Anti-skimming legislation is signed into law by Governor Wolf

Pennsylvania just put identity thieves on notice. Try to steal someone’s credit card information by “skimming” it, or with any other fraudulent device and you’re going to pay – big time.

With a stroke of Governor Tom Wolf’s pen, one of PFMA’s top legislative priorities of 2018 became a reality. The governor signed into law House Bill 1918 – spon-sored by state Rep. Kristin Phillips-Hill – which criminalizes and establishes stiff penalties for thieves using tools to steal others’ credit card information.

Credit card fraud is one of retailers’ worst nightmares, costing a collective $580.6 million in losses and $6.47 billion in pre-vention costs. Although card holders are generally protected from liability when a fraudulent crime happens, it still costs a significant amount of time, stress, and fees in filing suspicious activity reports with banks, credit card companies, and credit reporting agencies.

Legislation that would amend Pennsylvania’s Price Gouging Act by reducing the duration of price restrictions imposed when the governor declares a state of disaster emergency was unanimously approved by the state senate in June.

The measure, sponsored by Sen. Randy Vula-kovich and strongly supported by the Penn-sylvania Food Merchants Association, heads to the House of Representatives for consider-ation.

State law prohibits “unconsciously excessive” prices on all consumer goods and services when the governor declares a state of emer-

gency. The price restrictions re-main in effect for 120 days, but the governor has the authority to re-new and extend the restrictions. For instance, a di-saster declaration issued by Gov. Tom Wolf on Jan. 10, 2018 was re-newed on April 4

and imposed price restrictions on all retailers, distributors, and manufacturers of all consum-er goods and services in the state for the next six months.

Senate Bill 1172 would require a separate declaration be issued to impose price restric-tions on consumer goods and services during emergencies. This would allow the state to impose those restrictions as needed, instead of placing restraints on commerce for an arbi-trary, one-size-fits-all time period.

The measure would also reduce the duration of price restrictions to 15 days, with option-al extensions up to 60 days and allow officials to narrow the scope of pricing restrictions to a more specific group of goods and services. PFMA will continue to monitor the Legislation.

“Three months plus an additional 30 days after termination is an excessively long period compared to other state

laws and has resulted in situations where pric-ing restrictions from a disaster declaration for a winter snowstorm have remained in place until June or later,” Sen. Vulakovich said. “In fact, emergency declarations issued for winter storms in early March can remain in place and maintain price restrictions through the Fourth of July.”

PFMA will continue to push for this legisla-tion to become state law and monitor it as it moves through the General Assembly.

Public relations professional and former news reporter Matthew Kemeny joined the Pennsylvania Food Merchants Association staff June 8 as Director of Communications and Media Relations.

In his new role, Kemeny is responsible for overseeing content cre-ation, public relations, and social media efforts for the statewide trade organization representing convenience stores, supermar-kets, independent grocers, wholesalers and consumer product vendors.

Kemeny has more than 15 years of ex-perience in communications and me-dia relations, most recently serving as Director of Public Affairs for the Penn-sylvania Commission for Community Colleges. His experience also includes communications leadership roles at the Pennsylvania Coalition Against Domestic Violence, Capital BlueCross and Susquehanna Bank.

“We’re delighted to welcome Matt to PFMA,” President and CEO Alex Baloga

said. “ He brings a wealth of experience in communications, media relations, and storytelling to our organization.” Prior to working in public relations, Kemeny was a reporter for The

Patriot-News/Pennlive in Harrisburg and The (Scranton) Times-Tri-bune.

A resident of Swatara Twp., Dauphin County, Kemeny earned his master’s degree in Public Affairs Reporting from the University of Illinois-Springfield and his bachelor’s degree in Communications from Albright College. He is a member of the Public Relations So-ciety of America (PRSA) – and the Pennsylvania Government Rela-tions Association.

In his spare time, Kemeny loves to spend time with his wife Gail, 2-year-old daughter, Lily, play golf, cycle, hike, and play guitar – not all at the same time, mind you.

For the first time in four years, the state budget was approved and signed by the governor prior to the June 30 deadline.

The $32.7 billion spending plan did not have any major tax or fee increas-es other than a 34 percent hike in an assessment on hospitals that ex-pected to generate an extra $75 million in the fiscal year 2018-19 budget.

However, the budget did make a new investment in fighting an insect that’s wreaking havoc on the hardwood and fruit industries in Pennsyl-vania, especially grape, wine and beer production. It sets aside $3 million to fight the spotted lanternfly, which was first spotted in Berks County in 2014 and has led to a quarantine in 13 counties. The money will supple-ment more than $17 million invested by the federal government.

Pennsylvania dairy farmers were winners in the budget, receiving $5 mil-lion in grant money to help survive an economic crisis brought on by fall-ing milk prices and a decline in consumption of beverage milk. House Bill 1929 authorized the aid and lawmakers approved it several days after the Senate Agriculture and Rural Affairs Committee held a pub-lic hearing June 19 on the state of the dairy industry.

Milk prices are down 40 percent since 2014.

“We need to make dairy farming and agriculture a priority,” Senate Major ity Leader Sen. Jake Corman said. “It’s nice to talk about supporting the agriculture community in Pennsylvania. But we need to take action that will attract a processing facility to locate here in order to help our farmers all while stimulating our local economies.”

In addition, spending in the budget includes:

• $500,000 in the state food purchase program• $1 million recapitalization for Healthy Food Access Financing Initiative. • $139,000 increase in spending to pay for West Nile virus and Zika virus control.

It’s the first budget Gov. Tom Wolf signed since taking office in 2015. In prior years, he allowed the budget bill to become law without his signa-ture. Called a “bipartisan effort,” the budget was approved 188-10 in the House and 47-2 in the Senate.

Philly’s sugar-sweetened beverage tax that’s been having a devastating effect on neighborhood businesses, employees, families and customers since it was approved last year.

House Bill 2241, which was approved by the House Commerce Commit-tee on May 1, would invalidate any current fees or taxes levied by local governments, including the sugar-sweetened beverage tax in Philadel-phia. House members are expected to consider the measure when they return to session in September.

In a recent column, the Philadelphia Daily News criticized the tax along with other taxes, licenses, and fees levied by the City of Brotherly Love. Columnist Stu Bykovsky noted “Mayor (Jim) Kenney invented a crushing beverage tax,” and referred to the city as “Taxadelphia.”

Opponents to House Bill 2241 stressed that replacement revenue to the beverage tax needs to be identified.

To highlight how onerous the tax is, a study done by Oxford Economics using independent market research data found that beverage sales by grocery stores fell 24 percent in the city since the tax went into effect, while equivalent sales in the suburbs increased by 14 percent.

Due to the revenue loss, the businesses have reduced their workforces by nearly 1,200 jobs, according for nearly $54 million in lost labor earnings and $80 million in local economic losses.

PFMA will continue to advocate for House Bill 2241 and encourages its members to contact us with questions or concerns about potential ordi-nances or other governmental action.

Raise your glasses for a toast: On June 29, the Giant Food Store in Camp Hill became the first establishment in the borough to sell alcohol. Cheers!

In the fall election, residents overwhelmingly voted in favor of allowing businesses in Camp Hill – a longtime “dry” borough – to sell alcohol.

Giant executives joined business and industry leaders for a ceremonial ribbon-cutting for the Friday afternoon unveiling and opening of the Beer & Wine Eatery at the Trindle Road location.

It is Giant’s 65th Beer & Wine Eatery to open across its four-state footprint.

“It’s a great selection – when you look around – you have beer and wine from all over the state, all over the country,” said Matt Simon, Vice-Pres-

ident of Marketing for Giant. “There are hundreds from Pennsylvania – chardonnays, pinots, you name it, the variety is there for you. Domestic imported, we have them all.”

In November, 73 percent of residents voted to make Camp Hill “wet” and permit alcohol sales. The Beer & Wine Eatery in Camp Hill is open Monday through Saturday from 7 a.m. to 10 p.m.

PFMA, PA Ag Dept. host spotted lanternfly webinar

Perhaps the biggest current threat to Pennsylvania’s forestry and orchard products measures only an inch long and a half-inch wide.

Native to southeast Asia, the spotted lanternfly was first spotted in Berks County in 2014. This insect has the potential to greatly impact the grape, hops and logging industries. Early detection is vital for the protection of PA businesses and agriculture.

Last month, the state Department of Agriculture and PFMA teamed up to host an informational webinar on the dangers of the Spotted Lanterfly and steps you can take to product your goods.

The 2018-19 state budget includes $3 million for Spotted Lanternfly control.

“We believe we would be impacted, economically, to the tune of $19 million dollars,” said Dana Rhoads, state plant regulatory official for the Department of Agriculture. “So, there is a lot to lose if we do not try to control spotted lanternfly.”
