FACTUAL ANTECEDENTS On 09 January 2015, MIPGC filed the instant Petition for the recovery of the allegedly unauthorized deductions made by NPC om its payments based on an existing Generating Capacity Purchase Agreement (GCPA) and Supplemen tal Agreement to the GCPA (Supplemental Agreement) executed by and between the following parties: (1) NPC; (2) PowerOne Corporation (POC), MIPGC's predecessor; and (3) Oriental Mindoro Electric Cooperative, Inc. (ORMECO).
