Japanese set up collision, says expert Japan has accused Greenpeace of ramming its whaling ship in the Southern Ocean and then selectively editing video coverage of the collision for the world's media. But a maritime law expert believes the video footage shows the Japanese set up the collision - which has led to an escalating diplomatic row between Japan, New Zealand and Australia - so they could blame it on the protesters.

Japan's Institute of Cetacean Research director-general Hiroshi Hatanaka said video taken from the Nisshin Maru showed the Greenpeace ship Arctic Sunrise could have avoided the collision on Sunday but instead turned hard to port. "The skipper turned the boat into the path of the Nisshin Maru and rammed us at our weakest point," he said. "It was a deliberate action to get media coverage."

However, Australian maritime law expert Dr Eric Wilson, of Monash University, Melbourne, said the Arctic Sunrise was set up for the collision by the clever skipper of the Nisshin Maru. "By executing a 360-degree turn at exactly the moment he did, he created a situation where the Greenpeace vessel could not but strike the Japanese vessel. "But at the same time, it was Greenpeace who rammed the Nisshin Maru and not the Nisshin Maru which rammed the Greenpeace vessel. "The skipper artificially set up the obstacle so it was the Greenpeace vessel which physically collided with the Nisshin Maru ... physically, materially, Greenpeace executed the ramming action." Dr Wilson said neither party could be arrested upon returning to port but there was an excellent chance that if the Greenpeace vessel docked in a Japanese port it would be impounded pending legal action. Meanwhile, Japan called on Canada and Netherlands to take control of anti-whaling protest boats in the Southern Oceans to stop the clashes between the vessels and whaling ships.

Japan has warned that if the confrontations continue to escalate it will send police aircraft to the Antarctic waters to protect its fleet. Mr Moronuki said Canada and Netherlands were responsible for the actions of the protest ships because the two Greenpeace vessels were registered in the Netherlands and the Sea Shepherd ship was Canadian. New Zealander Phil Lloyd, who is aboard the Greenpeace ship Esperanza, told the Herald yesterday via satellite phone that the New Zealand and Australian Governments needed to put more resources into patrolling the whale sanctuary.

Navy divers hauled 120 suspected perlemoen (abalone) poachers from the sea between Cape Recife and Sardinia Bay near Port Elizabeth on Tuesday. "This was part of our highly visible policing. Whenever divers wanted to go into the sea, we sent out navy divers with them," environmental affairs department spokesperson Abeeda Mugjenkar said on Wednesday. The removal of suspects from the water followed the arrest last week of twelve people caught poaching. On Tuesday, the navy divers found 176 shucked perlemoen stashed in the water. "Our primary goal is to make sure that the abalone does not get out of the water," Mugjenkar said. According to Mugjenkar, poaching strategies were changing. Poachers were diving closer to shore rather than using rubber ducks to dive from further out to sea. The department's assistant director of environmental protection, Keith Govender, said the department was having a "huge success rate" with their visible policing in the Port Elizabeth area. The protection units had been mandated to restrict poaching, and that was why the 120 suspected poachers were evicted from the water. "We cannot arrest them when we can't find anything on them," he said. However, Govender said he knew that poachers were hiding shucked perlemoen on the sea bed and returning to retrieve them when "nobody was around". "We are frustrating them. It is good. We will win the battle to protect our marine resources," he said. Govender said the "red and white ships you see around PE" were part of the department's environmental strategy.

Four poachers were arrested on Friday at Willows and Schoenmakerskop, and 391 shucked perlemoen were confiscated. On Thursday, eight poachers were arrested at Cape Recife and 729 shucked perlemoen were confiscated. Smal said there were "a lot of local groups here poaching". They liked to take the perlemoen out of their shells because that made them easier to transport. "They weigh less shucked," he said. Smal said the poachers had all appeared in court.

New owner for Incat wave piercer A 91 m Incat wave piercing catamaran that is the current holder of the Hales Trophy is getting a new owner, a new paint job--and a massive duty-free shop. Built in 1988 as Cat-Link V, the vessel took the Hales Trophy for the fastest Atlantic crossing on its delivery voyage and also set a new 24 hour steaming record--1,018. 5 nautical miles.

On delivery, Cat-Link V entered service between Arhus and Kalundborg, Denmark. The following year, the vessel's charter was taken over by Mols-Linien, it was switched to the Arhus--Odden route and renamed Mads Mols. Now the ship is to enter service for another Scandinavian operator, Master Ferries will take delivery of the vessel on March 1, 2006 for entry into service on a new route between Kristiansand in Norway and Hanstholm in Denmark in spring. The new name of the first high speed vessel to bear the Master Ferries livery is Master Cat. Svein Olaf Olsen, the CEO of Master Ferries commented, Over recent months we inspected a variety of fast ferries from around the world, however we were attracted to the Incat 91 metre Wave Piercing Catamaran due to its speed, capacity, economy, reliability and perhaps most importantly, its seakeeping. roughest short sea routes. No other hull form comes close to matching the capabilities of the wave piercing catamaran-- one only has to look at the cross English Channel fast ferry market which is 100% Incat wave piercing catamarans. "Master Ferries is modeled on the highly successful low cost airline concept, especially adapted to the ferry world," said Olsen. There have been a number of successful low cost ferry operations started with Incat catamarans in the last two years. Master Ferries will be the first to bring this concept to Norway and we will do so with two fundamental differences. The first is that 50 percent of the passenger space will be allocated to Master Class, a first class ferry experience which includes a high quality buffet dining experience. The second is that there will be two huge duty free shops on board and these will sell hundreds of line items including perfumes, alcohol, foodstuffs, household goods and clothing". Olsen said Master Ferries had chosen to purchase rather than charter Master Cat. We chose to purchase the vessel because "the Incat wave piercing catamarans have the highest residual values in the fast ferry industry" and ( it will give us a much stronger EBITDA ratio. Incat Chairman Robert Clifford says that with the sale of the vessel "Incat is once again in the situation where all our many wave piercing catamarans are fully employed." We now expect this demand for quality wave piercing catamarans to manifest into orders for new tonnage, not just from existing customers in Europe and North America, but from established operators in new markets, such as Asia and the Caribbean," he said. As interest in fast transportation continues to swell Incat is well placed to meet this demand, Robert Clifford said. Before delivery to Master Ferries the vessel is undergoing a major refurbishment. To take full advantage of Duty Free opportunities between the two countries a new shop will be provided in the aft cabin. The vessel is powered by four MAN B&W Ruston 20RK270 diesel engines, each rated at 7,080 kW at 1030 rpm, driving four Wartsila Lips LJ145D waterjets through Renk ASL060 gearboxes. On sea trials an average speed of 48.1 knots (lightship) and 43 knots (465 tonnes deadweight) was achieved.

Gard faces Aries payout Aries Maritime Transport is to try to recover part of a mounting bill arising from trouble with the product carrier Aries from Norwegian insurer Gard. Aries says it has incurred maintenance, operating costs and loss of hire costs of $850,000 in December following the discovery of hull and deck cracking on the 84,000-dwt Citius (built 1985). Citius is currently undergoing inspection and repair. Aries attributes the damage to severe weather encountered in the Bay of Biscay on the vessel’s last voyage. The ship was subsequently detained by port state control inspectors at the UK port of Bristol over the cracking and other deficiencies including a failure of the shipboard safety management system. The Citius is currently undergoing repair and being examined by classification society surveyors to determine the extent of work that will be necessary. The Citius was on charter to Glencore at $18,330 a day with earnings augmented by a profit sharing agreement that contributed over $1m of revenue through the final quarter of 2005. It is unclear if the loss of hire cover provided by Gard is restricted to the daily earnings of the Citius or also has some provision for the profit share. The Aries loss of hire cover has a 14 day time deductible where the owner bears the loss before any payout begins.

Aries could also make a recovery from its hull underwriters if the damage to the Citius is attributable to severe weather but might well face problems if there are other contributory factors. Richard Coxall, the finance chief of Athens based Aries is currently in the US and could not be reached for comment. Aries was one of last year’s spate of shipping IPOs pricing its stock below initial target levels after it was revealed that Greek shipowner, Harry Petrakakos, who was set to be chief executive of the company had attempted an insurance fraud by deliberately causing an explosion on a vessel he owned.

De dienst Noordzee heeft het laatste nog bestaande contract met een particulier voor het Grevelingenmeer niet verlengd. Daarmee komt een einde aan een lange traditie. Bruënaar J. de Ronde (63) heeft het werk 26 jaar gedaan. Het bedrijf ging al vanaf begin vorige eeuw over van vader op (schoon)zoon. In eerste instantie omvatte het rayon ook de Krammer, Keeten, het Mastgat en de Krabbenkreek. De laatste jaren beperkte zijn werkgebied zich tot de hoofdbetonning in de Grevelingen. Rijkswaterstaat heeft besloten het meerjarencontract niet langer te verlengen, omdat het de betonning geheel in eigen handen wil hebben. Een bezuiniging levert dat niet direct op, aldus diensthoofd W. Risseeuw van de regio zuid. „Het is eerder wat efficiënter. We gaan het op de Grevelingen met ons eigen vaartuig vanuit Bruinisse doen. We hebben er van de dienst Zeeland behoorlijk wat taken bijgekregen en daarin nemen we de controle en onderhoud van de tonnen gelijk mee. Op de andere vaarwateren doen wij dat ook al. Boven de rivieren zijn het veelal aannemers die het onderhoud van vaarwegen er als een extraatje bij doen.“ Aan de betonning zelf verandert in de Grevelingen niets, aldus Risseeuw. De herinrichting van het vaargebied is vorig jaar voltooid, nadat een eerder plan om de recreatiebetonning drastisch te verminderen tot protesten van watersporters en andere belanghebbenden leidde. Wat wel wordt aangepast, is de betonning in het Veerse Meer. Risseeuw verwacht daar volgende maand te kunnen beginnen met het verbeteren van de vaarwatermarkering. Het aantal tonnen wordt uitgebreid en ook het ’nevenwater’ wordt van boeien voorzien. De Ronde is nu 63 en geeft aan het werk graag nog een jaartje langer te hebben willen doen, tot aan zijn pensioen. „Het is een vrij beroep, niemand die op je vingers staat te kijken.“ Die mogelijkheid zat er volgens Risseeuw echter niet meer in. De concurrentieregels bij Rijkswaterstaat schrijven een open inschrijving voor op de klussen die worden uitbesteed. De dienst werkt in dat geval met een driejarencontract. Bovendien is decennia geleden al besloten de betonning van de vaarwegen waar mogelijk in eigen beheer te nemen, aldus het regiohoofd, en op de langlopende contracten een uitsterfconstructie toe te passen. „De Ronde is daar destijds eigenlijk al doorheen geslipt. In 2004 liep zijn contract eigenlijk af, maar toen hebben we er nog een extra jaar uit kunnen slepen. Nu gaat dat écht niet meer en dus hebben we er, in goed overleg, met ingang van 2006 een punt achter gezet. In die zin is hij inderdaad de laatste in de traditie van particuliere tonnenleggers.“ De Ronde had overigens geen dagtaak (meer) aan zijn werk voor Rijkswaterstaat, zo geeft hij aan. Ook voor de gemeente Schouwen-Duiveland en aannemers verricht hij voorkomende werkzaamheden op de Grevelingen.

The damage to the TOR DANIA

A section of the bow of the cruiseship Norwegian Pearl, under construction at Germany’s Meyer-Werft, lies 20 meters under water today in the outer Elbe 35 kilometers northwest of Cuxhaven. Germany’s Emder Zeitung writes that the 2,700 lane-meter, 22,000-gt ro-ro Tor Dania (built 1978) somehow came between tug Emstug and the barge Emsponton 7, which was carrying parts of the cruise newbuilding, and parted the 200-meter long tow line. Then ro-ro and barge collided, resulting in damage to Tor Dania and loss of the 32 meter long, 16 meter wide and four meter high section of the bow.

The owner of the tug is said to have been directed to remove the section as quickly as possible from its position in the channel near Buoy No 1. The sunken section has been marked by floats. The barge was also carrying other sections from Poland, where Danzig’s Aluship had manufactured them.

The German newspaper describes the damage to Tor Dania as a 12 by three-meter loarge hole two or three meters above the waterline on the stern. Local media quote an official of Meyer-Werft as saying: “Of course it is annoying but we are not going to panic over it. Deadlines will not be endangered as a result.” Norwegian Pearl was set for delivery a year from now.

CSCL Orders Boxship Quartet China Shipping Container Lines (CSCL) has ordered four 4,250-teu containerships at Dalian New Shipbuilding & Heavy Industries in a deal worth $230.8 mn. Fast-expanding CSCL has previously ordered nine 4,250-teu vessels at Dalian New and five at Shanghai-based shipbuilder Hudong-Zhonghua. It has taken delivery of four ships each from the two yards and is scheduled to take the remaining vessels by the end of next year, according to Tradewinds.

Gdansk turns to Ukraine The board of Poland’s Gdansk shipyard has turned to Ukraine's consul general for help in finding workers. It is the first time the yard has embarked on an overseas recruitment drive via a foreign diplomat. "We have recently received so many orders for ship construction that we are in need of hands to work. We lack around 800 workers. If we managed to attract 100-150 people from Ukraine, it would make us really happy," Gdansk’s administrative director Bogdan Oleszek told local media. Ukraine's consul general Zinowij Kurawskyj said he would inform local authorities in the Black Sea regions where the Ukrainian shipbuilding industry is concentrated. Oleszek added that problems with insufficient labour began with Poland's accession to the EU. "People give up their jobs to go to work abroad, where they earn several times as much as in Gdansk," he said.

Dubai Drydocks to Unveil $60M Project According to reports, Dubai Drydocks will launch its $60 million newbuilding panel line and steel structure assembly facility in July. The yard, whose current shipbuilding facility has a monthly turnover of 2,800 tonnes of steel, plans turning over similar volumes of steel per month for the newbuilding. It is already building the gravity base structure for a 10,000 steel construction with an extensive piping arrangement and four 6,200 dwt bunker tankers due to be delivered in March. Dubai Drydocks, which also wants to be involved in tanker, bulk carrier and containership sectors through series building, is planning to build four 47,000 dwt products carriers in a series that could extend to 20 vessels. It is said that the yard had also signed letters of intent covering the construction of the bottom end of two semi-submersibles and two accommodation barges for Caspian Sea duties. The first phase of work, involving the landward panel line, is expected to finish by April, while the load-out facility will be ready by August. In addition to shipbuilding the new plant will add 10 per cent to the existing shiprepair capacity of the Dubai Drydocks. Overall, the plant once ready will account for 25 per cent of Dubai Drydocks total turnover, enabling it to build vessels up to 15,000 to 20,000 dwt, including tankers and container ships. The plant will be able to build 120m long and 60m wide vessels and with a width of 60m, it is possible that Dubai Drydocks could build hulls in three sections for future FPSOs. Launched late in 2004, the Safina project is being constructed within Dubai Drydocks existing site adjacent to Port Rashid and Dubai Maritime City. The project will occupy 140,000 square metres from the current shipyard area of 800,000 square metres. The project will include an innovative hydrolift system for launching new build ships.

Singapore in $9b P&O bid British ports and ferries group P&O has received a 3.5 billion ($9 billion) bid approach from Singaporean state-owned port operator PSA International, trumping an agreed offer from Dubai Ports. P&O said yesterday that the approach from PSA, owned by Singapore government investment agency Temasek, valued its stock at 470p a share, compared with an earlier offer of 443p a share from Dubai Ports in a deal agreed last November. A tie-up with P&O would give PSA greater access to markets in Europe, India, Australia and the United States, though it would probably be forced to sell some assets in the Dutch port of Antwerp for competition reasons, one analyst said. The offer is at a 6 per cent premium to Dubai Port's offer but only a penny above P&O's closing share price yesterday after a 2.6 per cent rise during the day. The stock has risen by more than 50 per cent since news of Dubai Port's offer in November. The global ports industry has been consolidating in recent months as shipping markets have basked in a three-year boom on the back of blistering growth in Chinese demand, a global economic recovery and expanding international trade. Dubai Ports said it remained committed to the successful completion of its agreed 3.3 billion deal and urged P&O shareholders to hold tight for now. A source said Dubai Ports would wait to see if PSA submitted a formal offer before contemplating raising its bid. Temasek owns 4.1 per cent of P&O, whose full name is Peninsular & Oriental Steam Navigation, the world's fourth-largest ports group. P&O said the offer from PSA was subject to the Singaporean group conducting due diligence and receiving the unanimous recommendation of the board. P&O had been due to call a shareholder meeting to vote on the Dubai offer on January 20 but said it had delayed the meeting for two weeks to give PSA, the world's second-biggest port operator, enough time to decide whether to make a formal bid. Another source said PSA would begin sifting through P&O's books as soon as possible with a view to making a firm offer within weeks.

Dock Workers Strike on Harbor Plans Tens of thousands of dock workers in several European Union nations went on strike Wednesday to protest plans to liberalize cargo handling at EU seaports, unions said. The European Transport Workers' Federation said a total of about 40,000 people were participating in 12 countries to protest an EU bill that would open up cargo handling to competition, ending the situation in many European ports where loading and unloading is run by monopoly handlers.

Supporters say the bill is needed to cut costs, speed up deliveries and encourage investment in ports across the 25-nation bloc. Dock workers' unions fear it would lead to lost jobs, lower wages and less safety. They want qualified stevedores to continue carrying out dock work, arguing the job is too specialized to leave to personnel on board the docking ships. The European Parliament will discuss the issue at its meeting Monday in Strasbourg, when dockers planned a major demonstration in the French city. Some 4,500 German port workers took part in Wednesday's strike, which paralyzed container terminals in the North Sea port of Hamburg where some 1,000 workers walked out, the service workers union ver.di said. "Not one crane is moving," union spokesman Uwe Schroeder said. In Bremen and Lower Saxony state, 1,600 workers took part in protests. Short strikes were also planned in Baltic Sea ports. German Transport Minister Wolfgang Tiefensee joined the criticism, saying the plan could damage the ports and result in job losses. "Port Package II will not lead to more competition and higher quality in the seaports," Tiefensee said. "We fear that it could come to job losses in the ports on a large scale." In Rotterdam, only a few hundred dock workers were expected to stage a four-hour strike at the European Container Terminals, according to Port Authority spokesman Sjaak Poppe. With 58,000 employees working at Europe's largest port, however, operations would barely be affected, he said. Workers planned to strike for four hours in Antwerp, Belgium, the EU's second biggest port. They were expected to be joined by colleagues in three other Belgian ports. Dock workers in Finland also took part in the staggered strike, scheduled to last a few hours Wednesday, but it was not expected to halt passenger ferries between Finland, Sweden and Estonia, union officials said. "We want to take our message to the European Parliament," said Juhani Koivunen, a Finnish union spokesman. The EU's executive Commission redrafted the bill after the European Parliament rejected the last attempt to open up port services in 2003, following several dock workers' strikes.

China's First Ferry Ship Takes Water The first ferry ship to serve China's longest ferry railway across the Bohai Straits took water in Tianjin on Tuesday morning and is to be officially delivered this July.

The ship, named "China Railway Bohai No.1", is the first roll-roll ship in China to use a power engine, and also the first of its kind in the world using the latest third-generation power engine system. "The ship will be a milestone in China's ferry ship manufacturing industry," said Gao Xuehu, head of the Tianjin Xingang shipbuilding plant, the ship's builder. According to Gao, the ferry, designed to withstand gale-force winds, is 182.6 meters long, 24.8 meters wide and weighs 22,700

dead weight tonnages (dwt).

Gao said the new ship is designed to accommodate trains, motor vehicles, as well as passengers. In a single journey, the ship can carry a 4,000-tons freight train with 50 carriages, or 50 units of 20-ton vehicles, or 25-units cars, or 480 passengers. Starting from Yantai and ending at Dalian, the ferry railway links two of China's peninsular economic powerhouses, Liaoning and Shandong provinces, and is an important part of China's coastal railway corridor. Currently, the overland railway journey covers 1,801 kilometers from Yantai to Dalian. The water route shortens this distance to 159.8 kilometers, sources with the Ministry of Railways said. The ministry said two such ships will be built for ferry service on the waterway. Construction of the first ferry ship started on December 18, 2004 in Tianjin. And construction of the second ship started in July 2005, and will be delivered before December 26 this year.

The Beijin-based company made more than CNY 20bn ($2.5bn) last year as its containership operation China Cosco Holdings (CCH) benefited from increased Chinese exports. CCH has 122 ships Cosco itself is doubling its fleet of very large ore carriers (VLOCs) with a slew of newbuildings. Rettig Group Ltd Bore will acquire Rederi Ab Engship

All shareholders in Rederi Ab Engship have accepted Rettig Group Ltd Bore's offer to buy their shares. It is the intention to complete the transaction by the end of February 2006.

The planned acquisition is another step in Bore's active growth strategy following the purchase of Bror Husell Chartering Ltd last October. It will strengthen Bore's ability to serve the customers both in the RoRo and in the small tonnage markets. After this acquisition, Bore's fleet will comprise 21 owned vessels in total, 11 RoRo and 10 container and dry cargo carriers. The annual turnover

Heavy Lift Vessel Enters Pearl Harbor with SBX

The heavy lift vessel MV Blue Marlin enters Pearl Harbor, Hawaii with the Sea Based X-Band Radar (SBX) aboard after completing a 15,000-mile journey from Corpus Christi, Texas. SBX is a combination of the world’s largest phased array X-band radar carried aboard a mobile, ocean-going semi-submersible oil platform. It will provide the nation with highly advanced ballistic missile detection and will be able to discriminate a hostile warhead from decoys and countermeasures. SBX will undergo minor modifications, post-transit maintenance and routine inspections in Pearl Harbor before completing its voyage to its homeport of Adak, Alaska in the Aleutian Islands.
