Avenue. Request: Variance from Chapter 27:
1) Section 4.2.2 H Accessory buildings structures and uses to build a swimming pool within 5 feet of a rear property line and
2) Section 5.1.10 Maximum lot coverage to increase the lot coverage from 35% to 39.28% to build a swimming pool
Staff Recommendation: Denial. The applicant is proposing to construct a swimming pool in an alley and has not received permission from the property owner (DeKalb County) to request a variance on this property.
Request for variance at 747 hillmont Ave for Pool installation
Requesting Variance on 2 issues of concern, lot
coverage and building within 5ft of the property line
for the installation of a in ground pool.
Regarding building within 5ft of the property line. The
backyard is extremely narrow not allowing us much
room to start with. We have pushed the pool up
against the home (1ft off to be exact) to keep as much
room as possible. If we had suffienct room we would
by all measn keep the pool over 5ft from the line
however we physically have no other choice. The pool
itslef is a very conservative size, 12ft x 21ft, for an
example, the average pool I install is a 16ft x 32ft for
typicall families of 4. We are simply trying to bring a
backyard to life with a pool as so many other residents
within the county have. Seeing the width of the
backyard should show that we are not asking for an
unreasonable variance.
Installation of a pool here will not materially
detrimental to the public or injurous to the property or
the adjacent land. Behind the pool there is a 6ft tall
privacey fence which blocks the view from the road.
There is a sidewalk adjaent to the road but it is well
over 30ft away as well so no pedestrians or drivers

would see any complications either. There are no
homes within 50ft from the pool, so being on the
property line will not interfere with other residents
within the community. Even in the event that the pool
area did flood, all water would flow down the driveway
to a dead end side street due to the grade and not to
the neighboring road way or fellow properties. This
installation would not cause any saftey hazard for the
community or the home owner, the pool is fenced on
all 4 sides with a 6ft privacey fence including a self
closing and self locking gate to keep non residents out.
Lot Coverage issue.
Regarding lot coverage we are requesting an increase
to 39.28%, a mere 4.28% over the max. We feel this
request is justifed seeing how 747 Hillmont is
significantly smaller than the 10,000 sq ft minimum lot
size of Dekalb county by over 3,000 sq ft. The entire
pool area addition is well under 1,000 sq ft. If the lot
was 10k sq ft we would not need this variance at all.
We see no special privileges being requested due to
this. Increasing the lot coverage would not be
detrimental to any neighboring properties including
747 Hillmont. The propsed change will not increase any
runoff. The decking material used will all be permeable
to allow water through to the soil. Additioanlly the
system we build is proprietary needing no free
standing filter as seen on tradtional pool systems. The
removal of the tradtional filter means we don’t have to
backwash our system resulting in excess water on the
ground. Our systems unique build style also means
there is no forseable reason to drain the pool and

sealed filitration unit means no fear of leaks. The pool
being so close to the house will not damage it either, it
is a sub wall made of concrete with hardyboard
concrete siding. We have no fear of future wood rot or
property damage due to this. Mentioned above there
is no home closer than 50ft to the pool area so
increased noise would not be an issue. The lot
inbetween the road and pool is far too narrow for any
future contruction projects by the county or devolpers.
In close we hope you will see our request through and
let us continue in the contruction of this project.
Restricting this lot size increase would be at a huge
disadvantage to the Guzman family. I met with Mr.
Guzman before they haad purchased the lot to see if a
pool installation was possible. I personally never would
have guessed that these issues would have arised. My
client is from the area and loves it dearly, this house is
meant to be a forever home and is only requesting to
install a small splash pool so that he and his loved ones
can enjoy the outdoor area in the Ga heat.

DAMAGE AND SOIL EROSION.
4. THE CONTRACTOR SHALL PROVIDE ANY EXCAVATION AND MATERIAL SAMPLES
NECESSARY TO CONDUCT REQUIRED SOIL TEST. ALL ARRANGEMENTS AND
SCHEDULING FOR TESTING SHALL BE THE CONTRACTOR'S RESPONSIBILITY.
5. SOILS TESTING AND ON-SITE INSPECTIONS SHALL BE PERFORMED BY AN
INDEPENDENT GEOTECHNICAL ENGINEER. THE SOILS ENGINEER SHALL PROVIDE
COPIES OF TEST REPORTS TO THE CONTRACTOR, THE OWNER AND THE
OWNER'S REPRESENTATIVE AND SHALL PROMPTLY NOTIFY THE OWNER, HIS
REPRESENTATIVE AND THE CONTRACTOR SHOULD WORK PERFORMED BY THE
CONTRACTOR FAIL TO MEET THESE SPECIFICATIONS.
6. ALL AREAS TO RECEIVE PAVEMENT, STRUCTURES OR FILL MATERIAL SHOULD BE
STRIPPED OF ORGANIC MATERIAL AND TOP SOIL PRIOR TO COMMENCEMENT OF
CONSTRUCTION. TOPSOIL SHOULD BE STOCK PILLED ON SITE FOR LATER USE IN
LANDSCAPE AREAS (IF APPROVED BY THE OWNER), DISPOSED OF IN A
DESIGNATED AREA ON SITE, OR WASTED OF SITE. TOPSOIL SHOULD NOT BE
USED AS STRUCTURAL FILL.
7. ALL FILL MATERIAL TO BE UTILIZED ON THE PROJECT SHALL BE FREE OF
ORGANIC OR OTHERWISE DELETERIOUS MATERIALS AND COMPACTED TO
MINIMUM DRY DENSITIES CORRESPONDING TO 95% OF MAXIMUM DRY DENSITY
AS OBTAINED BY STANDARD PROCTOR, WITHIN 1 FOOT BELOW PAVEMENT
SUBGRADE. FILL SHALL BE PLACED IN LIFTS NOT TO EXCEED 6 INCHES IN
COMPACTED FILL THICKNESS. A REPRESENTATIVE OF THE GEOTECHNICAL
ENGINEER SHOULD MONITOR ALL FILL OPERATIONS.
8. TREE PROTECTION AND EROSION CONTROL MEASURES ARE TO BE
ACCOMPLISHED PRIOR TO ANY OTHER CONSTRUCTION ON THE SITE AND
MAINTAINED UNTIL PERMANENT GROUND COVER IS ESTABLISHED.
9. ALL SEDIMENT CONTROL DEVICES AND TEMPORARY SEDIMENT POND FEATURES
ARE TO BE CONSTRUCTED AND FULLY OPERATIONAL PRIOR TO ANY OTHER
CONSTRUCTION OR GRADING.
10. CONSTRUCTION ENTRANCE PADS SHALL BE INSTALLED BY THE CONTRACTOR
AT EACH CONSTRUCTION ACCESS POINT (PRIOR TO LAND DISTURBANCE).
11. ALL SLOPES SHOULD BE STABILIZED AS SOON AS POSSIBLE.
12. IT IS THE CONTRACTOR'S RESPONSIBILITY TO PERFORM REQUIRED
MAINTENANCE OF ALL EROSION AND SEDIMENT CONTROL DEVICES TO ENSURE
THEIR FUNCTION AT ALL TIMES.
13. ALL WORK SHALL COMPLY WITH APPLICABLE STATE, FEDERAL AND LOCAL
CODES AND ALL NECESSARY LICENSES AND PERMITS SHALL BE OBTAINED BY
THE CONTRACTOR AT HIS EXPENSE UNLESS PREVIOUSLY OBTAINED BY THE
OWNER.
14. NECESSARY BARRICADES, SUFFICIENT LIGHTS, SIGNS AND OTHER TRAFFIC
CONTROL METHODS AS MAY BE NECESSARY FOR THE PROTECTION AND
SAFETY OF THE PUBLIC SHALL BE PROVIDED AND MAINTAINED THROUGHOUT
THE CONSTRUCTION ON ALL PUBLIC ROADS.
15. DEVIATIONS FROM THE CONSTRUCTION DOCUMENTS WITHOUT THE PRIOR
CONSENT OF THE OWNER, HIS REPRESENTATIVE OR THE ENGINEER MAY BE
CAUSE FOR THE WORK TO BE UNACCEPTABLE.
16. PROPOSED CONTOUR INTERVALS ARE AS LABELED. ALL PROPOSED CONTOURS
ARE FINISHED GRADE.
17. MAXIMUM SLOPE OF EMBANKMENT SHALL BE THREE FEET HORIZONTAL TO 1
FOOT VERTICAL, 3:1.
18. ALL DIMENSIONS ARE TO BACK OF CURB, FACE OF BUILDING, OR AS NOTED.
19. ALL MATERIALS SHALL BE NEW UNLESS USED OR SALVAGED MATERIALS ARE
AUTHORIZED BY THE OWNER.
20. ALL BUFFERS AND TREE SAVE AREAS SHALL BE CLEARLY IDENTIFIED BY
FLAGGING AND/ OR FENCING PRIOR TO COMMENCING ANY LAND DISTURBANCE.

BMP WATER QUALITY NOTES:
1. WATER QUALITY BMP(S) WATER QUALITY DEVICES TO BE INSTALLED AT TIME
OF FINAL LANDSCAPING.
2. AS-BUILT WATER QUALITY CERTIFICATION AND LOT AS-BUILT SURVEY
(INCLUDING WATER QUALITY BMP(S)) IS REQUIRED PRIOR TO CERTIFICATE
OF OCCUPANCY.
3. BMP LOCATIONS SHOWN ARE APPROXIMATE AND ANY DEVIATIONS FROM
LOCATION SHALL BE APPROVED BY THE ENGINEER.
4. STONE BEDDING TO BE NO. 57 STONE PLACED ON LEVEL TRENCH BOTTOM.
5. ALL DOWNSPOUTS AND DRAINAGE INLETS TO BE DIRECTED TO THE BMP
DEVICE. ALL DRAIN PIPES SHALL HAVE A POSITIVE SLOPE.

AS OVERFLOW STRUCTURES;
- MOW GRASS FILTER STRIPS AS NECESSARY , REMOVE GRASS CLIPPINGS
2. SEMI-ANNUALLY:
- CHECK OBSERVATION WELLS FOLLOWING 3 DAYS OF DRY WEATHER, FAILURE TO
PERCOLATE WITHIN THIS TIME PERIOD INDICATES CLOGGING;
- INSPECT PRETREATMENT DEVICES AND DIVERSION STRUCTURES FOR SEDIMENT
BUILD-UP AND STRUCTURAL DAMAGE;
- REMOVE TREES THAT START TO GROW IN THE VICINITY OF THE TRENCH
3. AS NEEDED:
- REPLACE PEA GRAVEL/TOPSOIL AND TOP SURFACE FILTER FABRIC (WHEN
