Dane County Recount Minutes

The Dane County Canvass Board convened at 9 a.m. on Wednesday, April 27, 2011, in room

354 of the City-County Building, 210 Martin Luther King Jr Boulevard.

The Dane County Canvass Board completed the recount at 8:00 p.m. on Saturday, May 7,

2011

Original Result: Prosser 48,636 votes, Kloppenburg 133,565 votes

Tabulators: Dane County Municipal Clerks, Chief Inspectors and Election Officials were used

as tabulators for this recount.

Security: Only two keys exist for this room. County Clerk Karen Peters holds one key, and

Judy Nowak of the County Clerk’s Office holds the other key. Dane County Facilities

Management does not have a key to this room.

Municipal clerks kept all election materials secured in their municipality prior to delivering

their poll books, ballots, absentee certificates, and absentee requests to the Dane County

Clerk’s Office on Friday, April 22, and Monday, April 25, 2011. The County Clerk kept these

materials secure in the County Clerk’s Office and vault until the County Clerk secured them

in room 354 of the City-County Building the afternoon of Tuesday, April 26, 2011.

To accommodate space restraints, ballots for the City of Madison were kept secure in the

Madison City Clerk’s Office storage facility at the Village on Park until transported directly to

room 354 of the City-County Building by City Clerk’s Office personnel the day before they

would be recounted. City of Madison poll books, absentee certificates, and absentee

requests were kept secure in the Madison City Clerk’s Office until transported directly to

room 354 of the City-County Building by City Clerk’s Office personnel the day before they

would be recounted.

Methodology: Tabulators followed the following steps for each reporting unit throughout the

process:

• Ballot container seal numbers are compared to the Chief Inspector’s Statement and

any discrepancies are noted for the minutes.

• All ballots are sorted in order to separate the apparent absentee ballots. In Dane

County, Municipal Clerks are asked to mark their absentee ballots with a red stamp

reading “Absentee.” Absent such a mark, tabulators make a determination if there is

evidence that a ballot has been folded and bears the initials of the Municipal Clerk.

• The non-absentee ballots are separated into one pile for each candidate.

Undervoted, blank, write-in or irregularly marked ballots are segregated for review by

the Board of Canvassers.

• The stacks of ballots bearing undisputed votes for each candidate are, in full view of

the candidates’ representatives, counted into smaller stacks of 25, criss-crossed to

avoid admixture, which are then reviewed by a second tabulator to verify that there

are 25 ballots in each smaller stack. At the same time, the tabulator verifies that the

mark on each ballot is for the correct candidate.

• Next, each stack of 25 is checked again by a different tabulator, who inspects the

ballots to ensure that they bear the initials of two election inspectors. If any are found

to be missing one or both sets of initials, the ballot is set aside pending verification that

there are not more ballots than voters. The type and number of these irregularities are

noted in the minutes.

• Stacks of 25 are combined into stacks of 100, criss-crossed, and tallied along with any

remainder stacks.

• Absentees are counted in an identical manner at a separate table.

• Any paper ballots which were hand counted are treated the same way and then

added to the “regular” ballot total.

• At the absentee table, any remade ballots are compared to their originals to verify the

accuracy of the duplication.

• The total number of absentee and regular ballots cast is verified.

• The number of regular, absentee and write-in or irregular ballots for each candidate is

then added together by the Board of Canvass to obtain the final tally.

• All materials are re-sealed in new ballot containers with new seal numbers which are

noted in the minutes.

Notification: The Dane County Clerk’s Office posted its public notice of this recount on

Monday, April 25, 2011, at noon.

• The County Clerk reviewed the process that will be followed and the rules for the

observers.

• Karen Peters introduced the Board of Canvassers.

• City of Fitchburg submitted a chain of custody for all election materials.

• Tabulators verified that the seals on the ballot bags matched the seal numbers on the

Inspector’s Statement. There were no objections.

• The seventeen (17) regular absentee certificates were matched to their absentee

requests.

• Canvassers determined five (5) write-ins as votes for Kloppenburg. There were no

objections.

• The ballots were sealed in bags with seal numbers 0663641, 0663690 and 0663680.

• The Tabulators identified 79 ballots marked Absentee.

• The 80th Absentee ballot was determined by the Canvassers to be a re-made ballot

that was not stamped or marked Absentee. There were no objections.

• There is one Absentee ballot without the Clerk’s initials which the Canvassers

determined to be a clerical error. There were no objections.

• One (1) more vote was counted for Kloppenberg and one more vote was counted

for Prosser than was counted on Election Day.

• The Board of Canvassers determined that two ballots must have been marked with

a ball point pen. There were no objections.

• Board of Canvassers counted 294 absentee certificates, 291 were listed on the

Inspectors’ Statement. The absentee log showed 294. The Board of Canvassers

determined this was a counting error by the Chief Inspector. There were no

objections.

• The thirty (30) absentee certificates were matched to their absentee requests.

• A ballot had no clerk initials, this was ruled a clerical error. There were no objections.

• Three ballots had no inspectors initials, this was ruled a clerical error. There were no

objections.

• One ballot had one inspector’s initials. The Board of Canvassers ruled this was a

clerical error. There were no objections.

• On the inspectors’ statement, the bag seal numbers were not written in, however the

bags were sealed. There were no objections.

• One (1) more vote was counted for Kloppenberg than was counted on Election Day.

• The thirty-five (35) regular absentee ballot certificates were matched to their

absentee requests.

• The Tabulators checked the ballot bag seal numbers and verified that they matched

the seal numbers recorded on the Inspectors’ Statement. There were no objections.

• Two (2) absentee ballots had no absentee stamp.

• Two (2) absentee ballots were blank.

• One (1) absentee ballot was marked with the point of the arrow connected to each

name. The Board of Canvassers ruled this was a vote for Kloppenburg. There were no

objections.

• A bag containing ballots for wards 10-14 was inadvertently added to wards 7-9 in the

hand count. Upon discovering this, Tabulators separated out ballots for wards 10-14.

• On the inspectors’ statement, the bag seal numbers were not written in, however the

bags were sealed. There were no objections.

• One (1) more vote was counted for Kloppenburg than was counted on Election Day.

• City of Stoughton submitted a chain of custody for all election materials.



• One (1) voted ballot contained only one set of election official initials. There were no

objections.

• One absentee ballot was correctly rejected on election day for lack of the voter’s

signature. There were no objections.

• Three absentee enveloped could not be matched to their applications. However, a

review of the records demonstrated that they were issued and returned in the

Municipal Clerk’s office. There were no objections.

• Upon initial review, the number of ballots exceeded the number of voters by 5 (973 vs

968). Tabulators reviewed the number to total ballots checking for ballots with

erroneous header codes. Upon review, a stack of 20 ballots had been assumed to

have 25 ballots, thus the number of ballots and voters matches perfectly. There were

no objections.

• There was one more apparent absentee ballot than absentee envelopes, however

since the total number of ballots does not exceed the total number of voters, no

additional action need be taken. There were no objections.

• The ballots were sealed in bags with seal numbers 0663647 and 0663638.

witness address. Only three of the ballots apparently needing an original application

were not paired to one. A review of the absentee ballot log and SVRS showed

application dates, dates mailed and dates returned, all timely. There were no

objections to proceeding with the tabulation of all apparent absentee ballots.

• One Election Day ballot was found to bear only one set of election official initials.

There were no objections to its tabulation.

for rejection. There were no objections.

• Nine (9) ballots were, upon review, issued and voted in the clerk’s office, despite

having other witness addresses. There were no objections.

• One (1) absentee ballot envelope issued on Election Day for a hospitalized voter

could not be matched to its original application. There were no objections to its

tabulation.

• One (1) regular absentee envelope could not be matched to its original application.

The absentee log and SVRS both document its application date, and sent and

received dates. There were no objections.

• One (1) ballot from Election Day bore only one set of inspector’s initials. There were

no objections.

• One (1) write-in vote for Kloppenburg had not previously been tallied, so it was

added to the totals. This resulted in an overall gain of one vote in the totals. There

application request. It appears that these voters requested absentees for both

elections in 2011 on one request, and the request application was not with the

paperwork for this election. There were no objections.

• Absentee ballot issued at counter in clerk’s office did not have an elector signature

on the certificate. This is a clerical error according to the Government Accountability

Board. There were no objections.

• Two (2) ballots issued at the polling place had only one set of election inspector

initials. There were no objections.

• Some of the ballots from this reporting unit were sealed in a separate envelope by the

Sun Prairie Clerk on election night. The Sun Prairie Clerk placed a certification on the

envelope on election night that she sealed the ballots in the envelope after the

District 3 Chief Inspectors handed the ballots to her separately with questions on

election night. The seal number on the envelope matched the seal number on the

certification statement. There were no objections.

• Two (2) ballots with only one set of election official initials. There were no objections.

• Ballots were sealed in containers with seal numbers 414812, 414811, 414810, and

414809.

• The ballots were sealed without the blank ballots that canvassers had reviewed.

These ballots were sealed in an envelope with seal numbers 406241 and 414817.

and crossed out original totals, noting the correct total of voters 2568.

• Tabulators recounted the number of voter slips recorded in the voter books at 2569.

• City of Verona submitted a chain of custody for all election materials.

• The seal number listed on the Inspectors’ Statement did not correspond with any of

the seals used on the ballot bags. There were no objections.

• The seal on the ballot bag and the number on the ballot bag matched, this number

was not written on the Inspectors’ Statement.

• In the rejected absentee envelope certificate the inspectors had placed a ballot

they had remade. This should have been in an envelope marked “Ballots to be

Remade” and there was no identifying mark to match it to the remade ballot. There

were no objections.

• Three absentee certificates did not have a corresponding application. There were no

objections.

• There were a total of 229 absentee ballots, and a total of 229 absentee certificates,

but only 220 marked on the Inspectors’ Statement. There were no objections.

• Six absentee ballots without initials, one without the stamp. There were no objections.

• Three blank absentee ballots. There were no objections.

• One ballot with only one set of initials.

• Ten blank ballots. There were no objections.

• Three voters were recorded as absentee in one book that were recorded as regular

in the other poll book. Tabulators verified that these voters were absentees.

• 11 absentee ballots were marked with a Sharpie marker rather than the proper ballot

pen. At the polls two election officials used an official ballot marking pen to mark

over the marks made by the voters on these ballots. These ballots should have been

duplicated by the election officials to preserve the original marks made by the voter.

Counting these ballots by hand today reduced the number of undervotes that were

recorded by the tabulator on Election Day. These 11 absentee ballots, combined with

the 13 blank ballots, equaled the number of undervotes marked on the tabulator

results tape. There were no objections.

• Ballots were sealed in containers with seal numbers 0663653, 0663651, 0663652,

0663654.

• City of Verona submitted a chain of custody for all election materials.

• The seal number listed on the Inspectors’ Statement did not correspond with any of

the seals used on the ballot bags. There were no objections.

• There were four absentee certificates that did not have corresponding applications.


• Supplemental poll list shows one voter who registered on the county poll list but not

on the city poll list.

• One absentee ballot that was not initialed in the clerk’s office. There were no

objections.

• Tabulators counted the ballots and came up with 92 less than the count on Election

Day. The Verona Clerk called the City Administrator who then checked and found

unbagged and unsealed ballots in her office. City Administrator Bill Burns immediately

brought a bag of ballots to the recount.

• Upon arrival in the recount room, the City Administrator and City Clerk were put

under oath and completed a chain of custody statement for these ballots.

• The Board of Canvassers questioned the City Administrator and City Clerk about the

ballots. They stated that they were unsealed when stored in the City Clerk’s locked

office since Election Day. The City Administrator sealed them in a ballot bag at the

Verona Clerk’s office after counting them today and then brought them to the

recount.

• The Dane County Clerk put the Verona City Clerk Judy Masarik, City Administrator Bill

Burns, Chief Inspector Gail Bogdoanow, Chief Inspector Ruth Jensen and Chief

Inspector Kathleen Olson under oath. Each person acknowledged that they were

sworn in and they are under oath.

• The designated representatives for each candidate examined the Verona officials.

They determined that some ballots had been pre-initialed and pre-stamped with the

ward number, but not issued to any voters. It was determined that there may have

been ten such ballots. The designated representative for Prosser requested that the

City Clerk secure and seal these ten ballots and submit them as an exhibit to the

Board of Canvassers.

• The designated representatives questioned the Verona officials about the security of

the City Clerk’s office. The Clerk’s office has been unlocked at some points since

Election Day. The Verona City Administrator, the Police department and Alvin from

maintenance all have access to the Clerk’s office.

• The Verona City Clerk and the City Administrator stated under oath that they had not

tampered with the ballots.

• The Dane County Clerk asked whether anyone remembered having seen a stack of

ballots that may have remained unbagged on election night. Chief Inspector

Bogdanow remembered tallying the write-in votes on a stack of ballots, and that the

ballots may not have been included in the ballot bags at the end of the night. She

said they may have, instead, been returned to the Clerk’s office with other election

materials.

• The Deputy Clerk opened the ballot bag. Chief Inspector Bogdanow said she

recognized the stack of ballots as well as the rubber band around them. The Board of

Canvassers compared these ballots to the write-in tally sheet from election night and

determined that they were from the write-in bin of the ballot box. There were two

ballots in the stack labeled as remade ballots. These remade ballots matched the

corresponding original ballots sealed in the envelope labeled “Ballots that have been

duplicated.” Two ballots in the stack were completely blank.

• The ballots were hand-counted by the Board of Canvassers. There were no

objections.

At 2:05 p.m., we were rotating workers between poll book reconciliation and ballot

counting. Two Tabulators had been working on poll book reconciliation since 8 a.m. and

needed to be given a new task. The Madison City Clerk asked for volunteers from the ballot

counting table to move to poll book reconciliation. Nobody volunteered. The Madison

City Clerk next asked which municipality each Tabulator was from, to determine which

Tabulators had a while to wait before their municipality’s ballots would be counted. Two of

the individuals seated at the ballot table did not answer until the third time the Clerk asked

this question. They then responded that they were from Madison. She asked if they were

from the Town of Madison, and they responded that they were from the City of Madison.

The Clerk did not recognize these individuals as City of Madison Chief Inspectors, and

questioned them further. She determined that they were not City of Madison Inspectors,

and had not been scheduled to work at this recount. These individuals said they were “with

Prosser,” at which time the Madison City Clerk summoned the County Clerk. The County

Clerk brought the designated representative for each candidate together and then initiated

the following proceeding:

3 and I'm representing Justice Prosser's campaign,

4 working with Jim Troupis, who is the lead attorney

5 regarding Justice Prosser's campaign. We're here

6 today to -- we have two people who consider

7 themselves to be volunteers, and when they came in

8 to the re-election office, office facility, they

9 said that they were here to volunteer, and they

10 were willing to count ballots. What they did not

11 understand is that you had to pre-register to be a

12 tabulator, to make sure that the county clerk

13 allowed you to be part of that, and there is a lot

14 of people that are tabulators, so it's a fairly

15 large group of people.

16 We found out that they weren't

17 pre-registered to be tabulators, and at that point

18 they stopped becoming tabulators, and we moved on.

19 The purpose of this hearing is to make the record

20 to get the facts for everyone, so that they can

21 look at it, and the county clerk will talk and she

22 talked with both sides, the Kloppenberg and Prosser

23 campaign, and we don't think that there was

24 anything done illegally or inappropriately

25 regarding the counting with the county. We believe

15 help you count votes. We did the other day, too.

19 MR. SWEENEY: You're not registered with

20 Jim Troupis or Justice Prosser's campaign?

22 MR. SWEENEY: She can only get one of us

2 MR. SMITH: To help out with the recount.

3 MR. SWEENEY: Do you have questions for

5 MS. LALIME: No, I don't have any

6 questions. Our campaign says if the numbers all

7 added up correctly, we'll agree that it was a

8 mistake.

9 MS. PETERS: I'm Karen Peters, the county

10 clerk, and what we decided to do when people came

11 to the front door, because we had asked for

12 volunteers, we had the city clerk in Madison

13 handling most of the volunteers because I didn't

14 have time. So we asked the municipal clerk to

15 appear, to bring an inspector and more if they had

16 them. As people came in, we would ask them are you

17 here as a designated representative, because we

18 knew we could only have one of them, are you an

19 assistant representative, or a tabulator here to

20 volunteer, and I believe when we asked that, he

21 said he was a tabulator here to volunteer, meaning

22 that's what he was here to help with, but he was

23 not on anything that we were associated with.

24 MR. SWEENEY: It's fair to say where the

25 mistake was made is he could have called and

1 volunteered through the city clerk and through you,

2 and he didn't do that.

3 MS. PETERS: Actually Maribeth has a

4 list of people, but it's quite a long list, and at

5 times they switch between themselves. But we are

6 only using certified election inspectors as our

7 tabulators. So when they asked -- my understanding

8 is when they asked where are you from, he said City

9 of Madison, so we assumed it was one of the City of

10 Madison tabulators.

11 MR. SWEENEY: When, in fact, he lives in

12 the City of Madison. It was just an error, and it

13 should in no way affect the count.

After this proceeding, all Tabulators wrote the name of their municipality on their nametags.

• On Election night the Town of Sun Prairie ran out of ballots for the Sun Prairie School

District. The Town Clerk had taken the pdf supplied by the Dane County Clerk and

printed a paper copy on an 8 ½ x 11 sheet of paper when submitting the sample

ballot to be printed in the newspaper. When she ran out of ballots on Election night,

she took that copy and enlarged 32 copies of 11 x 17 ballots. At the end of the night

they issued all 32 enlarged copies to voters and needed to issue a ballot to an

additional voter. The Clerk issued the 8 ½ x 11copy instead of making another

enlarged copy. There was a lot of discussion on this issue, and it was agreed that this

would be noted in the minutes. There were no objections.

• Both Prosser and Kloppenburg gained one vote.

• Number of voter slips recorded in the poll book was three (3) less than the number of

ballots counted. Kloppenburg’s Designated Representative requested that this

discrepancy be investigated. Town of Sun Prairie Clerk and Chief Inspector

reconciled the poll books once again and checked all absentee certificates to verify

that their voter slip numbers were recorded in the poll book. Town of Sun Prairie

officials confirmed that there were 805 voter slip numbers recorded in the poll book,

and all absentees had been recorded in the poll book.

• The Board of Canvassers drew down three (3) ballots from the blank ballots. The

designated representative for each candidate had no objections.

• The pollworkers rejected three absentee ballots. One was from a voter deceased

before Election Day, one was cast by a voter who chose to vote on Election Day

before his absentee had been processed, and one absentee request did not have

the voter’s signature. The Board of Canvass determined that the last of these was

rejected in error, as a request had been received timely via e-mail and the use of a

ballot certificate envelope not bearing the sentence “I further certify that I requested

this ballot” is a clerical error and not a defect. The envelope was opened and the

ballot tabulated. There were no objections.

• Three e-mailed ballots were received at the polls, assigned numbers and set aside by

the pollworkers to confer with the Town Clerk. They were not remade or tallied until

after the polls had closed and results had been reported to the County Clerk. At the

Board of Canvass, the ballots were had counted and added to the totals. These

ballots were counted at the recount as well. There were no objections.

• Two absentee envelopes did not bear the initials of the clerk. They were counted

without objection.

• Three regular ballots had only one set of inspector’s initials. They were counted

without objection.

• 822 ballots were found, 13 of which were undervotes for the office. The tabulators

suspected that blank ballots which had been initialed but not given to voters were

erroneously included in the sealed envelopes at the end of the night. The canvassers

examined the undervoted ballots to determine if any were completely blank. Six (6)

entirely blank ballots were found, which exactly corresponds to the discrepancy. The

Canvassers unanimously agreed to remove the six entirely blank ballots, which were

folded in half as a means of future identification. There were no objections.

• Twenty-three (23) ballots issued at the polls had only one set of election official initials.

• There was one ballot that was remade and about which there were questions. The

original ballot was marked for Kloppenburg and the remade ballot was marked for

Prosser. This was remade ballot #1 documented on the Inspectors’ Statement at 7:45

a.m. The City Clerk called the Chief Inspector, Ingrid Rothe, who recalled using the

good ballot/bad ballot stickers when issuing the voter a second ballot. The

canvassers spoke to the Chief Inspector over the phone. Ms. Rothe said that other
