NGO plea to NHRC

Sudar, a non-government organisation based in Sathyamangalam, has appealed to the National Human Rights Commission (NHRC) to transfer to Tamil Nadu the cases registered by the Andhra Pradesh police against 17 tribal people of Bargur for allegedly cutting red sanders in Seshachalam Forest in 2013.

The 17 persons facing cases were among a group of 46 workers from Bargur villages who were taken to Seshachalam forest by two local brokers stating that their services were required for cutting bamboo in Kerala forests

False cases

False cases were framed against them. Due to the torture, one among them Madhan had died.

Calling for judicial inquiry into the brutal attack, Sudar Director S.C. Nataraj demanded compensation for the victim’s wife, who, he said, was in abject poverty.

Huge debts

The need for transfer of the cases from Andhra Pradesh to Tamil Nadu had arisen as the 16 villagers, who were also in huge debts due to their borrowings from money-lenders at exorbitant interest rates for legal expenses fear for their lives after the gunning of 20 Tamil wood cutters by Andhra Pradesh police, Mr. Nataraj said in his letter to NHRC Chairman.

HYDERABAD:Favouring a judicial probe into the recent encounter killing of 20 woodcutters from Tamil Nadu in the Seshachalam forest, the National Human Rights Commission (NHRC) on Thursday decided to send its own team within a week to the area for an on-the-spot inquiry.

The NHRC, led by its chairperson Justice KG Balakrishnan, took up hearing on the encounter on the second day of the commission’s camp sitting here in Hyderabad. The NHRC members heard complaints of rights activists, representing the encounter victims, and the Andhra Pradesh government’s submissions patiently for over an hour.

“Why hasn’t a judicial inquiry been ordered?” Justice KG Balakrishnan questioned the AP government, and pointed out that it was the norm in such cases. In response, AP police counsel M Naga Rahu explained that the State government had ordered a magisterial inquiry and informed that a special investigation team was also being constituted to probe the incident.

While expressing displeasure over the State government’s failure to implement its April 13 orders, the commission issued a series of directives to its representatives. It wanted them to submit details of the police personnel injured, medical reports, call data of officials, wireless messages and vehicles used during the encounter among others.

The activists representing the victims demanded a judicial inquiry as per 176(1) A of the CrPC. Henri Tiphagne, a rights activist, sought protection for the witnesses following which the commission directed the government to facilitate recording of witness statements in Tamil Nadu under Section 164 of the CrPC. The commission gave two weeks to the AP government to submit all the reports. The commission had earlier taken suo motu cognizance of the killings and issued a notice to the government.

Meanwhile, the high court granted more time to the government to file a counter affidavit on petitions seeking a CBI probe into the killings.

Sinha was hearing complaints by Mohammed Ahmed, father of Viquaruddin activists seeking action against the police personnel involved in the encounter. Mr Ahmed asked whether it is possible for a person with hand cuffs and chained legs to snatch a weapon from the police and the pictures of the scene of offence clearly shows that it was a cold blooded murder. It was brought to the notice of the bench that a day prior to the killings, one of the deceased, Zakir was taken to the Warangal prison from Chanchalguda prison in the city, despite his appearance along with the other four before the trial court at Hyderabad on April 7. While asking to furnish the reasons for shifting him from the city to Warangal, the NHRC bench pointed out that it is raising suspicion at the motive of the police. assaulted the jail staff in Chanchalguda prison. “As the suspects killed several policemen, it seems that out of vindictiveness, the police eliminated them,” the bench said. NHRC holds open hearing: The full bench of the NHRC, which conducted an an open hearing in the city on Thursday directed the Cyberabad Police commissioner C.V. Anand to submit within three weeks, the report on the progress of the investigation including postmortem reports with regard to the police firing in Kishanbagh area of the city on May 14 last year. The bench was dealing with complaints seeking action against the police for opening fire on a mob through BSF police personnel during a clash between two groups in Kishanbagh in which three people were killed and 18 were injured. 90-yr-old incited mob: Police The NHRC bench on Thursday directed the SP of Srikakulam district to submit postmortem reports of the deceased who were killed in police firing on February 28, 2011 during an agitation against the establishment of thermal power plant in Kakarapalli of the district. The bench also directed to furnish the copies of medical reports of the police personnel injured in the clash. The bench was dealing with a complaint by the villagers alleging that the police held a 90-year-old woman responsible for the agitation and was arrested. It wondered how a 90-year-old woman who is in immovable condition could lead the mob to attack the police. Gail probe on hold: The NHRC on Thursday directed the East Godavari police to complete the investigation with regard to the fire mishap caused due to the leakage of gas pipe line of the GAIL in Nagaram village in which 21 people were killed and 18 others injured. While hearing the complaints from the villagers seeking action against the GAIL authorities, the bench enquired with the police about the progress of the investigation. The police said that the investigation was put on hold as the union petroleum minister ordered probe through a high level committee. Labour abuse may invoke SC Act: A bench of the NHRC conducting an open hearing here on Thursday directed the AP and the Telangana governments to examine the possibilities of booking a case under the SC and the ST (Prevention of Atrocities) Act, 1989 in the incidents of bonded labour. While hearing the complaints from victims of bonded labour from both the states, the bench said it would be more appropriate if the cases are booked under the Act 1989, in addition to the cases under the Minimum Wages Act and bonded labour, as in most of the cases, the victims belong to the SC and the ST communities. The bench also enquired about the progress of the investigation in the case of the children involved in bangle making. The police, however, said that the investigation is yet to complete. The bench suggested taking steps to recover Rs 20,000, which were given as compensation to the victim from the owners of the units.

HYDERABAD:Members of the Human Rights Forum, in a written memorandum on Thursday, to the National Human Rights Commission (NHRC) chairman Justice KG Balakrishnan, placed their concerns about the recent incidents in which 20 persons in Andhra Pradesh and five in Telangana were gunned down in alleged encounters. The subsequent averment of the police that the killings were the result of ‘firing in selfdefence’, were in serious doubt, the letter said.

VS Krishna, HRF general secretary, along with S Jeevan Kumar, president, in the letter, stated that the commission may direct the governments of Andhra Pradesh and Telangana to file cases of culpable homicide amounting to murder and other appropriate sections of the IPC and relevant sections of the SC, ST (Prevention of Atrocities) Act, 1989 against all police personnel responsible for the wanton and deliberate killing of 25 persons in both these ‘encounters.’

They also said that the criminal investigation into the case must be handed over to an independent agency. Either the CBI or a Special Investigation Team monitored by the Supreme Court must be handed over the cases for there to be a credible investigation. A magisterial or judicial enquiry is no substitute for this lawful process, they said.

They also requested the Commission to call upon the Andhra Pradesh government to see that judicial officers visit the prisons where the undertrials relating to red sanders smuggling were languishing and release those prisoners, who have already completed half the maximum period of imprisonment their offence prescribes under law in line with the Supreme Court’s order of September 5, 2014 with regard to Section 436 of the Criminal Procedure Code.

Further, they requested the Commission to recommend to the governments of AP and Telangana the modalities for payment of substantial compensation to the families of the 25 killed. And also, issue concrete suggestions to the local judiciary regarding taking into cognizance suo motu of ‘encounter’ killings as cases of murder under Section 302 IPC. And last, to constitute a special investigating team of the NHRC on both these cases and as a first step, visit the sites where the alleged encounters took place.

Commission decides to send own teams to the spots for investigation

Hyderabad: The National Human Rights Commission (NHRC) on Thursday asked

the Andhra Pradesh and Telangana police to conduct a judicial inquiry into the

Seshachalam and Aleru encounters, respectively. It may be recalled that 20 red

sanders woodcutters in Seshachalam forest area in Chittoor district were gunned down

on the intervening night of April 6 and 7 by the Special Task Force (STF) police, who

were deputed to check red sanders smuggling in the forest area. Similarly, in Aleru

five undertrials were shot dead by the Telangana police on April 7.

The NHRC, on the second day of its camp sitting at Dr Marri Chenna Reddy Human

Resource Development (MCRHRD) Institute in Jubilee Hills, chaired by Former

Chief Justice of Supreme Court KG Balakrishnan questioned as to why the State

governments were reluctant to go for a judicial inquiry on the encounter case when the

crime was of such high magnitude was involved and instead ordered a revenue officer

inquiry.

The other members of the Commission Justice Cyriac Joseph, Justice D Murugesan

and SC Sinha expressed disapproval over non-compliance of its April 13, orders

regarding the submission of report with full details of investigation. The legal advisor

of the AP police, M Naga Raghu, who presented before the Commission a set of

reports, said the police were not supposed to divulge the details to anybody except the

High Court who gave the instructions not to reveal the proceedings.

“The police is to provide the wireless set log details as well as the mobile numbers of

the officers, the details of injuries received by the police involved in the alleged

encounter within two weeks. The Commission also said that it is sending its own team

of officials to visit the encounter spot and other places within a week to submit a

report on the incident,” Balakrishnan said. The Additional Director General of Police

(Legal) of AP police, Ray Vinay Ranjan, informed the Commission that the State

government has decided to constitute a Special Investigative Team (SIT) to

investigate into the encounter incident.

“The names of the members are yet to be finalised for the SIT,” he informed, and

sought two weeks time from the Commission. The Commission also directed the

investigating agency to facilitate the recording of the evidence of the three eye

witnesses, who had already deposed before the NHRC under section 164 of the CrPC

by a magistrate in the Seshachalam case.

The executive director of People’s Watch (A program unit of the Centre for

Promotion of Social Concerns), Henri Tiphagne, argued that the alleged encounter

was a clear case of abduction, torture and raised allegations of extrajudicial action.

He further maintained that the allegations were to do away with evidence. “The

orders have been directed by top leaders of the AP government and gave the ‘green

signal’ to carry out the firing,” Henri alleged, adding that the phone records would

reveal the involvement of all officers.

Hyderabad: The National Human Rights Commission (NHRC), headed by its chairperson K G Balakrishnan, on Thursday conducted a public hearing here on the issue of farmers' suicides in Telangana.

It directed the state government to file a report on the various welfare activities for the benefit of farmers.

During the hearing, the NHRC chairperson directed some civil society activists, who represented the matter, to promote awareness among the members of farming community on different aspects.

The petitioners had sought the Commission's intervention on the issue farmers' suicides.
