They then agree, take some, and are arrested for possession. 6) Intoxication Defense claims diminished responsibility based on substance intoxication, resulting in reduced liability and distant mental state Charlie Sheen was high on bath salts, and punched his neighbor, believing him to be a dragon. 7) Alibi A defense raised by the accused claiming that he or she was somewhere else when the crime was “I couldn’t have assaulted Megan at 7pm, because I was at soccer from 6:30pm-9:00 pm”

10) Balance of Probabilities

Burden of proof in civil trials, try to convince judge

Ashley has no other defense other than there is not strong enough evidence that she committed the crime so she uses the Balance of Probabilities defense.

11) Self Defense The defense of one’s person or interest especially through use of physical force which is permitted in certain cases

If Paolo was acquitted on a robbery charge, the police cannot bring the same charge against him two years later because they have more evidence.

15) Necessity The defense that one had no choice but to break the law

Shirley had to sneak onto Tom’s property to see if Tom was beating his kids or not

16) Compulsion The action or state of force or being forced to do something ( peer pressure)

Group of friends at the store and one person tells another to go in and steal a bunch of candy

17) Duress Accused was forced by the threat of violence to commit a criminal act

Someone was kidnapped then forced to shoot someone else against their will
