DEAR MEMBERS :

This has been a busy month of planning upcomingassociation events.

With a new leadership structure in place at the FCC, we areplanning a Fall Reception to welcome the new FCC Chairmanand Commissioners on September 30 from 5:30 – 8:30 p.m. atthe Newseum. From 5:30 – 6:30 p.m., attendees will be ableto tour the Newseum exhibits and from 6:30 – 8:30 p.m., thereception will be held in the 7th Floor Conference Center and Terrace. I hope you’llmake plans to join us in welcoming them.

We’re also planning a reception with Commission bureau and office chiefs in mid-October, the 20th annual Charity Auction on November 12, and the Chairman’sDinner on December 10 (in conjunction with the PLI Conference).

Our CLE schedule will kick off on September 9 with a timely look at the lobbyingrules and restrictions in the new administration – sponsored by our ProfessionalResponsibility Committee. Major CLEs are also in the works by the Broadband andMass Media Committees in October and November.

Of course, committee brown bags are being planned for August and September.And don’t forget to mark your calendars for the 13th Annual FCBA Foundation GolfTournament – now rescheduled for September 10.

A complete list of upcoming programs and events can be found on page 24.

Also in this newsletter is a listing of committee and chapter co-chairs. I urge all ofyou to contact the co-chairs with ideas for committee lunches, CLE programs andother events that form the core of the association’s membership activities. Myhighest priority is to make sure that our programs are as timely, useful andinteresting as possible for the membership.

By now, all of you should have received membership renewal instructions. (If youhave not, you can also find instructions on page 3 of this newsletter.) Please renewtoday – and keep taking advantage of member benefits, including discounts toFCBA events and programs. Note to procrastinators: We’re going to try to publish anew FCBA directory as soon as we can in the new year. Because of publishingschedules, that essentially means that we need to have a complete membership listby early October. So, don’t be left out. Renew today!

Constitution andBylaws CommitteeAt the request of the ExecutiveCommittee of the FCBA, theConstitution and Bylaws Committeerecently conducted a review of theFCBA Bylaws and made several changesto the status of certain committees, andmade several housecleaning changes aswell.

First, four previously “ad hoc”committees - Homeland Security andEmergency CommunicationsCommittee, Intellectual PropertyCommittee, Judicial PracticeCommittee, and the Privacy and DataSecurity Practice Committee — gainedfull committee status. Further, in lightof the development of the Internet, and

the recognition that many of thesubjects previously covered by theCyberspace Committee were alsorelevant to a number of specific practicecommittees, the Executive Committeeapproved the deletion of thatcommittee.

In addition, the Cable PracticeCommittee was changed to the VideoProgramming and DistributionCommittee so to acknowledge thedevelopment of alternative videodistribution platforms. Finally, thedescription of the Diversity Committeewas modified to reflect the excellentwork that the Committee hasundertaken to promote diversity in thecommunications industry.

This year, the co-chairs of theCommittee — M. Anne Swanson andLee G. Petro — have been tasked withthe enviable job of updating thedescriptions for the other Committees,and will undertake their annual reviewof the Constitution and Bylaws for anyother suggested changes. Any suchsuggestions will be compiled in a reportand delivered to the FCBA’s ExecutiveCommittee for consideration.

At its June 25 Reception, the FCBApresented its second Excellence inGovernment Service award to Evan R.Kwerel. The award recognizes people withlong-term careers in the federal governmentin the field of communications who arededicated to the pursuit of excellence andpublic service. Evan, a Senior Economist inthe FCC’s Office of Strategic Planning andPolicy Analysis, and known worldwide forhis work on the academic underpinnings ofauction theory and its practicalimplementation, has served at the FCC since1983.

The FCBA also took this occasion of itsreception recognizing excellence ingovernment service to announce itscommendation of the FCC and NTIA stafffor their outstanding effort and outreach tothe American public to minimize thedifficulties inherent in the digital televisiontransition. For months, and even years,hundreds of FCC and NTIA staff haddedicated themselves to making the digitaltelevision transition work, culminating inthe efforts necessary to “cross the finish line”on June 12, 2009, less than two weeks beforethe reception. At the reception, the FCBAhosted representatives of the staff membersthat worked hand-in-hand with industry onthe digital television transition. While FCBAmembers understand as well as anyone thatthere is still work to be done to fully reap thebenefits of the digital transition, tomemorialize their efforts at the June 12,2009 deadline, the FCBA formallycommended the dedicated members ofgovernment working on the task.

For almost two decades, the staff of the FCC and NTIAhave worked to transition the broadcast televisionindustry from analog technology to digital technology.Earlier this year, concerned that the public was not readyfor the changes that would come with this transitiondespite the tireless efforts of the FCC and NTIA staff,Congress extended the date set for the final transitionuntil June 12, 2009. For many months, the staff of theFCC and NTIA have committed themselves to addressingthe problems faced in this historic endeavor, reaching outto American citizens and traveling to where they live andwork in an effort to make as smooth as possible the digitaltransition. In an almost unprecedented effort, the FCCand NTIA staff have worked diligently with privateindustry on behalf of their constituents: the citizens ofthe United States. For this effort, the FCBA commendsthe digital transition team, including not only ChairmanCopps and Commissioners Adelstein and McDowell atthe FCC and Acting Assistant Secretary Anna Gomez andAssociate Administrator Bernadette McGuire-Rivera atNTIA, but the hundreds and hundreds of other leadersand staff who worked indefatigably over the past sixmonths, and prior years, under difficult circumstances toassist viewers of broadcast television throughout thisnation.

FCBA FoundationReports Successful2008-2009 YearThe Federal Communications BarAssociation Foundation, celebrating the18th Anniversary of its founding, had asuccessful year providing charitablesupport for education and children’sissues in furtherance of the goals set outin its Mission Statement to:

1) Support worthwhilecommunications-related andeducational projects, as well as othercommunity service projects, particularlythose directed towards children andstudents, through financialcontributions and through volunteerservices provided by Foundationmembers and others.

2) Foster greater public awareness andunderstanding of the development ofcommunications technology, resourcesand law.

The Foundation’s accomplishments thisyear included awarding about $140,000in college scholarships, plus laptopcomputers, to 11 students from fiveinner-city District of Columbia highschools; providing $40,600 in stipendsto eight law students who acceptedunpaid communications-related legalsummer internships; donating $75,000to Horton’s Kids and over $16,000 tothe FCBA Foundation ScholarshipProgram raised during the annualCharity Auction co-sponsored with theFCBA’s Young Lawyers Committee, andnumerous volunteer activities. Theseactivities, and the Foundation’s overallsuccess, is a direct result of the generoussupport of individual FCBA members,as well as their firms and companies.This Annual Report summarizes theFoundation’s activities during therecently completed 2008-2009 year.

TRUSTEES

The Foundation is governed by a Boardof Trustees, most of whom are electedby the FCBA membership, but which

also may include persons appointed inaccordance with the Foundation’s By-Laws. This year’s Trustee’s were RickChessen, Erin Dozier, Stacy RobinsonFuller, Julie Kearney, Donna Lampert,Larry Movshin, Henry Rivera, andMegan Anne Stull. The Foundation’sofficers, as elected by the Board ofTrustees, were: Jane Mago, Chair; MikeAltschul, Treasurer; Natalie Roisman,Assistant Treasurer; Celia Nogales,Secretary; Rick Whitt, AssistantSecretary.

Three non-Board members workedextensively with the Board as co-chairsof the Volunteer Services Committee,Joanna Georgatsos, Howard Weiss, andTom Van Wazer. The FCBA’s ExecutiveDirector Stan Zenor, Director ofMember Services Kerry Loughney,Wendy Parish and Ann Henson,provided invaluable support to theFoundation.

SCHOLARSH IP PROGRAM

The Foundation’s scholarship program,the Chairman Robert E. LeeScholarship Fund, is its most significantundertaking, both in terms of the fundsawarded and in the amount of timerequired to administer the program.The 11 scholarships, and the laptopsawarded to the scholarship recipientshave the Foundation committingapproximately $140,000 to this year’sscholarship program, helping these verydeserving students. The scholarshiprecipients and additional details aboutthis year’s scholarship program aredescribed in the report, which appearedin the July 2009 issue of the FCBANews.

The scholarships are awarded based ona number of different criteria, includingthe student’s predicted ability to succeedin college, past academic performance,participation in school activities, schoolattendance, service to the community,financial need, and other relevantfactors that may apply to eachindividual applicant. The scholarshipapplicants are reviewed on the basis of awritten application (including

biographical information, academicperformance and an essay) and apersonal interview with members of theFoundation’s Board of Trustees andother FCBA volunteers.

Erin Dozier and Stacy Robinson Fullerserved as the Foundation’s ScholarshipCommittee Co-Chairs, overseeing theentire program. They were responsiblefor contacting and coordinating withthe seven District of Columbia highschools from which the Foundationsolicited applicants: Bell MulticulturalHigh School, Calvin Coolidge HighSchool, Cardozo High School, McKinleyTechnology High School, ThurgoodMarshall Academy Public CharterSchool, Roosevelt High School, andSpingarn High School. The Foundationreceived 31 written applications. TheScholarship Committee Co-Chairsparticipated in and coordinated thereview of the written applications,which determined the 15 applicantswho would be interviewed. The Co-Chairs also participated in andcoordinated the applicant interviews, inwhich the Trustees and other membersof the FCBA participated. The Co-Chairs also attended the awardceremonies at several of the highschools to announce the scholarshiprecipients at those schools.

The Foundation also continued itsmentoring program of soliciting FCBAmembers interested in serving as amentor to a scholarship recipient.Jennifer Holtz coordinated thisprogram. The mentors are available tohelp support the students in theirtransition to college. This is animportant component of the scholarshipprogram, as most of the scholarshiprecipients lack family members or otherpeople to whom they can turn whohave gone through the collegeexperience to provide advice andassistance. At year-end, theFoundation’s Board approved an eventwhere the scholarship recipients, theirmentors, and several Foundation Boardmembers attended the July 21Washington Mystics basketball game.Thanks to the National Association ofBroadcasters, who donated tickets totheir Executive Suite at the VerizonCenter for the Foundation to host thisevent.

INTERNSHIP PROGRAM

The Foundation’s internship programawards stipends from the ChairmanRobert E. Lee Scholarship Fund to lawstudents serving in unpaid

communications-related legal summerinternships. The Foundation madeawards to eight students, totaling$40,600. The base amount of eachstipend is $5,000, which is intended tohelp defray the student’s expensesduring the internship. One student isselected to receive an additional $600Max Paglin Award, in honor of theformer FCBA member, FCC GeneralCounsel and Executive Director, andfounder of the Golden JubileeCommission on Telecommunications.This year’s recipients, all interning at theFCC, are:

The 2008 Charity Auction was held onNovember 6, 2008. Co-sponsored bythe Foundation and the FCBA YoungLawyers Committee, this year’s eventraised $75,000 to benefit Horton’s Kidsand over $16,000 to benefit the FCBAFoundation Scholarship Program.Founded in 1989, Horton’s Kids(http://hortonskids.org/) is a D.C.-basednon-profit organization that providesacademic and social services to childrenliving in one of the city’s mostunderserved neighborhoods.

The Foundation continued its long-standing, monthly volunteer activities atMartha’s Table and McKenna’s Wagon.On the last Sunday morning of eachmonth, volunteers helped prepare mealsfor the homeless at Martha’s Table, andon the fourth Sunday of every monthvolunteers delivered meals to thehomeless in the District throughMcKenna’s Wagon (a mobile soupkitchen operated by Martha’s Table).Howard Weiss was responsible forcoordinating the Sunday morning mealpreparation, while Joanna Georgatsosand Tom Van Wazer coordinated theMcKenna’s Wagon volunteers.

FOUNDAT ION VOLUNTEEROF THE YEAR

At the FCBA’s annual meeting andluncheon on June 11, the Foundationrecognized Rudy Baca as its Volunteerof the Year. Rudy was a long-timesupporter of the Foundation’s effortsand was very involved in the CharityAuction, serving at the cashier’s table onthe night of the Auction for many years.

FUNDRAIS ING

The Foundation could not maintain orincrease the level of services it provideswithout the funds needed to do so. TheBoard of Trustees remained committedto funding scholarships and internshipsusing funds raised during the currentyear rather than drawing on theFoundation’s reserves. At the sametime, the Board hoped to further buildthe Foundation’s reserves towardseventually reaching a level at whichincome from the reserves is sufficient tohelp fund the Foundation’s on-goingwork. Fundraising is, therefore, acritical element to the Foundation’sability to fulfill its mission. MichaelAltschul and Larry Movshin co-chairedthe Foundation’s FundraisingCommittee, taking the lead in what wasa very successful year for donations,

particularly for the Robert E. LeeScholarship Fund.

McKenna’s WagonSeeking Volunteersfor August 23McKenna’s Wagon is a mobile soup andsandwich wagon that goes “on location”to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great wayto help the needy in the D.C.community. This is an especially goodexperience for the teens and pre-teensamong us who do not have a fullappreciation of the many privileges theyenjoy. Community service credits arealso available.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 pm incomfortable clothes and shoes. Martha’sTable is located in a yellow building at2114 Fourteenth Street, NW, in theDistrict, near the intersection of 14thand U Streets. On-street parking isavailable.

Upon arrival we get assignments (someof us will distribute snacks andsandwiches, others will serve soup), and

put on aprons before we depart in thevan to 5th and New York Ave., NW(near the new Convention Center). Weare driven by one of our experiencedvolunteers and the trip to distributionlocation takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is wellpatrolled by police. The fooddistribution is conducted in an efficient,calm and orderly fashion and many ofthe people we serve are quiteappreciative of our efforts. Once weserve all of the food, we do a clean up ofthe immediate area. Total time for thedistribution takes about one hour andwe usually return to Martha’s Table byor before 6:30 p.m.

We would love to have you join us onone of our upcoming food runs whichare always on the 4th Sunday of themonth. Libby Beaty1960-2009Elizabeth Waeger (“Libby”) Beaty,Executive Director of the NationalAssociation of TelecommunicationsOfficers and Advisors (“NATOA”) and aformer FCC Assistant Bureau Chief,died of cancer June 12, 2009.

Libby was born and raised in Pinson,Alabama, northeast of Birmingham, andattended high school there. She craftedher own B.A. in business managementand fine arts from Warren WilsonCollege in Swannanoa, North Carolina.Following graduation, she worked inNew York City for RKO Pictures, Tri-Star Pictures and Children’s TelevisionWorkshop. Libby earned her J.D. atBrooklyn Law School.

Prior to joining NATOA in 1999, Libbyserved in several managerial positions atthe FCC, including Assistant BureauChief of the Cable Services Bureau andhead of its Financial Analysis andCompliance Division.
