Opinion: Cyprus knew or should have known asbestos was in talc by 1955. Later tests confirmed the presence of asbestos in Cyprus talc.
Basis:
Mulryan testified that many government publications that indicated that asbestos was found with talc and this information was publically available in the 1950s.93 Mulryan agreed Cyprus and the "industry" knew that some talc contained tremolite. He knew that when he entered the industry in 1955.94
4/29/1976 Cyprus tested five samples of talc for Tremolite by XRD - all five samples test positive for tremolite95
7/13/1976 Cyprus reported on results of testing of five samples of talc- all contain tremolite
Lot 372 C-400, Lot 373 C-500, Lot 369-B C-400, Lot 856-139, Lot 858 13996
5/1977 Sample 100 was Cyprus <1 % tremolite97
On 2-15-1978 Cyprus told its customers:98
"Cyprus's Montana talc based products are considered to be free of asbestos as defined by OSHA. Although our California talc based products generally show no asbestos minerals at the lower limit of detectability by x-ray diffraction, they may occasionally show trace (0.1-0.3 % ) amounts of tremolite."
California talcs include: C-300, C-400, C-500, Furnace Creek, Furnace Creek Coarse, Sierralite, Sierra White 200, Sierra White 325, Sierra White IR, Mistron 139, Mistron F-128, Mistron Frost P, Mistron Frost P Compacted, Mistron HG0-75, Mistron MSC, Mistron Super Frost P, Mistron T-076
8/18/1976 XRD for tremolite in talc - Tremolite was detected in all samples99
8/26/1981 McCrone responded to Cyprus regarding Monoblend talc sample #110865 - "The sample contained a very small amount of chrysotile and may have been a contaminant." 100 Of
93 Mulyran 1-28-16 Owens, p. 26-27 94 Mulyran 1-28-16 Owens, p. 22-23, 25 95 CAM-21 96 CAM-106 97 CAM-19 98 CAM-4 99 CAM-49 10° CAM-126
course McCrone failed to justify this "contaminant construct.":

Obiective: Analyze samples for possible amphibole content,
RESULTS: The samples were analyzed by XRD in triplicate and the results are summarized in the following table:
% AMPHIBOLE

N.D. N.D. N.D.

Analysis by polarized-light microscopy with cispersion staining confinns the presence of an am·phioole mineral in the BT-Fines samples and in~icatesjhat this amphibole is actinolite.

(JbiediYe:
Results: Six samples of talc products from Bay Street were run by XRO for tremolite. All of them except Lot 412 sh.ow a small content of tremolite.
Attention is called to Sample Lot 886 of this group of samples. It is described as T076 product, milled 8/25/76. Another sample, Lot 886, also described in identical fashioo but 11\illed 8/27 /76 was analyzed on a previous day and reFOrtec in a different report, Project 76-0296-CIM-BS. Both amtain tremolite at 0.1S\ level.

Cyprus Industrial Minerals tompa~y's Montana talc based products are considered to1be free of asbestos as defined by the OSHA Safe~y an4 Health Standards (CFR 1910.1001 (a)). I
I
Although our California tal~ based products generally show no asbestos minerals at thei lower limit of detectability by X-ray diffraction, they may: occasionally show trace (O.ll-0.31) amounts of treinolite:- Our program of continuing checks of airborne dust at Jall Cyprus manufacturing plants show negative results for asbestps minerals including tre molite, thus assuring cornp~iance under the standard outlined under 1910.0110 (2) which ~as effective July l, 1975.
We attach a list of MontanJ and talifornia talcs for your reference and suggest that:this letter be kept with previous correspondence on this subject. As new regulatory data is published we will provide further clarification.

Dear Mt;. Kaz aa ian:
In response to your letter of 30 July 1981, I have enclosed the diffraction pattern of the monoblend talc sample #110865. The diffraction pattern is of a chrysotile single fiber taken·at 200 kV. The sample contained a very small amount of chrysotile and may have been a. c~ntaminant. The very small size of the single fibers (,-340 A diameter) make it difficult or impos~ sible to get a diffraction pattern using less than 200 kV. You had ment.i.oned that you were using low kV, I feel that this could be the problem with seeing the pattern,
Please contact me if you have any questions.
Sincerely,
Richard M. Ellis, Jr. Research Microscop~st

subject: Samples of fibrous talc from the Beaverhead mine are suspected to contain tremolite. A sample of BT-Fines, Sample No. A06078-4 may also contain tremolite.
Objective: Analyze samples for possible amphibole content.
RESULTS: The samples were analyzed by XRD in triplicate and the results are summarized in the following table:
