.Sub: Stainless steel frame- Structural Stability of Dome and its supporting system.

This bears reference to reply from P&D Bureau - Structural Consultant (Mr. Choudhari),dated

24.06.2013, for the stability of Dome structure at construction stages and at permanent stage. Our

Engineers visited Delhi{dt 5.06.2013) and Mayapur{18.06.2013) at Client office (lskcon Temple) for

discussing the matter.

Our observations are as follows; .

1) We have submitted methodology for shuttering and concerting of dome vide Drg. 8844/PP/603

to 6_12 (dt 24.06.2012) ; 701 & 702 {dt 25.01.2013) showing planned lifts of 1200mm for the

dome .. Also Refer MOM. dated 24.08.2012.

2) .As the Construction progresses towards the Crown/ Centre of the Dome, the load on SS frame

will increase a s the inclination of SS frame decreases.

3) Design prepared tiy P&D Bureau accounts for only 20 kg/sqm load from sflell on SS frame.

However, it does not take into consideration of (DL concrete Load +LL +Shutter load) & Lateral

pressure of green concrete. This will be of the order of 450kq/sqm & 1200kg/sqm respectively at top of the dome. Refer sketches/ figures attached.

4) The Dome structure along with SS frame will behave as a composite one. Th is aspect is also not

considered.

5) There have been frequent changes in Main Dome structural drawings since 2011- viz. in stainless . -

steel frame structure, frame support arrangement, structural sectional details, RC Ring beam

details, etc. - -

6) Design of connectiun of Dome (SS Fra�e) 15tructure to Ring_ beam/Slab at @ 50.650m level to be

checked.

7) Design of RCC Ring Beam @ ·so.650m slab level along with cantilever slab I beam supported on this ring

beam.(As per dwg no. MT-S-42A1) - as per relevant Indian codes. The design should be based on

relevant loading to be transferred from Dome , Service slab , architectural finishes , etc. . The design

should include safe capacity of RCC Beam in Shear , Bending and torsion along with Design of Lap

Length of reinforcement.

From all of the above apprehension, we request you to get the design proof checked considering safety

and stability at all stages.

Meanwhile, we will continue with preparation of fabrication drawings as per P&D Bureau design drawings

to us.

.Idealization 1. Geometry 1.1 Shikbar is in two parts. Luw-9' part has been idealized as a curve directly

derived from Architectural section drawings in Feb 2012. Upper part comprises kalas and is idealized for the profile in architectural section

drawings.

1.2 There are 16 columns ·supporting the Shikhar. Accordingly 16 major

meridional ribs (structural steel lattices) have been provided in the lower

as well as upper part.

As columns are spaced at 5.524 meters one number secondary rib per

column bay have been provided in lower part of the Shikhar.

. Hare Krishna. Please accept my humble obeisances. All glories to Srila Prabhupada.

Many senior devotees have asked me what happened with Pundarika Govinda as well voiced concern stemming from comments he made regarding the lack safety of the dome and the super structure.

PUNDARIKA GOVINDA'S ROLE IN THE TOVP

Govinda was hired by the TOVP to be a site manager only. The fact of the matter was that he was NEVER a project manager for the TOVP, as he claimed to be. Unfortunately, he believed he was in a position of authority over my architects and consultants, when the reality was that he didn't even know who they were. The irony of the situ�tion is that Govinda had been in charge of the site management so far, consistently assuring me that all was fine, and as soon as he was out of the TOVP team, he suddenly began to publically make incorrect statements about the project.

1. THE TOVP ARCHITECTS

Kindly note that the architectural designs and drawings began in 2006.

a. In 2009, when Govinda was hired, he persisted on inducting Premnath as the architect. i. While Premnath claimed to have a big company and showed big plans on taking

up the TOVP, he ended up giving us a young inexP.erienc�d girl to do_ the work. ii. He demanded an exorbitant amount of money per month and had �o

involvement at all. iii. There were surprisingly hardly any drawings issued from his office and - �

communication from his e-nd was practically nil. iv. There is no base to any argument suggesting that his recommendations were

dismissed in favor of pursuing less reliable designs. v. We have been thorough in our research, design and construction. Any

implications to the contrary are an insult to the dedication and hard work our staff has put into this project.

vi. �remnath was never our r:nain architect. b. The Architectural Team:

i. We formed an in house team of 6 professional, fully qualified architects who have been working diligently, with dedication and professionalism. under the visiQn of Bhavananda aR<f1 for the TOVP. I also-have three Russian.architects

• working with me in Mayapur and four artistic architects who do the subtl_e

designs. ii. Other than them working for less than one third of what Premnath was asking

for, we have leaped ahead in design and construction as soon as we formed this in house team.

2. STRUCTURAL STABILITY

a. Dome: i. The dome has always been designed to take the load of the ribs, kalash and

ornamentation. The recent letter sent by Gammon to Govinda upon which Govinda made the incorrect statements was only a query which Gammon posed for the Structural Engineers in a meeting. The matter has been clarified by the Structural consultant and drawings and documents were issued to support the clarification. We are looking into using a light weight material for all the building ornamentation which is furthering the safety factor of structural weight.

b. Planetarium: i. The Planetarium theatre was never designed to be in RCC. It was a conscious

decision made unanimously that the Planetarium theatre would be constructed in light weight material, post RCC work.

ii. The theatre and the projection dome have to be very closely coordinated given that the building would take 5 to 6 years for completion, only after which the projection dome could be selected and installed.

iii. The projection dome has a dynamic technology being enhanced every year. We bought that time to ensure that the Planetarium projection dome corresponds with the current technology after the building is erected.

iv. All the weights and parameters have been well considered durinb structural design.

If any more detailed clarifications are required,- I can get my architect, Vilasini dd, and our structural engineer, Mr."Chaudhari, to send you a report with the data supporting the safety of execution and design. I would never allow an inferior structure to be erected.

3. MARBLE:

We have gotten flawless white marble which is nearly imp�ssible to find. The cost is approx_imately one-third of the price of Indian white marble, which would have been inferior quality.

I want to assure everyone that everything is fine. There are no projects in the world without some problems, but they are dealt with. I hope that the GBCs are happy with my work, but it's their �ecision if they want to appoint an independent architectural f-irm to audit the situatiOil. If anyone has an,y further queries, I welcome them to the TOVP office to meet my staff. It could be beneficial for the GBCom and Directors to have the experience of seeing what our team does by interacting personally with them. Perhaps this could reassure any lingering doubts. it would also be good moral support and inspiration for our team.

As you are aware, the said project consists of Main temple, Narasimhadev Temple a.nd exhibition wings along with other utility buildings like sub-station, ground level/underground water reservoirs, fire fighting, pump houses, pavements, storm water drainage, roads, boundary walls, landscaping, etc. Services like all civil works, all architectural works including finishing works (interior and exterior), electrical works; fire protection system, plumbing and sanitation system are to be provided to make the project complete and fully operational. ·

The tender documents have been issued to pre-qualified tenderers for civil works compnsmg sub-structure (piling & foundation) and super-structure. The tender has been prepared based on preliminary drawings, specifications, and BOQ as prepared and updated by yourself and other consultants, and the schedule for award of the above mentioned work is as follows.

a) Issue tender to pre-qualified tenderers 23rd ofNovember 2009. b) Receive tenders by 29th of December 2009. c) Analyze and evaluate the tenders and carry out negotiations for

award of co!ltract by the end January 2010.

SCOPE OF WORK

Considering the above, your scope of work is outlined below:

1. You will ha've detailed discussions with the project team and the senior engineers & officers at Mayapur so that you can get the complete background of the project and the requirements of Mayapur Project Authority (MP A).

2. You will at the soonest meet all the Consultants at Delhi for vetting the structural, electrical, fire, plumbing and sanitation drawings, works and services and thoroughly review their work and give your findings separately for each consultant and the previous Architect. All the consultants shall be. notified by :MP A, that they shall be required to work under your direction as the Principal Architect of the project.

You, in close consultation with us, will evaluate all the tenders for civil works (sub-structure and super-structure) and participate in negotiations for the award of contract to the successful tenderer.

You will critically study all the building and project drawings, elevations and sections of the proposed complex developed by the previous architect and the other consultants and make suitable corrections,' alterations and modifications and finalize the same in consultation with and receiving institlcti®�, from the �1P A Kindly note that the basic concept of the project as approved by the MPA will not be:), disturbed. ·;;-:

major activities and the estimated completion time taking into account the input of different consultants and the contractors.

You will also prepare the detailed bar chart for each year starting from January 2010 and finalize the same after consultation with the consultants and the MP A. You shall also update the bar chart from time to time to reflect the actual progress.

As the Principal Architect, you shall take lead initiative to coordinate and monitor the progress of works of the structural and other consultants, current and future, for the various services as well as all the contractors at site.

You shall provide all the necessary details, data and architectural drawings to enable the consultants to proceed with their work.

You shall provide, time to time, any necessary drawings/information required for submission to government authorities for approval.

YO. You will follow-up and receive all information, schemes, designs and drawings from all the consultants for the various services. After consultation with and receiving instructions from the MP A, you will finalize the schemes, designs and drawings to permit the consultants to proceed with the preparation of the tlnal working drawings for the various services

1 1. You will follow-up and receive the detailed working drawings for the RCC and structural works (sub-structure & super-structure) and release the same to the contractors for construction after consultation with and receiving instructions from the l\1P A

13. You shall prepare all the necessary tender documents with preliminary and subsequent drawings for interior design and exterior finishing works of the building and the domes in consultation with and receiving instructions from the MP A, and assist the I\1P A in negotiations with and selection of the suitable contractors for the various finishing works.

14. You shall provide detailed working drawings for architectural work to the contractors at site after consultation with and receiving instructions from the MP A

15. You shall prepare all necessary drawings tor landscaping and finalize the same in consultation with and receiving instmctions from the �A

16. You shall, throughout the project period, always maintain an adequate number or' architects, engineers and staff working on the said project in your Kolkata/Mumbai offices and you will carry out most of the work from your Kolkata office/Mumbai offices. You will also depute one engineer or architect at site office for co-ordination with the Project Team. Necessary site office fl!-cilities & accommodation shall be provided at no cost by �A

17. You shall also make sufticient periodical visits at site from time to time to ensure that all and any of the work is carried out as per your guidance, specification, and drawings, as well as upon request from the�A.

18. You shall personally participate in all the progress and critical meetings at site or elsewhere with the consultants, contractors and MP A

19. You ·will assist in measurement ofwork and certify all the bills of the contractors for payment.

20. As a Principal 1-\rchitect you shall keep the Mayapur Project Authority always informed about the · progress ofwork and submit periodic reports, and if there are any delays, you will inform the Mayapur

Project Authority cause for each delay, and the agency responsible for the Delay

WORK AB • .o\NDON.M.ENT/TERMINATION:

If this Agreement is terminated for any valid reason (by the Owner or Architect giving at least one month's (30 days) prior notice on either side), or should the work be abandoned, closed or postponed for any reasons, the Principal Architect shall be paid remuneration tor all work completed by him up to that time as mutually agreed upon by the two parties.

In case of any disagreement regarding the said remuneration or otherwise, the decision of the Project Director shall be final and binding. Furthermore, the Owner need not obtain any NOC from the Architect herein, but may proceed to select another Architect to continue the work to ensure the project is not delayed, stopped or

. loss thereby incurred.

COMPLETION PERIOD:

Considering the unique nature, intricacies and magnitude of the project the projected completion date of six (6) years from 1st December 2009, i.e. November 2015, is our intended target date. Ilowever, if the project gets delayed beyond the said target date for any reason/s whatsoever the Architect shall continue to render his services, without any extra charges to us, until due completion of the project.

ARBITRATION:

1 . All differences and disputes arising between the Owner/Client and the Architect on any matter coooected with this Agreement or in regard to the interpretation of the content thereof shall be referred to an Arbitrator in accordance with the below provisions:

2. Project Director shall be the Sole Appointing Authority in this regard. The fact that the Arbitrator so nominated by the Appointing Authority has held or holds the position of authority in Iskcon or otherwise is closely associated with it, or had occasion to express views in any of the matters in disputes or differences, shall be no ground of objection to such appointment.

3. In the event the Arbitrator, so appointed, desires not to act or is otherwise unable to act as such Arbitrator at any time after his/her appointment, the Appointing Authority would be entitled to appoint any Arbitrator or further Arbitrators on the aforesaid basis and terms until the reference .is concluded by an award.

4. It is made clear that no person other than a person appointed by the Appointing Authority should act as Arbitrator and if, for any reason, that is not possible, the matter is not to be referred to arbitration at alL

5. Any party seeking arbitration under this clause shall have to inform the Appointing Authority in writing giving particulars of the claims and/or disputes, and the Appointing Authority will have the absolute discretion to decide whether or not such claims and/or disputes are serious or important enough to merit a reference to the Arbitrator.

6. No lawyers will be allowed to participate or be present at the time of hearing of the arbitration proceeding.

7. In all cases where the amount of the claim in dispute is Rupees one lakh (1, 00,000/-) and above, the Arbitrator should be obliged to give reasons for the award. The award and directions of the Arbitrator shall be final and binding.

8. Subject to the aforesaid, provisions of the Arbitration Act, 1940, or any statut01y modifications or re-enactment thereof and Rules made thereunder and tor the time being in terce shall apply to the arbitration proceedings under this clause.

1. Ar. Prem Nath, with 45+ yr. of experience in Architecture, is also Chartered Engineer, member

of ASID (USA); Prem Nath And Associates is a firm having annual avg. turnover of Rs. 7.5Cr.;

2. Prem Nath's association with ISKCON dates back to 1975, when Srila Prabhupad Maharaj had

blessed him to design the 1st ISKCON Temple in India at Juhu, Mumbai; Prem Nath also

completed the 2nd Phase of ISKCON (HOE) Juhu and ISKCON School;

3. In Nov. '09, Prem Nath had interview meeting with Sadbhujadasji, Ambrishprabhuji,

Lavangamataji, Chaturmasyadasji, Bhuvanadaji, wherein his credentials were reviewed;

4. Prem Nath's office, was visited too & being satisfied Prem Nath's fees & terms were finalized;

5. Ar. Prem Nath was appointed as 'Principal Architect' of TOVP thru an appointment letter dated

21st December 2009, for a Professional Fees of Rs. 190 lacs.

6. On priority basis the Plans, Elevations, Sections, Details, etc. were prepared by Prem Nath's

office, followed by quick process of BOO/Tender/Specs.; construction initiated in Jan-Feb. '10;

7. GFC Drawings were done so as to enable all agencies I consultants to incorporate their

details, Municipal Drawings too were prepared & Environment requisites too were worked out;

8. Sadbhujadasji as the Project Director has been managing various other developments, "

however needed an Architect of experience to take-up & steer the project further;

9. Sadbhujadasji assumed himself to be the Sole Architect of the project and expected Ar.

Prem Nath to be his assistant - in order to retain all the 'Glory' & 'Credit' to himself and

maintain his, so called, 'Supremacy';

10.Ambrishprabhuji started directly interacting with Prem Nath for his much appreciated Visuals,

Sadhbhujadasji instructed Ar. Prem Nath to send all communications 'thru Him only';

11. Prem Nath And Associates, had deployed personnel for day-to-day coordination and ease of '

design-detail coordination, they too, were beleaguered and sent back;

· 12. Sadbhujadasji appointed Ar. Vilasini as the Executive Assistant, & eventually discontinuing

Prem Nath And Associates services, appointed Ar. Vilasini as the project Architect;

13. Prem Nath And Associates chose to ease out of the project- Satadhanyaji closed the contract

with only 20% fees whereas more than 50% of 'fee eligible' work was already done;

14. Today, it is learnt that lack of coordination and absence of an experience Architect

coordinating the project has created various issues & project is stuck at the Dome level; Ar.

Prem Nath even today, holds ISKCON on a very High Respect and having faced a lot of wrath

And Associates, a firm having an annual average turnover of Rs. 7.5Cr.;

1.2. The firm handles all types of projects with a team of 60-70 professionally qualified

Architects, Interior Designers, Engineers and administrative support staff;

1.3. Prem Nath's association with ISKCON dates back to 1975, when Srila Prabhupad Maharaj

had blessed him to design the 1st ISKCON _Temple in India at Juhu, Mumbai; when Prem

Nath was called for the said Juhu Temple, the said project was going thru few issues,

which with Srila Prabhupad Maharaj's blessing Prem Nath was able to sort and get the

project on smoother track of development;

1.4. During the said period Prem Nath had various one-on-one discussions with Srila

Prabhupad Maharaj for the Juhu project and was then shared the dream of

developing the 'Vedic Planetarium', way back in 1975-78;

1.5. Recently, Ar. Prem Nath has also successfully completed 2"d Phase of ISKCON Hare

be the prospective Architect for the, then not progressing, Temple Of Vedic Planetarium

(TOVP) at Mayapur;

And Associates Office in Mumbai, and met the entire team of personnel being deployed for

the project which included the following qualified professionals:

2.2. 7. Ar. Bhakti Sawant- Architect, 3 Years Experience;

2.2.8. Mr. Pritesh Vasa-3D Visualiser, 7 Years Experience;

2.2. 9. Mr. Nilesh Kolekar- Interior Designer, 8 Years Experience;

2. 3. Post the above visit, being satisfied with the professional setup, Chaturmasyadasji and

Govindasji were asked to negotiate and finalize the professional terms for the TOVP

project with Ar. Prem Nath;

3. Scope of Ar. Prem Nath, M/s. Prem Nath And Associates, was finalized as, to be the

'Principal Architect' of the TOVP Project and to coordinate with other consultants viz.

Structure, MEP, etc.

3. 1. Detailed scope of services listed Preparation of preliminary drawings, BOQ, Tender

Documents, Specifications, Good For Construction (GFC) Drawings, Periodic Review of

works, Periodic Site visits; and the appointment was finalized thru an appointment letter

dated 2 1st December 2009, for a Professional Fees of Rs. 190 lacs.

4 . . Project Progress:

4. 1. TOVP project was a long awaited dream of Srila Prabhupad Maharaj and was suffering

with various issues, viz. Land Matters, Design Issues, etc. and as Fate would have it,

Ar. Prem Nath was again able to get project to moving further- and so it happened;

4.2. On urgent priority basis the Plans, Elevations, Sections, Details, etc. were prepared by

Ar. Prem Nath's office, in correlation with the already prepared Structural Drawings and

other details; followed by quick process of BOQ, Tendering, Specifications, etc. as also

recorded in the Letter of Appointment;

4.3. Apart from Ar. Prem Nath being completely involved in the project, the above listed Key

personnel were personally trained and guided by him; the team had a very rigorous

working on the project, upto an extent of often working overnight, to achieve the quick

targets;

4. 4. Based on the above prompt working, the contract to start construction was awarded and

work was initiated at Site by Jan-Feb. 201 0; Prem Nath himself frequented to Mayapur,

to assure best of project initiation and execution; while Govinda prabhu was appointed as

the Project Manager of the project;

4.5. Work on the GFC Drawings was done so as to enable all other agencies I consultants to

incorporate their details - similarly Municipal Drawings too were prepared and

Environment requisites too were worked out in coordination with Satadhanyaji;

4.6. These GFC drawings I details were prepared from Pile foundation level to the Dome level

and in complete comprehensive form;

4. 7.1t may be relevant to mention hereby that it is commendable that Govinda prabhu being

from a mechanical engineering background was conferred the responsibility of such large

civil construction job - we are sure, by now, having spent so many years in this project,

Govinda prabhu has become worldly wiser, however he was easily able to coordinate with

Prem Nath and both shared mutual comfort of talking to each other and getting the project

up and running; Govinda prabhu always appreciated Ar. Prem Nath for this;

5.1. Sadbhujadasji in his capacity as the Project Director of TOVP has been at Mayapur since

long and has been managing various other developments within the campus - however it

seemed as if he was Not able to carry forward TOVP project since it was beyond the

perception and needed an Architect of experience to take-up the matter and steer it

further;

5.2. Sadbhujadasji's job, as the project director, was to get the best out of all his team

members and appointed professionals and get the Job Done; however, Sadbhujadasji

EGO did not allow him to do so, he assumed himself to be the Sole Architect of the

project and expected Ar. Prem Nath to be his assistant- in order to retain all the 'Glory'

& 'Credit' to himself and maintain his, so called, 'Supremacy';

5.3. Sadbhujadasji wanted to keep Control with himself- he did not want any other consultant,

including Ar. Prem Nath to come in foreground;

6. Few examples shall explain how a professional scope of Ar. Prem Nath started getting into

controversies;

6.1. During the design development period Ambrishprabhuji started directly interacting with

Prem Nath for the much appreciated Visuals prepared by Ar. Prem Nath - this was

taken by Sadhbhujadasji in bad taste and instructed Ar. Prem Nath to send all

communications 'thru him only';

6.2. Prem Nath And Associates, for day-to-day coordination and ease of design-detail

coordination deputed a lady Architect (Ar. Bhakti) at site;

6. 2.1. However within a few days of working, she was confronted by Sadbhujadasji with a

question, "Who is your Boss?" which was obviously answer by the lady as "Ar. Prem

Nath" (Prem Nath is the boss of the firm) - this again was taken in the wrong spirit

and Sadbhujadasji expected her to answer him with his name;

6.2.2. Resultant to the above, the lady Architect was not even provided working

comfort at Mayapur, No Computer I Printer provided, No Office Space provided,

she carried her own laptop from Mumbai however No Plug Points provided in

her room;

6.2. 3. Eventually the lady Architect returned back to Mumbai, disheartened and upset

with the Rude Behavior of Sadhbhujadasji;

6.2.4. Similarly couple of other deployed engineers at site, were beleaguered and sent

back;

6.2.5. This eventuated in various discomforts in professional working and was later

apparent that it was a preplanned scheming done to discontinue the services of

Prem Nath And Associates, having received all GFC Drawings & Details;

6.3. A new team was already being built by Sadbhujadasji, by appointment of Ar. Vilasini as

the executive assistant - and dealing all matters thru her; and eventually

discontinuing Prem Nath And Associates services and appointing Ar. Vilasini (an

architect with only few years of experience) as the project Architect;

7. Prem Nath And Associates chose to ease out of the project, hoping all good happens to the

long awaited dream of Srila Prabhupad Maharaj, since they did not want to involve themselves

in 'uncalled-for' Politics - Satadhanyaji closed the contract with only 20% fees whereas more

than 50% of 'fee eligible' work was already done by Prem Nath by working for more than 12

months;

8. A letter of appreciation of services too was issued to Ar. Prem Nath, which is on record;

9. Today, it is learnt that the drawings issued by Prem Nath And Associates, way back in 2010

have been able to only get the project moving uptill today - and a thorough lack of

coordination and absence of an experience Architect coordinating the project has

created issues in Services, Minute details, Elevations, Elevators, Escalators, Rain Water pipe

camouflaging, and so on; the project is stuck at the Dome level;

10. What the project needs is an Experienced Architect who is dedicated to the professional

and works in the interest of the project without any preconceived qualms - Ar. Prem Nath

even today, holds ISKCON on a very High Respect and having faced a lot of wrath is yet

humble enough to return back to the project and move forward, if called upon;

You are fully aware that schematic arrangement of Planetarium seating had to be frozen before pile layout drawings were issued. At that stage no feed back was available on l ikely load of Planetarium seating , its dome etc. None of the architect! drawings at that stage indicate RCC step up seating arrangement.

Please understand that we have kept provision for steel skeleton supporting seating arrangement of the Planetarium. Kine arrange to"update your seating arrangement details with steel supports fixed to floor with anchor fasteners.

Central dome of main temple block has been aligned to sit on the column grid and effective inner

diameter adju$ted to 54.0 mts. (Ref drg no. TVP WD-24 sec AA ', TVP WD-25 sec BB ') 2.10. Central dome bottom arch features

on the main dome the openings and arch features above service floor lvl 2 The arch and column rows

in the section and elevation have been generally matched with the view.

2.1 1 . Staircase blocks details:

Windoyv openings on 1he sou1h and north side have heen removed so as to match the elevation

.lavational proj ection and features have been \VOrked out and marked in the plan accordingly

showing the cornice and dummy columns on the fayade.
