTP to only take the test mass high vehicle and not to use the interpolation between test mass low and test mass high. In such cases there is the potential for vehicles with higher criteria pollution emissions than the test vehicle to be approved. A solution is required to overcome this issue.

Action from 10th April: Klaus Steininger requested for ACEA (via Bill Coleman) to provide a proposal for limits in terms of vehicle parameters (road loads and test masses) that would define criteria pollutant emission vehicle families in case the manufacturer chooses to test only the "worst CO2 emission case" vehicle in the combined approach. Update from AdminWG 24th June: Bill mentioned that this would only apply to small volume manufacturers and is in affect a ‘dead issue’. Closed issue.

c. AdminWG 29th April – Bill Coleman raised the point that there is a need to review type approval certification requirements / procedures.

Related e-mail from Stephan Redmann (25th April 2014): “A general remark: we are still facing the problem that the test reports are not harmonized and usually not electronically available. So, the information needed for subsequent testing (or other justified purposes) will be in principle available, but in practice not easily be derived. We already saw these problems several times in the past, e.g. when KBA was requested to provide RLD data.

During our discussions today an idea came up by Bill Coleman, which seems to be a very good solution. Instead of harmonizing the test reports or shifting all the needed information to a higher document level (information document or CoC), we may invent a new harmonized document in future. Such a “test information document” could summarize all relevant information which is needed for subsequent testing and can be provided easily by the type approval authority on request.”

d. AdminWG 20th May – having two implementing regulations could cause some issues for type approval numbering. The number uses 715/2007 + the latest amendment. Any change that needs to be made to both 692/2008 and xxx/2015 would need to be made with two separate regulations in order that the NEDC and WLTP type approval numbers are not the same. e. AdminWG 28th May – André Rijnders mentioned that the default running resistances table was discussed in Munich - looking to update the information to correct the table values from the worst case to the mean. This could be just a EU issue or it could also apply to GTR. Administrative elements will be affected and it would ‘overrule’ default running mass in Euro 6 procedure. André will start the ball rolling with this work, probably via a proposal to the GTR group. Outstanding issue. Phase 1b.

f. AdminWG 19th June 2014 and AdminWG 24th June 2014: Following initial discussions on 19th June, Béatrice Lopez provided a presentation at the 24th June face-to-face meeting on the number of tests for criteria pollutant emissions – linked to the presentation by Markus Bergmann at the GTR IWG#7 in Geneva. Presentation provided by Béatrice (“UTAC_Number of tests Results) criteria pollutant emissions”). It was agreed that Béatrice’s proposal to use an average figure for the criteria pollutant emissions in the Certificate of Conformance. Needs to be discussed/agreed at EU WLTP. Outstanding issue. 8 Introduction into UNECE RegulationAn update on the status of the work to prepare the EU WLTP regulation was presented to the 69 th GRPE in June 2014 - as Informal document GRPE-69-17. The presentation provided some background to the work, introduced the approach that was being adopted and outlined the main outstanding issues.

The latest draft of the EU WLTP (Annex XXI) was provided to the GRPE for reference – as Informal document GRPE-69-16.

At the 69th GRPE in June 2014, prompted by a question from OICA the GRPE participants, including the UNECE secretariat, considered how the EU WLTP could be carried forward into UNECE legislation. The GRPE chair (Christoph Albus) requested that discussions should be had prior to the GRPE in January 2015 to decide how to progress.

At the AdminWG on 24th June Klaus Steininger informed the meeting that he has contacted UNECE colleagues in Geneva with regard to this issue but had yet to receive a response. It was agreed that we need to prepare a proposal for the January 2015 GRPE in order to inform the other Contracting parties of the approach that is to be used. Outstanding issue
