Starting Pizza Delivery? Have questions? Welcome to the Miami Subs Pizza Delivery 

Insurance Handbook. The purpose of this guide is to walk you through what Delivery

Insurance is and why it is extremely important to have it. We ask that you take the time to

read this information carefully. Delivery Insurance protection is a key component to

keeping you, your employees, and your business safe and sound.

OVERVIEW

Prior to start Pizza Delivery, you will be

required to obtain the following types of 

insurance coverage:

1. Delivery Insurance

2. Workers Compensation

Coverage

Restaurantinsuranceonthego.com, a PJK

with both of these coverages at a

competitive pricing. For more information

Should you decide to purchase your

Delivery Insurance coverage from another

source, you must be sure that the insurance

company you select has at least a financial

rating of A by A.M. Best.

Miami Subs Required Coverage

Limits

1. Delivery Insurance

Simply put Delivery Insurance covers your

business in the event an employee, while

delivering food in your behalf, injures

another person. Lawsuits against

businesses delivering food are becoming

increasingly common and the legal costs,

court fees and damages, even if you are

ultimately vindicated or found to be not at

fault, can have a devastating impact on your

business.

It is important to note that while an

employee is driving his or her own personal

car on company business that their auto

policy will respond on a primary basis for an

accident. Your Delivery Policy will respond

excess of the personal auto policy.

By your Miami Subs Franchisee Agreement,

you are required to carry a minimum

amount of $1,000,000 Combined Single

Limit (CSL) of Delivery Insurance.

2. Workers Compensation

Workers Compensation covers workers

injured on the job, whether they’re hurt on

the workplace premises or in auto accidents

while delivering. Workers Compensation

also provides payments to injured workers,

without regard to who was at fault in an

accident, for time lost from work and for

medical and rehabilitation services.

It also protects you from lawsuits resulting

from workplace accidents.

By state law, and by your Miami Subs

Franchisee Agreement, you are required to

carry the minimum amount for all

employees:

$100,000 per accident

$500,000 disease – policy limit

$100,000 disease – each employee

MOTOR VEHICLE REPORT (MVR)

Before you hire a driver to deliver for you, you

will need to make sure that the driver has a

current, valid operator’s license and a

satisfactory driving record.

As a Miami Subs franchisee, you can obtain

Motor Vehicle Reports in two ways:

1. Calling ChoicePoint MVR Services at

1-888-888-8888

2. Faxing an MVR Request to fax # 954-979-

Motor Vehicle Reports

Why it’s needed 

Can you tell by just looking at someone that

they are a good driver? Of course not! The

motor vehicle report (MVR) is a standardized

report (by state) that accounts for the driving

records of the individual – moving violations,

accidents, DUI, etc. are all documented. A MVR

will verify that your present or prospective

driver has a current, valid operator’s license and

a satisfactory driving record. They reflect a

person’s driving habits and, to a degree, indicatefuture driving habits/practices.

What to look out for

Individuals with these violations should NOT  be

hired as drivers:

More than two moving violations

in the last 36 months

One at fault accident in the last 36

months

The driver also CANNOT have ANY major traffic

citations or incidents. Major citations are as

follows:

Driving Under the Influence

Driving While Impaired

Driving in Possession of Alcohol or

Drugs

Refusal to submit a blood, urine or

breath test

Driving with a suspended or revoked

license

A Felony in which a vehicle is used (i.e.

Vehicular Manslaugther, VehicularHomicide, Vehicular Assault, Hit & Run,

eluding a peace officer)

Reckless Driving

Careless Driving

Driving over 100 MPH; Speed Contest;

Racing

Driving 35 MPH or move ABOVE the

posted speed limit

Other Considerations

Drivers must be at least 18 years of age

and have a minimum of two years

driving experience

If the driver has a violation for driving

without current vehicle registration, a

current license, or current insurance;

then that driver must have the

insurance checked at least every 3

months for 2 years

All vehicles driven on your behalf should

be inspected and meet state’s safetyrequirements

NO driver shall under ANY circumstance

carry passengers in/on the vehicle during

deliveries

A driver charged with any MAJOR 

citation must be suspended from driving

duties until all charges have been

dismissed or a judgement is entered in

favor of the driver. Until this is resolved,

the driver may NOT drive

Any driver observed driving in an unsafe

manner or driving an unsafe vehicle,

must be barred IMMEDIATELY from

driving duties

Drivers shall NOT be permitted to

operate a cellular telephone or other

similar device while operating an

automobile on your behalf. If a driver

has a need to use such device in the

course of performing his or her duties,

the driver should utilize a hands free

device or exit the roadway and park the

vehicle to make a call. Any driver caught

in non-compliance of this policy should

be considered for termination or placed

in a non-driving role

Do’s and Don’t’s

DO Hire and keep good drivers. Let it

be known IN WRITING that you

don’t tolerate bad or aggressive

drivers

DON’T  You may be tempted to pay

yourself for small claims (say

$1,000 and under). But NEVER - 

NEVER - NEVER make

payment for claims yourself  – 

you may void the insurance

policy and the insurance

company’s defense, putting

yourself at risk of being without

legal defense protection

DO Establish a filling system that

can help you keep track of your

drivers MVRs, insurance and

vehicle information, and

deliveries made

DON’T Hurry your drivers or stipulate

that the delivery be

accomplished within a specified

time of receiving an order

Frequently Asked Questions (FAQs)

Q. I registered the auto that I use for my delivery 

in a separate company that owns nothing but 

the auto. My store is protected from claims,

right?  

A. No, you are not. In most states, common

ownership of assets and shared operations may

allow an injured person to sue you. We highly

recommend that you discuss this further with

your attorney.

Q. What if I hired drivers as independent 

contractors? Would that release me from any 

delivery liability? 

A. No, it would not. Only because you may call

someone an independent contractor for taxing

purposes, that doesn’t make them one. Courts

determine this on a case by cases basis. We

highly recommend that you discuss this further

with your attorney.

Q. What if I transferred all of my assets to my 

wife’s name – would that make me judgement 

 proof?  

A. No, it would not. You could still be subject to

the anguish and process of a Court of Law. We

highly recommend that you discuss this further

with your attorney.

Q. I am only hiring drivers that have their own

insurance policy, why do I need to purchase my 

own?  

A. What if the delivery person has little insurance

or if it just cancelled? There would be nothing to

protect your business.

Q. What type of insurance are my drivers required 

to purchase and maintain while working for me? 

A. Florida’s minimum coverage is $10,000

personal injury protection (PIP) and $10,000

property damage liability per person and $20,000

per accident. This is commonly referred to as

10/20/10.

Q. Is there a limit of how many drivers I can have

delivering at any one time? 

A. No, there is not. You can hire and keep as many

qualified drivers as you need.

Q. Can my drivers deliver anything that is on my 

menu? 

A. Yes they can.

Q. How do you determine the premium for my delivery policy? 

A. Your policy premium is determined by many

factors, including but not limited to: Delivery

Annual Gross Sales.

Q. Can this premium be financed or do I have to

 pay it in full? 

A. The premium can be financed with 25% down

payment and 9 monthly installments. Financing

charges apply.

CLAIMS

What to do after an auto accident:

Stay as calm as possible. Check for

injuries. Life and health are more

important than damage to vehicles.

When in doubt, call an ambulance

If the accident is minor and there are

no serious injuries, move cars to a safe

place, rather than risk being in moving

traffic

Turn on hazard lights. If needed and

possible, use cones, warning triangles

or flares for safety

CALL the police no matter how minor

the accident is

Don’t sign any document unless it is

for the police or a representative of 

your insurance company

Make immediate notes about the

accident including the specifics

If possible, obtain witness informationBe polite, but DON’T tell the other

drivers or the police that the accident

was your fault, even if you think it

was. After accidents people are

normally shaken up and it is wise to

state only the facts

Limit discussing the accident to your

insurance agent and the police. Even if 

the facts are embarrassing to you, be

truthfulIf possible and if it is safe to do so,

taking pictures of the accident scene

may be helpul

Reporting a claim

Claims can be reported by calling 1-800-622-2122

When reporting a claim, please try to have this

information handy:

Date, time and location of the accident

Information on the other driver, including

name, address, phone number and driver

license number

Details on the other vehicle involved,

including make and model, license plate

and VIN

Insurance information from the other

involved parties, including the carrier and

policy numbers

Contact information for any witness and

law enforcement agencies that arrived atthe scene
