    Defers resolution of the allocation of $206 million in electricity crisis related refunds among

    bundled service and direct access customers to a subsequent phase of this proceeding.

    Company, the County of Monterey, and the Monterey County

    Water Resources Agency

     A13-05-017

    In the Matter of the Application of California- American Water Company for an Order (1) Approving aSettlement Agreement with the County of Monterey and the Monterey County Water Resources Agency to

    Settle and Resolve Claims and Issues Between the Parties and to Promote the Development,

    Construction and Operation of a Water Supply Project for Monterey County on an Expedited Basis, and

    (2) Authorizing the Transfer of Authorized Costs Related to the Settlement Agreement to Its Special

    Request 1 Surcharge Balancing Account.

    PROPOSED OUTCOME: 

     Adopts the Settlement Agreement and Mutual Release and revision to rates requested by

    California-American Water Company (Cal-Am) in Application 13-05-017 as adjusted in the decision.

     

     Authorizes Cal-Am recovery of $1,918,343, which equates to $2,682,900 (the original request)minus $764,557.

      The disallowance does not prejudice or prejudge any future request by Cal-Am for recovery of the

    $764,557 in a future application.

      Closes the proceeding.

    PROPOSED OUTCOME: 

    Denies Southern California Gas Company’s Petition to Modify Decision (D.) 13-11-023 to clarify

    that the $200.9 million cost cap established in D.13-11-023 is to be adjusted to reflect escalation

    after March of 2013.

    PROPOSED OUTCOME: 

    The California Public Utilities Commission (CPUC) ratifies the President’s selection of Dr. Peter

    S. Lam for consideration by the Chair of the California Energy Commission (CEC) for reappointment

    to the Diablo Canyon Independent Safety Committee (DCISC), and Dr. Michael D. Quinn for

    consideration by the Chair of the CEC for appointment to the DCISC.

    SAFETY CONSIDERATIONS: 

    The appointed candidate will serve a three-year term on the DCISC, which is responsible for

    reviewing operations at Pacific Gas and Electric Company's Diablo Canyon Power Plant for thepurpose of assessing the safety of operations and suggesting any recommendations for safe

    operations.

    Ratification of the CPUC President’s selection of candidates for appointment to the DCISC will

    California-American Water Company Re-Instatement of the

    Sand City Surcharge

    Res W-5025, Advice Letter No. 1069 filed on January 8, 2015 - Related matters.

    PROPOSED OUTCOME: 

     Authorizes California-American Water Company (Cal-Am) to re-instate the Sand City surcharge

    at the current rate in effect when it expires on January 1, 2015 to be made effective March 1, 2015 if

    a final decision in the 2013 General Rate Case in Application (A.) 13-07-002 is not issued by end of

    February 2015.

      Rejects Cal-Am’s Advice Letter 1069 if a Commission Decision in A.13-07-002 is issued prior to

    the effective date of this Resolution.

    SAFETY CONSIDERATIONS: 

    By restoring payments for water production from the Sand City Desalination Plant that havelapsed because of the delay in issuing a decision in A.13-07-002, this Resolution provides a

    stopgap to ensure that Cal-Am receives revenues from sales of potable water from the Sand City

    Desalination Plant that will give Cal-Am the necessary financial resources to safely operate and

    maintain this plant for the benefit of its customers, employees, and members of the general public.

    matters.In the Matter of the Application of the Los Angeles to Pasadena Metro Blue Line Construction Authority for

    an order authorizing the construction of two light rail transit tracks at-grade crossing West Avenue 45 in

    the City of Los Angeles, County of Los Angeles.

    PROPOSED OUTCOME: 

    Grants Los Angeles County Metropolitan Transportation Authority’s Petition to Modify Decision

    02-05-047 to increase speed at the West Avenue 45 at-grade crossing from 20 to 45 miles per hour.

      Encourages Los Angeles County Metropolitan Transportation Authority to erect temporary signs

    (in language to maximize outreach to the community) at the pedestrian crossing for at least three

    months.

      Closes the proceeding.

    SAFETY CONSIDERATIONS: 

    Given the decade-plus accident free history at the crossing, no immediate safety concerns arise

    from increasing speed at West Avenue 45.

    ESTIMATED COST: 

    Since the decision only authorizes a change in speed at the West Avenue 45 crossing, we do not

    foresee a fiscal impact at this time.

    (TracFone). D.14-01-037 is a decision in Phase 2 of this Order Instituting Investigation/Order to ShowCause (OII) proceeding, I.09-12-016. Phase 2 of this OII concerns two issues: (1) determination of the

    amount of delinquent user fees and public purpose program (PPP) surcharges (also known as, “universal

    end user” surcharges) that TracFone owes; (2) determination of appropriate penalties, if any, in light of

    TracFone’s violations of and non-compliance with the various laws, regulations and directives requiring it

    to remit such surcharges and pay such fees. D.14-01-037 determined that TracFone owed a total of
