Penta signs worldwide Elektra distribution dealVancouver -based Penta Records has signed aworldwide distribution agreement withElektra Records (exclusive of Canada), and afirst for a Canadian independent label, yetthe principles involved: John Ford, LouBlair, Sam Feldman and Bruce Allen haven'tsigned any acts to their roster, and don't ex-pect their first release until the spring of nextyear.

In addition to and augmenting theElektra deal, Penta and WEA Music ofCanada concluded a separate agreement that

CFTO-TV, Global and the CanadianAssociation of Broadcasters wanted a reviewof last year's decision by the Copyright Ap-peal Board that fixed the royalty rate forprivate television at 2.1 percent of grossrevenues and removed a royalty cap imposedthe previous year. The broadcasters believed"the Board had erred in law in its decision."

However, the decision was upheld in theFederal Court by the panel of judges, whoalso dismissed the CBC's request for a similarreview affecting its tariff as approved for1986 on the same grounds as private televi-sion.

Jackson TV campaign toCBS makes their marketing objective quiteclear: to get the two million people thatbought Thriller back into the stores to buythe Bad album, and over the Christmasseason the label has budgeted $175,000 fortelevision advertising to do so.

Bad, having already topped four -timesplatinum in Canada within its first two mon-ths of release and the third single The WayYou Make Me Feel climbing charts veryquickly, looks to have the potential of itspredecessor but CBS hopes to reach "farbeyond" radio listeners and regular recordbuyers by utilizing a heavy saturation level ofadvertising.

By successfully appealing to those buyerspreviously, Thriller has broken all salesrecords in Canada and worldwide sold over38 million copies, so CBS is planning again tobring "both the regular music consumer andthe consumer that seldoms listens to commer-cial radio stations or visits record stores"back and well into the new year also.

"Larry's first priority will be to find anddevelop local talent in cooperation with ouroffices in the United States," states companyPresident Peter Erdmann. Currently the labelhas only the new Men Without Hats albumcharting and has been subject to criticism fortheir irreverence towards Canadian talent.

"Canadian artists stand a much betterchance of international success if they arebacked by the joint belief and commitment ofboth North American operations." Erdmanncontinues. "This does not mean that ourdoors will be closed to regional projects, butthat in our main efforts will be directedtowards international potential."

Although PolyGram has developed afine roster of up and coming talent in othercountries, particularly British, their cor-porate philosophy has been a point of con-cern for many managers in this country in re-cent years.

"I'm not sure when logic prevails. In fact," he confides, "I'm not sure what the

condition of our license is. In some ways it looks like we have an amended license to basic. Do we then take on the new conditions

and responsibilities of that basic license or do we play it out until 1989?

"I believe it's a basic license today but that doesn't mean a helluva lot until other

people agree with me. "We're very pleased but we didn't apply

for it per se," he continues. "Basically, what we said was 'If you move anyone to basic, we

want to go too.' But I'm pretty happy with the way it's come down the way it has.

New Order compilation goes gold sparks new set

Substance, New Order's compilation album featuring tracks not previously found on LP

format and containing the hit True Faith, has surpassed the gold plateau in Canada; primarily due to the fact that it was made available to fans as a double set in the CD

configuration, with an additional 12 tracks included, comprised of the B-sides to all the

singles on the package. The band, formed after the demise of

Joy Division, continues to exude quite an in- fluence on the current dance scene and this is

their first gold record here, a testament to their broad -base of support.

Hence, PolyGram has now released Substance Sides, 14 tracks and over 90

minutes of music "for the price of a single cassette." Extended plays and dub mixes

make up the majority, but neither Murder nor Thieves Like Us Instrumental have ever

been released domestically. As well, True Faith Dub, taken from the

True Faith Remix 12", does not appear on the Substance CD and like Bizarre "Dub"

Triangle, it's a bonus track exclusive to the cassette.

expected to quadruple - the advertising rate

will also summararily increase over time. "On the other side of the coin," con-

cludes Fitzgerald, "the amount of dollars we're taking out of the subscriber base will

decrease, and that's on file with the Commis- sion, but when it's all said and done we don't

see the bottom line changing to any great ex- tent."

Songwriters offered free magazine yet few left

Soundmakers, formerly the Music City Song Festival (MCSF) Songwriters' Enquirer, is

currently being offered "while the supply lasts" to individuals and organizations at no

charge; free. The educational magazine con- tains over 40 pages of articles - contributed by

"experts" from the music industry -

plus directories of studios, songwriter workshops

and seminars. Topics covered include: Publishing, by

Arthur Braun, General Manager of U.S. Operations for the Dick James Organization;

Home Studies, by Tom Lubin, author of the book on recording, Capture The Wind; Per-

forming Rights Societies, by Brad O'Shea, author, Just For The Record; and The

Techniques of Rhymes, by Buddy Kaye, reci- pient of 13 gold records and author of Buddy

Kaye's Method Songwriting course. "The key to a great song is to write something simple," says Braun in his article.

"Say it in a natural way with a new approach, musically fresh," he advises. "Don't use standard chord progressions you have learn-

ed in music class -

it's obvious. "It all goes back to the basic fact that if

you don't have a good song, you don't have the record

. . . all records now are work

records. We work them to get them recorded and released, and they must be good songs.

"Today," Braun concludes, "the better the song, the better the production and the

more exciting the artist, the better the chances are for success."

Dan Hill writes Billboard's #1 A/C song for '87 Dan Hill continues to be one of Canada's most successful and widely

covered songwriters. Now Billboard is about to announce that Can't We Try, the massive ballad success from his current album, is the

year's No. 1 A/C record in the United States. In Canada and the U.S.. the album's second single, Never Thought

(That I Could Love), is the follow-up smash. The song is now Top 10 on AC charts in R&R and Billboard. In fact, Hill has had a song

on Billboard's AC chart every single week for more than a year. Dan Hill has been entrusting CAPAC to administer his performing rights since 1974. We are proud of his continuing success.

Higgin's unveils Canada's"Consumers are forced to determine if they'llenjoy what they hear on a disc, based on whatthey see through a blister pack," says PaulHiggins, who officially opened The CD Bar(Nov. 25), Canada's first consumer -relatedentertainment complex devoted exclusively tocompact discs and hardware.

He continues with, "We are all victimsof a marketing strategy that says if you likean artist in general, or a particular song onthe radio, you'll like the whole album. Thatwas okay when the purchase was a $3.99record, but today there is much more musicavailable in every genre . . . not only perfor-mance, but sound quality can also varydramatically on compact disc."

Earlier this year, Higgins conducted asurvey of CD buyers and found that morethan 80 percent agreed with his beliefs,"They wanted access to more informationand the opportunity to listen to discs prior topurchase," says Higgins. His CD Bar,located next to CITY -TV in downtownToronto, offers a unique private in-storeauditioning.

"Auditioning allows the consumer tosample music to which they might not other-wise be exposed to," he continues, "as wellas to make informed purchasing decisions."

Soviet musicians angeredover album content"It's a pity our hit song has been cut from theAmerican record," complains Boris Greben-shchikov, front man for the Soviet rock actAquarium, after the double album titled RedWave: Four Underground Soviet RockGroups was recently released on the Big Timelabel.

Not only are the so-called rockers upsetat the song selection, but they're apparently -also "angered" by the underground status ofthe album, since they do not consider theirmusic underground, but actually commercial.These groups evidently draw full houses andlarge TV audiences in the USSR, according toa Novosti Press Agency report.

At a time of gladnost and Billy Joel'sKohuept, the music industry in the SovietUnion is striving for creative independence,something of a misnomer even in Westernsocieties. This means they turn down state -sponsored tours, choosing instead to spendthe time composing.

"Frequent performances leave little timefor composition," furthers Aquarium'smanager Vitali Kalmanov. "The pleasure weget is more important than a high salary,although we don't want to be left without it."Dmitri Levkovsky, who manages Games,adds, "We could give many concerts on acommercial basis and make a lot of money,but this is a kind of bondage. Besides, com-mercial music has to follow fashion."

However, recording music, whethercommercial or not, is a bigger problem Sovietmusicians face, as demand exceeds supply.Recording facilities are booked far in ad-vance "with many celebrities still waitingtheir turn," hence musicians prefer to usefilm and TV studios to shoot videos, which"is just what we need today," concludesLevkovsky.

Walking captures essence of CamJane Siberry's latest record has an intriguingcharacteristic about it, in that its own preten-sions aren't bound by what can possibly becalled commercial, yet because most Cana-dian rock bands previously have been cajoledinto a strained existence determined by their -eventual success stateside, The Walking ex-.emplifies what should always be expectedfrom this nation's musicians: quality.

"There's a lot of room in the ar-rangements where I wanted the band to bespontaneous and improvise," says Siberry."There's a lot of wonderful playing on thisrecord. I felt badly putting on any vocalsafter hearing the bed tracks, because theycovered up so much. It would make a greatinstrumental record."

The Speckless Sky, which went gold lastsummer, won her and her band acclaim fromboth the industry and the public alike, oneach side of the border. Warner Bros. thisyear took over the international distributionof forthcoming records from Windham Hill,who had entered the picture following the NoBorders Here release.

"This was the first time I've had to writeall the songs without ever having performingthem live before we went into the studio,"she confides. "They were all brand new andnot completely finished, which made it a bitharder when I eventually went into the studioto sing."

The consumate artist, Siberry takes herwork seriously: from the continuous "scrib-bling" of notes to the arranging of newmaterial at her 12 -track home studio, fromrecording at Manta Sound to performing thefinished songs; now the task of selling herpiece of art lies in the hands of the variouslabels.

"There are parts on this record that arenot a regular style of lyric, more likesplashes," she explains. "In the lyric book,

Walking captures essence of Canadian songwriting Jane Siberry's latest record has an intriguing

characteristic about it, in that its own preten- sions aren't bound by what can possibly be

called commercial, yet because most Cana- dian rock bands previously have been cajoled into a strained existence determined by their

-

eventual success stateside, The Walking ex-. emplifies what should always be expected

from this nation's musicians: quality. "There's a lot of room in the ar-

rangements where I wanted the band to be spontaneous and improvise," says Siberry.

"There's a lot of wonderful playing on this record. I felt badly putting on any vocals

after hearing the bed tracks, because they covered up so much. It would make a great

instrumental record." The Speckless Sky, which went gold last summer, won her and her band acclaim from

both the industry and the public alike, on each side of the border. Warner Bros. this year took over the international distribution

of forthcoming records from Windham Hill, who had entered the picture following the No

Borders Here release. "This was the first time I've had to write

all the songs without ever having performing them live before we went into the studio,"

she confides. "They were all brand new and not completely finished, which made it a bit

harder when I eventually went into the studio to sing."

The consumate artist, Siberry takes her work seriously: from the continuous "scrib-

bling" of notes to the arranging of new material at her 12 -track home studio, from

recording at Manta Sound to performing the finished songs; now the task of selling her

piece of art lies in the hands of the various labels.

"There are parts on this record that are not a regular style of lyric, more like

splashes," she explains. "In the lyric book,

there are actually two ghost poems which I

extracted from what you hear me sing. I

decided to put . . .

not poems, but just scrib- blings, so the extraction isn't too obscure,

and people can see where it all came from."

To that even artists aren't aware of, for example, the current state of radio, or

airplay and its affect on earnings (sales), is

not only naive but also a fallacy. In fact, sell- ing gold is neither surprising nor disappoin-

ting yet rather confusing, at a time when Wrestlemania sells out stadiums. Perhaps for

the consumer, in this day and age, wrestling is

more entertaining. "I had a number of songs, and eventual-

ly these ones that are on the album, clustered together in my mind as being a good group to

concentrate on," Siberry adds. "It's more like a tone, a colour. There's a real autumn -

winter feel to it, a lot of the colours are autumn: the reds, rusts and golds.

"Warner's are very aware that I want to work with people who'll encourage me in the

direction that I'm trying to go, as opposed to people who would discourage. So they respect that, and they have a lot of acts on

their label who are very similar to me, in that they aren't necessarily commercial

songwriters but they are highly respected." The names David Byrne and Laurie

Anderson crop up in conversation, as does K.D. Lang's, when discussing other artists on

the roster. But for Jane Siberry the true test of faith will come in the new year, when her

tour begins, taking her across North America and Europe in three months.

"It's not long for some people but I don't want to do that," Siberry concludes. "I really like to perform and work with the band

and travel. It's just another variation. I like to write, arrange, record but never too much of one thing. I like the different facets of

what I do .. . I like to go on the road but not

for too long. "People tend to forget that people who

write or are in the music world aren't in it for just 'the career' but they're in it because they

are truly writers or musical people. I have

many personal projects that I do on the side just for the love of it."

Siberry's bowling party "a roaring success" Celebrating the release of Jane Siberry's

latest LP, The Walking, Toronto -area retailers were invited to participate in one of

the most imaginative promotions this in- dustry has seen in a while. Held at Fall-

ingbrook Bowling Alley in Scarborough, Duke Street Records treated bowlers (and

non -bowlers alike) to a night of fun and exer- cise.

"It was a roaring success," explains David MacMillan, the label's marketing

representative, whose responsibility it was to organize the event. Although there are no im- mediate plans for another bowling release

party, he hopes his idea of a toboganning party for Neo-A4's new Colin Thurston's

Present, and bowling, among the various retailers were members of Siberry's band and

her manager Bob Blumer, Duke Street and MCA staffers. Peter Vitols took the high

average prize, leading his team that included Rob Yale, Chris Ryan and Sandra Hummel

(both of Sam's), Duke's Pat Hope and the band's John Myhr to overall victory.

MacMillan also mentions there were prizes for lowest score, lowest team average

and most strikes as well. Not only was Siberry product offered, and competitively fought

for, but also "practice sets" for in -home use for those unfortunates who couldn't quite

knock down as many pins as Vitols. Siberry's critically -acclaimed album,

slated for release on Warner Bros in the U.S. this January, and RPM's front page pick

(Nov. 21), is starting to pick up steam across the country at retail, whereas radio seems a

little reticent to add the first single, the title track, in great numbers.

Daynard's move toCHFI benefits childrenFollowing his departure from CKFM, long-time Toronto morning man Don Daynard hasjoined CHFI and the station held a "welcomebash" at the Inn On The Park on Dec. 1 inhis honour, with dancing to the music ofyears gone by and all profits to the CanadianChildren's Foundation.

Over 800 people attended the launch andcelebration of Daynard's new morning show,and his return to air, which includes a nightshift co -hosting (with Brian Master) theSaturday Night Oldies show.

charity organization Helping Others Incor- porated distributed over $25,000 worth of

McCoy Bohn launch new smaller market program

The Vancouver -based programming con- sultants McCoy Bohn have launched a new "alternative" program, aimed at the small and medium market broadcasters, called Ins- tant Access Consulting.

Offered on a market -exclusive basis to stations not competing with the company's current clients, the program, says president Chuck McCoy, will provide "a system that allows small and medium markets to make

use of our services in a way that gives max- imum flexibility to the broadcaster. "We worked on the premise that most

arrangements with Jaroco Records, Nashville to release Danny Davis and The Nashville

Brass featuring Dona Mason records in Canada. Their first release Green Eyes

(Cryin' Those Blue Tears) bulleted up the U.S. charts for 5 straight weeks. There was

no Canadian distributor. Their follow-up I've Got A Memory, is set to be released

December 4th on the Tembo label and distributed by BMG.

Freedom rush releases new Crawley single

Freedom label president Scott Richards reports the rush release of Siobhan Crawley's

new single, Valentino. The single was culled from her upcoming LP, Without Warning,

which also contains her past releases, You're In Love, Closer, and her big hit of The Best

Way. The LP is now in the warehouse at Electric Distribution. A video of Valentino is also being

readied for release.
