The well nest would consist of two monitoring wells and would be installed as part of the monitoring program for the Ace Services site remedial efforts. Black & Veatch Special Projects Corp. (BVSPC) is currently working as a contractor for Region VII of the U. S. Environmental Protection Agency (EPA). BVSPC is designing a remediation program for the chromium- contaminated groundwater plume associated with the Ace Services site located 345 Convesse Avenue in Colby, Kansas. Property records from the Thomas County appraisers office identify you as the owner of the property in which we would like to install a groundwater monitoring well nest. Two preferred proposed locations for the well nest are illustrated on the enclosed aerial photos. The well nest will consist of two monitoring wells located within 15 feet of each other. Each well will be constructed to allow monitoring of a discrete zone at approximately 220 feet and 175 feet depth. The monitoring wells will help establish the size and concentration of the plume. We will install the wells using rotary wash drilling techniques. Soil cuttings will be temporarily stored near the well head for approximately the imagine-build company™

Dear Mr. Havel:

10 days until analytical results are completed at which time thecuttings will be removed or spread to the ground if you prefer.

Well head completions can be above ground with protective guard posts orflush mount if you prefer. Similar wells have been recently installedalong Country Club Drive at Fourth Street near the public water supplypump house. If you wish to collect a split sample we will gladly fillsample jars you provide. The drilling and sampling will be performed inapproximately one 5-day period.

Enclosed are two signed Access Agreements. If you allow us access toinstall the wells, please sign both copies of the enclosed AccessAgreements. Please keep one copy for your records and return the otherto me in the self-addressed/stamped envelope.

ACCESS AGREEMENT

RIGHT OF ENTRY TO PREMISESGrantor (the property owner) consents to and authorizes the United States EnvironmentalProtection Agency (USEPA), Black & Veatch Special Projects Corp. (BVSPC), or otherauthorized representatives, pursuant to RAC VII Contract No. 68-W5-0004, collectively theGrantee, to enter and perform certain environmental investigative activities upon the followingdescribed premises:

PURPOSE OF INVESTIGATIONThe purpose of the investigation is to determine whether soils at and ground water beneath theproperty is contaminated with hazardous substances.

INVESTIGATIVE ACTIVITIESThe investigative activities are expected to include:

a. The geoprobing and drilling of holes for subsurface investigation including the useof a geoprobe sampler, drilling rigs, trucks and other equipment as necessary;

b. Installation and development of permanent, secured monitoring wells;

c. Temporary storage of stockpiled soil until removed by USEPA representative ordispersed on the ground around the monitoring wells.

d. The taking of such soil and water samples as may be determined to be necessary;

e. Placement of protective posts around the permanent, secured monitoring wells;

f. Other actions related to the investigation of surface and subsurface contamination andmaintenance of the permanent, secured monitoring wells.

AGREEMENT NOT TO INTERFEREThe permanent, secured monitoring wells will remain the property of the Grantee during theterm of the Agreement and the Grantor agrees not to open the wells or take any action or allowanyone to use the property in any way that would interfere with the operation of the wells orthe activities of the Grantee, or which could endanger the environment.

TERMThis access agreement shall be operable for the period of time it takes to complete theRemedial Action. Upon completion of the Remedial Action, all rights and privileges givenby the Grantor shall cease on that date, unless extended by subsequent agreement.

I have read the foregoing document and understand that it is an agreement granting permissionto the Grantee to enter the above described premises for purpose of conducting environmentalinvestigation and remedial activities, and I agree to its terms and conditions.
