So as to more properly manage a search for responses to your thirty-six separate requests for information, you were informed the Department determined to search for any responsive public information it could locate that appeared to be responsive to one or more of the separate requests for information, rather than attempting to undertake a separate and distinct search for information in the order the multiple requests had been submitted.

GENERAL ORDER 81.1

REVISED AUGUST 2012

LICENSE PLATE RECOGNITION PROGRAM

1. PURPOSE. The purpose of this order is to establish standardized policy and procedures regarding the use of License Plate Recognition (LPR) systems.

2. GENERAL.

a. The use of LPR technology has been demonstrated to be a valuable tool for law enforcement officers in the detection of wanted vehicles.

b. License Plate Recognition systems revolutionize how officers search for wanted vehicles. The LPR system consists of a dedicated computer and multiple cameras to automatically locate, read, and compare license plates against wanted vehicle databases. This technology provides a manner in which vehicle license plates can be automatically scanned from a moving vehicle or fixed location.

c. The wanted vehicle database used within the LPR program is considered an automated "hot sheet" and may contain license plate numbers of stolen vehicles, wanted felony vehicles, vehicles with lost or stolen plates, vehicles wanted in connection with certain crimes, missing persons, Amber Alerts, or other lawful reasons.

d. If a wanted vehicle is detected, the LPR system should be set to alert trained personnel with both an audible and visible signal. Images of the license plate and vehicle, as well as a brief explanation of the nature of the want will be displayed. The entire process is entirely automatic and is performed in less than one second. This process allows hundreds of vehicles per hour to be scanned and compared against wanted vehicle databases.

f. The California Highway Patrol (CHP) operates both fixed and mobile LPR systems. Fixed systems are placed in strategically significant locations throughout the state. Mobile systems are typically deployed in areas experiencing high rates of vehicle theft.

g. Field Support Section (FSS) has been assigned as the Office of Primary Interest (OPI) for all matters related to the LPR program.

3. POLICY. These policies and procedures apply to all departmental personnel who operate and/or support LPR systems either equipped in an enforcement vehicle or established at a fixed location.

a. License Plate Recognition systems shall only be operated by trained departmental personnel.

b. Disclosure regarding the Department's use of LPR technology is permitted. However, departmental personnel should only disclose fixed site. locations and data obtained by the technology to law enforcement personnel for official use only (FOUO) with a legitimate investigatory need.

c. A wanted vehicle discovered through use of the LPR system does not constitute probable cause to make an arrest. Departmental personnel shall verify all matches of wanted vehicles through the California Law Enforcement Telecommunication System (CLETS) prior to making an arrest.

d. All inquiries from allied agencies, or other entities, concerning the Department's LPR program shall be referred to the OPI.

e. Any CHP LPR database will be designed to electronically log all LPR license plate inquiries noting the date, time, and identification of the requestor.

f. A log shall be maintained by FSS LPR staff in order to track all FOUO search requests of the LPR database. Field Support Section will be the only point of contact for LPR database searches, as well as the only authorized provider of LPR database information requested. At a minimum, the log will contain the following information for all LPR related searches:

(1) Date of inquiry.

(2) License plate to be searched or partial plate search.

(3) Agency or Area making the request.

(4) Name of requestor.

(5) Phone number of requestor.

(6) Electronic mail (e-mail) address of requestor.

(7) Case number of the investigation being conducted.

(8) Date of crime.

(9) Type of crime.

(10) Information provided and in what format (e-mail, hard copy, etc.).

g. The FSS commander or designee will conduct quarterly audits of the electronically flagged LPR database inquiries and the FSS log to ensure proper documentation and accountability is maintained.

4. INSTALLATION OF LICENSE PLATE RECOGNITION EQUIPMENT.

a. License Plate Recognition equipment shall not be installed in departmental vehicles or established at fixed locations without prior approval/coordination with the OPI.

b. Installation of LPR equipment shall be accomplished by the vendor, the vendor's authorized representative, and/or departmental personnel trained by the vendor. Installation of LPR equipment on departmental vehicles must conform to standards outlined by Fleet Operations Section and FSS.

c. Information Technology Section (ITS) will maintain and upgrade, as necessary, the servers for both the fixed and mobile platforms and the communication bridges at the fixed site locations. Additionally, ITS, with the assistance of FSS, shall ensure that all commands with assigned LPR vehicle{s), requiring thumb drives, maintain one nonencrypted workstation available to facilitate the downloading of current wanted vehicle database information. All requisitions for equipment will be submitted through FSS, with the assistance of ITS, when necessary. Funding for this program will be provided with FSS equipment funds.

(1) When LPR equipment fails and is no longer serviceable, FSS will determine the appropriate actions for repair or disposal of the equipment in compliance with existing policy.

5. PROCEDURES.

a. Mobile License Plate Recognition Systems.

(1) Departmental personnel shall follow proper operating procedures as outlined in the Operator's Guide assigned to each LPR vehicle.

(2) Departmental personnel shall log on to the LPR system using the user identification number and password provided by FSS.

(3) Mobile LPR systems with thumb drives shall be updated with the most recent wanted vehicles database prior to each shift.

(4) Upon conclusion of each shift, all data collected on thumb drives shall be downloaded through the designated nonencrypted work station to the data repository.

(5) Commanders should develop local Standard Operating Procedures (SOP) concerning the deployment of LPR vehicles within their command. Primary consideration for deployment of LPR vehicles should be given to beats that experience high levels of traffic volume and high rates of vehicle theft.

b. Fixed License Plate Recognition Systems.

(1) When operational, fixed LPR systems shall be monitored 24 hours each day by trained personnel.

(2) Commanders having primary responsibility over a fixed LPR system should develop local SOP consistent with Annex A.

6. DATA TRANSFER. STORAGE. AND RETENTION.

a. Mobile License Plate Recognition Systems.

(1) All data transfers shall be accomplished by a trained user through use of a data transfer program on the Department's Intranet.

(2) Division network administrators shall ensure the LPR data transfer program is installed on Area networks and available to trained departmental personnel where LPR vehicles are operated.

(3) Information Technology Section shall maintain mobile LPR system data storage servers and retain data records for a period of 60 days, after which the data shall be purged.

(4) Access to this data is limited to law enforcement personnel with an official investigatory need.

b. Fixed License Plate Recognition Systems.

(1) Data transfers are accomplished automatically through the Department's Intranet.

(2) Information Technology Section shall maintain fixed LPR system data storage servers and retain data records for a period of 60 days, after which the data shall be purged.

7. LEGAL CONSIDERATIONS.

a. Access to wanted vehicle information by technological means does not constitute a Fourth Amendment search. Observations made by peace officers without physical intrusion into a protected (constitutionally) area does not involve· the Fourth Amendment or require a court order. The use of LPR technology to augment or increase an officer's observations is consistent with case law regarding the use of artificial illumination to aid in an officer's observations. Additionally, the courts have ruled that the use of binoculars or similar magnification devices does not constitute an unreasonable search. License Plate Recognition Technology simply accomplishes the same task, as field personnel observing a license plate and manually entering the plate into the database. However, there has been no decision in case law or documented in statutory law that holds that LPR technology results in a constitutional search.

8. ANNUAL REPORTING REQUIREMENTS.

a. Reporting. Pursuant to Assembly Bill 115, Section 2413 of the California Vehicle Code is amended to read:

(1) The Department of the California Highway Patrol shall, as a part of the annual automobile theft report submitted to the Legislature pursuant to subdivision (b) of Section 10901, report the LPR practices and usage,

including the number of LPR data disclosures, a record of the agencies to which data was disclosed and for what purpose, and any changes in policy that affect privacy concerns.

INTEGRATED TRAFFIC MONITORING CAMERA SYSTEM

AN AGREEMENT BETWEEN

THE CALIFORNIA HIGHWAY PATROL (CHP)

AND THE NATIONAL INSURANCE CRIME BUREAU (NICB)

1.0 Definitions. For the purposes of this Agreement, the following terms shall have the definitions set forth below:

1.1 ALPR: Automatic License Plate Recognition.

1.2 Clearance Agreement: Written agreement between the Department and NICB specifying the information exchange standards for all Sites in the State.

1.3 Department: The California Highway Patrol.

1.4 NICB: National Insurance Crime Bureau, a non-profit organization incorporated in the State of Illinois.

1.5 Parties: NICB and the Department.

1.6 Southern Shield: An electronic screening program operated by CHP and NICB to detect and interdict stolen vehicles. Southern Shield uses ALPR technology to screen license plate data, checked at highway speeds, by use of optical character recognition camera systems installed over the roadway. These systems determine the status of the plate when compared to a list or lists of wanted vehicles.

1.7 State: The state government of California, including stakeholder government agencies.

1.8 Sites: State weigh stations, ports-of-entry, and inspection stations or locations equipped with ALPR Traffic Monitoring Equipment.

1.9 Site Agreement: Written agreement between the Department and NICB specifying configuration details, maintenance and cost responsibilities of the Parties for one or more Sites.

1 .10 Steering Committee: The ALPR Steering Committee as described in this Agreement.

CHP - NICB ALPR Agreement

2.0 Objectives of this Agreement.

2.1 The State, acting through the Department, seeks to provide electronic screening services for the detection and interdiction of stolen and other wanted vehicles operating on the states highways.

2.2 NICB, within the public-private partnership formed with the Department, intends to assist in this effort by purchasing and installing ALPR systems to assist in establishing a highly effective electronic screening network, agrees to continue assisting California in meeting its objective of detection of stolen vehicles.

2.3 By this Agreement, and according to provisions set out herein, the Department and NICB agree to establish and continue ALPR service in California.

2.4 This Agreement does not create an exclusive relationship between the Department and NICB for providing electronic screening services. NICB agrees that if one or more similar site systems are, or become available, the Department has the option of entering into similar agreements that may include providing equal right of access to site components provided or funded by the Department, except that such use shall not interfere with NICB­provided equipment or operations. Such additional site system would have no right to use, share or interfere with the components provided or funded by NICB, including NICB owned transponders, although NICB would have the option of reaching an agreement with any other provider under which equipment provided or funded by NICB could be shared.

3.0 A Partnership Building Upon California's Vision for ITS Technology.

3.1 The CHP desires to continue providing intelligent transportation systems (ITS) for the efficient movement of persons, goods and services. NICB will support, complement and enhance the CHP's vision for ITS ALPR deployment within California. With this Agreement, the Parties mutually commit to the following:

3.1.1 The Parties will support Southern Shields core values and work cooperatively toward interoperability among physical systems and information sharing systems within this screening program.

3.1.2 The State will retain ownership and control of all State-provided equipment associated with the State's electr onic screening deployment, unless stated otherwise in this Agreement or a Site Agreement.

3.1.3 NICB will retain ownership and control of all NICB provided equipment associated with the State's electronic screeni ng deployment, unless stated otherwise in this Agreement or a Site Agreement.

3.1.4 Responsibility to maintain and upgrade the components of each Site shall rest with the Party that owns the component, unless otherwise stated in this Agreement or Site Agreement.

CHP - NICS ALPR Agreement

4.0 Implementation of New ALPR Sites in California.

4.1 The Parties agree that determination of the Sites at which NICS owned ALPR systems will be operated will be by mutual agreement and approved by the both parties. Site selection will be based on an evaluation of a variety of factors, including, anticipated costs, operational hours, and estimated traffic flow patterns.

4.2 The Parties agree to enter into one or more Site Agreement(s) for implementation of ALPR operations at Sites. Each agreement will detail the ALPR Site configuration and specify the Parties' respective respo nsibilities including the Department's expense 0 bligations, if any. Each Site Agreement will become part of this Agreement.

4.3 NICS will provide ALPR equipment at no charge to the State.

4.4 The Department acknowledges that NICS's re venue is from program fees established by NICS's Soard of Directors and collected from participating insurance carriers. No State agency will be responsible for collecting or verifying such fees.

4.5 The Department and NICS will mutually develop a schedule for ALPR Site implementation. If the Department requires public funding to deploy one or more Sites, the Parties acknowledge that the ALPR deployment schedule will be contingent on the allocation and/or approval of necessary funding at such Sites, as determined by the Department.

4.6 The Department will coordinate with other State agencies to facilitate the implementation of ALPR.

4.7 For any new or renovated Site planned to be an ALPR Site, the Department will request that Site construction plans include ALPR related equipment, including, as needed: pole bases, reader poles, cabinet bases, conduit, guard rail, trenching, access to power, signage, and in-pavement work. The Parties will mutually establish cost responsibility for PrePass related equipment and construction at such Sites in a Site Agreement and approval will be obtained by mutual agreement as noted in 4.1.

4.8 Upon request, the Department will provide Site drawings showing the "as is" configuration of ALPR equipment installed by NICS or its subcontractors.

5.0 Operating ALPR Systems in California

5.1 The Department will provide program oversight, with executive approval, through Enforcement Services Division. The commander of Field Support Section or his designee shall serve as liaison between the Department and

NICB and it shall provide guidance to the Department regarding electronic screening policy matters.

5.2 The Department will establish uniform ALPR screening criteria that shall be valid at each Site. The Department understands that NICB has a vested interest in the success of this program and will endeavor to work closely with NICB on the establishment of appropriate data screening procedures, storage and retention. Such criteria will be mutually endorsed by the Department and HELP in the form of a Clearance Agreement. Modifications to the Clearance Agreement may be made by mutual agreement.

5.3 Data collected by this system may be released to NICB based on specific criteria established by Field Support Section and shall be retained by the Department for a period determined by the Department. Data collected at these sites will be shared with NICB to assist both entities in evaluating vehicle theft patterns and trends and to establish and monitor the efficiency of the system at that particular site.

6.0 The Department's Operational Responsibilities

6.1 As it would with State-owned equipment, the Department and other State employees or its agents will exercise reasonable care in the normal daily operation of NICB owned ALPR equipment located at California Sites. NICB accepts no liability for equipment that is not provided reasonable security or is subjected to abuse, misuse or neglect.

6.2 The Department will coordinate with NICB in the monitoring of the performance of State-owned electronic screening equipment and respond to any component failure within 24 hours. Repair or replace any component for which it is responsible will be accomplished as soon thereafter as is reasonably possible.

6.3 The Department will coordinate with the California Department of Justice for access to data for the purpose of validating stolen vehicle data for the ALPR program, at no cost to NICB.

6.4 The Department will notify NICB of roadway construction or other highway and Site closures that impact ALPR Site operations.

6.5 The Department will allow NICB to conduct physical inspections of operations at selected sites. Such inspections will consist of gathering data and be unobtrusive to site officers and operations and will be conduced only with advanced written approval from Field Services Section.

6.6 The Department will monitor the performance of ALPR systems and components, including those provided by NICB, and respond to any component failure in a timely manner.

6.7 The Department will routinely update ALPR Site computers -- generally, at least once per business day -- to include any appropriate additions or deletions of wanted vehicle data.

6.8 The Department will provide initial on-site training for enforcement personnel and staff at Sites and additional refresher training as necessary.

7.0 NICS's 0 perational Responsibilities

7.1 NICB will provide to the Department a series of standard ALPR operational reports and tabulations summarizing ALPR operations and traffic volumes in the State. Any special reports or tabulations requested by the Department must be consistent with NICB data policies. NICB will provide special reports as necessary at no charge to the Department.

7.2 NICB will ensure the security of any nonpublic State data provided to NICB. NICB shall allow only its employees, appropriate subcontractors and other authorized individuals to access nonpublic State data, and then only to perform the functions and duties needed to analyze vehicle theft related data. No other access, use or sale of such data shall be allowed.

7.3 NICB will notify the Department prior to the installation, repair and or modification of NICB provided Site hardware if Site operations will be affected.

8.0 Miscellaneous

8.1 Either party may terminate this Agreement at any da'te established by mutual agreement. Within 30 days following termination, at no cost to the State, NICB will remove all NICB-owned equipment from CHP Sites and return the Sites to the original condition prior to installation of ALPR equipment. In the event of termination by NICB, the Department shall have the option of purchasing NICB's physical infrastructure investment in State Sites at NICB's investment value, but such option shall not include proprietary software or intellectual property.

8.2 NICB shall indemnify, defend, and hold harmless the State of California, the California Highway Patrol, its Commissioner and officers, agents, and employees for and against any and all claims, losses, damages, liabilities, judgments and actions of any kind or nature, whether at law or equity, and any other costs and expenses, including reasonable attorney's fees a nd other costs of defending against such actions, arising from, in whole or in part, or caused by thE;) malfunction or misuse of any materials, goods or equipment of any kind or nature furnished by NICB or its agent, or arising, in whole or in part, from any acts or omissions by NICB's directors, officers, agents, assigns, independent contractors or employees in relation to NICB's

obligations and requirements under this Agreement or with respect to the subject matter thereof.

8.3 The Parties shall comply with all laws, rules and regulations forwarded by the Department to NICB throughout the term of the Agreement, all as may be amended or updated from time to time.

8.4 Any modifications to this Agreement shall be made in writing and signed by the Parties. Notices under this Agreement are valid if sent by overnight delivery or certified mail (return receipt requested), and shall be deemed received the third day following the date the notice is postmarked. Notices should be addressed as follows:

8.5 The Department assumes no responsibility or liability for any costs incurred by NICB prior to signing this Agreement.

8.6 The Parties agree to cooperate fully, to work in good faith, and to mutually assist each other in the performance of this Agreement. In connection therewith, the Parties shall periodically meet upon the reasonable request of each other and shall confer in good faith with respect to the current and future operation of ALPR and with a view toward improving the same and resolving any problems that may arise. A Party shall not unreasonably withhold its approval of any act or request of the other as to which its approval is necessary or desired.

8.7 This Agreement is subject to and shall be construed in accordance with the laws of the State of California, and any litigation with respect thereto shall be brought in the courts of the State, to the extent permitted by law.

8.8 Each provision of this Agreement shall be interpreted in a way that is valid under applicable law. If any provision is held to be invalid, void or otherwise unenforceable by a court of competent jurisdiction, such provision may be reformed by the Parties, insofar as possible, to cure the defect and give maximum effect to their intent in entering into this Agreement and in any event the remainder of the Agreement shall continue in full force and effect.

4.4 The Department acknowledges that NICS's principal source of revenue is from membership assessments established by NICS's Board of Directors and paid by NICB members. No State agency will be responsible for collecting or verifying such membership assessments ..

4.5 The Department and NICS will mutually develop a schedule for ALPR Site implementation. If the Department requires public funding to deploy one or more Sites, the Parties acknowledge that the ALPR deployment schedule will be contingent on the allocation and/or approval of necessary funding at. such Sites, as determined by the Department.

The Parties will mutually establish cost responsibility for ALPR related equipment and construction at such Sites in a Site Agreement and approval will be obtained by mutual agreement as noted in 4.1.

4.8 Upon request, the Department will provide Site drawings showing the "as is" configuration of ALPR equipment installed by NICS or its subcontractors.

5.0 Operating Al.PR systems in California

5.1 The Department will provide program oversight, with executive approval, through Enforcement Services Division. The commander of Investigative Service!, Section

. or his designee shall serve as a liaison between the Department and ·NICI3 and it shall provide guidance to the Department regarding ALPR policy matters.

5.2 The Department will establish one set of uniform ALPR screening criteria that shall be valid at each Site within the State. The Department understands that I-.JICS has a vested interest in the success of this program and the Department will endeavor to work closely with N I CB on the establishment of appropriate data screening procedures, storage and retention. Such criteria will be mutually endorsed by the Department and NICS in the form of a Clearance Agreement. Modifications to the Clearance Agreement may be made by mutual agreement.

5.3 Data collected by this system shall be released to NICS based on specific screening criteria established by Investigative Services and shall be retained by the CHP for a period determined by the Department. Data collected at theses sites will be shared with NICB to assist both entities in evaluating vehicle theft patterns and

trends and to establish and monitor the efficiency of the system at that particular site.

6.0 The Departmenfs Operational Responsibilities

6.1 As it would with State-owned equipment, the Department and other State employees or its agents will exercise reasonable care in the normal daily ()peration of NICS owned ALPR equipment located at California Sites. NICS accepts no liability for equipment that is not provided reasonable security or is subjected to abuse, misuse or neglect.

6.2 The Department will coordinate with NICS in the monitoring of the performance of· State-owned electronic screening equipment and respond to any component failure within 24 hours to repair or replace any component for which it is responsible as soon thereafter as is reasonably possible.

6.3 The Department will assist in coordinating among appropriate State agendes in accessing data for the purpose of validating stolen vehicle data for the ALPR program; at no cost to NICS.

The Department will provide notification to NICS ofroadway construction or other highway and Site closures that will impact ALPR Site operations.

The State will allow NICS to conduct physical inspections of operations at selected sites. Such inspections will be for limited time periods, consist of gathering data and be unobtrusive to site officers and operations.

The Department will monitor the performance of ALPR systems and components inclUding those provided by NICS and respond to any component failure in a timely manner.

The Department will routinely update ALPR Site computers r_ generally, at least once per business day -~ to include any appropriate additions or deletions of wanted vehicle data.

6.8 The Department will provide initial on-site training for enforcement personnel and staff at Sites and additional refresher training as necessary.

7.0 NICS's Operational Responsibilities 7.1 NICS will provide to the Department a series of standard ALPR operational reports

and tabulations summarizing ALPR operations and traffic volumes in the State. Any special reports or tabulations requested by the Department must be consistent with NICS data policies. NICS will provide special reports as necessary cit no charge to the Department.

7.2 NICS will ensure the security of any nonpublic State data provided to NICS. NICS shall allow only its employees, appropriate subcontractors and other authorized individuals to access nonpublic State data, and then only to perform the functions

and duties needed to analyze vehicle theft related data. No other access, use or sale of such data shall be allowed .

7.3 NICS will notify the Department prior to the installation, repair and or modi11cation of NICS provided Site hardware if Site operations will be affected.

8.0 Miscellaneous

8.1 Either party may terminate this Agreement at any date established by mutual agreement. Within 30 days following termination, at no cost to the State, NICB will remove all NICB-owned equipment from CHP Sites and return the Sites to the original condition prior to installation of ALPR equipment. In the event of termination by NiCe, the Department shall have the option of purchasing NICS's physical infrastructure investment in State Sites at NICB's investment value, but such option shall not include proprietary software or intellectual property. .

8.2 NICS shall indemnify, defend, and hold harmless the State of California, the California Highway Patrol, its Commissioner and officers, agents, and employees for and against any and all claims, losses, damages, liabilities, judgments and actions of any kind or nature, whether at law or equity, and any other costs and expenses, including reasonable attorney's fees and other costs of defending against such actions, arising from, in whole or in part, or" caused by the mellfunction or misuse of any materials, goods or equipment of any kind or nature furnished by NICS or its agent, or arising, in whole or in part, from any acts or omissions by NICS's directors, officers, agents, assigns, independent contractors or employees in relation to NICS's obligations and requirements under this Agreement or with respect to the subject matter thereof.

8.3 The Department shall indemnify, defend, and hold harmless the NICS and its member companies, officers, agents, and employees for and against any :and all claims, losses, damages, liabilities, judgments and actions of any kind or nature, whether at law or equity, and any other costs and expenses, including reasonable attorney's fees and other costs of defending against such actions, ariSing from, in whole or in part, frOm any acts or omissions by Department's directors, officers, agents, assigns, independent contractors or employees in relation to Department's obligations and requirements under this Agreement or with respect to the subject matter thereof.

8.4 The Parties shall comply with all laws, rules and regulations fOlWarded by the Department to NICB throughout the term of the Agreement, all as may be amended or updated from time to time.

8.5 Any modifications to this Agreement shall be made in writing and signed by the Parties.

8.6 All notices under this Agreement must be in writing and are validly sent if sent by overnight delivery or certified mail, return receipt requested, and shall be deemed received the third day following the date the notice is postmarked. Notices should be addressed as follows;

8.9 This Agreement is subject to and shall be construed in accordance with the laws of the State of California, and any litigation with respect thereto shall be brought in the courts of the State, to the extent permitted by law.

8.10 Each provision of this Agreement shall be interpreted in a way that is valid under applicable law. If any provision is held to be invalid, void or otherwise , unenforceable by a court of competent jurisdiction, such provisiqn may be reformed by the Parties, insofar as possible, to cure the defect and give maximum effect to their intent in entering into this -Agreement and in any event the remainder of the Agreement shall continue in full force and effect.

8.11 Titles and headings are inserted in this Agreement for reference purposes only, and shall not be used to interpret the Agreement.

License Plate Recognition Device

The CHP has deployed License Plate Recognition (LPR) technology statewide since 2005, beginning with a test project in 2003. The Department currently has deployed 19 mobile LPR patrol vehicles and four fixed sites throughout California.

The Department has been awarded a two million dollar Homeland Security Grant for the purchase of approximately 100 additional mobile LPR systems, pending spending authority approval by the California Legislature.

The Department has established in policy that all plates read by its LPR units are stored for a maximum of 72 hours. This mechanism is automated within the LPR server and purges all LPR data 72 hours following the reading of the vehicle's license plate. The Department's LPR coordinator conducts a weekly audit to ensure data is not retained or stored beyond the 72 hour window.

The system is protected from external access by firewalls and internal security features that are required by departmental policy, state laws, and regulations. Access to data stored within the server is limited to approved Information Management Division employees and specified Field Support Section LPR program personnel. Additionally, access to this data is limited to law enforcement personnel with an official investigatory need.

The LPR's have been responsible for the recovery of over 1600 stolen vehicles and the arrest of over 600 suspects. The estimated value of the recovered vehicles is nearly $13 million. Currently the CHP deploys and utilizes LPR systems as an enforcement tool throughout the State of California.

LPRs work as an electronic "hot sheet" of sorts. The license plate numbers of stolen/wanted vehicles are stored in a data base maintained by the Department. The LPR scans the license plates and alerts an officer when it matches the license plate of a stolen vehicle.

Testing was performed on a Ford Crown Victoria equipped with an Automated License Plate Reader (ALPR), manufactured by Vigilant Video, Condor VS Model COVS-647-564-08-VV-0. This vehicle was also equipped with a CPVE platform.

The test results indicate that the ALPR system installed with either a dedicated laptop or integrated into the CPVE system causes an unacceptable level of receiver de-sense. The de-sense manifests as an audible repetitive pulses that can be heard on the low band and UHF radios.

At this time, the Vigilant ALPR installation must be heavily altered to comply with the State receiver sensitivity requirements. It is not recommended for installation at this time.

Testing has been performed on 1 each Automated License Plate Reader (ALPR), Condor VS Model COVS-647-564-08-VV-0, Serial Number 2121010032, per State of Cali fomi a specification number DGS# IFB 1107-031. The ALPR unit evaluated was installed in a CPVE equipped Ford Crown Victoria Patrol vehicle (Vehicle 0637). The ALPR equipment consisted of trunk mounted equipment, laptop computer, and three roof-mounted cameras (driver-side and passenger-side cameras-forward of the light bar, and parking camera, passenger-side-rear of the light bar). It should be noted that the ALPR equipped vehicle utilized a laptop computer installed on the passenger-side of the vehicle, as the ALPR system in this vehicle had not been integrated into the CPVE. The purpose oftesting was to determine if the ALPR system caused any degradation to the CPVE/mobile radio systems, or the CPVE/mobile radios caused any degradation to the ALPR system.

The following Lowband, VHF, UHF and 700/800 mobile radio equipment and associated antennas were evaluated under various test conditions for degradation. A summary of those test results are listed as follows, with specific degradation versus test frequency data listed in Table 1:

1. Lowband mobile radio receiver degradation up to 12.4 dB (1 dB maximum degradation per Paragraph 1.2.4 of specification) was measured when the ALPR system (ALPR trunk equipment + laptop computer) was powered on. Repetitive pUlsing noises could also be heard over the mobile radio speaker. It was also noted that 5.0 dB oflowband receiver degradation occurred when the ALPR trunk equipment was powered on, but with the associated laptop powered off. RF noise from the laptop appeared to begin as soon as the computer began to boot up.

2. VHF mobile receiver degradation up to 14.9 dB (1 dB maximum degradation per Paragraph 1.2.4 of specification) was measured while the ALPR system was running. Degradation of up to 3.3 dB was noted when the ALPR hunk equipment was powered on but the laptop powered off. RF noise from the laptop began as soon as the computer was tumed on and began to boot up.

3. UHF mobile receiver degradation up to 2.8 dB (1 dB maximum degradation per Paragraph 1.2.4 of specification) was measured due to the ALPR system. Degradation did not vary, even when the laptop computer was powered off. Repetitive pulsing noises could also be heard over the mobile radio speaker.

4. No mobile receiver degradation was observed on the 700/800 mobile radio.

5. It should also be noted that interference to the ALPR system was observed when transmitting on the Lowband and VHF radios. A number of live camera images from the ALPR. system changed in brightness/became distorted when transmitting on those mobile radios.

A byproduct of the ALPR interference is audible repetitive pulses that can be heard on the mobile radio speakers in the Lowband and UHF bands. It should be noted that interference to the mobile receivers is likely to be widespread and may not be limited to the test bands and frequencies used in the testing associated with this report.

Although not specified in the State specification, the close proximity of the driver-side and passenger-side ALPR cameras to the VRS antenna could affect the antenna's radiation pattern. Further investigation and testing would be necessary to detelmine the effect the cameras have on the VRS radio antenna performance.

Field Support Section (FSS) has recently procured 120 new mobile License Plate Recognition (LPR) units from Vigilant Video. In order to efficiently test, install, and deploy these new units to the field in a timely manner, Enforcement and Plmming Division (EPD) is requesting coordinated assistance from Fleet Operations Section (FOS).

Field Support Section is requesting an FOS technician be made available on IV:i.onday, October 31, 2011 to assist Vigilant Video with the installation of two test LPR units. The installation is scheduled to be conducted during one eight and a one half hour workday. Vigilant Video will be onsite at FOS to provide guidance and direction. On Tuesday, November lSI, and Wednesday, November 2nd, FSS is requesting the availability of one teclmician to be present during the protocol testing which will occur at the Academy. h1 addition to the protocol testing, one LPR vehicle will be sent over to the Department of General Services (DGS) for radio frequency interference (RFI) testing. Although it is not anticipated that the FOS technician will be needed for the RFJ testing, FSS requests that one technician be made available to respond to DGS should adjustments to the installed LPR unit be needed.

The protocol testing is scheduled to conunence during daylight hours on Tuesday, November lSI and during nighttime hours on Wednesday, November 2nd

. In order to ensure efficiency during the protocol testing, FSS is requesting that an FOS teclmician be present for teclmical assistance. This would require the FOS teclmician adjust their work schedule on 'Nednesday,.November 2nd in order to be present during the nighttime testing. Exact times for testing will be coordinated between FSS staff and the FOS technician.

In looking fonvard to the installation and eventual deploymenl of the remaining] ] 8 units to tbe field, EPD is requesting ongoing coordination belween FOS and FSS be maintained to ensure that LPR units are installed and properly deployed. The remaining LPR units have been strategically designated to be deployed to ueld divisions in order give them the additional tool needed in order to combat vehicle theft.

The California Highway Patrol is procuring Automated License Plate Reader (ALPR) systems for installation in patrol vehicles.

1.2. GENERAL REQUIREMENTS

1.2.1. ALPR system shall be a 3-camera system. Each camera shall be capable of infrared detection and color overlay.

1.2.2. ALPR systems shall be in compliance with the California Vehicle Code including, but not limited to, the requirements noted in Division 12, Chapter 2.

1.2.3. ALPR systems demonstrating the ability to comply with the requirements in this specification shall complete CHP testing protocols one through five with an efficiency rating of no less than eighty (80) percent on any individual protocol. The testing shall include both daylight testing and testing during hours of darkness. Refer to Attachment A for CHP testing protocols.

1.2.4. The ALPR system shall have an overall efficiency rating of no less than eighty five (85) percent in aggregate upon completion of CHP protocol testing.

antenna whether it be radiated or conducted radio frequency interference (RFI), or electromagnetic interference (EM I). If the system causes any two or all three types of interference, the total combined allowable receiver degradation is 1 dB at all CHP frequencies. See Attachment B for radio degradation testing details.

1.2.6. In the future, the ALPR system may be controlled by a third party control device known as the Consolidated Patrol Vehicle Environment (CPVE). Should the CHP choose to integrate the ALPR into the CPVE environment, the ALPR supplier shall cooperatively work with the CHP and the CPVE contractor to successfully accomplish this integration effort.

2. PRODUCT REQUIREMENTS

2.1. FUNCTIONAL REQUIREMENTS

2.1.1. The ALPR system shall read and record the Vehicle License Plate (VLP) of a target vehicle whether it is approaching or receding from the image capturing device.

2.1.2. The ALPR system shall read the VLP of the target vehicle while the platform is stationary or mobile. Additionally, the system shall read the VLP of a target vehicle while the target is stationary or mobile.

2.1.3. The ALPR system shall read VLP's where the speed differential between the patrol vehicle and the target vehicle is up to 110 mph without degradation.

2.1.4. The ALPR system shall be able to read plates from other states and that capability shall include the capability to read plates (compliant with appropriate state legislation) from Nevada, Arizona, and Oregon as a minimum.

2.1.5. The ALPR system shall have the ability to read those plates that remain readable to the human eye where some characters are partly obscured (e.g. tow hitch).

2.1.6. The ALPR system shall present within the graphic user interface (GUI) a cropped image of each plate (hereafter referred to as a 'plate-patch' image) alongside the digitized read to allow for operator verification.

2.1.7. The plate patch image and digitized read will be presented to the operator at sufficient size to be readable (on a 10" or greater screen) from a distance of up to 4 feet.

2.1.8. The ALPR system shall also present within the GUI an uncropped color image of each plate read (overview). The overview image shall be of sufficient dimension to allow the operator to identify the vehicle type and color.

2.1.9. The ALPR system shall allow the operator to search the captured plate database for vehicle license plates. All matches to the search shall display the vehicle plate patch, vehicle overview image, date and time stamp and GPS location.

2.1.10. The running log will have a scroll function allowing the operator to look through previous reads. Any previous reads, when selected by the operator will be presented in the GUI with the overview and plate-patch images, alongside a timestamp and GPS location of the selected read.

2.1.11. The ALPR system shall be capable of displaying an on-screen map of the GPS coordinates associated with selected reads.

2.1.12. The ALPR system shall provide the operator the ability to display an on-screen visual

map of the location of a read on all screens where a GPS location is provided (hit, read, and search screens)

2.1.13. At all times, the operator will have the opportunity to correct any misreads by the system. The option to correct a plate will be presented as a single or double touch icon in the GUI and shall not require the use of sub-menus.

2.1.14. The correction of any plate will be included in an audit trail and the corrected plate will be sent to the database for matching.

2.1.15. Once the VLP of the target vehicle has been read, the ALPR system will search all relevant databases for the VLP.

2.1.16. Only one context-compliant result will be reported for each license plate read and sent to the database for searching.

2.1.17. If there is no record of the VLP on any such database the ALPR system will record the reading and log the read and the image in a running log. This log of plate reads shall be available for review by the operator.

2.1.18. All VLP's that DO NOT match a loaded database shall be stored as a "read"/"detection", which shall contain information, as a minimum, of operator's identity, GPS location and timestamp and the relevant plate-patch and overview images. This data shall be stored on the local hard drive until such time as it has been exported for storage.

2.1.19. The GUI will present a single-touch icon to the operator for the manual entry of a license plate for checking. Any plates entered by this method will be sent to the database for matching and the transaction recorded in an audit trail.

2.1.20. If the reading of the vehicle is matched against any of the VLP's that are held on any of the databases within the ALPR system, it is considered to be a match; The operator will be provided with an image of the VLP and the vehicle in order that he I she can make a comparison and verify the match.

2.1.21. The ALPR system will automatically trigger an audible alarm and display of a "hit screen" when a match is made against the database. The system will simultaneously provide the operator with a report from the database relating to the VLP match.

2.1.22. The hit screen will contain the plate patch, VLP interpretation, color overview, time of capture, database source identification, vehicle and other details from the database.

2.1.23. The ALPR system shall allow for variations to the audible alarm specific to the database from which the match was generated.

2.1.24. The ALPR system shall maintain a record of the number of hits made and the details of all matches.

2.1.25. The ALPR system shall be capable of sending a JPEG compressed image, via e-mail to a destination configurable by the system administrator, of the originating video source from such a hit within a few seconds as a verification of the remote alert in 2.3.11.

2.1.26. The ALPR system shall utilize GPS data to log where and when the match against a VLP was made.

2.1.27. All devices shall continue to read VLP's while the operator is dealing with a current match or dealing with any other menu or sub menu of the system.

2.1.28. For all VLP's that match a loaded database, the system shall display database's description code on the GUI.

2.2. HARDWARE REQUIREMENTS

2.2.1. The ALPR system shall be capable of being operated, with an adequate power supply, 24 hours a day, 365 days a year.

2.2.2. The ALPR system shall be capable of operation on all of the CHP's current touch screens. All icons shall be of sufficient size to allow operation via the touch screen without the use of a stylus.

2.2.3. The import/export of the data shall be achieved via a standalone device, e.g. USB memory stick, which shall be independent from the current systems environment, or by wireless means to the ALPR Database Server Application (See requirement 2.3.3).

2.2.4. Cameras used by the system shall be housed in weather proof housings capable of withstanding extreme conditions. The system shall be sealed to prevent damage from the elements and to prevent moisture from depositing on the lens during operation.

2.2.5. If mounted on the exterior of the vehicle, cameras shall be low profile and be small enough in size as to not interfere with existing equipment. (light bar)

2.2.6. If mounted in the interior of the vehicle, the camera shall be of such a size as to not present a strike hazard or interfere with the driver's vision.

2.2.7. For exterior mounting, manufactures shall supply a stable permanent camera mounting system capable of withstanding the extreme driving conditions experienced in patrol operations. The mounting system or systems shall be compatible with the Federal Signal Vision and Whelen Liberty light bars currently in use by the CHP and shall not interfere with the operation of these light bars. If mounted on Whelen Liberty Light bars, the mounting shall be approved by Whelen and shall not alter the warranty of the light bar.

2.2.8. Mounting systems shall be capable of horizontal, vertical and rotational movement to ensure optimum camera alignment. Once secured, the mounting shall not move under normal operating conditions, including extreme wind pressures, rough terrain and mechanical car washing.

2.3. SOFTWARE REQUIREMENTS

2.3.1. The ALPR system shall be software based and capable of running on standard computers, Mobile Data Computers, or the CHP's current mobile computer environment running Windows XP professional or newer.

2.3.2. The operating system shall be able to be configured, if required, by State information technicians with the assistance of the supplier, to meet current security policies, e.g. desktop restrictions. The ALPR system shall recognize license plates that are compliant with California legislation for the current style and manufacture of license plates.

2.3.3. The software supplied by the vendor for this project must include database server connectivity software to facilitate the remote transfer of data to and from an ALPR Database Server Application.

2.3.4. Where alternative import / export routines are considered in accordance with the

requirements of this specification, and in order to ensure a capability to import and circulate reports as required, devices and data shall be compatible with the following operating systems: Windows XP Professional or newer.

2.3.5. The process of importing data shall allow the ability to bring in single databases to add to already existing databases held on the system.

2.3.6. The ALPR system shall allow for multiple databases of target VLP's. Those databases shall allow for the entry of both license plates and associated data. The associated data field shall accommodate not less than 200 characters of entry.

2.3.7. All databases shall have a priority set against them. The priority level of each database shall be definable by the system manager. While an operator is dealing with a match on the device, should a further match be made it shall, depending on whether its database priority is higher or lower than that being dealt with, place the new match "behind" or "in-front" of the current match.

2.3.8. After a valid user logs onto the system, the user shall be given an option to import new databases and at the same time export and thus clear down any images/information captured since the last import/export.

2.3.9. The ALPR system shall offer different levels of privilege and access to databases for users which can be configured by the system administrator.

2.3.10. In terms of Homeland Security and the policing of serious and organized crime, the database software must include the ability to set up and protect databases that are extremely sensitive in nature, and are only accessible and alerted to those operators with the appropriate privileges.

2.3.11. The ALPR system will be configurable to run such databases as 'covert' databases for general users - not alerting general operators to vehicles that match on those databases, but capable of remotely alerting interested parties with the appropriate privileges via GSM text message or e-mail. Such remote alerts will include VLP, GPS timestamp and the originating system 10.

2.3.12. Any data stored on the hard drive shall be encrypted prior to export.

2.3.13. The ALPR system shall be able to provide, in the exported data, an audit trail capable of being presented in evidence including, as a minimum the following: log on/log off data, database upload information, details of vehicles checked and 'hits' generated.

Operator Training

• The contractor shall provide a "train the trainer" class for up to 25 persons.

• The operator/user training course shall cover the complete aspects of the operation of the Automated License Plate Reader (ALPR) from a user/system operator prospective, including, but not limited to, setup, configuring networks, etc., for the equipment specified herein.

• The training course shall be conducted at the ordering agency location to be identified in the purchase document.

• The contractor shall provide a complete operator's instruction/guide on the setup and operations of the ALPR.

• The operator training course shall include operating procedures for all the different types of required equipment.

• The contractor shall provide a general operating booklet for each of the participants in the operator training course.

• The booklet shall include a description of each operational feature and function. The description shall state what the feature/function does and how to activate/deactivate it.

• A copy of the manufacturer's training, on CD or DVD format, shall be given to each student that attends a training class.

Technician Training

• The contractor shall provide a "train the trainer" class for up to 25 persons.

• Given a classroom condition with the specified equipment and materials, the State technical staff shall learn the information necessary to earn the manufacturer certification for maintenance and repair.

• The training course shall be designed for a group of 25 students per class.

• The length of the course shall be sufficient to provide for the training objective. The training shall not exceed eight (8) hours on anyone day and the days shall be consecutive.

• The training course shall be a manufacturer certified course for the equipment specified. The training course shall include, but not be limited to, the following topics:

o Installation and initial checkout procedures. o Theory of operation. o Programming software procedures. o Routine maintenance practices and procedures. o Trouble-shooting techniques and procedures.

• The training course shall be conducted by a manufacturer trained and certified instructor. The State prefers the training be provided by a certified instructor employed by the manufacturer. If the manufacturer does not directly employ the instructor, the contractor of the equipment shall provide, upon request, to the State, proof of certification that the instructor is manufacturer trained on the specified equipment and will present the same course as if given by the manufacturer.

• The contractor shall supply each trainee with the following material (in electronic and hardcopy form) that is specific to the equipment ordered:

o A copy of the Operation and Maintenance manual o Documentation covering all modifications made to the equipment in

compliance with the State specification. o Programming software. o Programming instruction manual. o A copy of the manufacturer's training, on CD or DVD format will be

given to each student that attends a training class.
