Notice to All Contractors

The City of Rome welcomes your proposals for construction work!

The City of Rome requires that the following documentation be provided prior to the signing of a work agreement with any

Community Development Block Grant sub-recipient, commercial façade program participant, or any agreement which involves

federal funding.

1) Verification that contractor “Doing Business As” (DBA) is not included on any state or federal debarment list.

2) Compliance with all City of Rome insurance and worker’s compensation/disability coverage requirements.

3) Signed Non-collusive bid sheet

*IMPORTANT*

Davis Bacon Act (DBA) Compliance for Contractors, Community Development Block Grant (CDBG) Sub-Recipients, and for

Federally Funded Projects.

All prime contractors performing work on construction projects that are assisted with Federal funds are subject to Davis-Bacon

prevailing wage requirements. The wage decision for your project must be included in the scope of work that you are producing or

submitting. If the wage schedule is not included, please contact the project administrator for a copy of the wage decision prior to

accepting or submitting an estimate.

Certified payroll sheets must be submitted weekly and include all on-site project workers. If the payroll sheets are numbered

consecutively you do not need to submit “no work” payrolls for weeks of no site work. Site visits and worker interviews will

periodically and randomly occur to verify the accuracy of the certified payrolls. Agreements for work between a sub-recipient and a

contractor must include the HUD form 4010 (Federal Labor Standards Provision), and the original wage schedule.

No payments or reimbursements will be processed until all certified payroll sheets and worker interviews have been submitted for the

project or phase. The submitted sheets must be accurate and complete, and the minimum wages listed must conform to the original

wage schedule. If deficiencies are found in submitted payroll sheets, restitution of such wages must be made prior to the City of

Rome processing any payments or reimbursements.

All necessary documentation (Contractor Registration, Lead Certification and required insurance forms) must be on file with the

Community and Economic Development Department, prior to the award of a project. Projects will not be awarded to contractors without

the necessary documentation.

All estimates must conform to the attached project specification sheets and all must be itemized as indicated. Estimates must be

included for all itemized specifications. No partial bids will be eligible. All estimates must be accurate and final. The City of Rome

reserves the right to remove line items, if necessary, or to reject all bids if they exceed project budgets or time constraints.

All building permits shall be obtained by the contractor from the Code Enforcement Department prior to the start of work. All work

must comply with local and state building codes and regulations.

11:30 A.M. local time, July 30, 2020, for the following project:

PROJECT DESCRIPTION: Selective demolition, framing, installation of new windows, repair & paint existing wood trim.

Bids will be advertised electronically at www.romenewyork.gov; under the treasurer and purchasing tab. Bids are also advertised with the Mohawk Valley Builders Exchange at: www.mvbe.com; BidNet Direct at www.bidnetdirect.com; and the New York State Contract Reporter at: www.nyscr.ny.gov/agency/index.cfm. The documents are available for download (Adobe PDF) at the City’s website on the purchasing tab at no charge; however, be advised that incomplete bids will be disqualified.

All mail must be received prior to 11:30am July 30, 2020 for bid opening. The City of Rome will not accept late bid submissions. Electronic submissions are not permitted for these bidding documents. Bid opening information will be available through YouTube immediately following the bid opening at https://m.youtube.com/channel/UC3-zq8doKqMbceHj5n0XSYg . Bid package can be delivered to Rome City Hall and dropped in overnight depository. Submission envelope to be sealed and clearly labeled.

Each project proposal will be time-stamped by the City Clerk’s Office when received and must

include all elements listed.

Contractors that obtain contract documents must notify the issuing office in order to be placed on the official plan holder’s list, in order to receive addenda and other bid correspondence. Please

contact the Department of Community and Economic Development at (315)838-1726 with your

name and email address to be placed on the official plan holder’s list. Bids received from

contractors other than those on the official plan holder’s list will not be accepted.

Addenda, if any, will be issued only to those persons whose name and address are on record with

the City as having obtained a bid packet. Addenda to the bid, when issued, will be on file in the

Engineering Office at least five days before the bid opening date. If addenda’s are issued for this

contract all official plan holders will be issued with addenda by mail or email. The

acknowledgement of addenda is found on the Bid Form.

Bids shall be accompanied by money order, certified check or bid bond in the amount of five

percent (5%) of the bid, payable to the order of the City Clerk, City of Rome, New York. The

successful bidder may be required to furnish a Performance Bond and a Labor and Materials

Bond in the amount equal to the contract award.

A portion of this project is funded through the Community Development Block Grant through

direct Federal financial assistance provided by the US Department of Housing & Urban

Development (HUD). All components of this project are subject to the following state and federal

conditions:

Davis Bacon Related Acts (DBRA) consisting of the following: The Davis Bacon Act;

Copeland Act 40 U.S.C. 3145; Reorganization Plan No. 14; Department of Labor 29 CFR

Parts 1, 3, and 5; Contract Work Hours and Safety Standards Act

WAGE RATES: The Davis-Bacon Act requires that the contractor must use the

higher of the federal or state rates. New York State Prevailing Wages are required for

this project in all cases where the NYS Prevailing Wage is higher than the Federal Wages.

Prevailing wage rates are only required for on-site labor and/or installation; and are not

applicable to manufacturing, supply, delivery, and/or fabrication.

Comply will all HUD Section 3 provisions. HUD Section 3 Code of Federal Regulation at

24 CFR 135 applies to construction contracts exceeding the $100,000 threshold. All

applicable regulations must be followed if bid total exceeds the threshold.

Section 3 of the Housing and Urban Development Act of 1968 as amended, 12 U.S.C.

1701. Section 3 requires that to the greatest extent feasible, opportunities for training or

employment be given to low and very low income residents of the project area and

contracts for work in connection with the project be awarded to business concerns that

provide economic opportunities for low and very low income persons residing in the

metropolitan area in which the project is located.

It is the policy of the City of Rome to encourage the greatest possible participation of minority

and women-owned business enterprises. All qualified Minority and Women-Owned Business

Enterprises (MWBE) suppliers, contractors, and/or businesses will be afforded equal opportunity

The owners are soliciting proposals from qualified firms or individuals to provide construction services to renovate the front and side facades of 209 N. Washington Street in Rome, NY. Please provide bids broken down in the following categories. Some or all of the categories of work will be implemented, based on what can be accomplished within the project budget.

SCOPE OF WORK:

General Note: If exterior work is performed during cold winter months, Contractor shall provide

temperature control measures as required by materials used.

1) N. WASHINGTON STREET FAÇADE:

a) SELECTIVE DEMOLITION

i) Remove 5 existing windows (2 on ground floor & 3 on upper floor). Prep openings forreplacement windows.

ii) Remove semi-circular attic window. Prep for replacement window.

b) BUILD KNEE-WALLS BELOW WINDOWS

i) See attached drawings for details.ii) Frame knee walls below 2 existing ground-floor windows. Use 2x4 or 2x6 framing to match

existing wall construction. Fill cavities with batt insulation (3 ½” thick R-15 or 5 ½” thick R-21 insulation, depending on stud size). Provide ¾” exterior plywood sheathing and coverwith Tyvek (or equal). Tape all joints w/ peel & stick flashing.

iii) Finish interior wall surface with 1/2” drywall. Tape & sand all joints.iv) Trim & panel materials shall be Restoration Millwork PVC trim and paneling, as noted in

drawings. Install per manufacturer’s instructions. All fasteners to be stainless steel. All

corners, miters and seams to be glued with approved adhesives. All fastener holes to be

filled with approved filler.

c) INSTALL WINDOWS

i) See attached drawings for details.ii) Install 5 new vinyl double hung windows & semi-circular attic window.iii) Paradigm Tapestry series, or equivalent; Color White. Windows to include Low “E” & Argon

gas, with muntins to match existing windows. Provide full screens on double hung windows.Height and width of new windows shall match height and width of existing windows (fieldverify sizes prior to ordering)

iv) Installation shall include all work on the interior as needed, including jamb extensions,sheetrock work in disturbed area (tape & sand only), repairs to existing finishes impacted bywindow installation, etc. Any voids around windows shall be properly insulation andcaulked. Owner will be responsible for painting and interior trim work.


i) See attached drawings for details.ii) Scrape all loose paint & repair soft / damaged wood trim. Repair/ replace piece of missing

trip from column capital (see drawings)iii) Prime & paint all existing wood trim, including columns, window & door casings, frieze

board, pediment, and fascia.


2) W. LIBERTY STREET FAÇADE:

a) SELECTIVE DEMOLITION

i) Remove 3 existing windows (2 on ground floor & 1 on upper floor). Reframe openings asrequired and prep for replacement/wall infill as indicated on drawings.

ii) Remove solid wall infill from old window opening on upper floor. Reframe and prepopening for new window.

iii) Cut 4 openings in existing wall for new windows(1) Note: Drawings and scope of work assume exterior wall has wood framing. If wall is

made of CMU or Clay Tile, refer to details issued separately by Owner’s Engineer

b) FRAME OPENIGS & INSTALL 4 NEW WINDOWS

i) See attached drawings for details.ii) Reframe existing ground floor window openings for new windows. Use 2x4 or 2x6 framing

to match existing wall construction. Fill cavities with batt insulation (3 ½” thick R-15 or 5 ½”thick R-21 insulation, depending on stud size). Provide ¾” exterior plywood sheathing andcover with Tyvek (or equal). Tape all joints w/ peel & stick flashing. TYPICAL WINDOW FLASHING DETAIL

WINDOW LINTELS- STRUCTURAL CLAY TILE

The single story, exterior wall on West Liberty Street was originally constructed with structural clay tile, with a plaster stucco finish on the exterior. Be advised that the interior may have a stucco finish. Over the life of the building furring strips and horizontal siding has been added to the exterior. In addition, the exterior wall had a wood framed wall, with insulation and drywall, constructed along the the interior.

A window lintel shall be installed in the structural clay tile section of the composite wall. The lintel shall have a minimum of (6”) six inch bearing on each end. The clay tile joints are filled with 1/2” mortar. The lintel shall be mortared to the underlying tile and all exposed voids of the tiles shall be filled with the same type of mortar.

The lintel shall consist of (2) angles, L 5x3.5x0.25, ASTM A 36 steel. One angle shall support the rear of the upper tiles and one angle shall support the front side of the upper tiles. All stucco shall be cleaned off thoroughly so the new lintels can be bonded to the clay tile. (see pg 2 of 3)

An alternate lintel may also be used. (2) Reinforced Precast Concrete Blocks, 5” x 10” (verify height of original tile), with (2) No. 5 reinforcement bars. The concrete shall have a compressive strength of fc’= 4,000 psi and the reinforcement steel shall be fabricated in accordance with ASTM A 615 Gr. 60. The precast lintels shall cure for a minimum of 21 days prior to loading.

The Contractor shall exercise care to prevent construction debris and dust from entering the building.

Introduction to the Prevailing Rate Schedule

Information About Prevailing Rate Schedule

This information is provided to assist you in the interpretation of particular requirements for each classification of worker contained in theattached Schedule of Prevailing Rates.

Classification

It is the duty of the Commissioner of Labor to make the proper classification of workers taking into account whether the work is heavy andhighway, building, sewer and water, tunnel work, or residential, and to make a determination of wages and supplements to be paid orprovided. It is the responsibility of the public work contractor to use the proper rate. If there is a question on the proper classification to beused, please call the district office located nearest the project. District office locations and phone numbers are listed below.

Prevailing Wage Schedules are issued separately for "General Construction Projects" and "Residential Construction Projects" on a county-by-county basis.

General Construction Rates apply to projects such as: Buildings, Heavy & Highway, and Tunnel and Water & Sewer rates.

Residential Construction Rates generally apply to construction, reconstruction, repair, alteration, or demolition of one family, two family, rowhousing, or rental type units intended for residential use.

Some rates listed in the Residential Construction Rate Schedule have a very limited applicability listed along with the rate. Rates foroccupations or locations not shown on the residential schedule must be obtained from the General Construction Rate Schedule. Pleasecontact the local Bureau of Public Work office before using Residential Rate Schedules, to ensure that the project meets the required criteria.

Payrolls and Payroll Records

Contractors and subcontractors are required to establish, maintain, and preserve for not less that six (6) years, contemporaneous, true, andaccurate payroll records.

Every contractor and subcontractor shall submit to the Department of Jurisdiction (Contracting Agency), within thirty (30) days after issuanceof its first payroll and every thirty (30) days thereafter, a transcript of the original payrolls, subscribed and affirmed as true under penalty ofperjury.

Paid Holidays

Paid Holidays are days for which an eligible employee receives a regular day's pay, but is not required to perform work. If an employeeworks on a day listed as a paid holiday, this remuneration is in addition to payment of the required prevailing rate for the work actuallyperformed.

Overtime

At a minimum, all work performed on a public work project in excess of eight hours in any one day or more than five days in any workweek isovertime. However, the specific overtime requirements for each trade or occupation on a public work project may differ. Specific overtimerequirements for each trade or occupation are contained in the prevailing rate schedules.

Overtime holiday pay is the premium pay that is required for work performed on specified holidays. It is only required where the employeeactually performs work on such holidays.

The applicable holidays are listed under HOLIDAYS: OVERTIME. The required rate of pay for these covered holidays can be found in theOVERTIME PAY section listings for each classification.

Supplemental Benefits

Particular attention should be given to the supplemental benefit requirements. Although in most cases the payment or provision ofsupplements is straight time for all hours worked, some classifications require the payment or provision of supplements, or a portion of thesupplements, to be paid or provided at a premium rate for premium hours worked. Supplements may also be required to be paid or providedon paid holidays, regardless of whether the day is worked. The Overtime Codes and Notes listed on the particular wage classification willindicate these conditions as required.

Effective Dates

When you review the schedule for a particular occupation, your attention should be directed to the dates above the column of rates. Theseare the dates for which a given set of rates is effective. The rate listed is valid until the next effective rate change or until the new annualdetermination which takes effect on July 1 of each year. All contractors and subcontractors are required to pay the current prevailing ratesof wages and supplements. If you have any questions please contact the Bureau of Public Work or visit the New York State Department ofLabor website (www.labor.ny.gov) for current wage rate information.

Apprentice Training Ratios

The following are the allowable ratios of registered Apprentices to Journey-workers.

For example, the ratio 1:1,1:3 indicates the allowable initial ratio is one Apprentice to one Journeyworker. The Journeyworker must be inplace on the project before an Apprentice is allowed. Then three additional Journeyworkers are needed before a second Apprentice isallowed. The last ratio repeats indefinitely. Therefore, three more Journeyworkers must be present before a third Apprentice can be hired,and so on.

Holiday Codes

PAID Holidays:

Paid Holidays are days for which an eligible employee receives a regular day's pay, but is not required to perform work. If an employeeworks on a day listed as a paid holiday, this remuneration is in addition to payment of the required prevailing rate for the work actuallyperformed.

OVERTIME Holiday Pay:

Overtime holiday pay is the premium pay that is required for work performed on specified holidays. It is only required where the employeeactually performs work on such holidays. The classifications are listed in alphabeticalorder of ""identifiers"" that indicate whether the particularrate is a union rate (current union negotiated rate for local),a survey rate (weighted average rate) or a union average rate(weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosedin dotted lines beginning with characters other than ""SU"" or""UAVG"" denotes that the union classification and rate wereprevailing for that classification in the survey. Example:PLUM0198‐005 07/01/2014. PLUM is an abbreviation identifier ofthe union which prevailed in the survey for thisclassification, which in this example would be Plumbers. 0198

indicates the local union number or district council numberwhere applicable, i.e., Plumbers Local 0198. The next number,005 in the example, is an internal number used in processingthe wage determination. 07/01/2014 is the effective date of themost current negotiated rate, which in this example is July 1,2014.

Union prevailing wage rates are updated to reflect all ratechanges in the collective bargaining agreement (CBA) governingthis classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate thatno one rate prevailed for this classification in the survey andthe published rate is derived by computing a weighted averagerate based on all the rates reported in the survey for thatclassification. As this weighted average rate includes allrates reported in the survey, it may include both union andnon‐union rates. Example: SULA2012‐007 5/13/2014. SU indicatesthe rates are survey rates based on a weighted averagecalculation of rates and are not majority rates. LA indicatesthe State of Louisiana. 2012 is the year of survey on whichthese classifications and rates are based. The next number, 007in the example, is an internal number used in producing thewage determination. 5/13/2014 indicates the survey completiondate for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until anew survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicatethat no single majority rate prevailed for thoseclassifications; however, 100% of the data reported for theclassifications was union data. EXAMPLE: UAVG‐OH‐001008/29/2014. UAVG indicates that the rate is a weighted unionaverage rate. OH indicates the state. The next number, 0010 inthe example, is an internal number used in producing the wagedetermination. 08/29/2014 indicates the survey completion datefor the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January ofeach year, to reflect a weighted average of the currentnegotiated/CBA rate of the union locals from which the rate isbased.

While completion of Form WH-347 is optional, it is mandatory for covered contractors and subcontractors performing work on Federally financed or assisted construction contracts to respond to the information collection contained in 29 C.F.R. §§ 3.3, 5.5(a). The Copeland Act (40 U.S.C. § 3145) contractors and subcontractors performing work on Federally financed or assisted construction contracts to "furnish weekly a statement with respect to the wages paid each employee during the preceding week." U.S. Department of Labor (DOL) regulations at 29 C.F.R. § 5.5(a)(3)(ii) require contractors to submit weekly a copy of all payrolls to the Federal agency contracting for or financing the construction project, accompanied by a signed "Statement of Compliance" indicating that the payrolls are correct and complete and that each laborer or mechanic has been paid not less than the proper Davis-Bacon prevailing wage rate for the work performed. Contribut ions made orcosts reasonably ant ic ipated for bona f ide fr inge benef i tsunder Sect ion l(b)(2) of the Davis-Bacon Act on behalf oflaborers or mechanics are considered wages paid to suchlaborers or mechanics, subject to the provisions of 29 CFR5.5(a)(1)(iv); also, regular contribut ions made or costsincurred for more than a weekly period (but not less oftenthan quarterly) under plans, funds, or programs, whichcover the part icular weekly period, are deemed to beconstruct ively made or incurred during such weekly period.

Such laborers and mechanics shal l be paid the appropriate wage rate and fr inge benefi ts on the wage determinat ion for the classif icat ion of work actual ly performed, without regard to ski l l , except as provided in 29 CFR 5.5(a)(4). Laborers or mechanics performing work in more than one classif icat ion may be compensated at the rate specif ied for each classif icat ion for the t ime actual ly worked therein: Provided, That the employer’s payrol l records accurately set forth the t ime spent in each classif icat ion in which work is performed. The wage determinat ion (including any addit ional c lassif icat ion and wage rates conformed under 29 CFR 5.5(a)(1)(i i ) and the Davis-Bacon poster (WH-1321) shal l be posted at al l t imes by the contractor and i ts subcontractors at the site of the work in a prominent and accessible, place where i t can be easi ly seen by the workers.

(i i ) (a) Any class of laborers or mechanics which is notl isted in the wage determinat ion and which is to beemployed under the contract shal l be classif ied inconformance with the wage determinat ion. HUD shal lapprove an addit ional c lassif icat ion and wage rate andfringe benefi ts therefor only when the fol lowing cri ter iahave been met:

(1) The work to be performed by the classif icat ionrequested is not performed by a classif icat ion in the wagedeterminat ion; and

(2) The classif icat ion is ut i l ized in the area by theconstruct ion industry; and

(3) The proposed wage rate, including any bona f idefringe benefi ts, bears a reasonable relat ionship to thewage rates contained in the wage determinat ion.

(b) I f the contractor and the laborers and mechanics to beemployed in the classif icat ion (i f known), or theirrepresentat ives, and HUD or i ts designee agree on theclassif icat ion and wage rate (including the amountdesignated for fr inge benefi ts where appropriate), a reportof the act ion taken shal l be sent by HUD or i ts designee tothe Administrator of the Wage and Hour Divis ion,Employment Standards Administrat ion, U.S. Department ofLabor, Washington, D.C. 20210. The Administrator, or anauthorized representat ive, wi l l approve, modify, ordisapprove every addit ional c lassif icat ion act ion within 30days of receipt and so advise HUD or i ts designee or wi l lnot i fy HUD or i ts designee within the 30-day period thataddit ional t ime is necessary. (c) In the event the contractor, the laborers or mechanicsto be employed in the classif icat ion or theirrepresentat ives, and HUD or i ts designee do not agree onthe proposed classif icat ion and wage rate (including theamount designated for f r inge benefi ts, where appropriate),HUD or i ts designee shal l refer the quest ions, includingthe views of al l interested part ies and the recommendationof HUD or i ts designee, to the Administrator fordeterminat ion. The Administrator, or an authorizedrepresentat ive, wi l l issue a determinat ion within 30 days ofreceipt and so advise HUD or i ts designee or wi l l not i fyHUD or i ts designee within the 30-day period thataddit ional t ime is necessary. (d) The wage rate (including fr inge benefi ts whereappropriate) determined pursuant to subparagraphs(1)(i i ) (b) or (c) of this paragraph, shal l be paid to al lworkers performing work in the classif icat ion under th iscontract from the f irst day on which work is performed inthe classif icat ion.

(i i i ) Whenever the minimum wage rate prescribed in thecontract for a class of laborers or mechanics includes afringe benefi t which is not expressed as an hourly rate, thecontractor shal l ei ther pay the benefi t as stated in thewage determinat ion or shal l pay another bona f ide fr ingebenefi t or an hourly cash equivalent thereof.

(iv) I f the contractor does not make payments to a trusteeor other third person, the contractor may consider as part

The Secretary of Labor may require the contractor to set aside in a separate account assets for the meeting of obl igat ions under the plan or program. 2. Withholding. HUD or i ts designee shal l upon i ts ownact ion or upon writ ten request of an authorizedrepresentat ive of the Department of Labor withhold orcause to be withheld from the contractor under thiscontract or any other Federal contract with the same primecontractor, or any other Federal ly-assisted contractsubject to Davis-Bacon prevai l ing wage requirements,which is held by the same prime contractor so much of theaccrued payments or advances as may be considerednecessary to pay laborers and mechanics, includingapprent ices, trainees and helpers, employed by thecontractor or any subcontractor the ful l amount of wagesrequired by the contract In the event of fai lure to pay anylaborer or mechanic, including any apprent ice, trainee orhelper, employed or working on the site of the work, al l orpart of the wages required by the contract, HUD or i tsdesignee may, after wr i t ten not ice to the contractor,sponsor, appl icant, or owner, take such act ion as may benecessary to cause the suspension of any furtherpayment, advance, or guarantee of funds unt i l suchviolat ions have ceased. HUD or i ts designee may, afterwrit ten not ice to the contractor, disburse such amountswithheld for and on account of the contractor orsubcontractor to the respect ive employees to whom theyare due. The Comptrol ler General shal l make suchdisbursements in the case of direct Davis-Bacon Actcontracts.

3. (i) Payrolls and basic records. Payrol ls and basicrecords relat ing thereto shal l be maintained by thecontractor during the course of the work preserved for aperiod of three years thereafter for al l laborers andmechanics working at the si te of the work. Such recordsshal l contain the name, address, and social secur i tynumber of each such worker, his or her correctclassif icat ion, hourly rates of wages paid (including ratesof contribut ions or costs ant ic ipated for bona f ide fr ingebenefi ts or cash equivalents thereof of the types describedin Sect ion l (b)(2)(B) of the Davis-bacon Act), dai ly andweekly number of hours worked, deduct ions made andactual wages paid. Whenever the Secretary of Labor hasfound under 29 CFR 5.5 (a)(1)(iv) that the wages of anylaborer or mechanic include the amount of any costsreasonably ant ic ipated in providing benefi ts under a planor program described in Sect ion l(b)(2)(B) of the Davis-Bacon Act, the contractor shal l maintain records whichshow that the commitment to provide such benefi ts isenforceable, that the plan or program is f inancial lyresponsible, and that the plan or program has been

communicated in writ ing to the laborers or mechanics affected, and records which show the costs ant ic ipated or the actual cost incurred in providing such benefi ts. Contractors employing apprent ices or trainees under approved programs shal l maintain wr it ten evidence of the registrat ion of apprent iceship programs and cert i f icat ion of trainee programs, the registrat ion of the apprent ices and trainees, and the rat ios and wage rates prescribed in the appl icable programs. (i i ) (a) The contractor shal l submit weekly for each weekin which any contract work is performed a copy of al lpayrol ls to HUD or i ts designee i f the agency is a party tothe contract, but i f the agency is not such a party, thecontractor wi l l submit the payrol ls to the appl icantsponsor, or owner, as the case may be, for transmission toHUD or i ts designee. The payrol ls submitted shal l set outaccurately and completely al l of the information requiredto be maintained under 29 CFR 5.5(a)(3)(i) except that ful lsocial securi ty numbers and home addresses shal l not beincluded on weekly transmittals. Instead the payrol ls shal lonly need to include an individual ly ident i fying number foreach employee (e.g., the last four digits of the employee’ssocial securi ty number). (b) Each payrol l submitted shal l be accompanied by a“Statement of Compliance,” s igned by the contractor orsubcontractor or his or her agent who pays or supervisesthe payment of the persons employed under the contractand shal l cert i fy the fol lowing:

(1) That the payrol l for the payrol l period contains theinformation required to be provided under 29 CFR 5.5(a)(3)(i i ), the appropriate information is being maintainedunder 29 CFR 5.5(a)(3)(i), and that such information iscorrect and complete;

(2) That each laborer or mechanic (including each helper,apprent ice, and trainee) employed on the contract duringthe payrol l period has been paid the ful l weekly wagesearned, without rebate, either di rect ly or indi rect ly, andthat no deduct ions have been made either di rect ly orindirect ly from the ful l wages earned, other thanpermissible deduct ions as set forth in 29 CFR Part 3;

(3) That each laborer or mechanic has been paid not lessthan the appl icable wage rates and fr inge benefi ts or cashequivalents for the classif icat ion of work performed, asspecif ied in the appl icable wage determinat ionincorporated into the contract.

(c) The weekly submission of a properly executedcert i f icat ion set forth on the reverse side of Optional FormWH-347 shal l sat isfy the requirement for submission of the“Statement of Compliance” required by subparagraphA.3.(i i )(b).

(d) The fals i f icat ion of any of the above cert i f icat ions maysubject the contractor or subcontractor to civi l or c riminalprosecut ion under Sect ion 1001 of Tit le 18 and Sect ion231 of Tit le 31 of the United States Code.

(i i i ) The contractor or subcontractor shal l make therecords required under subparagraph A.3.(i) avai lable forinspect ion, copying, or transcript ion by authorizedrepresentat ives of HUD or i ts designee or the Departmentof Labor, and shal l permit such representat ives tointerview employees during working hours on the job. I fthe contractor or subcontractor fai ls to submit the requiredrecords or to make them avai lable, HUD or i ts designeemay, after wri t ten not ice to the contractor, sponsor,appl icant or owner, take such act ion as may be necessaryto cause the suspension of any further payment, advance,or guarantee of funds. Furthermore, fai lure to submit therequired records upon request or to make such recordsavai lable may be grounds for debarment act ion pursuant to29 CFR 5.12.

4. Apprentices and Trainees.

(i) Apprentices. Apprent ices wil l be permit ted to work atless than the predetermined rate for the work theyperformed when they are employed pursuant to andindividual ly registered in a bona f ide apprent iceshipprogram registered with the U.S. Department of Labor,Employment and Training Administrat ion, Off ice ofApprent iceship Training, Employer and Labor Services, orwith a State Apprent iceship Agency recognized by theOff ice, or i f a person is employed in his or her f i rst 90days of probat ionary employment as an apprent ice in suchan apprent iceship program, who is not individual lyregistered in the program, but who has been cert i f ied bythe Off ice of Apprent iceship Training, Employer and LaborServices or a State Apprent iceship Agency (whereappropriate) to be el igible for probat ionary employment asan apprent ice. The al lowable rat io of apprent ices tojourneymen on the job site in any craft c lassif icat ion shal lnot be greater than the rat io permit ted to the contractor asto the ent ire work force under the registered program. Anyworker l isted on a payrol l at an apprent ice wage rate, who

is not registered or otherwise employed as stated above, shal l be paid not less than the appl icable wage rate on the wage determinat ion for the classif icat ion of work actual ly performed. In addit ion, any apprent ice performing work on the job site in excess of the rat io permit ted under the registered program shal l be paid not less than the appl icable wage rate on the wage determinat ion for the work actual ly performed. Where a contractor is performing construct ion on a project in a local i ty other than that in which i ts program is registered, the rat ios and wage rates (expressed in percentages of the journeyman’s hourly rate) specif ied in the contractor’s or subcontractor’s registered program shal l be observed. Every apprent ice must be paid at not less than the rate specif ied in the registered program for the apprent ice’s level of progress, expressed as a percentage of the journeymen hourly rate specif ied in the appl icable wage determinat ion. Apprent ices shal l be paid fr inge benefi ts in accordance with the provisions of the apprent iceship program. I f the apprent iceship program does not specify fr inge benefi ts, apprent ices must be paid the ful l amount of f r inge benefi ts l isted on the wage determinat ion for the appl icable classif icat ion. I f the Administrator determines that a dif ferent pract ice prevai ls for the appl icable apprent ice classif icat ion, fr inges shal l be paid in accordance with that determinat ion. In the event the Off ice of Apprent iceship Training, Employer and Labor Services, or a State Apprent iceship Agency recognized by the Off ice, withdraws approval of an apprent iceship program, the contractor wi l l no longer be permit ted to ut i l ize apprent ices at less than the appl icable predetermined rate for the work performed unt i l an acceptable program is approved.

(i i ) Trainees. Except as provided in 29 CFR 5.16, trainees wil l not be permitted to work at less than the predetermined rate for the work performed unless they are employed pursuant ‘ , to and individual ly registered in a program which has received prior approval, evidenced by formal cert i f icat ion by the U.S. Department of Labor, Employment and Training Administrat ion. The rat io of t rainees to journeymen on the job site shal l not be greater than permit ted under the plan approved by the Employment and Training Administrat ion. Every trainee must be paid at not less than the rate specif ied in the approved program for the trainee’s level of progress, expressed as a percentage of the journeyman hourly rate specif ied in the appl icable wage determinat ion. Trainees shal l be paid fr inge benefi ts in accordance with the provisions of the trainee program. I f the trainee program does not mention fr inge benefi ts, t rainees shal l be paid the ful l amount of f r inge benefi ts l isted on the wage determinat ion unless the Administrator of the Wage and Hour Divis ion determines that there is an apprent iceship program associated with the corresponding journeyman wage rate on the wage determinat ion which provides for less than ful l f r inge benefi ts for apprent ices. Any employee l isted on the payrol l at a trainee rate who is not registered and part ic ipat ing in a training plan approved by



the Employment and Training Administrat ion shal l be paid not less than the appl icable wage rate on the wage determinat ion for the work actual ly performed. In addit ion, any trainee performing work on the job site in excess of the rat io permit ted under the registered program shal l be paid not less than the appl icable wage rate on the wage determinat ion for the work actual ly performed. In the event the Employment and Training Administrat ion withdraws approval of a tra ining program, the contractor wi l l no longer be permit ted to ut i l ize trainees at less than the appl icable predetermined rate for the work performed unt i l an acceptable program is approved.

(i i i ) Equal employment opportunity. The ut i l izat ion of apprent ices, trainees and journeymen under 29 CFR Part 5 shal l be in conformity with the equal employment opportunity requirements of Execut ive Order 11246, as amended, and 29 CFR Part 30.

5. Compliance with Copeland Act requirements. Thecontractor shal l comply with the requirements of 29 CFRPart 3 which are incorporated by reference in this contract

6. Subcontracts. The contractor or subcontractor wi l linsert in any subcontracts the clauses contained insubparagraphs 1 through 11 in th is paragraph A and suchother clauses as HUD or i ts designee may by appropr iateinstruct ions require, and a copy of the appl icableprevai l ing wage decision, and also a clause requiring thesubcontractors to include these clauses in any lower t iersubcontracts. The prime contractor shal l be responsiblefor the compliance by any subcontractor or lower t iersubcontractor with al l the contract c lauses in thisparagraph.

7. Contract termination; debarment. A breach of thecontract c lauses in 29 CFR 5.5 may be grounds forterminat ion of the contract and for debarment as acontractor and a subcontractor as provided in 29 CFR5.12.

8. Compliance with Davis-Bacon and Related Act Requirements.

All rul ings and interpretat ions of the Davis-Bacon and Related Acts contained in 29 CFR Parts 1, 3, and 5 are herein incorporated by reference in this contract

9. Disputes concerning labor standards. Disputes aris ing out of the labor standards provisions of this contract shal l not be subject to the general disputes clause of this contract. Such disputes shal l be resolved in accordance with the procedures of the Department of Labor set forth in 29 CFR Parts 5, 6, and 7. Disputes within the meaning of this c lause include disputes between the contractor (or any of i ts subcontractors) and HUD or i ts designee, the U.S. Department of Labor, or the employees or their representat ives.

10. (i) Certification of Eligibil ity. By entering into th iscontract the contractor cert i f ies that neither i t (nor he orshe) nor any person or f i rm who has an interest in thecontractor’s f i rm is a person or f i rm inel igible to beawarded Government contracts by virtue of Sect ion 3(a) ofthe Davis-Bacon Act or 29 CFR 5.12(a)(1) or to be

awarded HUD contracts or part ic ipate in HUD programs pursuant to 24 CFR Part 24.

(i i ) No part of this contract shal l be subcontracted to anyperson or f i rm inel igible for award of a Governmentcontract by virtue of Sect ion 3(a) of the Davis-Bacon Actor 29 CFR 5.12(a)(1) or to be awarded HUD contracts orpart ic ipate in HUD programs pursuant to 24 CFR Part 24.

(i i i ) The penalty for making false statements is prescribedin the U.S. Criminal Code, 18 U.S.C. 1001. Addit ional ly,U.S. Criminal Code, Sect ion 1 01 0, Tit le 18, U.S.C.,“Federal Housing Administrat ion transact ions”, provides inpart : “Whoever, for the purpose of . . . inf luencing in anyway the act ion of such Administrat ion.. . . . makes, utters or publ ishes any statement knowing the same to be false. . . . . shal l be f ined not more than $5,000 or imprisoned not more than two years, or both.”

11. Complaints, Proceedings, or Testimony by

Employees. No laborer or mechanic to whom the wage, salary, or other labor standards provisions of this Contract are appl icable shal l be discharged or in any other manner discriminated against by the Contractor or any subcontractor because such employee has f i led any complaint or inst i tuted or caused to be inst i tuted any proceeding or has test i f ied or is about to test i fy in any proceeding under or relat ing to the labor standards appl icable under this Contract to his employer.

B. Contract Work Hours and Safety Standards Act. Theprovisions of this paragraph B are applicable where the amount of theprime contract exceeds $100,000. As used in this paragraph, theterms “laborers” and “mechanics” include watchmen and guards.

(1) Overtime requirements. No contractor or subcontractorcontracting for any part of the contract work which may require orinvolve the employment of laborers or mechanics shall require orpermit any such laborer or mechanic in any workweek in which theindividual is employed on such work to work in excess of 40 hours insuch workweek unless such laborer or mechanic receivescompensation at a rate not less than one and one-half times the basicrate of pay for all hours worked in excess of 40 hours in suchworkweek.

(2) Violation; l iabil ity for unpaid wages; l iquidated

damages. In the event of any violat ion of the clause set forth in subparagraph (1) of this paragraph, the contractor and any subcontractor responsible therefor shal l be l iable for the unpaid wages. In addit ion, such contractor and subcontractor shal l be l iable to the United States (in the case of work done under contract for the District of Columbia or a terri tory, to such District or to such terri tory), for l iquidated damages. Such l iquidated damages shal l be computed with respect to each individual laborer or mechanic, including watchmen and guards, employed in violat ion of the clause set forth in subparagraph (1) of this paragraph, in the sum of $10 for each calendar day on which such individual was required or permitted to work in excess of the standard workweek of 40 hours without payment of the overtime wages required by the clause set forth in sub paragraph (1) of this paragraph.



(3) Withholding for unpaid wages and l iquidated

damages. HUD or i ts designee shal l upon i ts own act ion or upon writ ten request of an authorized representat ive of the Department of Labor withhold or cause to be withheld, from any moneys payable on account of work performed by the contractor or subcontractor under any such contract or any other Federal contract with the same prime contract, or any other Federal ly-assisted contract subject to the Contract Work Hours and Safety Standards Act which is held by the same prime contractor such sums as may be determined to be necessary to sat isfy any l iabi l i t ies of such contractor or subcontractor for unpaid wages and l iquidated damages as provided in the clause set forth in subparagraph (2) of this paragraph.

(4) Subcontracts. The contractor or subcontractor shal linsert in any subcontracts the clauses set forth insubparagraph (1) through (4) of this paragraph and also aclause requiring the subcontractors to include theseclauses in any lower t ier subcontracts. The primecontractor shal l be responsible for compliance by anysubcontractor or lower t ier subcontractor with the clausesset forth in subparagraphs (1) through (4) of thisparagraph.

C. Health and Safety. The provisions of this paragraph C areapplicable where the amount of the prime contract exceeds $100,000.

(1) No laborer or mechanic shal l be required to work insurroundings or under working condit ions which areunsanitary, hazardous, or dangerous to his health andsafety as determined under construct ion safety and heal thstandards promulgated by the Secretary of Labor byregulat ion.

(2) The Contractor shal l comply with al l regulat ionsissued by the Secretary of Labor pursuant to Tit le 29 Part1926 and fa i lure to comply may result in imposit ion ofsanct ions pursuant to the Contract Work Hours and SafetyStandards Act, (Publ ic Law 91-54, 83 Stat 96). 40 USC3701 et seq.

(3) The contractor shal l include the provisions of thisparagraph in every subcontract so that such provisions wi l lbe binding on each subcontractor. The contractor shal ltake such act ion with respect to any subcontractor as theSecretary of Housing and Urban Development or theSecretary of Labor shal l di rect as a means of enforcingsuch provisions.

SECTION 3 GUIDELINES AND INSTRUCTIONS

Section 3 requires that when contracting or employment/training opportunities are generated because an applicable federally funded project necessitates the awarding of contracts or the employment of additional personnel through individual hiring, the recipient must give preference to low- and very low income persons and/or businesses owned by these persons or that substantially employ these persons.

The following Section 3 documents are included in these bid documents.

City of Rome Section 3 Policy Statement The City of Rome supports the Department of Housing and Urban Development’s (HUD’s) legislative efforts to provide preference to low- and very low-income residents of the local community (regardless of race and gender), and the businesses that substantially employ these persons, for new employment, training, and contracting opportunities resulting from HUD funded projects. HUD’s regulations on Section 3 can be found in the Code of Federal Regulations, at 24 CFR 135.

As a recipient of HUD funding, the City of Rome certifies it will comply with the requirements of Section 3. HUD-funded programs include CDBG Entitlement, HOME, and the Neighborhood StabilizationProgram. The requirements of Section 3 also apply to contractors or subcontractors that receive contractsin excess of $100,000 for Section 3 eligible projects and activities.

SECTION 3 FAQs

How does Section 3 differ from the Minority/Women Business Enterprise programs? Section 3 is both race and gender neutral. The preferences provided under this regulation are based on income level and location. The Section 3 regulations were designed to encourage recipients of HUD funding to direct new employment and contracting opportunities to low-income residents, and the businesses that employ these persons, within their community regardless of race and/or gender.

How can a business become certified as a Section 3 business? Rome’s Department of Community & Economic Development (CED) provides a form that a business can fill out to certify as a Section 3 business (Attached).

How can businesses find Section 3 residents to work for them? Businesses can recruit Section 3 residents in public housing developments and in the neighborhoods where the HUD assistance is being spent. Effective ways of informing residents about available training and job opportunities are: contacting resident organizations, local community development and employment agencies; distributing flyers; posting signs; and placing ads in local newspapers. CED will assist.

Will HUD require Section 3 compliance? Yes. HUD monitors the performance of contractors, reviews annual reports from recipients, and investigates complaints. HUD also examines employment and contract records for evidence that recipients are training and employing Section 3 residents and awarding contracts to Section 3

City of Rome Procedures to Help Ensure Section 3 Compliance

The work to be performed under this bid specification/contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended. The purpose of Section 3 is to ensure that all “new” employment generated by HUD assistance or other assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very-low income persons, particularly persons who are recipients of HUD assistance. All City of Rome projects with accepted bids that exceed $100,000 shall be subject to hiring at least one Section 3 employee/trainee for the duration of the project.

THE SUCCESSFUL BIDDER ON THIS JOB WILL BE REQUIRED TO HIRE A MINIMUM OF ONE (1) QUALIFIED SECTION 3 EMPLOYEE FOR A MINIMUM OF 120 HOURS.

The City of Rome anticipates and will assist the contractor to seek a qualified individual through a YouthBuild program, the Workforce Investment Board, local colleges and trade union programs or other means. The new Section 3 hire(s) will require an aggregate of 120 hours during the project. If using Journeyman & Apprentices, only Registered Apprentices from NYS-Certified Apprenticeship Programs will be considered. Please see the Laborer (Heavy & Highway) and Mason - Building sections of the Prevailing Wage Schedule included in the project manual/bid documents.

Please use the following examples to budget your proposed employment requirements in your bid:

Laborer (Heavy & Highway): $24.30 plus fringe ($40.84/ hour) @ 120 hours = $ 4,900.80

NYS Registered Apprentices: Mason - 1st Term Setter*: $14.83 plus fringe ($23.64/ hour) @ 120 hours = $ 2,836.80 Mason - 1st Term Finisher*: $14.95 plus fringe ($23.41/ hour) @ 120 hours = $ 2,809.20

Section 3 DEFINITIONS

A. "Section 3 - covered assistance" means funding provided under HUD that is expended for workarising in connection with:

1. housing rehabilitation, including reduction and abatement of lead-based paint hazards,(but excluding routine maintenance, repair and replacement);

2. housing construction; or3. other public construction projects (which includes other buildings or improvements,

regardless of ownership).

B. "Employment opportunities generated by section 3 covered assistance" means all “new”employment opportunities generated by the expenditure of Section 3 covered assistance.

C. "Section 3 Business" means a business concern:

1. That is 51 percent or more owned by section 3 residents; or2. Whose permanent, full-time employees include persons, at least 30 percent of whom are

currently Section 3 residents, or within three years of the date of first employment withthe business concern were Section 3 residents; or

3. That provides evidence of a commitment to subcontract in excess of 25 percent of thedollar award of all subcontracts to be awarded to business concerns that meet thequalifications set forth in paragraphs (1) or (2) in this definition of "Section 3 business".

D. "Section 3 Project" means the construction, reconstruction, conversion or rehabilitation ofhousing (including reduction and abatement of lead-based paint hazards), other publicconstruction which includes buildings or improvements (regardless of ownership) assisted withHUD funding.

E. "Contractor" means any entity which contracts to perform work generated by the expenditure ofSection 3-covered assistance, or for work in connection with a Section 3 -covered project.

F. "Section 3 Contract" means a contract or subcontract awarded by an owner, contractor orsubcontractor for work generated by the expenditure of Section 3 covered assistance, or for workarising in connection with a Section 3 covered project. "Section Contracts" do not includecontracts for the purchase of supplies and materials except, however, when a contract formaterials includes the installation of those materials, that contract constitutes a Section 3Contract.

G. "Section 3 Resident" means:

1. A Public Housing resident; or2. An individual who resides in the metropolitan area or non-metropolitan country in which

the Section 3 covered assistance is expended (Utica-Rome MSA), and who is:3. A low-income person, as this term is defined in section 3(b)(2) of the 1937 Act (42 U.S.C.

1437a(b)(2)). section 3(b)(2) of the 1937 Act defines this term to mean families (includingsingle persons) whose incomes do not exceed 80 per centum of the median income for thearea, as determined by the Secretary, with adjustments for smaller and larger families,except that the Secretary may establish income ceilings higher or lower than 80 percentum of the median for the area on the basis of the Secretary's findings that suchvariations are necessary because of prevailing levels of construction costs or unusuallyhigh or low-income families; or

4. A very low-income person, as this term is defined in section 3(b)(2) of the 1937 Act (42U.S.C. 1437a(b)(2)). section 3(b)(2) of the 1937 Act defines this term to mean families(including single persons) whose incomes do not exceed 50 per centum of the medianfamily income for the area, as determined by the Secretary with adjustments for smallerand larger families, except that the Secretary may establish income ceilings higher orlower than 50 per centum of the median for the area on the basis of the Secretary'sfindings that such variations are necessary because of unusually high or low familyincomes.

H. "New Hires" mean full-time employees for permanent, temporary or seasonal employment.

SUBRECIPIENT (City of Rome) Section 3 RESPONSIBILITIES

Subrecipients of Section 3-covered funding have a responsibility to “ensure compliance” of their contractors and subcontractors. This means that a subrecipient must:

1. Notify contractors of their responsibilities under Section 3 including, but not limited to,incorporating the Section 3 Clause in contract documents.

2. Ensure Section 3 contracting and employment/training goals are met “to the greatest extentpossible.”

3. Refrain from entering into contracts with contractors that are in violation of 24 CFR Part 135.

4. Respond to complaints made to the recipient by Section 3 residents or business concerns that thesubrecipient, a contractor or subcontractor, is not in compliance with 24 CFR Part 135.

5. Cooperate with HUD in obtaining the compliance of contractors and subcontractors whenallegations are made that the subrecipient’s contractors and subcontractors are not in compliancewith 24 CFR Part 135.

CONTRACTOR Section 3 PROCEDURES & RESPONSIBILITIES

A. Every contractor and subcontractor must agree to be bound by the terms and intent of Section 3and to include the following "Section 3 clause" in every contract for work in connection with thisproject.

“The work to be performed under this contract is a project assisted under a program providingdirect Federal financial assistance from HUD and is subject to Section 3 of the Housing andUrban Development Act of 1968 as amended, 12 U.S.C. 1701. Section 3 requires that to thegreatest extent feasible, opportunities for training or employment be given to low and very lowincome residents of the project area and contracts for work in connection with the project beawarded to business concerns that provide economic opportunities for low and very low incomepersons residing in the metropolitan area in which the project is located. The Recipient willfurther include the above language in every subcontract or Purchase Order unless exempted byrules, regulations, or orders of the Secretary of Labor issued pursuant of Section 204 ofExecutive Order 11246 of September 24, 1965, so that such provisions, including sections for non– compliance will be binding upon each subcontractor or vendor. The Recipient will take suchaction with respect to any subcontract or purchase order as the Department of Labor may directas a means of enforcing such provisions, however that in the event that the Recipient becomesinvolved in, or is threatened with, litigation with a subcontractor or vendor as a result of suchdirection by the Department, the Recipient may request the United States to enter into suchlitigation to protect the interest of the United States.”

B. Every contractor and subcontractor must agree not to subcontract any work or permitsubcontracted work to be further subcontracted, without the prior written approval of the City.

C. Every contractor and subcontractor undertaking work in connection with a Section 3 Projectagrees to direct his/her best efforts to utilize low-and very low-income area residents asemployees to the greatest extent feasible. Every contractor and subcontractor must submitappropriate paperwork to:

1. Identify and describe the number of positions, by skill level, required to plan andimplement the work to be done under this Section 3 covered project;

2. Determine and describe how many of these positions are currently filled and which arenot filled by regular, permanent employees; and

3. Establish a target within each occupational category for the number of positions to befilled by Section 3 residents, if applicable.

D. In order to insure that contractors and subcontractors are meeting their obligations, they will berequired to document their efforts, and maintain such records and accounts for a period ofthree (3) years, and permit access to books, records, and premises for purposes ofinvestigation in connection with a grievance, or to ascertain compliance with theseregulations. Section 3 is a provision of the Housing and Urban Development (HUD) Act of 1968

that helps foster local economic development, neighborhood economic improvement, and individual self-sufficiency.

Section 3 Employment Goals

Thirty percent (30%) of new employment opportunities should be awarded to Section 3 residents. Progress toward Section 3 employment goals must be reported on attached forms – before final payments will be made to selected contractor.

A. If a contractor or subcontractor will hire new employees as a result of receiving HUD assistance,these jobs must be provided, to the greatest extent feasible, to low- and very-low income persons,especially those living in the project area.

B. All contractors will seek low- or very low-income persons residing in the metropolitan area for noless than 30% of all new hires. When a person is newly hired by the contractor for the project, thecontractor must show evidence of seeking Section 3 Residents. Any employment resulting fromthese expenditures, including administration, management, clerical support, and construction, issubject to compliance with Section 3. Recipients are required, to the greatest extent feasible, toprovide all types of employment opportunities to low and very low-income persons, includingpermanent employment and long-term jobs. Recipients and contractors are encouraged to haveSection 3 residents make up at least 30% of their permanent, full-time staff.

C. Section 3 resident who has been employed for 3 years may no longer be counted towards meetingthe 30% requirement. This encourages recipients to continue hiring Section 3 residents whenemployment opportunities are available.
