DAILY EXCELSIOR, JAMMU WEDNESDAY, DECEMBER 21, 2016 (PAGE 13) Appx ‘A’ NOTICE FOR ARBITRATION PROCEEDINGS Whereas on the 30th day of Jan 2008, an agreement was entered into between the President of India represented by HQ Chief Engineer, 31 Zone, Pin - 914631, C/o 56 APO (referred as “Government’’) and M/s Techno India (referred as “Contractor’’) R/o Rameshwari, Shivpora, Srinagar under which the said Contractor among other condition contracts to provide “Provision of Hanger at Manasbal’’ bearing CA No. CESZ-54/2007-08. The contract was cancelled by the Accepting Officer i.e Chief Engineer, 31 Zone Srinagar under conditions of contract due to default of contractor on 14th May 2013. The Union of India has to realise the Govt dues from the Contractor and thus arbitration is under process. Whereas the contractor, proprietor of firm, Sh R L Kotwal original resident of Dehradun, Uttarakhand has expired during Jan 2013. The UOI (Government) is unable to locate their addresses of the firm which was presently not existing within the jurisdiction of police station at Srinagar as per police report. The where about of the legal heirs of the firm are also unknown to the UOI as the same was asked from the SSP/DM/DC Dehradun, Uttarakhand. The Arbitrator was appointed by the UOI in terms of Contract Provisions contained in condition 70 of IAFW-2249 vide Engr-in- Chiefs branch MOD, Kashmir House, New Delhi-110011 letter No. 13600/NC/402/10/E8 dated 25 May 2016 and entered into refer- ence vide Arbitrator letter No. PAC/2813/NP/02/E8 dated 10 Jun 2016 as served to the contractor on his address as per record and same was received back from Postal authorities. Notice is hereby served on behalf of UOI to the legal heirs partici- pating in arbitration proceedings for adjucation of disputes. Otherwise there shall be no option with UOI to proceed Ex-Parate.
