1 Dear Member of Congress, The undersigned businesses and organizations, representing a coalition of over 900 national, state and local affordable housing stakeholders, urge the 113 th Congress to extend the minimum 9 percent Low- Income Housing Tax Credit (Housing Credit) rate for new construction and substantial rehabilitation, and establish a minimum 4 percent rate for the acquisition of affordable housing, before it adjourns. While we believe the minimum 9 and 4 percent Housing Credit rates should be made permanent, a temporary extension of these provisions for at least two years will still significantly strengthen the Housing Credit at virtually no additional cost to taxpayers. We urge Congress to make these critical changes as soon as possible. The Housing Credit, America’s main tool for financing affordable rental housing, has produced or preserved over 2.7 million affordable homes since it was created in 1986. However, while demand for affordable rental housing is at an all-time high, financing these homes has become more difficult especially with the expiration of the minimum 9 percent Housing Credit rate at the end of 2013. Housing Credit rates are currently determined by a complex formula (known as the “floating rate”) tied to ever-changing federal borrowing rates. The lower that federal borrowing rates fall, the lower the Housing Credit rate becomes, which in turn reduces the equity available for individual developments. Because federal borrowing rates have sunk to historic lows, there is now 15 to 20 percent less Housing Credit equity available for any given property than Congress originally envisioned. Without sufficient equity, many worthwhile properties are simply impossible to finance. Properties underwritten with the floating rate generally either require other funding sources to help fill the financing gap or must charge rents at levels that allow for higher levels of debt service. Unfortunately, other gap financing sources, such as HUD programs and state financing, are strained and have an extremely limited capacity to meet financing needs. Without the flexibility to provide increased Housing Credit equity, some properties simply will not move forward. Often, these are properties that meet strategic needs, for example serving target populations or located in areas that have access to transportation or other infrastructure. The flexibility to provide this additional equity has become more and more important as construction costs have climbed, incomes have stagnated and soft financing sources have become more limited in recent years. Setting minimum credit rates results in no substantial costs to taxpayers. Each state’s annual Housing Credit allocation is determined by its population not credit rates. Moreover, minimum credit rates do not mean that developers are automatically awarded higher credit amounts. States are statutorily mandated to provide no more Housing Credit equity than necessary to make a deal feasible. The minimum credit rate simply provides states the flexibility to increase equity if it is necessary, and only to the extent to which it is required for viability. States take this responsibility seriously, as it is in their interest to stretch affordable resources as far as possible. The floating rate, however, makes it difficult for states to allocate scarce resources as effectively, impacting the communities and residents that rely on them. The undersigned businesses and organizations, representing a coalition of over 900 national, state and

local affordable housing stakeholders, urge the 113th Congress to extend the minimum 9 percent Low-

minimum 9 percent rate in the American Taxpayer Relief Act of 2012. That extension expired at the

end of 2013. In the absence of congressional action to further extend this provision, credit rates are

once again subject to the floating rate system. Since then, legislation to enact permanent minimum 9

and 4 percent credit rates has secured broad bipartisan support in both the House and the Senate.

Minimum 9 and 4 percent credit rates were also approved in the Senate Finance Committee’s Expiring

Provisions Improvement Reform and Efficiency (EXPIRE) Act on a bipartisan basis in April 2014.

We ask that Congress act quickly to strengthen the Housing Credit once again by approving minimum

credit rates, which will have minimal costs but significant impacts on affordable housing development.
