June 22, 2015 OSCAR NUNEZ 603 Isabelle Royale Hotel and Suites, Valdez Street, Barangay Poblacion, Makati City, Philippines RE: FORMAL DEMAND LETTER Dear Mr. Nunez: For almost seven (7) months you have failed to substantially construct the Three Story Residential Building with Roof Deck as agreed in the January 5, 2015 Acknowledged Memorandum of Agreement you had with me. You’ve received payment, as agreed, in the aggregate amount of PHP1,080,000.00 for the construction of the said building but you’ve barely even started and the Two Hundred Thirty (230) day agreed deadline is barely a month away. Finishing construction in time, as of the writing of this letter, is an impossibility. I have constantly asked you to do your work but you’ve ignored our calls and texts. In the off chance that you do reply, you do so through text with excuses of purchase of materials and empty promises of continuing construction. I have put up with your inaction for quite some time now and have suffered untold emotional and monetary hardships because of you. I have lost trust in you and decided to discontinue our agreement for material breach of the provisions contained therein. For this reason, FORMAL DEMAND is hereby made upon you to return the aggregate payments in the amount of Pesos: One Million and Eighty Thousand (PHP 1,080,000.00), and pay legal interest with respect to the delay. Your failure to heed this demand shall leave me with no other recourse but take appropriate legal steps

Your failure to heed this demand shall leave me with no other recourse but take appropriate legal steps including filing a case in court to enforce my right and protect my interest.
