The Commission meeting was officially called to order by Chair Don Simmons Ph.D. at 7:16PM, following the presentation by Raben Bora, Landscape architect, on the gardens of Thomas ('Tommy'J Church.

B. Review and Adopt Amendments to the Historic Presetvation Commission By-Laws

Karana Hattersley-Drayton pointed out several issues in the draft amended by-laws (which were previously presented for review at the September meeting). The agenda and staff reports will now be posted ideally by the Wednesday prior to the Commission meeting (Section 8-b). The "Matters Not on Posted Agenda" refers to extraordinary circumstances only, such as an emergency demolition when an item cannot be continued until the next meeting. Section 14 (New Matter) definitely makes it inappropriate for either commissioners or the public to present documents during the meeting and then take action. One would have to present the materials two working days before the HPC or continue the item for another month. Ms. Drayton also brought up the issue of "three unexcused absence." (Article 5, Section 4). How is "unexcused" defined? She also noted that the City Attorney's Office has provided a basic resolution, should the Commission decide to adopt the amended by-laws tonight.

Don Simmons asked whether the HPC would switch to the Rosenberg Rules of Order from the Roberts.

Karana Hattersley-Drayton: Yes, Rosenberg's are incorporated as referenced in the amended By-Laws and are much more straight-forward and easy to use.

There were no other questions from the Commission and no comments from the public. On a vote of 5-0 the amended by-Jaws were adopted, with motion by Molly LM Smith and second by Robin Goldbeck.

C. Review and Provide Comments on Conceptual Plans for the Future Relocation of the Van Ness Gate Entrance (HP# 082) Located at 2208 S. Van Ness Avenue Due to Potential Impacts from High Speed Rail Pursuant to FMC 12-1606 (b)(5)(6).

Karana Hattersley-Drayton gave a power point with a brief history of the Van Ness Gate Entrance citing the reason for the potential relocation, due to a proposed cul-de-sac at the southern terminus of Van Ness Avenue as a consequence of the High Speed Rail corridor. Elliot Balch (Downtown Manager) followed with additional slides which showed the current location and the span of the arch; its potential relocation to another site on Van Ness Avenue (where it would fit, with some adjustment), a site on Fresno Street (where it would not fit) and finally a location at the top of Fulton Mall/Street (Tuolumne and Fulton). Commissioner Woolf: Observed that the arch will need to be taken apart anyway so adding a piece, if that is needed for a specific location. will not be an issue.

Bill Robinson: Asked whether this would work in the Fulton Mall project? (Answer from Mr. Balch is yes.)

Commissioner Woolf: Commented that the Fulton Mall location was beautiful.

Chair Simmons called upon Sally Caglia, whose father Frank restored the sign in 1989-90, to comment on her thoughts for a new location.

Sally Cag/ia: The current sign was constructed in 1929. She feels that the Fulton Street/Mall location fits architecturally with the adjacent buildings of the Warnor's Theater and the San Joaquin Light and Power Company. Reminded the Commissioners that the Tuolumne Street overpass will go away and thus this will be an even more marked entrance into downtown Fresno. Remarked how much her father loved Fresno.

Don Simmons: Asked if there was any reason to not keep it in its current location at the foot of Van Ness?

Sally Caglia: There will be a 12-foot fence there and the sign would not be easily seen. She would also warty about vibrations from the passing train. She is personally not concerned about the loss of the sign on Van Ness; thinks if moved to another street there could be a plaque explaining the reason for the new location.

Elliot Balch: In terms of place making the arch is nicely framed at the Fulton Mall/Street location.

Molly LM Smith: Agrees that the Fulton Street location is the logical entrance to downtown, would provide an anchor and would announce downtown Fresno. The sign would not have to be altered to fit there, something she could not support.

Lisa Woolf: Sign could be changed to say "downtown."

Molly LM Smith: Likes idea of adding a plaque that identifies the former location.

Robin Goldbeck: The location at the entrance to the Fulton Mall (or Street) would add a "there, there," a place to gather: "Meet me at the arch."

Patrick Boyd: Prefers to see the sign visible from the highway, a reason to draw people off the freeway into the City. It is important to have branding. Sign could work well anywhere downtown, suggests that other gateway locations be reviewed as well. If it was placed at the Fulton Mall would need to change out and replace some of the light posts and other ''goofy stuff' that is currently at this site.

Elliot Balch: Noted that Tuolumne and H will be an intersection.

Patrick Boyd: Another potentia/location is that the arch could serve as the entrance point to the High Speed Rail Station to downtown. In that case it would be a pedestrian entrance; one could see if from the train. It would convey Fresno's respect for histoty.

Don Simmons: Also favors the relocation to the Mariposa entrance of the High Speed Rail station. One could therefore walk by the sign, not just drive by. /tis important to be able to read the sign. Put it in a place that is pedestrian friendly, and which also can serve as a place maker and photo option for weddings.

The agenda item was opened to the public for comment by Chair Simmons.

Patricia Rodriguez (Fresno State Humanics Student) spoke to the importance of catching visitors, and stressed the importance of our histoty and culture. She likes the Fulton Mal/location.

Greta Chase (?): If the sign was moved to be near the station, would we have a say about landscaping (concern apparently about current parking lots there).

Elliot Balch: Noted that ideally need to remove parking lots at both Mariposa and Fulton Mal/locations.

The agenda item was closed to the public.

VII. CHAIRPERSON'S REPORT

A. Discuss Commission's FY 2013 Annual Report to the Council.

Chair Simmons encouraged the Commissioners to send him any additional activities they had attended or extracurricular duties to include in the annual report. [Since the HPC is required to visit sites prior to a vote

Ms. Drayton discouraged listing these visits in the document.] Dr. Simmons requested that Karana send him any photos or additional information.

B. Update on Meetings of the Fulton Mall Design Steering Committee.

Chair Simmons is a member of the Fulton Mall Design Steering Committee, which has met numerous times with the City's consultants who are tasked with designing the three options for the Fulton Mall. Dr. Simmons stated that there have been open discussions about all three alternatives, and that there is no one favorite, with pros and cons for each. There is no perfect alternative. He voiced a concern that staff of the Downtown Partnership has taken a strong anti-preservationist stance, with negative comments on Facebook. He feels that these are not helpful and that preservationists have been made to look anti­progress and anti-downtown, which is not the case. He stressed that this is not a healthy conversation and also was concerned that there had been no consultation with the 1-fistoric Preservation Commission as a whole.

VIII. UNSCHEDULED ITEMS

A. Members of the Commission

1. Sub-Committee Report on the Craycraft Home (HP#182). Lisa Woolf recused herself from this agenda item and left the room, as she is potentially interested in buying the Craycraft.

Molly LM Smith reported for the sub-committee as Jason Hatwig is out of town. The property owner allowed for Ms. Woolf, her engineer and others, including Mr. Hatwig, engineering staff from Fresno State University and Scott Vincent, architect, to tour the site on Wednesday the 2:fd. Jason prepared a report that was not forwarded yet to the Commission as the hope was to have additional comments from Scott Vincent added to it. There were varying perspectives, with the San Francisco-based engineer rather discouraging and Mr. Vincent, who recently took the lead on the restoration of the Helm Home, very upbeat. Jason Hatwig had reported on the potential use of the epoxy solution for the inner walls, however he also noted that the psi on the bricks is VERY high, and there is no evidence of stress on the outer walls ... in short, although the building has issues it appears to be structurally quite strong. Karana Hattersley-Drayton recommended that the sub-committee incorporate Mr. Vincent's observations into a more thorough report for the next meeting.

Molly Smith stated that she will be out-of-town and not present at the November meeting.

B. Staff

1. After Action Report on "Raise the Roof lor the King of Western Swing" October 26111•

Karana Hattersley-Drayton reported that the fundraiser at AP Cal was musically a very successful event, with attendance by both Carolyn Wills (daughter of Bob Wills) and a performance by Dayna Wills, his niece. There were two separate pedal steel players and at one time, three fiddlers on stage. The venue was a/so very nice BUT the attendance was poor, unfortunately.

2. Bike Through History 2 November 2013. Karana reminded the Commissioners that Bike Through History is this next Saturday, with a tour through three historic neighborhoods. We still need a couple of volunteers to help.

3. Fulton Mall Notice of Preparation Scoping Meeting 5 November 5-8 PM (Council Chambers).

Ms. Hattersley-Drayton announced that the Scoping Meeting for the Fulton Mall EIR is next week. 4. Status Report on Preparation of Survey Forms for the Proposed Huntington Blvd. Historic

Karana reported that she recently finished the survey work for the south side of Huntington Blvd. and still needs to finish the write-up of some of the survey forms for these properties. Work on this vel)! extensive District is thus 40% complete.

SUBJECT: REVIEW AND MAKE FINDINGS ON NON-PERMITTED WORK TO THE LIBERTY LAUNDRY (HP#262) LOCATED AT 1830 INYO STREET PURSUANT TO FMC 12-1617, 12-1626 AND 12-1628.

RECOMMENDATION

Staff recommends that the Commission find that the property owner is in violation of FMC 12-1617. Pursuant to FMC 12-1628 staff additionally recommends that the Commission require that the now demolished cantilevered awning and sign be replaced in kind.

EXECUTIVE SUMMARY

Over the weekend of November 16th and 1 ih, the property owner removed without permit the metal cantilevered awning at the Liberty Laundry (HP#262). The awning was a character-defining feature of this one story brick commercial building which was constructed in 1928 as the Liberty Laundry. The awning was initially supported only by tie rods, however as early as 2006, due in part to water intrusion through the roof membrane, the canopy was pulling away from the veneer brick factade and Code Enforcement issued a Notice of Violation to the prior property owner. A "Notice to New Owner Regarding Existing Notice of Violation" was sent by certified mail to the new property owners, Lawrence and Jessie Clark on August 28, 2013. According to Mr. Clark he ordered his staff to tear off the awning when further structural failure was apparent due to concerns about public safety. The metal awning with its hand lettered signage was not kept, unfortunately, and no permit was pulled and no notification of this action was given to the City. Community Revitalization staff noticed the missing awning and reported it on November 19th. On November 20th code and preservation staff met with the property owner and architect on site. The property owner had previously submitted a site plan (Agenda Item VI. B) showing the factade of the Liberty Laundry without the awning and with other architectural and cosmetic changes as well.

Pursuant to FMC 12-1617 it is "unlawful for any person . . . to directly or indirectly alter, remodel, demolish, grade, remove, construct, reconstruct or restore any Historic Resource without first obtaining a city permit and the written approval of the Historic Preservation Commission." Furthermore, FMC 12-1628 provides that a property owner may be fined up to $10,000 for a violation of the Ordinance and "may be required to reasonably restore the building, structure, object or site to its appearance or condition prior to the violation, under the guidance of the Development Department."

Staff recommends that the Commission find that the property owner is in violation of the Historic Preservation Ordinance (FMC 12-1617) and be required to present plans, with a reasonable time table, for a facade awning that replicates the look and character of the original (FMC 12-1 628). Staff does not recommend additional fines at this time.

HPC Staff Report, Liberty Laundry Awning December 16, 2013

BACKGROUND

The brick masonry building located at 1830 lnyo Street was constructed in 1928 as a commercial laundry, the Liberty Laundry, for Rollin Pickford and his brother, William 0. Pickford. Although engaged in the laundry business throughout his professional career, Rollin Pickford is better known for his role in Fresno's artistic community and as a leading exponent of the California Plein Aire School (Exhibit A). The building was found eligible to the Local Register of Historic Resources in the 1994 Ratkovich Plan survey. Consultants for the South Stadium Project concurred with this 1994 evaluation in their 2007 historic survey of the area. The building was designated by the Fresno City Council to the Local Register of Historic Resources on September 23, 2008, under Criteria i and iii due to its association with Rollin A. Pickford (Criterion i) and as an excellent example of a commercial building type once prevalent in early 2011

' century Fresno (Criterion iii).

One character defining feature of this building was the flat metal canopy on the fac;:ade which cantilevered out over the sidewalk and which spelled out "Liberty Laundry" on a painted fascia board. As early as 2006 Code Enforcement found that the sign was structurally deficient (Exhibit B) and recommended that it be repaired, with additional supports and plans submitted to the Department. In 2008 Preservation staff and Commissioners Molly LM Smith and Michelle Randall visited the site and provided advice to the property owner, fire department officials and building staff as to how best to rectify the sag in the awning which was caused by water intrusion from the roof membrane. In 2010 the former property owner installed temporary 4x4 inch wood posts to provide additional support to the awning.

On January 4, 2013 the current owner, Lawrence Clark, met with Downtown and Historic Preservation staff to discuss his interest in purchasing the building and his concept for a redesign of the fac;:ade. At that meeting staff reminded Mr. Clark that the building was a historical resource and noted the benefits from historic status, thus federal historic tax credits and application of the California Historical Building Code. Additionally, staff explained the protocols for historic properties regarding fix and repair and/or replacement in kind for architectural elements on principle elevations. On August 28, 2013 Community Revitalization staff notified the owners by certified mail of the ongoing code violations (Exhibit B) and on November 161

h the awning was removed, without permit.

Public safety is critical; however, the property owner could have provided additional 4x4 supports as an interim measure. Additionally, once removed the awning sign should have been stored rather than discarded. Staff recommends that the Commission require that the property owner prepare and present plans, with a reasonable time table, for a new facade awning that replicates the look and character of the original.

Built in 1928, 1830 lnyo Street is a one-story, brick masonry commercial building, designed in the 201

h Century Commercial style. The rectangular-plan building is clad in brown facing brick on its front facade and has a truss roof with a gable-roofed monitor at the center. The roof is covered with built-up composition roofing material. The foundation is not visible from the street. The northwest-facing, primary facade consists of four bays. The storefront windows in each bay are located relatively high in the wall and have been boarded up with plywood. Entries are located in the end bays and have also been boarded up. A broad, flat metal canopy projects from the front facade and is supported by tie rods that attach to the upper wall. It has a paneled fascia, which bears faded signage, with decorative blocks at each corner. Above the canopy, a band of aluminum frame clerestory windows spans each bay. The upper wall and parapet are adorned with inset panels in the brickwork. The parapet is stepped and capped with a brick copping. The northeast facade has a single bay, articulated like those on the front facade, at the northwest end. The windows in this bay have been boarded up. A continuous panel of vertical groove plywood extends down the remaining length of the facade and may cover additional windows. (cont.)

1830 lnyo Street was constructed in 1928 for use as a light industrial building. The building was designed by contractors Yarnell & Garges. Little is known about James Yarnell. Homer Garges was known to have been a residential builder in Fresno for many years. In 1926, he designed and constructed a home for Rollin A. Pickford, one of the original owners of the subject building. Perhaps better known for his artistic endeavors, Rollin Pickford was a highly regarded regional watercolorist, considered to be of the California Plein Aire school and known for his Central Valley and Monterey Peninsula subject matter. His introduction to the laundry business came from his family at a young age. Though he continued to be involved with the industry throughout his working life, his primary career was as an artist. The Liberty Laundry was the first business located in the subject building and was owned by Rollin Pickfor and his brother, William 0. Pickford. The Pickfords owned other laundries in the area, including the Kohler Steam Laundry, Union Laundry, and the Fresno Steam Laundry. The Pickford laundry enterprise was started around 1920 with the purchase of the Kohler Steam Laundry from the brothers' aunt, Lottie Kohler. The Union Laundry was purchased in 1926 and the Liberty Laundry in 1928. The purchase of the business was the impetuous for the construction of the building at 1830 lnyo Street, which was adjacent to the site of the Kohler Laundry plant. The last addition to the Pickford's laundry conglomerate was the Fresno Steam Laundry in 1937. The Liberty Laundry plant functioned as a wholesale commercial cleaning business, specializing in towels, uniforms, and aprons for the hospitality and automotive industries. (continued)

The Liberty Laundry functioned in this capacity until it and the other Pickford holdings were purchased by the Los Angeles-based Crescent Towel and Linen Supply Company in 1944. Liberty Laundry continued to operate under this new ownership until 1964. The building then functioned as a furniture warehouse for many years and may continue to do so today.

Prior to the construction of the current building, the lot contained a small stable or garage building. With the steady growth experienced in the City of Fresno in the early 1900s, the South of Stadium Survey Area (Central Business District) gradually changed from a residential area to a commercial area. As early as 1918, Broadway Street had entirely transformed from residential to commercial use, while H Street continued to be dominated by industrial uses, including four major facilities for laundry, auto repair, foundry and machine works, and bottling and soda manufacturing. By 1948, the area was entirely commercial and industrial.

1830 lnyo Street maintains integrity of location, setting, and feeling; surrounded by other commercial and industrial properties on the margin between the commercial area along Broadway and the industrial area along H Street. The building has diminished integrity of association, however; as it is no longer used in its original capacity. Its integrity of materials, workmanship and design appear to be good, with no obvious alterations and the strong possibility that original windows and doors still remain within the boarded up openings. Any other changes that have been made are small and are generally in keeping with the types of changes many commercial buildings experience throughout years of use. The building generally retains its original appearance, as well as its ability to convey its age and use.

1830 lnyo Street is was deemed locally significant by the 1994 Ratkovich Study and though never formally listed, was said to be eligible for the Local Register of Historic Resources for the City of Fresno due to its architectural and social significance. It is said to be one of the few remaining early 201

h century commercial buildings in Fresno and is also associated with a prominent family important in local business history. Though the building does not appear to be eligible for the National or California Register, its eligibility for local designation is valid.

This property was not fully assessed for its potential to yield information important in prehistory or history, per NatiOnal Register Criterion D.

It has come to the attention of the Conununity Revitalization Division that you are the new owner of the subject property. The purpose of this letter is to bring to your attention the ongoing Code Enforcement action related to this property. On August 25, 2006, the Connnunity Revitalization Division issued a Notice ofViolation to Repair or Demolish Dangerous Building to the previous owner.

Enclosed is a copy of the original Notice of Violation. As the new owner, you are responsible for correcting all violations within the time frames identified in the Notice ofViolation. Beginning from the date of this Notice, you will be allowed the same period of time listed in the Notice of Violation. If you fail to correct the violations within the time specified in this Notice ofViolation, City staff may take action to pennanently correct the violations. If the building official has determined that it is economically unfeasible to repair the building(s), the City will proceed to demolish the building(s) at the owner's expense. The following options are also available to staff: issuance of administmtive citations with penalties connnencing at $200 per violation and initiating legal action.

A fee of$100 per hour is being charged for the enforcement services required to correct the violations on your property. This fee includes inspections of the property, and administrative time used by staff to resolve this matter. These charges are in addition to any required permits or related fees necessary to correct the violation.

NOTICE TO TAXPAYERS: Pursuant to the provisions of Sections 17274 and 24436.5 of the California Revenue and Taxation Code, the owner may lose certain deductions for interest, taxes, depreciation and/or amortization attributable to rental income derived from substandard housing.

RECOMMENDATION

Staff recommends that the Historic Preservation Commission review and make findings on the proposed renovations to Historic Property #262, the Liberty Laundry, as part of Site Plan Application S-13-061. Staff further recommends that the Commission approve all proposed renovations to the Laundry which are in compliance with the Secretary of the Interior's Standards for the Treatment of Historic Properties and find that the project is Categorically Exempt under the California Environmental Quality Act Class 31 (15331) and Class 32 (15332).

EXECUTIVE SUMMARY

The property owner, Lawrence Clark, has submitted a site plan application (S-13-061) for three parcels located at the southwest corner of lnyo Street and Broadway Street in Fresno. One of the parcels is vacant and will be upgraded and landscaped as parking for the two buildings adjacent to it, addressed as 1830 lnyo Street and 745 Broadway Street. The Liberty Laundry on 1830 lnyo is a designated historic resource (HP#262) and is thus conditioned by the City's Historic Preservation Ordinance which provides that the Commission must review and approve all building permits (FMC 12-1617). The Ordinance further stipulates that the proposed work to a historic resource must be consistent with the Secretary of the Interior's Standards. Projects which are consistent with the Standards are categorically exempt under the California Environmental Quality Act Class 31 (15331 ). The overall project also qualifies for a Class 32 (15332) exemption for In-Fill Development Projects.

BACKGROUND

Lawrence Clark (Clark Brothers, Inc.) has filed a Site Plan Application for three parcels located at the southwest corner of lnyo and Broadway Streets. Mr. Clark proposes to landscape and upgrade the vacant parcel at the corner to provide parking for the two adjacent buildings. The building located at 7 45 Broadway Street is a one-story masonry brick commercial building which was constructed in 1920. The first occupant was Payne and Clanton Auto Repair. Although the fa9ade originally had a nice Mission Revival flare to the cornice the patterned brick parapet was refaced with stucco around 1963. The building was included in the 2007 South Stadium project historic survey and was found to be ineligible to the Local, State and National Registers with concurrence from the City's Historic Preservation Commission. Therefore any fa9ade improvements to this building, as part of the project, are not under the purview of the Commission (Exhibit B).

Liberty Laundry, however, is a designated historic resource (HP#262). The one-story brick masonry building was constructed in 1928 as a commercial laundry for Rollin Pickford and his brother, William 0. Pickford. Although engaged in the laundry business throughout his professional career, Rollin Pickford is better known for his role in Fresno's artistic community and as a leading exponent of the California Plein A ire School (Exhibit C). The fa9ade has a stepped parapet and is faced with a brown veneer brick, similar to the brick used on the Carmel Saddlery on Broadway. The truss roof has a gable-roofed monitor with steel sash clerestory windows. A character defining feature of the building was a flat metal canopy on the faQade which cantilevered out over the sidewalk and which spelled out "Liberty Laundry" on a painted fascia board. This awning was removed without permit on November 16111 and is more fully discussed in agenda item VI A.

Liberty Laundry was found eligible to the Local Register of Historic Resources in the 1994 Ratkovich Plan survey. Consultants for the South Stadium Project concurred with this 1994 evaluation in their 2007 historic survey of the area. The building was designated by the Fresno City Council to the Local Register of Historic Resources on September 23, 2008, under Criteria i and iii due to its association with Rollin A. Pickford (Criterion i) and as an excellent example of a commercial building type once prevalent in early 2011

' century Fresno (Criterion iii).

The purpose of the Site Plan Application is to better integrate the three parcels, provide parking and to upgrade the facades of both buildings and the interior of Liberty Laundry. The proposed renovations to the Liberty Laundry are as follows:

• Reconfigure the sidewalk to provide accessible entrances. • Replace the single glazed steel sash windows with a storefront system. • Add pre-finished solid panels (perhaps stamped metal) on the fa9ade adjacent to new doors. • Clean existing brick including "yellow" veneer bricks on fa9ade and re-point grout. • Add a decorative foam corbel to the lnyo Street fa9ade and remove/demolish the existing metal

awning (which occurred without permit on November 16111).

• Provide new clerestory dual-glaze windows to replace existing single-glazed steel sash. • Add stucco foarn trim on a furred parapet element. lnyo elevation. • Provide two new storefront doors to the lnyo Street fa9ade. • lnfill windows on the west elevation (due to energy concerns) and add "Green walls" to the east

elevation next to the new parking lot.

FMC 12-1617 and the Secretary of the Interior's Standards:

As a designated historic building any changes or modifications to the Liberty Laundry must "be consistent with ... the Secretary of Interior's Standards" and not be detrimental "to the special historical, architectural or aesthetic interest or value of the Historic Resource." (FMC 12-1617 (h)(1). As a reminder, the Standards "are neither technical nor prescriptive, but are intended to promote responsible preservation practices that help protect our Nation's irreplaceable cultural resources. .. . they cannot, in and of themselves, be used to make essential decisions about which features of the historic building should be saved and which can be changed" (Introduction to Standards and Guidelines.). A general rule of thumb, however, as applied to Fresno's historic resources is to take great care with the principle elevations of a building---particularly with regards to character defining features--- but to generally allow changes to the interior.

The Standards include four treatment approaches: Preservation, Rehabilitation, Restoration and Reconstruction. Based on meetings with the applicant and the attached drawings, the Site Plan Review which includes the Liberty Laundry best fits within the Rehabilitation Protocol which is defined as '1he act or process of making possible a compatible use for a property through repair, alterations, and additions while preserving those portions or features which convey its historical, cultural, or architectural values." "Of the four treatments, only Rehabilitation includes an opportunity to make possible an efficient contemporary use through alterations or additions."

The property owner has expressed architectural respect for the Liberty Laundry through retention of the clerestory (monitor roof) and the wood truss system, cleaning and re-pointing the brick as needed, replacement of windows with energy efficient assemblages that match the style of the original, and retention and reconstruction of whole panels of the original steel sash windows on the east elevation. The addition of the green wall on this elevation is also, frankly, cool.

However, some of the proposed lnyo Street fa<;ade chan~es are not consistent with the Standards, would destroy character defining features of this early 201 century commercial structure and would, additionally, not allow for a Categorical Exemption under the California Environmental Quality Act. In particular:

• Removal of the metal cantilevered awning, as addressed in Agenda Item VI.A. The applicant will need to replicate this awning, which was a major character-defining feature of the building. Plans for the awning will need to be reviewed and approved by the City's Historic Preservation Project Manager and as needed by the full Commission. It is important to stress that the final product needs to replicate the character of the original although materials and techniques for the finishing may be more contemporary if needed.

• Changes to the stepped parapet on the principle (lnyo Street) elevation. Thus the new foam trim and furred "parapet element" should not ·be approved as it will create a faux historicism and remove or conceal original fabric, the veneer brick.

CEQA and Section 12-1617 of the Historic Preservation Ordinance:

Section 12-1617 of the Fresno Municipal Code provides guidance and direction to both staff and Commissioners on permits and reviews for designated historic properties. On a regular basis staff invoke Section 12-1617(b) which authorizes the Historic Preservation Specialist (now Project Manager) to approve non-substantial alterations to a Historic Resource. Such alterations include roof repairs and replacement, interior upgrades, and non-intrusive work. Environmental review in accordance with the California Environmental Quality Act (CEQA) is required "for applications or proposals to demolish, grade, remove or substantially alter the Historic Resource" (12-1617(c). If the applicant and the Commission agree that the original character of the lnyo Street fa<;ade must be maintained (as discussed above). then the project appears to be consistent with the Rehabilitation Treatment protocol of the Secretary of Interior's Standards. If so, the project qualifies for a Categorical Exemption Class 31 under CEQA 15331: "Class 31 consists of projects limited to maintenance, repair, stabilization, rehabilitation, restoration, preservation, conservation or reconstruction of historical resources in a manner consistent with the Secretary of the Interior's Standards for the Treatment of Historic Properties .... " (CEQA Guidelines, CELSOC 2006). In addition, Class 32 for In-fill Development Projects also

Should the Commission adopt the staff recommendations for the lnyo fac;ade treatment, the project can be environmentally expedited. If the applicant wishes to appeal these findings to the City Council the project will not qualify for a Categorical Exemption under CEQA and a new Environmental document will be required.

h Century Commercial style,. The rectangular-plan building is clad in smooth stucco on the front fac;ade. It has a shallow gable roof with a shaped parapet at the front. The foundation is not visible from the street. The northeast-facing primary fa~ade consists of three storefront bays. In each of the end bays are two large panes of plate glass in aluminum frames, while the center bay features an aluminum frame assembly consisting of glazed double doors with a thin transom, flanked by wide sidelights. Simple pilasters are located at the each end of the fac;ade. The upper wall and parapet are unadorned, but bear painted signage. The southeast fac;ade abuts a neighboring building and is not visible, but the northwest fac;ade only partially abuts another building and the northeast half is visible. It is unfenestrated, with a painted and partially stuccoed brick surface. The rear of the building is made of red brick with a concrete bond beam spanning the top of the wall and concrete plaster covering portions of the lower wall. It has simple rectangular window openings flanking a garage entrance. The building appears to be in good condition, but its physical integrity is poor.

745 Broadway Street was constructed in 1920 as a light industrial building to house an auto repair shop. The first listed occupant was Payne & Clanton Auto Repair in 1922. D.E. Watrous' auto repair business was also listed at the property that year. In fact, a number of related businesses may have operated from the building, as a newspaper article states that Broadway Auto Wrecking Co., owned by William Jaffe, had been located at 745 Broadway for fifteen years prior to 1933. William Jaffe is indeed listed in city directories from 1926 to 1931 , and was said to deal in tires and auto wrecking. By 1935, the City Vulcanizing Company, which had previously been located across the street at 746 Broadway, was located at the property and remained until1955. During this time, the building was owned by the Richter Brothers who are listed on building permits through 1963. The Richters are also known to have owned a bottling and soda works facility at the southern end of the block as well as the building at 641-651 Broadway Street. The remodeling of the entrance that occurred in 1955 coincides with a change in use from light industrial to commercial retail and probably consisted of changing vehicular entrances to retail-oriented display windows and personnel doors. At that time the Household Trading Co. came to occupy the building, which was then followed by Budget Furniture in 1960. From 1963 through 1964 the building underwent rehabilitation and stood vacant, perhaps in conjunction with another change of occupant. Acme Furniture, owned by Morris Levy, was then located at the address from 1965 through 1975. (continued)

The building is currently occupied by Broadway Furniture, continuing its use as a furniture and household goods retail establishment.

Prior to the construction of this building, the parcel contained a one-story dwelling. With the steady growth experienced in the City of Fresno in the early 1900s, the South of Stadium Survey Area (Central Business District) gradually changed from a residential area to a commercial area. As early as 1918, Broadway Street (then known as "I" Street), between lnyo and Ventura Avenue, had entirely transformed from residential to commercial use. Large parcels appear vacant on the 1918 Sanborn map indicating that the residential housing stock had already been demolished, and neighboring parcels contain the commercial buildings present today. Within the commercial context, automotive~related light industrial uses were prevalent.

745 Broadway Street retains integrity of location and setting. The building has diminished integrity of association and feeling due to the change in use from light industrial to retail, though it has retained its use as a furniture and household goods retailer since 1955. Alterations to the primary fa9ade, especially the truncation of the parapet, stucco cladding, and alterations to the storefront and entrance have diminished the building's integrity of design, materials, and workmanship.

7 45 Broadway Street does not appear to be eligible for the National or California Registers or for local listing. The building is not specifically associated with any significant person or events in the history of Fresno or the State of California. It has some local significance as a building that has housed automotive industry uses throughout its history; however, mere association with historic events or trends is not enough to warrant eligibility. The building does not embody distinctive characteristics of a period, type, or method of construction and is not architecturally distinctive. Additionally, its physical integrity is so diminished that it can no longer convey this significance.

This property was not fully assessed for its potential to yield information important in prehistory or history, per National Register Criterion D.

Built in 1928, 1830 lnyo Street is a one-story, brick masonry commercial building, designed in the 201

h Century Commercial style. The rectangular-plan building is clad In brown facing brick on its front fa~de and has a truss roof with a gable-roofed monitor at the center. The roof is covered with built-up composition roofing material. The foundation Is not visible from the street. The northwest-facing, primary fa~de consists of four bays. The storefront windows in each bay are located relatively high in the wall and have been boarded up with plywood. Entries are located in the end bays and have also been boarded up. A broad, flat metal canopy projects from the front fa~de and is supported by tie rods that attach to the upper wall. It has a paneled fascia, which bears faded sign age, with decorative blocks at each corner. Above the canopy, a band of aluminum frame clerestory windows spans each bay. The upper wall and parapet are adorned with inset panels in the brickwork. The parapet is stepped and capped with a brick copping. The northeast facade has a single bay, articulated like those on the front fa~de, at the northwest end. The windows in this bay have been boarded up. A continuous panel of vertical groove plywood extends down the remaining length of the fac;ade and may cover additional windows. (cont.)

1830 lnyo Street was constructed in 1928 for use as a light industrial building. The building was designed by contractors Yarnell & Garges. Little is known about James Yarnell. Homer Garges was known to have been a residential builder in Fresno for many years. In 1926, he designed and constructed a home for Rollin A. Pickford, one of the original owners of the subject building. Perhaps better known for his artistic endeavors, Rollin Pickford was a highly regarded regional watercolorist, considered to be of the California Plein Aire school and known for his Central Valley and Monterey Peninsula subject matter. His introduction to the laundry business came from his family at a young age. Though he continued to be involved with the industry throughout his working life, his primary career was as an artist. The Liberty Laundry was the first business located in the subject building and was owned by Rollin Pickfor and his brother, William 0. Pickford. The Pickfords owned other laundries in the area, including the Kohler Steam Laundry, Union Laundry, and the Fresno Steam Laundry. The Pickford laundry enterprise was started around 1920 with the purchase of the Kohler Steam Laundry from the brothers' aunt, Lottie Kohler. The Union Laundry was purchased in 1926 and the Liberty Laundry in 1928. The purchase of the business was the impetuous for the construction of the building at 1830 lnyo Street, which was adjacent to the site of the Kohler Laundry plant. The last addition to the Pickford's laundry conglomerate was the Fresno Steam Laundry in 1937. The Liberty Laundry plant functioned as a wholesale commercial cleaning business, specializing in towels, uniforms, and aprons for the hospitality and automotive industries. (continued)

The Liberty Laundry functioned in this capacity until it and the other Pickford holdings were purchased by the Los Angeles-based Crescent Towel and Linen Supply Company in 1944. Liberty Laundry continued to operate under this new ownership until1964. The building then functioned as a furniture warehouse for many years and may continue to do so today.

Prior to the construction of the current building, the lot contained a small stable or garage building. With the steady growth experienced in the City of Fresno in the early 1900s, the South of Stadium Survey Area (Central Business District) gradually changed from a residential area to a commercial area. As early as 1918, Broadway Street had entirely transformed from residential to commercial use, while H Street continued to be dominated by industrial uses, including four major facilities for laundry, auto repair, foundry and machine works, and bottling and soda manufacturing. By 1948, the area was entirely commercial and industrial.

1830 lnyo Street maintains integrity of location, setting, and feeling; surrounded by other commercial and industrial properties on the margin between the commercial area along Broadway and the industrial area along H Street. The building has diminished integrity of association, however; as it is no longer used in its original capacity. lts integrity of materials, workmanship and design appear to be good, with no obvious alterations and the strong possibility that original windows and doors still remain within the boarded up openings. Any other changes that have been made are small and are generally in keeping with the types of changes many commercial buildings experience throughout years of use. The building generally retains its original appearance, as well as its ability to convey its age and use.

1830 lnyo Street is was deemed locally significant by the 1994 Ratkovich Study and though never formally listed, was said to be eligible for the Local Register of Historic Resources for the City of Fresno due to its architectural and social significance. It is said to be one of the few remaining early 201

h century commercial buildings in Fresno and is also associated with a prominent family important in local business history. Though the building does not appear to be eligible for the National or California Register, its eligibility for local designation is valid.

This property was not fully assessed for its potential to yield information important in prehistory or history, per National Register Criterion D.

Applicant is requesting to rehabilitate a designated historic property on Fresno's Local Register of Historic Resources, Liberty Laundry (HP#262, 1830 lnyo Street) for adaptive reuse as office and commercial space. The proposal is consistent with the Rehabilitation Treatment of the Secretary of the Interior's Standards for the Treatment of Historic Buildings as required under the City's Historic Preservation Ordinance (FMC 12-1617(h)(1)). Additionally, the applicant is proposing to improve the vacant parcel located adjacent to the Liberty Laundry at 1880 lnyo Street for parking and to make minor fagade improvements to an existing, non-designated historic property located at 7 45 Broadway.

This project is exempt under Section 15331 (Class 31/Historic Resource Restoration/Rehabilitation), and Section 15332 (Class 32/ln-fill Development Projects) of the California Environmental Quality Act (CEQA) Guidelines.

EXPLANATION: Section 15331 (Class 31/Historic Resource Restoration/Rehabilitation), applies to projects that are limited to the maintenance, repair, stabilization, rehabilitation, restoration, preservation, conservation or reconstruction of historical resources in a manner consistent with the Secretary of Interior's Standards for the Treatment of Historic Properties. It has been found by the Historic Preservation Commission, with advice from the City's Historic Preservation Specialist, an individual meeting the Professional Qualifications Standards for Historic Preservation from the Secretary of the Interior's Standards and Guidelines as published in the Code of Federal Regulations, 36 CFR Part 61, that the proposed project is consistent with the Sec'y of Interior's Standards for the Treatment of Historic Properties. Section 15332/Ciass 32 exempts from the provisions of CEQA, construction of projects characterized as in-fill development meeting the following conditions: a) the project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations given that the site is planned and zoned for commercial and light manufacturing, b) the proposed development occurs within city limits on a project site of approximately .529 acres, which is less than the five acre maximum, and is substantially surrounded by urban uses, c) the project site has no value as habitat for endangered, rare or threatened species, which would be negatively impacted given that the site is relatively flat and is surrounded by urban uses, d) approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality, given that the conditions of approval will restrict uses that may be obnoxious to neighbors and the Public Works Division has reviewed the proposed project and has determined that Broadway and lnyo Streets are capable of handling the estimated traffic generated by the proposal, and e) the site can be adequately served by all required utilities and public services; whereas, the Department of Public Utilities has determined that water and sewer facilities are available to provide service to the subject site.

SUBJECT: REVIEW AND PROVIDE COMMENTS ON THE DRAFT ENVIRONMENTAL IMPACT REPORT FOR THE FULTON MALL RECONSTRUCTION PROJECT, CITY OF FRESNO, CALIFORNIA (STATE CLEARINGHOUSE NUMBER 2013101046) PURSUANT TO FMC 12-1606(5)(6).

RECOMMENDATION

Staff recommends that the Historic Preservation Commission review and provide comments on the Draft Environmental Impact Report (DEIR) for the Fulton Mall Reconstruction Project. Although the Fulton Mall is a historical resource for the purposes of the California Environmental Quality Act (CEQA), due to its designation on the California Register of Historical Resources, it is not a designated historic resource on the City's Local Register of Historic Resources. Therefore the Commission does not have approval authority over any proposed permits to this historic property but should review and provide comments as provided for in the City's Historic Preservation Ordinance, FMC 12-1606 (b)(5)(6). Additionally, the Commission may wish to consider whether the proposed project will cause a impact the eight historic buildings adjacent to the Mall. The Commission may adopt a resolution that incorporates comments or recommendations with a request to staff to prepare a letter to Elliott Balch, the City's Downtown Revitalization Manager. Separately from any action the Commission may take, individual members of the Commission as well as the public may address questions and provide comments to Mr. Balch during the public comment period, which closes January 13, 2014.

EXECUTIVE SUMMARY

The City of Fresno (City) proposes to reconstruct the Fulton Mall as a complete street by reintroducing vehicle traffic lanes to the existing pedestrian mall. The six-lineal blocks and three partial cross streets of the Mall are bounded by Tuolumne Street on the north and lnyo Street on the south. The Mall opened to the public on September 1 , 1964 and was designed by landscape architect Garrett Eckbo as a linchpin in the downtown master plan prepared for the City of Fresno by Victor Gruen (see DEIR chapter 4.2.7-9).

The City is proposing two build options for the Fulton Mall Reconstruction Project. Option 1 would reopen Fulton Street with two lanes, one lane of vehicular traffic in each direction alongside bicycle and pedestrian travel with on street parking along the length of the Mall. One of the two sidewalks along the street would have a 28-foot promenade, with the intention of approximating the mall-like pedestrian experience of Eckbo's Fulton Mall. This option would include artworks, water features (some relocated and/or resized) and landscaping. Option 2 would reconnect the street grid as in Option 1 but would rebuild elements of the Fulton Mall in 5-6 locations known as "vignettes" in generally their current size and configuration. To accomplish this, the two 11 -foot vehicle travel lanes would curve through the vignettes.

The Draft EIR addresses the potentially adverse environmental impacts which may be associated with the construction and operation of the project. The DEIR also identifies appropriate feasible mitigation

measures and alternatives that may be adopted to reduce or eliminate these impacts. Impacts were considered significant and unavoidable for both short-term aesthetics as well as historical resources with the latter (historic resources) being the purview of the Commission. Two measures are proposed to mitigate the impacts to the Mall. Mitigation Measure MM HR-1 would provide for a Historic American Building Survey (HABS) level 1 documentation of the Mall, prior to demolition or removal of any of the features. MM HR-2 would require that an interpretive program be developed using historic photos, drawings and text.

Several alternatives to Project Options 1 and 2 were considered but rejected (DEIR Section 6). The Alternative known as Option 3, restoration and completion of the original Mall as designed by Garrett Eckbo, was among those rejected as it would fail to meet the project objectives as outlined in Section 2 of the DEIR:

• Reconstruct Fulton Mall • Increase mobility and access to the Fulton Mall area • Provide convenient multi-modal access options on the Mall and its cross streets • Improve visibility of businesses, offices and other amenities in the Fulton Mall area by improving

traffic circulation • Maximize sustainable development and economic productivity in conjunction with other downtown

Redevelopment projects while complying with the requirement to receive federal transportation grant funds to minimize harm to the historic site resulting from the Project

• Provide greater long-term public use of Fulton Mall • Reconstruct Fulton Mall using funds and other sources, including grants, other than the City of

Fresno General Fund.

The Option 3 Alternative was also considered infeasible because no designated source of funding has been identified whereas Options 1 and 2, as transportation projects, qualify for funding through the Federal Highways Administration (FHWA).

Eight designated historic properties are located on parcels adjacent to the Fulton Mall. The eight buildings, which are listed on Fresno's Local Register of Historic Resources, are thus subject to design and permit review by the Historic Preservation Commission pursuant to FMC2-1617. The historic resources are as follows: the Radin-Kamp (J.C. Penney's) Department Store (1924), the Bank of Italy (1917), the Mason Building (1918), the Pacific Southwest Building (1923), the Helm Building (1914), the Mattei/Guarantee Savings (1920), the T.W. Patterson Building (1922) and the Hotel California (1923). Other buildings adjacent to the Mall have also been found eligible to the National Register and/or California Register but are not currently designated on Fresno's Local Register of Historic Resources. It is the staff opinion that the proposed Fulton Mall Reconstruction Project will not adversely impact or cause a significant adverse change to these historic buildings, as none of these properties will be demolished or altered and all were constructed prior to the period of significance of the Fulton Mall ( 1964) when Fulton Street had vehicular traffic and functioned as Fresno's "Main Street."

Appendix 2 of the DEIR includes a "City of Fresno DNCP and FCSP Historical Resources Technical Report" which has been prepared for the City's in-progress Downtown and Fulton Corridor Plans. RECOMMENDATION

Staff requests that the Historic Preservation Commission review and provide comments on The City's 2013 Certified Local Government Report to the State Office of Historic Preservation.

EXECUTIVE SUMMARY

The City of Fresno is a Certified Local Government (CLG) pursuant to a 1996 agreement with the California Office of Historic Preservation and the National Park Service. The National Historic Preservation Act adopted by Congress in 1966 (and amended) established "a Program for the Preservation of Additional Historic Properties throughout the Nation, and for Other Purposes." Section 101 of the Act established the National Register of Historic Places, established and/or revised regulations for State Historic Preservation Programs and established a CLG program that provides for a transfer of the portion of federal money from the state OHP to local communities. Certified Local Governments benefit from expedited review of some federally funded projects and may apply for grants. However, CLG's also must meet the provisions of the agreement including preparation of an annual report, which summarizes the City's overall preservation efforts.

The Historic Preservation Commission has two separate reporting tasks. The Historic Preservation Ordinance includes preparation of the annual CLG report as one of many Commission tasks (FMC 12-1606 (b)(16). In addition, the Commission By-laws provide that the Commission "may issue a public report setting forth its consensus on the general state of City preservation efforts in the City of Fresno." "This report shall reflect the views of the Commissioners and shall not be prepared in consultation with the staff or the City Council."

Due to the fact that the annual CLG report requires documentation of the City's overall preservation program, beyond the activities of the Historic Preservation Commission, the obligation for preparing this report has fallen to staff. By tradition, the Commission report is prepared by the Commission Chair with input from the members and is presented by the Chair (or his/her representative) to the City Council at a public hearing. This Commission report, when avai lable, is also included as an appendix to the CLG report.

" examples include roofing permits and projects that repair and replace in-kind.

2. California Environmental Quality Act

• What is the role of the staff and commission in providing inputto CEQA documents prepared for or by the local government? Pursuant to FMC 12-1606 (b)(5) the Historic Preservation Commission may participate in environmental review procedures under CEQA or NEPA "by providing review and comment on permit actions affecting designated Historic Resources, Historic Districts and Heritage Properties as the Commission deems appropriate." And as further stipulated at FMC 12-1617(c) the Commission has the right to approve the environmental document for a permit that proposes a substantial alteration of a historic resource. However, all projects which may potentially affect cultural or historic resources (designated or not) are reviewed by staff and as appropriate are referred to the Commission for public hearing. These include Mitigated Negative Declarations or perhaps a Finding of Conformity for projects that may be adjacent to a historic resource.

What is the role of the staff and commission in reviewing CEQA documents for projects that are proposed within the jurisdiction of the local government? See above.

4. Section 106 of the National Historic Preservation Act

• What is the role of the staff and commission in providing input to Section 106 documents prepared for or by; the local government? As a Certified Local Government, staff regularly prepares Section 106 reviews for HUD funded projects as provided for in the City's PA with the SHPO. These include senior and lead paint projects and minor rehabs. Rarely are these reviews for resources that are designated or eligible for

designation. In addition, often the proposed scope, exterior paint as an example, has no effect to the significance of the property. Commissioners are asked to review projects that may impact a designated historic resource or for a project that may impact a potential historic resource. The City, for example, has prepared new downtown plans which are funded through a CDBG grant. Staff has worked on these various plans and surveys and drafts have been presented to the Commission, along with presentations by the historic/environmental consultants on several occasions.

A. What are the most critical preservation planning issues? Two of the most critical preservation planning issues currently in Fresno are High Speed Rail and the revitalization of downtown. Fresno is ground zero for California's High Speed Train. Numerous parcels are being acquired along the right-of-way and there are community concerns, particularly in Fresno's Chinatown, about economic and historic impacts. However, the

required historic surveys, including sub-surface archaeological work, have also been an important positive ancillary of the project. The City is also in the midst of updating its General Plan and has, through various consultants, produced drafts of several downtown and community plans, all of which address historic preservation. The Fulton Mall, a pedestrian mall designed in 1964 by Garrett Eckbo and listed on the California Register of Historical Resources, is being considered for one of three major options that will either restore the Mall completely or dramatically alter it by adding traffic back onto the former Fulton Street.

B. What is the single accomplishment of your local government this year that has done the most to further preservation in your community? "See It, Save It, Celebrate lt." The City served as the nexus for bringing several non-profit heritage and community groups together in May in a week-long celebration of Fresno's history as part of the National Historic Preservation month. Six different events occurred over the week from walking and house tours to an underground "Speakeasy" party hosted by the Fresno Historical Society. City staff provided the Mayoral proclamation at the City Council meeting which kicked off the week and also prepared general publicity and a flyer. Groups that often disagree on preservation issues came together to celebrate Fresno's history.

C. What recognition are you providing for successful preservation projects or programs? We hold biennial Mayoral preservation awards which were last held in December 2012. Seven projects were recognized as outstanding examples of restoration and revitalization, all located within Fresno's Downtown Triangle. In addition, five individuals and/or groups were honored for their contributions to history, architectural research and community service. The awards were presented at a City Council meeting with a great turnout from the public.

D. How did you meet or not meet the goals identified in your annual report for last year? 1) Our collaborative May preservation week, "See It, Save It, Celebrate It" was a great success although it die! not include an actual workshop for Council, as initially consic!erec!. 2) The Hitching Post Thematic District was not completed although staff ac!c!ec! comparative information to the historic context from CLG colleagues. However, the Fig Garden Historic Context was completed and additionally a commemorative poster and architectural style guide were also prepared for this Caltrans-func!ec! project. 3) The roll-out elate for the General Plan update was delayed a year and as a consequence very little new work occurred on implementing the policies in the Historic and Cultural Resources Element. 4) No new work occurred on streamlining Native American reviews. 6} The City's historic database also was not posted to the web site clue to concerns about some of the information. However, numerous resources were ac!c!ed to this list and it continues to function as an important tool for staff project reviews.

E. What are your local historic preservation goals for 2013-2014? 1) A major goal will be to see the successful completion and vetting of all the various downtown, Fulton Mall and General Plans. 2} Complete the Huntington

Boulevard Historic District (half the properties have been surveyed as of December 2013). 3) Work with Preservation Partners for another collaborative May historic preservation week, with hopefully a major event at the boarded Hotel Fresno. 4) Help mount a permanent exhibit of china and historic photographs at the Mission Revival style Helm Home. 5) Continue outreach to college and high school communities about Fresno's history and the importance of preservation. 6) Collaborate on a workshop for policy makers on the economic and cultural benefits of preservation.

F. So that we may better serve you in the future, are there specific areas and/or issues with which you could use technical assistance from OHP? We always welcome OHP training and assistance in the San Joaquin Valley.

G. In what subject areas would you like to see training provided by the OHP? How you like would to see the training delivered (workshops, online, technical assistance bulletins, etc.)?
