In her farewell column last year, in commenting upon CVR MLS, 2010 President Karen Smith wrote: “it has

been a year of sowing seeds, many of which I hope will come to fruition in 2011.” As the end of 2011

approaches, I’m pleased to report that, indeed, many seeds have borne fruit this year.

All of the technology products launched in 2011 are designed to save members time, money, and effort as

well as to enhance their ability to meet the needs of their clients. In the first half of the year, we added DoxBox™

and Authentisign™. The former provides tremendous electronic storage capability (literally an electronic file

cabinet of real estate transactions) and the latter allows agents and clients the ability to execute transactions with

electronic signatures. These tools provide greater flexibility for those REALTORS® whose clients wish to combine

“high tech” with “high touch”.

In June we debuted a completely overhauled Mobile MLS. If you haven’t tried Mobile MLS in the past six

months, you don’t know what you’re missing. Mobile MLS literally puts the MLS in the palm of your hand; and

the ability to contact your fellow agents is just a click away. Just a couple of months ago, in September, we

launched rbiStats, an online statistical analysis of the local housing market. Through colorful graphs and charts,

rbiStats provides members with a clear, concise analysis of current market trends. In this day and age, we all

know that it’s not enough to provide listing data to buyers and sellers; rather, our value proposition is the wise

counsel we offer our clients. For members who wish to hone their market expertise, rbiStats is an excellent tool.

While the MLS was introducing us to a number of new, time-saving technologies, the Association was

providing us with a number of opportunities to learn how best to integrate these tools into our daily business

practices. In addition, RAR hosted a number of “special” educational, highly topical seminars in 2011 including:

RESPA Do’s and Don’ts; a housing forum with Majority Leader Eric Cantor; and most recently, an afternoon with

political scientist Dr. Larry Sabato. Dr. Sabato’s pithy commentary served as the introduction for our annual

RPAC reception. I’m really proud of the fact that despite the continuing challenges in the market place, so

many of you continued to support the REALTOR® Political Action Committee. Combined with our year-round

lobbying efforts, RPAC remains the best defense we have against ill-conceived legislation and burdensome

regulations that threaten our livelihood.

Speaking of our livelihood, the 2011 Central Virginia housing market is currently on pace to close out the

year slightly above or at least at the same level (in terms of units sold) as 2010. That’s quite remarkable given

that we had no housing tax credit to spur buying activity this year. And “remarkable” is the word that best

describes my year as your president—remarkably fast, remarkably fun, remarkably productive for you, the

members. I am honored to have served as your president. I now pass two batons, one to Scott Ruth who will

serve as your 2012 President of RAR; and one to Shanna Wiseman, 2012 CVR MLS President. Both Shanna and

Scott are smart, dedicated, and hard-working REALTORS® who will do superb jobs. We’re all in great hands.

CVR MLS added an impressive array of relevant and cutting-edgetechnology tools and services in 2011. In an increasingly mobileand online real estate marketing environment, members now haveat their disposal some of the most powerful and practical digitalbusiness tools available. The following tools and services weremade available to CVR MLS members in 2011:

1. Instanet Solutions – By adding both DocBox™ andAuthentisign™, CVR MLS now provides the full suite ofInstanet™ document creation, management and distributionservices. The completely paperless online electronic transactionis now possible. Using the Transaction Desk (TD) link inTempo™, members can now pull up a listing record on their PCand import the information directly into Instanet’s™ TransactionDesk. From there, they can automatically assemble and begin tofill out all necessary documents and forms, store them online,send them to all involved in the transaction for electronic signa-tures, then distribute them via email or fax. All of these tasks cannow be conducted completely electronically.

DocBox™ – Unlimited online storage and document distribution.With the use of DocBox™, members can access their completedreal estate transaction documents from any internet enabled deviceand distribute them to anyone electronically. The service providesunlimited online storage capacity. Documents can be emailed orfaxed to and from DocBox™, uploaded from a PC, or sent toDocBox™ directly from Instanet™ Forms. Included with DocBox™is the mobile access application DocBox2Go™, which wasdeveloped for use with Smartphones, iPads and tablets.

Authentisign™ – Electronic signature application.Any document, agreement or contract that requires legal authoriza-tion can now be signed electronically. Authentisign™ is simple touse, secure, and maintains a complete paper trail. Whichevermethod an agent uses to create a digital copy of a document,Authentisign™ will make it possible to sign digitally. In addition toallowing the online execution of agreements, Authentisign™ auto-matically emails copies with all signatures to those who havesigned the document.

2. Mobile MLS by Kurio® – Mobile MLS Access. Mobile MLS by Kurio® allows members of CVR MLS to access theentire database of MLS listings on any mobile internet enableddevice. Users can search for listings, view key information, view allphotos, e-mail listings with photos to clients and obtain listing agentand office information. It includes a variety of additional features,such as the ability to view similar listings in the immediate area,search by subdivision, find a property’s Walk Score®, and more.

3. rbiStats – An internet-based supplemental statistics tool. Members can access regional CVR MLS market trends in a varietyof graphs, charts, metrics and formats, then link this information totheir websites for customers and clients to view. The CVR MLSrbiStats page provides an intuitive and user friendly market snap-shot, as well as an online visualization of a wide variety of markettrends. In addition to this CVR MLS member benefit, RBI also offersa subscription service for more in depth market trend informationand highly customizable reporting.

4. RatePlug – Interactive, real-time mortgage information forlistings. RatePlug allows brokers to deliver interactive, real-timemortgage program, payment and qualifying information to clientsright from within Tempo™ listings. The tool also allows brokers ameans of promoting affiliated mortgage entities, or displaying up tothree preferred lenders of choice. It provides home buyers seekingfinancing options with a one-stop-shop approach.

5. MLS Resource Center – Valuable reference information.Accessible from My Sidebar within Tempo™, the Member ResourceCenter gives members searchable access to CVR MLS Rules andRegulations, upcoming class schedules, RAR and CVR MLS contactinformation, as well as monthly regional market trend reports fromRE Stats and quarterly reports from George Mason University.

With the introduction of these new tools, members have gainedaccess to several of the best technologies the industry has to offer.The CVR MLS will continue to make strides in time with the evolv-ing digital age of real estate.

For Central Virginia REALTORS®, 2011 was a year marked by signif-icant listing inventory, an increase in foreclosures and auctions, andeconomic uncertainty. With these market conditions came changesin buying habits, increased investor activity, and a surge in demandfor rental properties and property management services. Theseissues, among others, prompted a number changes to the CVR MLSrules and regulations, the addition of new fields in TEMPO™, andthe development of new transaction related forms.

Short Sale Pending Exemption RemovedCVR MLS listings subject to a ratified contract, including thoseawaiting lender approval, must now be pended in the MLS systemwithin three (3) days of Seller ratification. (Listings subject to a firstright of refusal may remain active until the first right has beenremoved).

Seller IdentificationThe full name of the Seller is required in the TEMPO™ OwnerName field. This requirement proved difficult for some REO listingswith a change in the asset managers or holding entity during thecourse of the listing. In these instances, if the name of the Seller isunknown at the time of listing entry, the term Owner of Record maybe entered into the Owner Name field. A Listing Participant orSubscriber must update the Owner Name field within 3 days ofobtaining the correct name(s) of the Seller(s). This provisionapplies only to listings entered with REO, as a selection in theOwned By field.

Auction Listings and Specified List PriceIn addition to listings subject to auction bylicensed auction firms, a number of listings wereentered into the MLS with sales prices that didnot accurately reflect what the owner was willingto accept, in the hopes of generating multipleoffers. This practice is a violation of the CVR MLSRules and Regulations, as well as a potential eth-ical violation for misrepresentation. New rulespertaining to Auction properties have beenadded to clarify the terms and conditions underwhich auction properties may be added to theMLS database and the basis for the list price.Note: Only licensed auctioneers may advertiseand auction real property in the state of Virginia.

SUPRA Lockbox Serial Numbers – New field addedThe SUPRA LB Serial# field in TEMPO™ mustnow be completed for any listing with lockboxservice authorized by a Seller. When LockboxCall Agent, Lockbox Call Owner, Lockbox CallTenant or Lockbox Go Direct is selected from theShowing Instructions drop down menu, users areprompted to enter the 8 digit SUPRA lockboxserial number. Note: The requirement to manu-ally populate the SUPRA LB Serial# field is notsatisfied by the process of linking a lockbox to alisting through SUPRAweb.

New “Structured Compensation Terms” FieldAll listings entered into the MLS database mustcontain an unconditional offer of compensation.Compensation must be expressed as a percent-age of the gross price, a flat fee, or a combinationof both. Compensation may be structured asagreed upon by the Seller and the listing broker,provided that the amount of compensation canbe calculated by a cooperating broker at the timean offer is prepared. The new StructuredCompensation Description field offers the listingagent the ability to describe the details or formu-la needed to determine his or her compensationfor a particular listing. This field may not be usedto alter or condition an offer of compensation, orto describe bonus information.

For the second time in four years, incumbent Supervisor G.Ed Via defeated Kevin Damian for the Ashland Board seat. Mr.Via defeated Mr. Damian by 15 votes in a three way race in 2007.

Winning a three way race, Supervisor Elton Wade will returnto office for his sixth term to represent the Cold Harbor District.

Beaverdam District Supervisor Aubrey Stanley, the onlySupervisor to run unopposed, will return to serve his seventhterm on the Board.

A numberof other initiatives were accomplished this year that are worth alook back.

The General Assembly adjourned in February and theREALTOR® legislative agenda was successful overall, thanks tothe help of our business conscious, RPAC supported legislators.

Legislation was passed prohibiting devel-opers from attaching private transfer feesto newly developed property for up to 99 years; lowering theburden of proof for tax assessment appeals; and making adher-ence to existing laws more manageable.

The online document storage solution DocBox™ was intro-duced to CVR MLS members in February, offering agents andbrokers the ability to archive and access contracts, negotiations,or any other document in a transaction that is faxed, uploaded,or emailed into the system from a mobile phone or computer.With this virtual document management system, uploaded filescan then be accessed anytime, anywhere, from virtually anycomputer or wireless device with internet access.

Also in February, RAR members enjoyed the opportunity tomeet and ask questions of a number of political representatives ina private session at RAR’s REALTOR® Day on the Hill. They werealso treated to lunch at Old City Bar on Main Street, followed bya tour of either the Governor’s Mansion or the Virginia Capitol.

In March, RAR Hosted a Housing Forum with SpecialGuest, House Majority Leader Eric Cantor, at the University ofRichmond Jepson Alumni Center. The event brought togetherover 200 REALTOR® members and industry experts to discussfederal policies affecting the housing market. The event waspart of RAR’s continuing efforts to provide educational opportu-nities to members that help inform them about economic andlegislative affairs affecting their industry. The day was a tremen-dous success and the event gained national exposure.

In April, RAR staff joined REALTOR® members, sponsors, anumber of other volunteers, and 15 local non-profit organiza-tions to help build and repair homes for neighbors in need dur-ing Affordable Housing Awareness Week.Earlier in the month, an educational sessionwas held at RAR that focused on financingoptions for first-time and low income homebuyers. The month ended with a full week ofvolunteer projects, the homelessness simula-tion experience Walking in Their Shoes, and a block party.

In May, RAR hosted a workshop for members with specialguest speaker Phil Schulman, a real estate attorney and nation-ally recognized RESPA expert. Schulman led a discussion onthe status of RESPA and mortgage lending reform, how the newConsumer Financial Protection Bureau will affect real estatetransactions, and the HUD Interpretive Rule concerning feesrelated to the sale of home warranties. He lent his expertise aswell as a bit of humor to the discussion, which was followed bya demonstration of Authentisign™, the new addition that joinedthe Instanet™ Solutions product lineup that month. AttorneyMichael Lafayette concluded the session with an overview onsome of the legal aspects of digital signature use.

Also in May, RAR formed the Young Professionals Network,a group of career-minded real estate professionals who period-

ically meet to educate themselves on the latesttechnology and industry practices, networkwith fellow REALTORS®, learn more about

their region and serve their communities.

Over the summer, Mobile MLS gotan extreme makeover. The new userinterface is sleeker, more advancedand very user-friendly. More impor-tantly, the new capabilities with thisupgrade surpass all aesthetic improve-ments. During the first week of itslaunch, nearly 500 members registeredto take advantage of this valuable member resource, whichis compatible with any internet enabled wireless device,including the iPad.

Yet another new CVR MLS member benefit was introducedin September. The supplemental statistics tool rbiStats makes itpossible to share local market statistics quickly and easily

through charts, graphs and metrics. Italso offers an online visualization of avariety of market trends, with the

option of a subscription which allows for even more in-depthanalysis and detailed customization abilities. Shanna Wiseman,the CVR MLS upcoming President, hopes to see more agentsbenefit from this member resource during the next year. “Thedata tables and statistics through rbiStats are useful tools thatagents are able to download and use for their presentations. Iwould like to see an increase in awareness among members onthis excellent tool,” she said.

The ability to choose rental properties within the Tempo™Prospect function to send to customers and clients was enabledin September. The only difference in the process of creating arental prospect is the selection of the Rental Property Type priorto entering search criteria. Rental properties also became avail-able, upon request by brokers and vendors, as feeds in the IDXprogram. “As a Property Manager, one of my primary goals for2012 will be to encourage those REALTORS® who managerental property to utilize the Rentals section to build a solid anduseful database,” Shanna Wiseman remarked.

In October, RatePlug, an additional CVR MLS benefit, wasintroduced to CVR MLS brokers. This new tool allows brokers todeliver interactive, real-time mortgage programs, payment and

qualifying information to clients, rightfrom Tempo™ listings. The tool allowsbrokers a means of promoting affiliatedmortgage entities, or displaying up to

three preferred lenders of choice. It provides home buyers seek-ing financing options with a one-stop-shop approach.

October marked the official graduation of the LeadershipDevelopment Academy’s class of 2011. The LDA is a 10-monthprogram designed to develop visionary, service-orientedREALTOR® members for professional, civic, and communityleadership roles.

Also in October, RAR held its Real Estate Trends Conferenceat the Virginia Museum of Fine Arts. The event featured specialguest speakers Dr. Paul Bishop, Vice President of Research withthe National Association of REALTORS®, and Dr. Larry Sabato,Political Analyst and Director for the University of VirginiaCenter for Politics. Updates and analysis were provided on thestate of the housing market, economic developments, buyerand seller trends, and the state of the political environment.

The Central Virginia MLS initiated a seasonal billboard mar-keting campaign that ran throughout the year, emphasizing thesentimental aspect of home ownership.

A number of new educational offerings were added overthe course of the year, including a broker office policy workshop(which included a sample office policy manual), a commercialcontract writing course, a course on commercial propertymanagement issues, a Residential Lease Purchase Agreementworkshop, a Short Sales & Foreclosures Resource (SFRDesignation) Course, a hands-on smartphone course and

Instanet™, DocBox™ and Authentisign™ training (with bothclassroom and hands-on instruction).

Looking ahead to 2012, Scott Ruth, RAR’s upcomingPreisdent, looks forward to increasing training on the severalnew technology tools that were introduced over the past year.“This is the year we really need to work on teaching membershow to use all of these tools and how to use data in more effec-tive marketing to consumers,” Scott added.

Scott grew up in Richmond, attending Collegiate School,then the College of Charleston. His career began in privatebusiness administration with the family-owned companyMetray, Inc., which his father founded and still runs. He hasnow been with Long & Foster for nine years and as a ManagingBroker for seven years at Long & Foster’s Tuckahoe office. Scottdescribes his leadership style as very hands-on. “I have an agentmentality, but with a corporate perspective,” he explained.

Among Scott’s top association interests are the data andtechnology products offered to members. “He’s very geeky,”Cheryl Hamm teased. “Data and technology help agents showvalue proposition to consumers,” Scott explained. He is partic-ularly interested in RE Stats, the IMAPP Tax Database, MobileMLS and Instanet™ Solutions.

With all the technology training RAR intends to accomplishin the coming year, including a Technology Fair in February,Mr. Ruth has chosen an excellent year to serve as President.And RAR is fortunate to have a leader in the coming year thatwill help members tap into their inner geeks as well. L

irst, there was the Mortgage Assistance Relief Services(MARS) Rule, which was primarily directed at compa-nies that offer loan modification services to consumers.But, the definition of loan modification service

providers was so broad that it was initially interpreted by theFederal Trade Commission to include real estate professionalswho provide assistance and negotiate with lenders on behalf oftheir short sale listing clients. These professionals were subjectto certain disclosure and document retention requirements.NAR adamantly disagreed, and on July 15, 2011, the FTCissued a statement announcing that it would not enforce mostprovisions of the MARS Rule against real estate brokers andtheir agents who assist financially distressed consumers inobtaining short sales. Agents who provide short sale negotiationservices to individuals other than their listing clients are stillsubject to the requirements of the MARS rule. But for mostagents, the rule is no longer an issue.

Just When it Seemed That the Storm Had Passed…We breathed a sigh of relief and thought all of the drama wasbehind us, but then the Federal Trade Commission (“FTC”)rolled out the Mortgage Acts and Practices - Advertising, or“MAP” Rule. MAP imposes requirements on those that provideinformation about mortgage credit products to consumers.This includes real estate professionals who partner with mort-gage lenders and/or convey mortgage related information toconsumers, such as giving a consumer a lender’s rate sheet orproviding paperwork to pre-qualify a borrower.

The new rule, which went into effect on August 19, 2011,prohibits misrepresentations in commercial communicationsabout any term or terms of a mortgage credit product. A “com-mercial communication” is defined as both oral and writtenstatements designed to “create an interest in purchasing goodsor services”, which in this case would be a mortgage creditproduct. A “mortgage credit product” is “any form of credit”

that is offered to a consumer and secured by the consumer’sdwelling. The Rule covers information about any and all mort-gage terms, as well as an extensive list of possible mortgageterms. Possible mortgage terms include interest rates; productssold in conjunction with a mortgage, such as credit insurance;amount of taxes; variability of interest rates; and prepaymentpenalties. Under the MAP Rule, the definition of ‘‘term,’’ is ‘‘anyfees, costs, obligations, or characteristics of, or associated withthe [mortgage] product.’’ The definition also includes “any ofthe conditions on or related to the availability of the product,’’and is intended to cover all aspects of a mortgage credit productwithout exception.

In other words, if an agent discusses any mortgage terms orproducts in a “commercial communication” (verbal, printed orelectronic), they must include a prominently displayed disclaimerindicating that they are not a mortgage broker and that theinformation provided should not be relied upon. For example,if an agent were to advertise “no down payment,” “3.5% inter-est,” “special financing available,” or “monthly payments under$1,500,” that agent would be required to provide specificdisclaimer language in a reasonably prominent location.Other examples of covered communications would be present-ing a lender’s mortgage rate sheet to a client or customer, orproviding pre-qualification paperwork from a lender or mortgagebroker. Agents and firms who share online space with lendersand mortgage brokers should review their sites to determine ifand where the required disclaimer language would be required.The disclaimer should be prominent and separated from othertext in the covered statement; as disclaimers in small type,placed at the bottom of a document or buried within the text,may not protect against misrepresentation claims.

CVR MLS Puts Subscriber Protections in PlaceRemarks entered into the TEMPO™ system are publicly dis-played. In order to protect CVR MLS subscribers from liability forthe inadvertent mention of loan terms or conditions, CVR MLShas embedded disclaimer language within the templates for allflyers and MLS facilitated communications. This action alsocovers the MAP archiving requirement as the MLS data, includ-ing the required disclaimer is archived for the mandatory twoyear period.

Agents Should Exercise Due Care in all Advertising and ConversationsWhile disclosure requirements are covered for information

included in CVR MLS listing data, there is still potential for

exposure in other multiple listing services, client and prospect

conversations, as well as online advertising, in flyers and in

email communications. We recommend adding the MAP dis-

claimer language to automated e-mail signatures to cover any

electronic communications that might include mortgage related

information. Agents must also exercise caution when speaking

with clients, customers and prospects about specific mortgage

products, as the disclaimer applies to verbal conversations as

well as print materials and communications.

Recordkeeping RequirementsReal estate agents and brokers subject to the MAP Rule are

required to keep all covered commercial communications for

two years from the date that the communication was made to

the consumer. In order to comply with this section, REALTORS®

should retain copies of all covered statements, flyers and adver-

tising in each consumer’s file (paper or electronic). This record

retention system should become part of the firms’s overall

record retention program.

Sample Disclaimer Language“This communication is provided to you for informationalpurposes only and should not be relied upon by you. [Name ofbrokerage] is not a mortgage lender and so you should contact[name of lender] directly to learn more about its mortgageproducts and your eligibility for such products.”

Virginia Implements New Disclosure RequirementsThere were two significant changes to Virginia’s real estate

disclosure requirements that went into effect July 1, 2011. A

new Residential Disclosure Form is now required for all covered

residential real estate transactions. The new form directs con-

sumers to a page on the website of the Department of

Professional and Occupational Regulation (DPOR). The intent

of this change was to eliminate the need to promulgate a new

form each time a new disclosure requirement goes into effect.

Licensees engaged by sellers, purchasers and landlords

who have actual knowledge of defective Chinese drywall in a

dwelling unit, must disclose that information to the prospective

tenant or purchaser. The disclosure is not required for properties

where defective drywall has been previously discovered and

abated. Property managers and leasing agents should be aware

that tenants who are not provided this disclosure within 60 days

of discovery of defective drywall now have the right to termi-

nate their lease agreements.

The Leadership Academy has been a great experience.

It not only allowed me to meet some wonderful people

and make new friends, it offered a place to share ideas,

gather a better understanding of the RAR organization

and it's processes, and learn about myself.

Before participating in the Leadership Development

I have always prided myself on being a big picture thinker;

little did I know how limited my knowledge was about my

job as a Realtor® and my support of RAR. I found out how

one person in an organization can make a difference by

Favorite Regional TraditionREALTOR®fest is one of my favorite real estate events that ourindustry offers. It is a chance to network with other agents in ourarea, hear excellent training forums by top business educators,and to hear from a key note speaker who offers a differentperspective on the industry. The trade show allows us to see thelatest industry related products and services available.

Favorite Vacation Spot I have several vacation spots that my family loves to take advan-tage of. Most of these locations are on the water. Charleston,South Carolina is one of my favorite places to get away outsidethe Commonwealth; however, in Virginia, the shores of VirginiaBeach and the banks of the Rappahannock River are two of myfavorite local places.

Hobbies/Activities outside the officeI am fortunate to have four incredible children and a wonderfulwife; I love nothing more than being outdoors with them all,whether it is on the water boating, surfing or fishing; or in thewoods exploring, camping or hunting.
