    OBJECTIVES

    Improve the efficiency in disposal of the business of Ministry ofCommerce.

    Delegate the powers vested with the Secretary Commerce to thelower echelons, as required under existing system of control.

    LEGAL REQUIREMENT FOR DELEGATION OF

    POWERS

    The Secretary Shall determine the maximum extent of delegation of

    powers to officers serving under him and issue clear standing orderslaying down these powers and also the manner of disposal of cases in theDivision and shall ensure that: -

    a) The distribution of work is equitable;b) The channel of submission of cases is vertical and

    not horizontal; andc) The tiers through which a case has to pass are

    ordinarily not more than two excluding theSecretary

    The Secretary shall review the delegation of powers to various

    officers periodically to ensure maximum delegation of authorityfor disposal of cases at the initial and middle levels, with anappropriate reporting system to keep him fully informed.1

    The Secretary may sub-delegate certain financial powers as areprovided and allowed under the System of Financial Controland Budgeting circulated vide Finance Divisions O.M. No.F.3(2)Exp.III/2006 dated 13-09-2006

    FRAMEWORK FOR DISPOSAL OF OFFICIAL BUSINESS

    Secretary

    The following cases shall be submitted to the Secretary of a Division2

    : -

    a) All cases, summaries and reports requiring submission to thePresident, the Prime Minister and the Cabinet.

    b) All the cases involving major policy and important administrativeissues.

    c) All the cases of appointment or promotions that have to be referredto the President, the Prime Minister, Minister-Incharge,Establishment Secretary or the Selection Board.

    d) All the cases involving foreign delegations and deputations abroad.

    e) All important cases relating to development plans, annual budgetand foreign exchange of requirements.

    f) All the cases of transfers of heads of Departments and theirDeputies.

    g) Proposals received from Provincial Governments which it isproposed to reject.

    Additional Secretary / Joint Secretary

    An Additional Secretary or a Joint Secretary, unless he is incharge ofa Ministry/Division, shall be entrusted with a well-defined sphere ofduty. Within this sphere he shall assume full responsibility and shallsubmit all cases direct to the Ministry for orders, such cases beingreturned to him through the Secretary. The Secretary shall have the

    power, however, to call for any case for his own consideration and to

    request that he be consulted in any particular case before it issubmitted to the Minister.

    Deputy Secretary

    A Deputy Secretary shall dispose of all cases in which no majorquestion of policy is involved or which under the rules or the standingorders he is competent to dispose of.

    Section Officer

    A Section Officer shall dispose of all cases where there are clearprecedents, and no question of deviation from such precedents isinvolved or which under the rules or standing orders he is competentto dispose of. In case of doubt he may seek verbal instructions fromhis senior officer.

    1 Creationoftemporary posts

    The creation of new posts inthe current expenditure shallrequire the approval of theFinance Division, even whenthese are included in thecurrent budget. The

    Secretaries of theMinistries/Divisions shallhave full powers to createnew post(s) in theDevelopmentExpenditure/PSDP, includedin PC-I or PC-II after theapproval of the project by therelevant forum subject toavailability of developmentbudget against EmployeesRelated Expenses. Theseposts shall be continued on

    year to year basis till thecompletion of the project.Such post(s) will cease toexist on theclosure/completion of theproject. After completion ofthe project and submission ofPC-IV, the barest minimumand essential posts(s) shall beconverted from DevelopmentExpenditure to CurrentExpenditure with theapproval of the Financial

    Adviser.

    The powers for revivalof that post shall not beexercised withoutobtaining priorapproval of theFinancial Adviser.

    year so that the postsnot agreed to by theFinancial Adviser arenot continued in thenext financial yeareven for a day.

    Establishment Divisionwill first be referred tothe EstablishmentDivision for clearance.

    (III) (a) No Ministry/Division/Deptt/Subordinate Office (including anyautonomous body) shall be authorized to re-appropriate funds from one developmentscheme to another development scheme. Inexceptional cases, however, re-appropriationof such funds may be allowed, wherenecessary, by Financial Adviser on therecommendation of Planning andDevelopment Division.

    (b) In the case of development schemes

    controlled/executed by the Planning andDevelopment Division themselves, approvalfor re-appropriation of funds from onedevelopment scheme to another, ifnecessary, shall be made with the priorapproval of the Financial Adviser to thatDivision.

    In the case ofexpenditure onworks, the conditionslaid down inparagraphs 31 and 32of Appendix 6 to theCentral Public WorksAccount Code shallalso apply.

    tear fluctuation in marketprices and obsolescence.
