• Attended meeting of the Safety & Wellness Committee, Planning Commission, and City Council

• Coordinated public information, signage, and staging for Public Hearing on Zoning Change Requests

• For July, 17,000 minutes of video from City Council’s live broadcasts on Facebook were viewed, which represents a 110% increase over last month. Of that, 6,600 views were 3 seconds, which represents a 41% increase.

• The July 7 City Council meeting broadcast live on Facebook in two parts due to technical difficulties. Part one reached 1,707 people, had 792 views and 2 shares, 44 engagements, and received approximately 29 comments. Part two reached 2,155 people, had 1,257 views and 2 shares, 406 engagements, and received approximately 71 comments.

• The July 23 Special City Council meeting broadcast live on Facebook in two parts due to technical difficulties. Part one reached 2,382 people, had 1,708 views and 8 shares, 1,145 engagements, and received approximately 173 comments. Beautification Board – Five Seats Available The Beautification Board meets monthly at 5:00 p.m. on the third Wednesday of the month, except July and December. This member board makes decisions regarding beautification efforts, such as the Gateway project and Clean Up Darlington Day, and landscaping plans.

Board of Zoning Appeals – Two Seats Available The Board of Zoning Appeals meets on an as-needed basis at 5:30 p.m. on Mondays and runs through the Codes Enforcement Department. This five-member board makes critical determinations on appeals and variances.

Design Review Board – Four Seats Available The Design Review Board meets on an as-needed basis. This member board makes decisions regarding signage and runs through the Codes Enforcement Department.

Historical Landmarks Commission – Three Seats Available The Historical Landmarks Commission meets quarterly at 5:30 p.m. on the first Monday of the second month of the quarter (February, May, August, and November). Called meetings are held as needed. This board makes determinations on the appropriateness of requested changes and repairs done in any of the city’s three residential historic districts.

Planning Commission – One Seat Available The Planning Commission meets on at 9 a.m. on the third Tuesday every other month. This board makes critical determinations on ordinance drafts, zoning, and the comprehensive plan.

Tree Board – Four Seats Available The Tree Board meets quarterly at 5:30 p.m. and on an as-needed basis. This board makes decisions regarding Arbor Day and other tree planting projects as well as determinations about removals.

Williamson Park Board – One Seat Available The Williamson Park Board meets monthly at 5:30 p.m. at the Harmon Baldwin Recreation Center, 300 Sanders St. This board makes decisions regarding Williamson Park as well raises funds to maintain the park.

DARLINGTON CITY PLANNING COMMISSION MEETING MINUTES TUESDAY, July 21, 2020 – 9 A.M.

City Hall, 400 Pearl St.

Attending were Planning Commission members Mr. Wiggins, Mr. Parnell, and Mr. Sprott; staff Ms. Rock, planning and economic development director; Ms. Jones, codes enforcement official; and Mr. Gainey, street and sanitation director; and several guests. Call to Order: Ms. Rock called the meeting to order at 9:00 a.m. She said Mrs. Kirchen asked to step down due to health issues.

Election of Chair: Mr. Sprott nominated Ms. Brown to serve as chair. Mr. Wiggins made the second. The motion carried unanimously.

Approval of the Minutes for the meeting of April 21, 2020: Mr. Wiggins made a motion to accept the minutes of the April 21, 2020, meeting as presented. Mr. Sprott made the second. The motion carried unanimously.

Zoning Change Request for 115 Siskron Street from CC to OR: Ms. Rock presented the application for a zoning change. The property owner, Mr. Terry Lewis, spoke on his own behalf. He said he has cleaned up the property, and it was a huge task to remove the asbestos in the old house. Mr. Lewis said he wants to move on to the next phase either office space or apartments, but he doesn’t have specific plans yet. Ms. Rock said the current zoning designation of CC allows for commercial or office space on the first floor and apartments above but not just apartments. Mr. Lewis said we need more people in town spending their dollars. Mr. Sprott said he would like to see what his plans were before making such a change. Mr. Lewis asked, does it really matter? He said he would not be doing Section 8 housing. Mr. Sprott said he was not crazy about just sticking apartments mixed in with the commercial center though he did agree that Darlington needed apartments. Mr. Lewis said we need to grow, and we are not going to if people keep blocking people putting money into this town. It will bring money into the town either way. Mr. Lewis continued, if you don’t let us change the town into something better, if you stifle growth, if we get blocked, I’m just walking away from it. Mr. Sprott said he wasn’t blocking anything, just suggesting getting a plan before changing something. Mr. Lewis said right now it is just a vacant piece of property. He said he spent $40,000 clearing the eyesore off it. Mr. Bill Bryant, a fellow business owner, said that if the zoning was changed, the City still had to approve his plans and give permits. He said aside from that, economically, we are in a sweet spot in terms of interest rates. He said you can build now as cheap as ever. Let the permitting process get started. Mayor Curtis Boyd agreed. He said, when he ran for mayor, he ran to see the town grow. He said he would love a drawn-out plan, but you have a man who grew up here, has a business here, spent money here, and wants to spend more money right here in Darlington. People living right here are going to make this work. Mayor Boyd said for us to get more business here, we must have more people. We must show that something’s happening here. He said I am standing here because that Council told Genesis no to progress. He wants to spend money in our town. We need people in the middle of everything. Businesses all through town need people to spend money in our town. He said

that it takes the three of you here to either stop it or start here. People threw eggs at Brasington 70 years ago, and now we can’t get the track in the city limits. Your decision today affects this town’s future. We have to start. I ran for mayor to make the town grow. I got nine people to believe in me. This man spent $2 to $4 million on Blue Street on 16 homes. Do you want 60 more homes in town? It’s in your hands whether we grow. Mr. Louie Hopkins said that mixed use is big in downtown revitalization because people like to live, walk, etc. Mr. Hopkins added that you need to allow mixed use to grow this town. Mr. Wiggins made a motion to recommend the Zoning Change Request for 115 Siskron Street from CC to OR to allow this development. Mr. Parnell made the second. Mr. Wiggins and Mr. Parnell voted in the affirmative. Mr. Sprott voted nay. The motion carried.

Zoning Change Request for 201 East Broad Street from GC to OR: Ms. Rock presented the application for a zoning change. Mayor Boyd said that he stepped in to this property with 9 investors to remove the eyesore that had been there on Broad Street for years, the Tyner warehouse. Mayor Boyd said he was approached by Mr. Evans who was interested in buiying the property if it could be changed to OR to allow him to build 14 homes, high-end apartments, inside the City limits. Mayor Boyd said he owns the remainder of the block and if Mr. Evans had the interest in continuing the development in the future. He said these would be brick, well-maintained apartments. It would be a showpiece for Darlington. Mayor Boyd said in talking with developers, they have said they can’t build apartments and homes fast enough in the Darlington and Florence area. This is another Darlington resident willing to take a chance on Darlington. The mayor said we appreciate his willingness to invest here. He could take his money elsewhere. Mr. Gainey said he was not against building on that corner, but he wanted everyone to recognize the storm water issue in that area. He said the pipes need to be upgraded from 24-inch to 48-inch. The storm water runoff comes from the Square down Main Street to Hardees and loops down Siskron and Russell back to Broad and Main. All of that system is owned by the state. Mayor Boyd said that we are one step ahead of Mr. Lewis on this project and that he has spoken with Senator Malloy to keep things moving with SCDOT. Mr. Evans is looking to start this project in January once he completes the ones on Blue Street. Mr. Sprott asked if he would keep the storm water on his property. Mr. Evans said he will build a retention pond or whatever is required to keep the runoff away from the street and other properties. Mr. Hopkins said it is more green space than is currently there based on these drawings. Mr. Sprott said he didn’t have a problem with this because they have a plan. As long as draingage stays on the property, I don’t have a problem. Mr. Evans said he wants to keep sthe storm water off the road and may change the layout to center the buildings on the property more. Mayor Boyd suggest an attractive retention pond on the Broad Street end. Mr. Gainey said after a rain event the water doesn’t stay long, it just takes time to drain. Mr. Wiggins made a motion to recommend the Zoning Change Request for 201 East Broad Street from GC to OR to allow this development. Mr. Parnell made the second. The motion carried unanimously.

New Business: Ms. Rock asked for the commission’s feedback on requiring an application fee for zoning change requests such as those presented. The fee for an Application to the Historic Landmarks Commission is $65 and the Board of Zoning Appeals is $300. She said there is actual

cost associated with printing the legal notice in the newspaper, posting signs, and sending certified letters out as required by law. Ms. Jones said that these are labor-intensive requests as well, as staff often have to research and discuss with developers various options. She suggested a $100 fee and suggested it might push people to have more of a plan when making these type of requests. Mr. Wiggins made a motion to recommend the City impose a $100 fee for zoning change requests. Mr. Sprott made the second. The motion carried unanimously.

Director’s Report: Ms. Rock polled Commission members, as requested by City Council, about a mask mandate. Mr. Sprott suggested doing what the City of Hartsville has done, suggesting it not requiring it. Ms. Rock said Hartsville passed a resolution encouraging citizens to wear masks in public. Mr. Wiggins agreed. He said people should still have that choice as mature adults. Mr. Parnell said that you will make people mad either way; however, he noted that any mandate would not infringe on someone First Amendment rights, because it has to do with saving people’s lives. Ms. Jones said enforceability would be the issue and completely unrealistic. Ms. Rock will forward these comments to Council.

Ms. Rock said, due to COVID-19, all future meetings would only be held if there was business to be acted upon.

Darlington Downtown Revitalization Association Report for Council – August 4, 2020

Due to the Governor’s executive orders regarding COVID-19 and social distancing requirements, the DDRA has postponed the annual Taste of Darlington, our monthly Member Breakfasts, and the Bringing Downtown Alive! Concerts. The Board has suspended all improvement grants until such time that we can resume our fundraising efforts.

We had record participation at our Annual DDRA Golf Tournament on June 24, at Darlington Country Club under the club’s new golf pro Jordan Hinson. The State Golf Association social distancing rules were relaxed to allow for more than one player per golf cart, and this allows our event to continue. That rule has since been reinstated. Thank you to Carolina Bank, Darlington Raceway, Fitness World Gyms, and Nationwide Insurance for their support of our tournament this year and in years prior.

In the meantime, we continue to promote Darlington and its businesses on Social Media and through our News Alert System each week. In April, we printed a half-page ad in the Morning News notifying customers of businesses that were still operating, and we continually update our Web page, www.BuildUpDarlington.org/covid19, as businesses adapt to this new normal.

Since we are unable to have our concert events downtown, we begin a summer promotion and contest to encourage shoppers to keep their dollars in Darlington. This effort to Save Our Restaurants & Eat Local will give patrons a chance to win one of three $250 cash prizes just for eating at locally owned restaurants in town. Simply eat local, get your brochure stamped or signed by the business when you pay, collect 20 stamps, and mail in your brochure to be entered into the drawing. We will draw the three winning tickets the first week of September.

The brochures will be available to print out from Facebook and from BuildUpDarlington.org as well as participating restaurants.

Grass Crew, cutting grass, checking and cleaning drains. One permanent employees is

still on medical leave and one has retired. We are relying on temps to fill in the gaps at

this time. We have 7 temps working. Two temps have been hired on as full time

employees, they are running the back of the garbage truck. They have been in training

for 13 weeks on the garbage truck.

Bridging the Gap (Disabilities group) is on a short manned crew. They are working only

2 times a week, due to the corona-virus quarantine.

Large order of landscaping equipment was submitted and approved. The order includes

the Rec Dept, Water Dept, Admin, and Street Dept’s equipment request.

Yard Debris crews collecting an abundance of yard debris. Everyone is cleaning yards

thru this stay at home period!

Garbage crews have had to increase their landfill runs daily because of the increased

refuse.

Vac truck and crew are running daily maintaining the drain lines. Concentrating on

S Main, Siskron, Rusell and E Broad St area.

Security camera’s have been installed thru out the street and sanitation department area.

Our departments have not experienced any exposure to Coronavirus thus far.

The departments’ capital fund account balance the end of Jun: $68,774.44

ORDINANCE NO. 2020-XX

ORDINANCE TO ENTER INTO INCENTIVE AGREEMENT WITH HDCC LLC

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DARLINGTON, SOUTH CAROLINA, assembled _____ day of _______________, 20___:

SECTION 1. The City of Darlington, hereafter referred to as THE CITY, will enter into an Economic

Development Agreement with HDCC LLC, hereafter referred to as THE DEVELOPMENT,

Whereas

I. The Development is located at 125 Country Club Road, Darlington, SC;

II. The Development began construction in February 2020, including a renovation of the exterior

and interior, and plans to be fully operational by the end of 2021;

III. The Development plans to exist at this location through January 2031;

IV. The Development intends to invest $3.279 million in capital expenses;

V. The Development intends to hire at least 10 full-time employees;

VI. The Development intends to hire with a preference for those living in Darlington County; and

VII. The combined investment of the Development, including a credit of $50,000 per job created,

exceeds $4.3 million.

In return for this investment, the development is requesting the City provide the following:

I. Reimbursement of 100 percent of building permit fees during the construction phase following

approval of this ordinance.

II. Reimbursement of business license taxes in the following manner:

a. One hundred percent for 2021;

b. Eighty percent for 2022; and

c. Sixty-six percent for 2023; and

d. Forty percent for 2024; and

e. Twenty percent for 2025; and

f. Zero percent for each taxable year of operation thereafter.

III. Reimbursement of local hospitality taxes, at a rate of 50 percent for a period of 12 months. Such

funds received through this incentive are to be spent only for purposes that are related to

tourism, pursuant to S.C. Code 6-1-730.

IV. Reimbursement of local accommodations taxes, at a rate of 50 percent for a period of 12

months from the initial collection of such taxes. Such funds received through this incentive are

to be spent only for purposes that are related to tourism, pursuant to S.C. Code 6-1-530.

SECTION 2. The City of Darlington affirms that, based upon any acquisition costs for the subject

property, along with good-faith estimates for the costs of physical improvements and the number of

jobs created, the Development will meet or exceed the minimum investment requirements of

subsection 22-105(a)(4); specifically, through

I. Anticipated business license fees of $1,078.00 annually;

II. Additional property tax revenue of $2,459.82 annually;

III. Utilities revenue of $4,178.00 annually; and

IV. Job investment credit of $500,000 based on 10 employees

Additionally, the Development will improve the quality of life; attract industry leaders to sell our

community as a place to live, work, and play, which in turn generates additional revenue for the City;

and to enhance the overall appeal of the community to potential residents, visitors, and businesses.

The amount of incentives granted to the Development shall not exceed the value of the direct and

indirect benefits of the Development to the City.

SECTION 3. Certification, commencement, and continuation of incentives.

No incentive shall commence or be given until such time as the Development has been issued a

certificate of occupancy and/or a business license as well as a certificate that all terms and benchmarks

included within the applicable incentive agreement, including without limitation benchmarks for capital

investment, property valuation, and job creation (the "benchmarks"), have been fully achieved or

otherwise completed.

Where benchmarks, such as the number of jobs created, are to be met continuously over a period of

time, the incentive recipient shall provide to the city, on an annual basis, sufficient proof that the

Development has continuously achieved or otherwise complied with such benchmarks. A Request for

Incentive Repayment must be submitted by July 31 of each year to the City Manager’s Office. Failure to

do so may result in reduction or forfeiture of incentives.

If, at any time after completion of a Development or at any time within the period of time during which

a Development is granted incentives, a Development fails to achieve or otherwise comply with a

benchmark, the council may, at its discretion and on a case-by-case basis:

(1) declare the incentive agreement null and void and refuse to grant any future incentives;

or

(2) decrease the amount of the incentives based upon the actual direct and indirect

benefits of the Development to the City and its citizens.

SECTION 4. This ordinance shall become effective upon its final adoption.

RESOLUTION OF DARLINGTON CITY COUNCIL

A RESOLUTION ENCOURAGING INDIVIDUALS TO WEAR FACE COVERINGS IN CERTAIN CIRCUMSTANCES

WHEREAS, it is well recognized that SARS-CoV-2, the virus that causes the disease

COVID-19, presents a public health concern that requires extraordinary measures and vigilance; and

WHEREAS, the President of the United States declared a National Emergency for the

United States and its territories in an effort to reduce the spread of the virus; and WHEREAS, COVID-19 has spread across the state with the South Carolina

Department of Health and Environmental Control (“SCDHEC”) confirming the localized person-to-person spread of COVID-19 in South Carolina, which indicated a significant risk of exposure and infection and creates an extreme public health risk; and

WHEREAS, as of July 31, 2020, the total number of confirmed cases in South Carolina

is approximately 87,572 and the number of confirmed deaths is 1,667. The number of confirmed cases in Darlington County as of July 31, 2020, is 1,023. The percentage of occupied hospital beds is at 61.4 percent; and

WHEREAS, if COVID–19 cases continue to increase in the State and in the City of

Darlington, the demand for medical, pharmaceutical, personal, and general cleaning supplies may overwhelm sources of supply; the private and public sector work force may be negatively impacted by absenteeism; and the demand for medical facilities may exceed locally available resources; and

WHEREAS, it is vitally important that we all work together to decrease the

widespread proliferation of COVID-19 among us all now rather than suffer the unfortunate and devastating consequences later; and

WHEREAS, health authorities, including the CDC, the Surgeon General of the United

States, and DHEC have recommended the use of face coverings as a means of slowing the spread of COVID-19; and

WHEREAS, in order to protect, preserve, and promote the general health, safety and welfare and the peace and order of the community, the City is taking steps to try and protect the citizens and employees of the City from increased risk of exposure; and

NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Darlington, South Carolina, the Darlington City Council, that due to the real and present concerns of the spread of COVID-19, it is encouraged that everyone in the City, to include City

employees, wear face coverings over the nose and mouth any time they are in contact with other persons who are not household members while in public areas, commercial/retail/business establishments, and city-owned facilities where social distancing is not possible.

This Resolution shall become effective immediately. All orders, resolutions, and parts thereof in conflict herewith are, to the extent of the conflict, hereby repealed.
